Ziegler, with the following members present: Mayor D.V. Cardillo and Aldermen B. Stortz, M. Wagner, M. Yantzi, J. Smola, G. Leadston, C. Zehr, T. Galloway, G. Lorentz and C. Weylie. MINUTES Before considering its Minutes of the meeting held on August 10, 1992 the Committee was requested to amend these Minutes in order to record that Mr. Paul Puopolo appeared as a delegation in regard to Kitchener Planning and Development Staff Report PD 79/92 - City of Kitchener Response to the proposed Private Servicing Amendment to the Regional Official Policies Plan. Mr. Puopolo's presentation was recorded but not transcribed into the official Minutes of the meeting. He had advised that he was representing Harold Seegmiller (Rockway Holdings) and the majority of landowners in Breslau and had indicated to the Committee that while he supported deferral of the Private Services Amendment, he was opposed to deferral of the Grand River Trunk Study by the Region of Waterloo. The Committee agreed to the requested amendment. Moved by Mayor D.V. Cardillo Seconded by Alderman B. Stortz That the Minutes of the Planning and Economic Development Committee regular meeting held on August 10, 1992, as amended this date and the special meeting held on August 12, 1992, as mailed to the members, be accepted. Carried CORRESPONDENCE Makinq Cities Livable Conference, Charleston S. Carolina - March 8-12/93 The Committee was provided with information respecting registration at the above noted conference and any committee member wishing further information was requested to contact Mr. S. Klapman. PERMITTED USES - 2209 KINGSWAY DRIVE Ms. Bobbie Pahl appeared as a delegation before the Committee regarding the property known municipally as 2209 Kingsway Drive with respect to her request that a bridal rental business rather than the existing use be permitted on the property. It was noted that the current C-6 zoning does not allow for a bridal rental business but she asked that the permitted uses under that zoning category be reviewed. Moved by Alderman G. Lorentz Seconded by Alderman B. Stortz That the Commissioner of Planning and Development be requested to review permitted uses under existing zoning of the property known municipally as 2209 Kingsway Drive and evaluate a request for a bridal rental business to locate on the subject property. And further, that a report on this matter be considered at the meeting of the Planning and Economic Development Committee to be held on October 5, 1992. Carried PLANNING AND ECONOMIC DEVELOPMENT COMMITTEE MINUTES - 270 - SEPTEMBER 14, 1992 PERMITTED USES - 2209 KINGSWAY DRIVE (CONT'D) The Chairman advised that this recommendation would be considered by City Council at its meeting to be held on Monday, September 21, 1992. PD 74/92 - HIGHLAND ROAD EAST - ZONE CHANGE APPLICATION 92171HIZJ (SCHARRY INVESTMENTS INC.) - ROCKWAY-ST. MARY'S WARD The Committee was advised that the Department of Planning and Development was in receipt of an application from Scharry Investments Inc. to change the zoning of lands located on the east side of Highland Road just south of Stifling Avenue. The proposed zoning change is from Semi- Restricted Residential (R2B) to Semi-Restricted Residential (R2) according to By-Law 4830. In this regard the Committee considered Staff Report PD 74/92 dated August 13, 1992 and the proposed By-Law dated August 13, 1992 attached to the Report. It was noted in the Report that the subject property has a lot area of 0.237 hectares (0.586 acres) and a frontage of 21.38 metres (70.17 feet) along Highland Road. The applicant intends to rezone the subject lands in order to erect a 21 unit, 3-storey apartment building. It was pointed out that notice that the Committee would hold a public meeting this date to consider this matter had previously been given. Mr. Z. Janecki advised that staff had nothing further to add to the report under consideration. Mr. Bill O'Neil, 139 Old Park Lane, appeared as a delegation on behalf of the applicant to advise of concurrence with the recommendation in the Staff Report. No other delegations responded to the Chairman's invitation to address the Committee on this matter. Moved by Alderman B. Stortz Seconded by Alderman G. Lorentz That Zone Change Application 92/7/HIZJ (Scharry Investments Inc.) requesting a change in zoning from Semi-Restricted Residential (R2B) to Semi-Restricted Residential (R2) according to By-law 4830 on Part of Lots 16, 17, 18 and 19, Registered Plan 25, more specifically described as Parts 1 and 2, Plan 