Ziegler with the following members present: Mayor D.V. Cardillo, Alderman J. Smola, Alderman G.L. Leadston, Alderman M. Wagner, Alderman C. Zehr, Alderman C. Weylie and Alderman T. Galloway. Officials Present: Mr. T. McKay, Mr. S. Klapman, Mr. B. Stanley, Mr. T. McCabe, Mr. J. Wallace, Mr. D. Snow, Mr. B. Liddle, Ms. P. MacPherson and Mr. L.W. Neil. 1.MINUTES Moved by Alderman G.L. Leadston Seconded by Alderman M. Wagner That the minutes of the regular meeting of the Planning and Economic Development Committee held April 6, 1992, as mailed to the members, be accepted. Carried 2. CORRESPONDENCE Nil. 3.PD 36~92 - 300 BRIDGE STREET EAST - REQUEST FOR DIRECTION RE PROCESSING -OFFICIAL PLAN AMENDMENT APPLICATION 92/5 (STEED AND EVANS LIMITED) - ZONE CHANGE APPLICATION 921191BIJW. The Committee considered Planning and Development Staff Report PD 36/92 dated April 14, 1992 which advised that the Department was in receipt of an Official Plan Amendment and Zone Change Application pertaining to lands having an area of 5.90 hectares (14.6 acres) located south of Bridge Street opposite the proposed extension of Stanley Avenue. The subject lands are proposed to be developed as a residential subdivision of 41 single detached lots and 32 semi-detached lots. Mr. T. McCabe advised that he had nothing further to add to the staff reporting respecting these lands which are known municipally as 300 Bridge Street East. Mr. S. Head attended the meeting as a delegation and advised that he was in agreement and that it was his intention to answer any questions of the Committee. No other delegations were registered respecting this matter. Alderman J. Smola questioned if staff would be considering a holding provision relative to this development and Mr. T. McCabe advised that there was no expectation on the part of staff for a need for a holding provision. Mr. D. Snow noted that staff have traffic impact analyses and will be addressing any problems in that regard. Moved by Alderman C. Weylie Seconded by Alderman J. Smola That Planning and Economic Development Committee recommend acceptance of Official Plan Amendment Application 92/5 and Zone Change Application 92/19/B/JW (Steed and Evans Limited - 300 Bridge Street East) for processing with the clear understanding that processing in no way implies acceptance or rejection of these applications. Carried The Chairman advised that this recommendation would be considered by City Council at its meeting to be held on Monday, May 4, 1992. PLANNING AND ECONOMIC DEVELOPMENT COMMITTEE MINUTES - 141 - APRIL 27, 1992 4. PD 26~92 - 19 SECORD AVENUE - ZONE CHANGE APPLICATION 91/35/S/VL (MANNARELLI & DOMODOSSOLA) - STANLEY PARK WARD. The Committee was advised that the Department of Planning and Development was in receipt of an application from Messrs Mannarelli and Domodossola to change the zoning of property known municipally as 19 Secord Avenue. The proposed zoning change is from General Residential (R3) to Semi-Restricted Residential (R2) with special regulations according to By-law 4830. In this regard, the Committee considered Staff Report PD 26/92 dated March 31, 1992 and the Proposed By-law dated March 23, 1992 attached to the report. It was noted in the report that the subject lands are located on the south side of Secord Avenue backing onto Ottawa Street North and are comprised of approximately 807 square metres (8690 square feet). Also, it was noted that the applicant intends to rezone the subject lands to permit the development of a fourth unit within the existing triplex dwelling. It was pointed out that notice that the Committee would hold a public meeting this date to consider this matter had previously been given. Mr. T. McCabe advised that staff had nothing further to add to the report under consideration and commented that there had been no response from the neighbourhood to the department's circulation. Mr. Mannarelli was in attendance and indicated his concurrence with the recommendation in the staff report. No other delegations responded to the Chairman's invitation to address the Committee on this matter. Moved by Alderman M. Wagner Seconded by Alderman C. Weylie That Zone Change Application 911351SNL (Mannarelli & Domodossola) requesting a change in zoning from General Residential (R3) to Semi-Restricted Residential (R2) with special regulations, on Lot 221, Registered Plan 1055, be approved, in the form shown in the Proposed By-law attached, dated March 31, 1992, subject to the following conditions being satisfied prior to any readings of the amending zoning by-law by Council. 1.To arrange for notification by letter from the Regional Municipality of Waterloo to the City's Clerk, that all Regional requirements have been satisfied with respect to the proposed zone change. 2.The Owner acknowledges that Condition 1 hereof is required to be satisfied no later than seven (7) months from the day of Council having approved by resolution, the amending zoning by-law relative to Zone Change Application 91/35/SNL. In the event this requirement is not fulfilled within the seven month period, Council shall consider rescinding their zone change approval. It is the opinion of this Committee that the approval of this application is proper planning for the City and is in conformity with the City's Approved Official Plan. Carried The Chairman advised that this recommendation would be considered by City Council at its meeting to be held on Monday, May 4, 1992. 