Reid -Chair Councillors D. Chapman, J. Gazzola, C. Michaud,and Ms. K. Huxted, Ms. S. Hossack, Ms. B. Mueller, Ms. V. Mance,and Messrs. J. Baker, P. Ciuciura andR. Parnell. Staff:L. Bensason, Coordinator, Cultural Heritage Planning V. Grohn, Heritage Planner D. Saunderson, Committee Administrator 1.DRAFT HERITAGE IMPACT ASSESSMENT (HIA) -19-41 MILL STREET Ms. A. Reid noted,at the request of the property owner,this item was deferred and is anticipated to be brought forward for the Committee’s consideration at the December 3, 2019 Heritage Kitchener meeting. 2.DSD-19-249-NOTICE OFINTENTION TO AMEND DESIGNATINGBY-LAW 84-52 -883 DOON VILLAGE ROAD Ms. K. Huxted entered the meeting at this time. The Committee considered DevelopmentServices Department report DSD-19-249, dated November 1, 2019regarding publishing a Notice of Intention to Amend Designating By-law 84- 52 for 883 Doon Village Road.Ms. V. Grohn presented the Report. In response to questions, Ms. Grohn advised the intentions ofthe amendment is to identify additional features on the property as having heritage significance. She stated after the Ontario Heritage Act was amended in 2005,there were different regulations imposed that require for a statement of significance to prepared and included in the designation By-law.She further advised the owner was required to complete a Stage 3 Archaeology Assessment as part of their Committeeof Adjustment consent decision, which was approved by the Ministry of Tourism, Culture and Sport, andincluded an additional requirement forthe designation By-law to identify portions of the property as an archaeological site, that wording has been included within the staff report. Questions were raised regarding the changes to the Ontario Heritage Act in 2005,and whether other designated properties should be reviewed and amended so they are in conformity with the new requirements of the Act. Ms. Reid advised that was outside the scope of the discussion related to the subject property, noting staff can note itand further discuss the matteras part of theheritage best practices. Mr. B. and Ms. A. LeFrance,property owners,were in attendance in support of the staff recommendation. Mr. LeFrance advised they were required to complete Stage 1 and Stage 2 archeological assessments,and depending on the findings would have been required to complete additional Stages. He indicated based on the discovery in the first two stages, they were required to complete a Stage 3 assessment, noting there were not enough artifacts discovered that would identify the land itself as having heritage value or interest. He stated although artifacts were discovered, nothing was found that was unexpected. He commented the archeologist who completed the assessment catalogued the artifacts and the Ministry of Tourism,Culture and Sport providedtheir clearance on the archeological assessment. In response to further questions, Ms. Grohn advised the Designation By-law will only apply to the retained lands. It will not be applied to severed lotsfronting onto Bechtel Drive. Mr. L. Bensason advised the Heritage Impact Assessment(HIA)that was completed in support of the severance application identified items on the property of heritage significance and staff have taken that into consideration when drafting the new Designation By-law for the subject property. Ms. K. Huxted questioned what the recourse would be if the Notice of Intention to Amend the Designating By-law was appealed.Mr. Bensason stated the property is already designated. He advised if the property owner appealed, they would be appealing the amending By-law. He further advised asthe property owner has been active and accepting of the process,it is unlikely they would object to the amendments. HERITAGE KITCHENER MINUTES NOVEMBER 5, 2019-36-CITY OF KITCHENER 2.DSD-19-249-NOTICE OFINTENTION TO AMEND DESIGNATING BY-LAW 84-52 -883 DOON VILLAGE ROAD(CONT’D) In response to questions, Ms. LeFrance advised the hog and hen house has a side yard setback of 1.5m from the proposed severed lots. She indicated she was not sure what the distance was from Doon Village Road. It was noted the hog and hen house would bevisible from Doon Village Road, but no longer visible from Bechtel Drive. In response to further questions, Ms. LeFrance advised the subject property is their family home. She indicated they have a vestedinterest as to what would be developed on the newly proposed lots as well, indicating they would like to see bungalows constructedsimilar to those on the opposite side of the street. Questions were raised regarding the designation process.Mr. Bensason advised the property owners were required to enter into a Heritage Covenant Agreement and provide a letter of credit prior to relocating the hog and hen house. He stated once the new lots are created,the Designation By-law can be updated, as the retained lot will then have a new legal description. It was noted any recommendation arising from this matter would be considered at the December 16, 2019 Council meeting. On motion by Ms. S. Hossack- it was resolved: “That pursuant to Section 30 (1) of the Ontario Heritage Act, the Clerk be directed to publish a Notice of Intention to amend designating By-law 84-52 for 883 Doon Village Road, as outlined in Development Services Department report DSD-19-249.” Councillor J. Gazzola left the meeting at this time. 3.INTRODUCTION NEW COMMITTEE MEMBERS On behalf of the members, Ms. A. Reidwelcomed Ms. B. Mueller,andMs. V. Mancewho were recently appointed totheHeritage KitchenerCommittee. Councillor J. Gazzola re-enteredthe meeting at this time. 4.DSD-19-247-HERITAGE PERMIT APPLICATION -HPA-2019-V-029 -8 DEVON STREET -ALTERATION AND CONVERSION OF A SINGLE DETACHED DWELLING INTO A DUPLEX The Committee considered Development Services Department report DSD-19-247, dated October 17, 2019 recommending approval of Heritage Permit Application (HPA) HPA-2019-V- 029to permit the alteration and conversion of a single detached dwelling located ontheproperty municipally addressed as 8 Devon Street, located within the Victoria Park Area Heritage Conservation District (VPAHCD). Mr. L. Bensason presented the Report.He indicated the property owner previously attended the August and September 2019 Heritage Kitchener meetings to receive feedback from the Committee on the proposed design/materials for the conversion of the