58R-1564, be approved, in the form shown in the proposed By-law attached, dated August 13, 1992, subject to the following conditions being satisfied prior to any readings of the Amending Zoning By-law by Council. To arrange for notification by letter from the Regional Municipality of Waterloo to the City's Clerk, that all Regional requirements have been satisfied with respect to the proposed zone change. The Owner acknowledges that Condition 1 hereof is required to be satisfied no later than seven (7) months from Council having approved by resolution, the amending zoning by-law relative to the Zone Change Application 92/7/H/ZJ. In the event this requirement is not fulfilled within the seven month period, Council shall consider rescinding its zone change approval. It is the opinion of this Committee that the approval of this application is proper planning for the City and is in conformity with the City's Approved Official Plan. Carried The Chairman advised that this recommendation would be considered by City Council at its meeting to be held on Monday, September 21, 1992. PD 62~92 - 121 BLUCHER STREET - ZONE CHANGE APPLICATION 911241BIPMc (LARRY PAUSER) PLANNING AND ECONOMIC DEVELOPMENT COMMITTEE MINUTES - BRIDGEPORT-NORTH WARD SEPTEMBER 14, 1992 The Committee was advised that the Department of Planning and Development was in receipt of an application from Larry Pauser to change the zoning of lands known municipally as 121 Blucher Street. The proposed zoning change is from Restricted Residential (R2A) to Semi- restricted Residential (R2B) with a deletion of uses and an addition of special regulations all according to By-Law 4830. In this regard the Committee considered staff report PD 62/92 dated July 28, 1992 and the proposed By-Law dated July 29, 1992 attached to the report. It was noted in the report that the subject lands are located on the southwest corner of Blucher Street and Dieppe Avenue and have a lot area of 555 square metres (5,974 square feet). The purpose of the application is to rezone the property to permit the use of the existing building as a duplex. It was pointed out that notice that the Committee would hold a public meeting this date to consider this matter had previously been given. Mr. T. McCabe pointed out that a previous application to allow for a triplex on the property had been refused and then commented on issues that were noted in the staff report. He indicated that he had nothing further to add to the report under consideration. Alderman J. Smola stated that he had a number of concerns concerning this application and also pointed out that he understood a tenant was occupying the third unit illegally and that another major concern was with respect to parking arrangements for the use proposed. Mr. Ed Dopp appeared as a delegation on behalf of area residents, many of whom were in attendance to oppose the zone change application. Mr. Dopp advised that the owner of the subject property had three electric meters for the property registered with the Hydro-Electric Commission, with two meters being registered in July and another one in August. He also pointed out that as of two weeks ago the third illegal living unit was occupied by a tenant. Mr. Dopp also indicated that the applicant who was a non-resident owner, never arranged for snow shovelling of the public sidewalk and that lot maintenance was poor. He also stated that the property was currently listed for sale with a real estate firm as having a triplex use. Mr. Dopp requested that the application be refused and the basement living unit be dismantled. Alderman M. Yantzi cautioned those in attendance that if the Committee refused the application, and if the applicant appealed to the Ontario Municipal Board, the Board might rule in favour of the applicant. No other delegations responded to the Chairman's invitation to address the Committee on this matter. Moved by Alderman J. Smola Seconded by Alderman C. Weylie That Zone Change Application 91/24/B/PMc (Larry Pauser) requesting a change in zoning from Restricted Residential (R2A) to Semi-Restricted Residential (R2B) with a deletion of uses and an addition of special regulations according to By-law 4830, on Lot 5, Registered Plan 647, be refused. It is the opinion of this Committee that the refusal of this application is proper planning for the City. Carried The Chairman advised that this recommendation would be considered by City Council at its meeting to be held on Monday, September 21, 1992. PD 70~92 - 260 HURON ROAD - ZONE CHANGE