5.PD 27~92 - 305-315 MARGARET AVENUE - ZONE CHANGE APPLICATION 92/10/M/VL (DREWLO HOLDINGS INC.) - BRIDGEPORT-NORTH WARD. The Committee was advised that the Department of Planning and Development was in receipt of an application from Drewlo Holdings Inc. to change the zoning of the property known municipally as 305-315 Margaret Avenue. The proposed zoning change would amend Section 15.1(q) of By-law 4830 to permit a maximum of two apartment buildings, whereas it is currently stated that the maximum development is two buildings. In this regard, the Committee considered Staff Report PD 27/92 dated March 31, 1992 and the Proposed By-law dated March 31, 1992 attached to the report. It was noted in the report that the subject lands are located north of Guelph PLANNING AND ECONOMIC DEVELOPMENT COMMITTEE MINUTES - 142 - APRIL 27, 1992 5.PD 27/92 - 305-315 MARGARET AVENUE - ZONE CHANGE APPLICATION 92/10/M/VL (DREWLO HOLDINGS INC.) - BRIDGEPORT-NORTH WARD. (CONT'D) Street and have frontage on Margaret Avenue, Guelph Street and Brunswick Avenue and were comprised of approximately 2.3 hectares (5.7 acres) in size. It was also noted in the report that the purpose of the amendment is to clarify the existing special zoning regulations applying to the lands to permit a maximum of two apartment buildings whereas it is currently stated that the maximum development is two buildings. It was pointed out that notice that the Committee would hold a public meeting this date to consider this matter had previously been given. Mr. T. McCabe advised the Committee that staff considered the application to be technical in nature and somewhat housekeeping related in order to clarify the intent of the development. Since the By-law currently limits the number of buildings to two, a By-law Amendment is required to permit the development of the proposed two single detached dwellings and legalize an indoor swimming pool that services the apartment buildings. Mr. P. Britton, appeared as a delegation on behalf of the applicant and advised that his client concurred with the recommendation in the staff report. No other delegations responded to the Chairman's invitation to address the Committee on this matter. Moved by Alderman J. Smola Seconded by Alderman M. Wagner That Zone Change Application 92/10/MNL (Drewlo Holdings Inc.) requesting a change in zoning to amend Section 15. l(q) of By-law 4830 on Part of Lot 6, 9 and 16 Registered Plan 373 and Part Lot 1, Registered Plan 290, be approved, in the form shown in the Proposed By-law attached dated March 31, 1992, without conditions. It is the opinion of this Committee that the approval of this application is proper planning for the City and is in conformity with the City's Approved Official Plan. Carried The Chairman advised that this recommendation would be considered by City Council at its meeting to be held on Monday, May 4, 1992. 6.PD 18/92 - SERVICE INDUSTRIAL AREAS - OFFICIAL PLAN AMENDMENT APPLICATION 91/14 (CITY OF KITCHENER) - ZONE CHANGE APPLICATION 911331TCIPMC (CITY OF KITCHENER) - REVISIONS TO BY-LAW 85-1. The Committee was advised that the Department of Planning and Development on behalf of the City of Kitchener initiated applications to amend both the Official Plan and the Zoning By-law. The purpose of the Official Plan Amendment is to amend the General Industrial land use category to allow "Convenience Retail" and "Personal Services" under the policy related to service industrial areas and to add a Special Policy which will prohibit "Convenience Retail" and "Personal Services" along Fairway Road and Courtland Avenue and to revise the "Land Use Map" to reflect this change as shown on Schedule "A" attached to Staff Report PD 18/92. Also, attached to the report was the Proposed Amendment to the Official Plan undated and the Proposed By-law undated to adopt this Amendment to the Official Plan. The subject lands affected by the proposed amendment are primarily found on the west side of Victoria Street North and the south side of Fairway Road and Courtland Avenue. The Committee also considered the related Zone Change Application and it was noted that the proposed zoning by-law represents a text change to By-law #85-1 to add to the list of permitted uses, in the Service Industrial (M-3) Zone, "Convenience Retail" and "Personal Services" with a new regulation which will limit any single convenience retail outlet to a maximum gross leasable commercial space of 225 square metres. The properties primarily affected are located on the west side of Victoria Street North extending from the Conestoga Parkway to the crossing of PLANNING AND ECONOMIC DEVELOPMENT COMMITTEE MINUTES - 143 - APRIL 27, 1992 6.PD 18/92 - SERVICE INDUSTRIAL AREAS - OFFICIAL PLAN AMENDMENT APPLICATION 91/14 (CITY OF KITCHENER) - ZONE CHANGE APPLICATION 911331TCIPMC (CITY OF KITCHENER) - REVISIONS TO BY-LAW 85-1. (CONT'D) Victoria by the Canadian National Railway. A special use provision will prohibit the two new uses within the M-3 Zone of properties located along Fairway Road and Courtland Avenue. Attached to Staff Report PD 18/92 was the Proposed By-law dated February 18, 1992 respecting the proposed rezoning. It was pointed out that notice that