single detached dwelling into a duplex. He provided an overview of the proposed design in comparison to what currently exists this date.He stated the owner has also updated theconstruction materials and intends on removing the existing brick from the rear portion of the building to complete the updates to the frontportion of the dwelling to have a more unified finish. He stated the rear of the property would be converted to siding to accommodate the re-use of the bricks at the front.Mr. Bensason provided an overview of the merits of the application, noting staff are recommending approval of the subject HPA. Questions were raised regarding the property owner’s requirement to attend Committee of Adjustment to complete the duplex conversion, noting a number of minor variances to the Zoning By-law seemedto be required. Mr. Bensason advised the Committee of Adjustment will be advised of the outcome of thismeeting. He indicated the proposed footprint of the building has HERITAGE KITCHENER MINUTES NOVEMBER 5, 2019-37-CITY OF KITCHENER 4.DSD-19-247-HERITAGE PERMIT APPLICATION -HPA-2019-V-029 -8 DEVON STREET -ALTERATION AND CONVERSION OF A SINGLE DETACHED DWELLING INTO A DUPLEX(CONT’D) minimal changes, noting theproperty is currently non-conforming and the Building Department would require the dwelling to be in compliance with the Zoning By-law prior to issuing a building permit for the renovations. Several members expressed support for the proposed changes to the dwelling’s design since the previous meeting. Specifically membersexpressed support for the re-use of the brick to give a more unified feel to the front of the property,as well as the articulations and projections. Mr. P. Ciuciurastated in his opinion,the proposed design will be more compatible with the streetscape then what was presented to the Committee previously. In response to questions, Mr. Bensason advised the Mason consulted on the design believes there is sufficient brick at the rear of the property to update the front façade. Ms. K. Huxted questioned whether the applicant could pursue a higher design than what is being considered this date, noting at the previous meeting,the property owner was pursuing a third storey. Mr. Bensason advised he was unsure this date,whether the property owner had fully abandoned the idea of adding another storey. He stated the Committee is being asked to approve the HPA as it is presented this date,and that does not include any additional height. He further advised that would not prohibit the property owner from pursuing further HPA’sat a future dateif it was his wish. He indicated if a third storey was contemplated,the property owner is aware he would be required to complete a Heritage Impact Assessment as part of that approval process. Questions were raised regarding the use of stamped concrete, interlock stones and vinyl windows and what the Victoria Park Area Heritage Neighbourhood Conservation District guidelines indicate for those materials. Mr.Bensason advised the guidelines do permit vinyl windows as long as they are the same shape and size as the previous opening. He stated the guidelines do not regulate concrete or interlock stone, and there are other properties within the District that haveused similar materials. Mr. Bensason advised the HPA could be dealt with through Delegated Authority if the motion was voted on and carried unanimously. The following motion was voted on and CarriedUnanimously. On motion by Mr. P. Ciuciura - it was resolved: “That pursuant to Section 42 of the Ontario Heritage Act, Heritage Permit Application HPA-2019-V-029, as outlined in Development Services Department report DSD-19-247, be approved to permit the alteration and conversion of a single detached dwelling located on propertymunicipally addressed as 8 Devon Street into a duplex, in accordance with the plans and supplementary information submitted with the application and subject to the following conditions: i.That a test panel of the proposed masonry work including brick infilling and repointing, be undertaken to the satisfaction of Heritage Planning staff before proceeding with such work on the entire building; and further, ii.That the final building permit drawings be reviewed and heritage clearance be provided by Heritage Planning staff prior to the issuance of a building permit.” 5.STATUS UPDATES -HERITAGE BEST PRACTICES UPDATE AND 2019 PRIORITIES -HERITAGE IMPACT ASSESSMENT FOLLOW-UPS Mr. L. Bensasonadvised staff anticipate bringing forward a report regarding Delegated Authority at the December 3, 2019 Heritage Kitchener meeting.He provided a general overview on what was being proposed for Delegated Authority, noting staff are only recommending minor amendments to the existing By-law. HERITAGE KITCHENER MINUTES NOVEMBER 5, 2019-38-CITY OF KITCHENER 5.STATUS UPDATES -HERITAGE BEST PRACTICES UPDATE AND 2019 PRIORITIES -HERITAGE IMPACT ASSESSMENT FOLLOW-UPS (CONT’D) In response to questions regarding the Heritage Best Practices, Mr. Bensason advised staff identified a number of initiatives that other municipalities have implemented to review for the City’s processes for items that could possibly be improved upon.He stated this included expiration dates on Heritage Permit Applications,and possible enforcement options were identified as areas for improvement. He indicated once the Delegated Authority By-law is updated, it will become part of staffs’ core business and further areas of improvement will be discussed. He further advised staffdevelop a two-year work planthat corresponds with the Committee’s Term, noting any improvements being consideredwould be included on that work plan. The Chair noted the previous request regarding the possibility of reviewingany properties designated prior to 2005, indicating she would follow up with staff regarding that request. Councillors D. Chapman and C. Michaud questioned whether they could be circulated on the list of the properties that were previously on the Heritage inventoryprior to establishing the Municipal Heritage Registrar. Mr. Bensason advised he could possibly provide a list of the properties that were evaluated when establishing the Municipal Heritage Registrar, but he was unsure this date whether he had a complete list with all of the properties that were previously on the registrar. 6.ADJOURNMENT On motion, this meeting adjourned at 5:23p.m. D.