APPLICATION 921151HIPMc (K. and R. Hardie) - SOUTH WARD The Committee was advised that the Department of Planning and Development was in receipt of an application from Karen and Richard Hardie to change the zoning of lands known municipally PLANNING AND ECONOMIC - ~72 - SEPTEMBER 14, 1992 DEVELOPMENT COMMITTEE MINUTES as 260 Huron Road. The proposed zoning change is from Restricted Residential (R2A) to Restricted Residential (R2A) with an extension of use and special regulations according to By- Law 4830. In this regard the Committee considered Staff Report PD 70/92 dated July 29, 1992 and the proposed By-Law dated July 2, 1992 attached to the report. It was noted in the report that the subject property was located on the south side of Huron Road across from the intersection of Battler Road and that the applicant proposes to establish a planning consultant/design business as a home occupation with a maximum net floor area of 90 square meters. It was pointed out that notice that the Committee would hold a public meeting this date to consider this matter had previously been given. Mr. T. McCabe advised that staff had nothing further to add to the report under consideration. No delegations responded to the Chairman's invitation to address the Committee on this matter. Stortz That Zone Change Application 92/15/H/PMc (Karen and Richard Hardie) requesting a change in zoning from Restricted Residential (R2A) to Restricted Residential (R2A) with an extension of use and special regulations according to By-law 4830 on lands described as part of Lots 7 and 11, Biehn's Tract, designated as Part 4 on Plan 58R-4067, be approved in the form shown in the proposed By-law attached, dated July 2, 1992, subject to the following conditions being satisfied prior to any readings of the By-law by Council. To arrange for notification by letter from the Regional Municipality of Waterloo to the City's Clerk, that all Regional requirements have been satisfied with respect to the proposed development. The Owner acknowledges that Condition 1 is required to be satisfied no later than seven (7) months from Council having approved the amending zoning by-law relative to the Zone Change Application 92/15/H/PMc by resolution. PD 88~92 - 3211 AND 3217 KING STREET EAST -ZONE CHANGE APPLICATION 89/14/K/ZJ (1. and D. CRNEKOVIC) - CHICOPEE WARD Alderman J. Ziegler disclosed a conflict of interest, vacated the Chair and abstained from all discussion as his property is located within the circulation area of the subject zone change. Alderman C. Weylie, Vice-Chairman, assumed the Chair to conduct this portion of the meeting. The Committee was advised that the Department of Planning and Development was in receipt of an application from Ivan and Dragica PD 88~92 - 3211 AND 3217 KING STREET EAST -ZONE CHANGE APPLICATION 89/14/K/ZJ (I. and D. CRNEKOVIC) - CHICOPEE WARD 9 (CONT'D) Crnekovic to change the zoning of lands known municipally as 3211 and 3217 King Street East. The proposed zoning change is from Agricultural (A) to Semi-Restricted (R2) according to By-law 4830. In this regard the Committee considered Staff Report PD 88/92 dated August 10, 1992 and the proposed By-law dated July 28, 1992 attached to the report. It was noted in the report PLANNING AND ECONOMIC - ~?$ - SEPTEMBER 14, 1992 DEVELOPMENT COMMITTEE MINUTES that the subject property was located on the south side of King Street East halfway between Fairway Road and Cameo Drive and had a lot area of 0.526 hectares (1.3 acres) and a frontage along King Street of 39.568 metres (129.82 feet). It was pointed out that notice that the Committee would hold a public meeting this date to consider this matter had previously been given. Mr. T. McCabe advised that staff had nothing further to add to the report under consideration. Alderman C. Zehr expressed a general concern with respect to intensified development along the entire length of King Street East in this area and the fact that there was no sidewalk for increasing numbers of residents that was creating a safety hazard particularly in the winter when the road shoulders are obstructed by snow accumulation. He questioned the procedure relative to provisions for a sidewalk and Mr. D. Mansell advised that with every development agreement the City obtains funding to support the future installation of a sidewalk but that the Region does not have all of the necessary widenings to allow for installation. In addition upgrading of this section of King Street East which would then allow for sidewalk