the Committee would hold a public meeting this date to consider these matters had previously been given. Alderman J. Ziegler pointed out to the Committee that a copy of a letter dated April 27, 1992 from Metro Capital Group had been distributed and should be considered following the staff representations with respect to these matters. Mr. T. McCabe introduced the changes proposed in the report and indicated that it was his belief that these sections of Fairway Road and Victoria Street North were the only two areas of the City where such M-3 zoning applied. The Committee considered the contents of the letter receipt this date from Metro Capital Group which advises of their objections to the staff recommendation that the proposed policy relative to Convenience Retail and Personal Service uses not include Fairway Road and Courtland Avenue. Mr. B. Stanley pointed out that as a result of receipt of a number of applications for Official Plan Amendment and Zone Change along Fairway Road, the objective of which was to add full retail, traffic studies were undertaken and it was agreed that such retail not be permitted until studies were completed. Both City and Regional Councils concurred with this approach and the Region has also initiated another full extended study of Fairway Road. Mr. Stanley noted that a major traffic problem remains and until further study and road improvements have been completed, staff recommend no additional retail be permitted. No delegations responded to the Chairman's invitation to address the Committee on these matters. In response to Mayor D.V. Cardillo, Mr. B. Stanley advised that there were approximately 12 sites on Fairway Road affected by this proposal. Moved by Mayor D.V. Cardillo Seconded by Alderman G.L. Leadston That the Official Plan Amendment - General Industrial (Service Industrial) and (Convenience Commercial and Personal Services) listed herein and the by-law implementing same, be approved namely: SECTION 4 - THE AMENDMENT The Official Plan of the City of Kitchener is amended as follows: 1.Section V.9A., General Industrial, is amended by deleting reference to "Convenience Retail" and "Personal Services" in the seventh paragraph, fourth sentence. 2.Map 1, "Plan for Land Use" is amended as shown on the attached Schedule "A". 3.Section IV. II "Policies for Specific Areas" is amended by adding the following policy. "CINotwithstanding Section V.9A., General Industrial, "Convenience Retail" and "Personal Services" shall be prohibited along Fairway Road South and Courtland Avenue East. It is the opinion of this Committee that the approval of this Official Plan Amendment is proper planning for the City. Carried PLANNING AND ECONOMIC DEVELOPMENT COMMITTEE MINUTES - 144 - APRIL 27, 1992 6.PD 18/92 - SERVICE INDUSTRIAL AREAS - OFFICIAL PLAN AMENDMENT APPLICATION 91/14 (CITY OF KITCHENER) - ZONE CHANGE APPLICATION 911331TCIPMC (CITY OF KITCHENER) - REVISIONS TO BY-LAW 85-1. (CONT'D) Moved by Mayor D.V. Cardillo Seconded by Alderman G.L. Leadston A)That Official Plan Amendment Application 91/14 (City of Kitchener), to amend the General Industrial land use category to allow Convenience Retail and Personal Services under the policy related to service industrial areas, with a special policy prohibiting these uses along Fairway Road and Courtland Avenue, be approved. It is the opinion of this Committee that the approval of this Official Plan Amendment is proper planning for the City. B)That Zone Change Application 91/33/TC/PMc (City of Kitchener) and the attached "Proposed By-law", dated February 18, 1992, representing amendments to By-law 85-1, to add to the list of permitted uses in the Service Industrial Zone (M-3), "Convenience Retail" and "Personal Services" with a new regulation to Section 21.3 which will limit any single convenience retail outlet to a maximum of 225 square metres and the addition of a special use provision prohibiting these uses along Fairway Road and Courtland Avenue, be approved, without conditions. It is the opinion of this Committee that the approval of this application is proper planning for the City and is in conformity with a recommended Amendment - General Industrial (Service Industrial) and (Convenience Commercial and Personal Services) to the City's Approved Official Plan. Carried The Chairman advised that these recommendations would be considered by City Council at its meeting to be held on Monday, May 4, 1992. 7.PD 34/92 - 141 COURTLAND AVENUE EAST - REQUEST FOR EXTENSION - ZONE CHANGE APPLICATION 901441CNL -ANTONIO DIAS. The Committee considered Staff Report PD 34/92 distributed this date advising of a request for an additional extension to Council's zone change approval to allow the owner of the property to complete necessary work required by the Ontario Building Code and to settle the costs of these works with an insurance company involved. Moved by Alderman C. Zehr Seconded by Alderman T. Galloway That Kitchener Council support an extension to the deadline of fulfilling conditions of approval of Zone Change Application 90/44/CNL (Antonio Dias -141 Courtland Avenue East) to September 30, 1992. Carried The Chairman advised that this recommendation would be considered by City Council at its meeting to be held on Monday, May 4, 1992. 8.ADJOURNMENT On motion, the meeting adjourned at 4:15 p.m. L.W.