construction as a result of re- engineering of the road right-of-way was many years away in consideration of the Region's roads program. Mr. D. Snow suggested that it may be that Transit stops could be worked on as part of an interim solution for the benefit of pedestrians. Alderman C. Zehr stated that a solution must be found to this increasing hazard. Ms. Maryanne Crnekovic, 45 Chartwell Court, appeared as a delegation representing Ivan and Dragica Crnekovic and advised that they were in agreement with the recommendations contained in the staff report. No other delegations responded to the Chairman's invitation to address the Committee on this matter. Moved by Alderman G. Leadston Seconded by Alderman B. Stortz That Zone Change Application 89/14/K/ZJ (Ivan & Dragica Crnekovic) requesting a change in zoning from Agricultural (A) to Semi-Restricted Residential (R2) according to By-law 4830, on Lots 20 and 21, Registered Plan 986, be approved, in the form shown in the proposed By-law attached, dated July 28, 1992, subject to the following conditions being satisfied prior to any readings of the Amending Zoning By-law by Council. To arrange for notification by letter from the Regional Municipality of Waterloo to the City's Clerk, that all Regional requirements have been satisfied with respect to the proposed zone change. Ziegler previously disclosed a conflict of interest and abstained from all discussion and voting as his property is located within the circulation area of the subject application. Alderman C. Weylie, Vice-Chairman, advised that this recommendation would be considered by City Council at its meeting to be held on Monday, September 21, 1992. Alderman C. Weylie then vacated the Chair which was assumed by Alderman J. Ziegler, Chairman who conducted the remainder of the meeting. PLANNING AND ECONOMIC DEVELOPMENT COMMITTEE MINUTES - 274 - SEPTEMBER 14, 1992 8. PD 81/92 CENTRE WARD - 296 FREDERICK STREET - ZONE CHANGE APPLICATION 921221FICL (LESLIE TOTH) The Committee was advised that the Department of Planning and Development was in receipt of an application from Leslie Toth to change the zoning of lands known municipally as 296 Frederick Street. The proposed zoning change is from Semi-Restricted Residential (R2B) to Restricted Commercial (C3) with a special list of uses all according to By-law 4830. In this regard the Committee considered Staff Report PD 81/92 dated August 7, 1992 and the proposed By-law dated August 10, 1992 attached to the report. It was noted in the report that the subject lands are located on the west side of Frederick Street between Locust Street and Chestnut Street. The applicant intends to rezone the subject lands to permit the conversion and/or use of the existing building for offices and residential uses in accordance with those uses permitted in the Central Frederick Secondary Plan. It was pointed out that notice that the Committee would hold a public meeting this date to consider this matter had previously been given. Mr. T. McCabe advised that staff had nothing further to add to the report under consideration other than to point out that the procedure was seen as an interim by-law for the time being pending Stage 6 of the Comprehensive By-law. No delegations responded to the Chairman's invitation to address the Committee on this matter. Moved by Alderman G. Lorentz Moved by Alderman M. Wagner That Zone Change Application 92/22/F/CL (Leslie Toth) requesting a change in zoning from Semi-Restricted Residential (R2B) to Restricted Commercial (C3) with a special list of uses all according to By-law 4830 on Part Lot 8, Plan 111, be approved in the form shown in the proposed By-law attached, dated August 10, 1992, subject to the following conditions being satisfied prior to any readings of the By-law by Council. To arrange for notification by letter from the Regional Municipality of Waterloo to the City's Clerk, that all Regional requirements have been satisfied with respect to the proposed development. The Owner acknowledges that Condition 1 is required to be satisfied no later than seven (7) months from Council having approved the amending zoning by-law relative to the Zone Change Application 92/22/F/CL by resolution. In the event this requirement is not fulfilled within the seven month period, Council shall consider rescinding its zone change approval. 8. PD 81/92 - 296 FREDERICK STREET - ZONE CHANGE APPLICATION 921221FICL (LESLIE TOTH) CENTRE WARD (CONT'D) It is the opinion of this Committee that the approval of this application is proper planning for the City and is in conformity with the City's Approved Official Plan. Carried The Chairman advised that this recommendation would be considered by City Council at its meeting to be held on Monday, September 21, 1992. PD 87~92 - ADDRESS CHANGE PROPOSAL - 520 LANCASTER STREET W. TO 585 BRIDGEPORT ROAD - BRIDGEPORT NORTH WARD The Committee was in receipt of Planning and Development Staff Report PD 87/92 dated August PLANNING AND ECONOMIC - ~?!~ - SEPTEMBER 14, 1992 DEVELOPMENT COMMITTEE MINUTES 18, 1992 advising that the City had received a request to change the address of the property known municipally as 520 Lancaster Street West to 585 Bridgeport Road. It was noted in the report that the extension of Bridgeport Road has resulted in the property now having frontage on Bridgeport Road rather than the access previously enjoyed from Lancaster Street West. The Committee was advised that staff had nothing further to add to the report under consideration. No delegations were registered respecting this matter. Moved by Alderman G. Stortz That Kitchener's City Council approve the property address change, for property assessment roll number 6-02-048, from 520 Lancaster St. W. to 585 Bridgeport Road, to be effective October 1, 1992, in the form shown in the Proposed By-law attached and dated August 18, 1992. Carried The Chairman advised that this recommendation would be considered by City Council at its meeting to be held on Monday, September 21, 1992. 10. PD 85~92 - HOMER WATSON BLVD. AND BLOCK LINE ROAD EXTENSION - MINOR CHANGE TO ZONING BY-LAW AND CHANGE TO DRAFT PLAN APPROVAL CONDITIONS (DREWLO HOLDINGS) - ZCA 881711BIZJ AND SUBD. 30T-86035 - FAIRVIEW WARD The Committee was in receipt of Planning and Development Staff Report PD 85/92 dated September 2, 1992 concerning a change to the proposed zoning by-law for zone change application 88/71/B/ZJ and revisions to Council's conditions for Draft Plan of subdivision 30T- 86035 (Drewlo Holdings Ltd). It was noted in the report that through the Region's final review of the plan, several minor changes were requested to the draft plan and these were explained in the report. Mr. T. McCabe briefly explained all of the changes which were considered minor in nature and in no way affected an adjacent subdivision. Mr. P. Britton appeared as a delegation on behalf of Drewlo Holdings and indicated support of the recommendations contained in the staff report. No delegations were registered respecting this matter. 10. PD 85~92 - HOMER WATSON BLVD. AND BLOCK LINE ROAD EXTENSION - MINOR CHANGE TO ZONING BY-LAW AND CHANGE TO DRAFT PLAN APPROVAL CONDITIONS (DREWLO HOLDINGS) - ZCA 881711BIZJ AND SUBD. 30T-86035 - FAIRVlEW WARD (CONT'D) Moved by Alderman B. Stortz Moved by Alderman M. Wagner That the "Proposed By-law" dated April 6, 1992 for Zone Change Application 88/71/B/ZJ (Drewlo Holdings Inc.) be replaced with the attached "Proposed By-law" dated August 31, 1992. That the Plan of Subdivision dated 90 12 03 be replaced with the attached Plan of Subdivision dated Revised 92 08 14. That the City Solicitor be authorized to change the conditions related to Subdivision Application 30T-86035 (Drewlo Holdings Inc.) approved by City Council on May 18, 1992 to reflect the changes to the numbering of lots and blocks and that the following new PLANNING AND ECONOMIC - :~?~ - DEVELOPMENT COMMITTEE MINUTES subsection be added to condition 51 as follows: SEPTEMBER 14, 1992 c) That Stage 3 of this Plan of Subdivision may register immediately consecutive with or subsequent to the registration of Draft Plan of Subdivision 30T-86036. That no further notice be required prior to the passing of the zoning by-law since the changes are minor and do not change the general nature of the subdivision or intensity of development. PRESENTATION -INFORMATION ONLY - HIGHWAY #7 PLANNING STUDY - WELLINGTON STREET TO THE GRAND RIVER - MCCORMACK, RANKIN AND MINISTRY OF TRANSPORTATION OF ONTARIO - BRIDGEPORT-NORTH WARD Mr. Kieth Anderson, Ministry of Transportation, London and Mr. Martin Scott, McCormack, Rankin, Mississauga appeared before the Committee to provide information relative to the Highway #7 Planning Study from Kitchener to Guelph and more specifically from Wellington Street to the Grand River within the boundary of the City of Kitchener. Mr. Anderson advised that the plan has been worked on for three years and that a number of changes have been made since 1990 when preliminary plans were presented. He indicated that they were now ready to proceed with a recommendation that would be tabled at Public Information Open Houses being held on September 30 and October 1, 1992. Mr. M. Scott reviewed the Kitchener portion of the project and the changes that have been made since the last presentation was made to Planning Committee. He very closely reviewed the changes that have been made in and around the intersection of Highway 86 and Wellington Street and ramps serving this interchange. Alderman B. Stortz questioned what the timing for the project might be. Mr. Scott indicated that a complete Environmental Assessment was necessary, that approximately two years would be required to conclude necessary property purchases after which the project would be prioritized by the province. Mr. Anderson assured the Committee that the Highway #7 project was considered a high priority at the provincial level. As a result of the latest proposals for alignment of new Highway #7 Mr. T. McCabe questioned the approach that the Planning Department should be taking with respect to requests for development anywhere near to the latest preferred route. Mr. Scott replied that until the Environmental PRESENTATION -INFORMATION ONLY - HIGHWAY #7 PLANNING STUDY - WELLINGTON STREET TO THE GRAND RIVER - MCCORMACK, RANKIN AND MINISTRY OF TRANSPORTATION OF ONTARIO - BRIDGEPORT-NORTH WARD (CONT'D) Assessment was approved, any development plans should be considered premature and that staff should advise prospective developers that an Environmental Assessment was underway. Ms. V. Gibaut drew attention to a building that the City is trying to sell in the Bridgeport Business Park that would be affected by the Highway #7 project. 12. PD 89~92 - SPECIAL MEETINGS OF PLANNING COMMITTEE TO DISCUSS HOUSING REPORTS PD 90~92 - THE SECONDARY UNIT APARTMENT EXPERIENCE IN THE CITY OF KITCHENER PLANNING AND ECONOMIC - ~?? - SEPTEMBER 14, 1992 DEVELOPMENT COMMITTEE MINUTES The Committee was in receipt of Planning and Development Staff Report PD 89/92 dated September 3, 1992 advising that at the Planning and Economic Development Committee meeting held August 10, 1992, the members received the Municipal Housing Statement, two official plan amendments dealing with second units in single detached dwellings and the staff response to the provincial government's consultation paper, "Apartments in Houses". The Committee had directed that staff make recommendations with respect to future meeting dates that these matters would be considered. The Committee was also in receipt of staff report PD 90/92 dealing with a report "Secondary Unit Apartment Experience in the City of Kitchener" and recommending that this report also be considered as part of discussions taking place relative to the reports dealing with apartments in houses and secondary apartment units. Lorentz Seconded by Alderman J. Smola That the report titled, "The Secondary Unit Apartment Experience in the City of Kitchener" attached to staff report PD 90/92 be tabled for information and considered as part of the discussions taking place at the Special Meeting of Planning Committee established to discuss the Provincial Consultation Paper and the Official Plan Amendments dealing with the subject of Secondary Apartment Units. Carried The Chairman advised that these recommendations would be considered by City Council at its meeting to be held on Monday, September 21, 1992. 13. PD 88/92 - KITCHENER'S RESPONSE TO THE PROPOSED VISIONS DOCUMENT "TOWARDS 2021" FOR THE REGION OF WATERLOO The Committee was in receipt of staff report PD 88/92 dated August 1, 1992 dealing with a response to the document of the Region of Waterloo titled "Towards 2021: Shaping our Regional Vision Together". Vision E and a Vision K were attached to the staff report and the main differences were pointed out. Ms. B. Newell noted that Vision K was considered tame compared to Vision E and if the Grand River Trunk Sewer System was to go ahead annexation of Breslau and the Airport area would have to be addressed. Mr. B. Stanley commented that since the Region brought forward the proposal for a regional trunk system then if the City was going to assume the costs of the system other benefits must be available to the municipality. Alderman C. Zehr responded that the rationale makes the assumption that the City would be paying these costs but noted that payment for the Trunk System was not a foregone conclusion and that the City's portion could be reduced substantially. Mr. Stanley noted that the Regional Vision C proposes a modest expansion of Breslau and that with this scenario the City of Kitchener was in a much better position to take advantage of this PLANNING AND ECONOMIC - ~78 - SEPTEMBER 14, 1992 DEVELOPMENT COMMITTEE MINUTES occurrence from a regional economic point of view. It was noted that should this happend then it would result in the shift of development pattern taking place. Moved by Alderman M. Wagner Seconded by Alderman B. Stortz That Kitchener Council submit Vision" K" to the Region of Waterloo for consideration in their visioning exercise, "Towards 2021: Shaping Our Regional Vision Together". Carried The Chairman advised that this recommendation would be considered by City Council at its meeting to be held on Monday, September 21, 1992. 14. 14. PD 83/92 - DEPARTMENT INITIATIVES TO IMPROVE ENFORCEMENT - AND - RESULTS OF OCTOBER 1991 ENFORCEMENT SESSION At the Committee's August 10th meeting consideration of PD 83/92 dated August 5, 1992 was deferred at the request of the Legal Department in order to allow them to present their concerns in caucus session. Prior to the meeting this date the Committee held a caucus meeting relative to this matter. As a result of that meeting staff were now proposing revisions to the recommendations contained in staff report PD 83/92. Moved by Alderman B. Stortz Seconded by Mayor D. V. Cardillo That the Staffing and Action Plan regarding By-law Enforcement, attached as Appendix "A", be accepted for information. That the attached report entitled "Municipal Enforcement in Ontario" be accepted for information. That the current practice of enforcement respecting Zoning, Fence, Sign, Lot Maintenance, Discarded Refrigerator, and Regulation of Animal By-laws initiated by complaint be confirmed and expanded to include enforcement initiated by staff respecting the following: a) health and safety issues; b) lodging houses in accordance with the policy approved by 28, 1991; Council on October PD 83/92 - DEPARTMENT INITIATIVES TO IMPROVE ENFORCEMENT - AND - RESULTS OF OCTOBER 1991 ENFORCEMENT SESSION (CONT'D) c) illegal uses discovered through joint inspection with fire or building staff; d) violations discovered on zone change or Committee of Adjustment refusals; and e) violations brought to the attention of the City through applications or written inquiries respecting a property To continue to give top enforcement priority to violations that deal with safety and health issues, and in particular, fences or shrubs causing sight obstructions, unsafe swimming pools, unsafe illegal residential units and discarded refrigerators. 5. To increase public awareness of the City's Enforcement Policies and Procedures by: a) hosting and participating in by-law educational sessions for neighbourhood associations, the business community and the general public. b) preparing and distributing information pamphlets outlining the Zoning Inspectors' role, complaint procedures and potential penalties. 8. That this By-law Enforcement policy be reviewed in one year. Carried The Chairman advised that this recommendation would be considered by City Council at its meeting to be held on Monday, September 21, 1992. 15. DEVELOPMENT CHARGES Alderman T. Galloway advised that he had received an inquiry from a local builder and pointed out that various municipalities were suspending, deferring or eliminating development charges respecting non-residential developments. He suggested that staff be asked to investigate this matter and determine what benefits if any have accrued to Kitchener as a result of its development charge policy. Alderman Zehr suggested that the question of volume of activity also be addressed. Mr. J. Witmer indicated that he could report regarding statistics that his division has compiled and it was agreed to refer the entire matter to the Development Charge Committee for consideration and response to the Planning and Economic Development Committee. 16. SUGGESTED CHANGES TO ENFORCEMENT UNDER THE PLANNING ACT 16. Ms. L. MacDonald advised the Committee that in discussions with SUGGESTED CHANGES TO ENFORCEMENT UNDER THE PLANNING ACT (CONT'D) provincial officials they had suggested that any changes that might be desired for the enforcement aspect of the Planning Act be conveyed to the province for consideration as part of its review of the Act. Moved by Alderman J. Smola Seconded by Alderman G. Leadston That we authorize the Kitchener Legal Department to convey to the Ministry of Municipal Affairs and to the Ministry of Housing, its suggested Changes to the Planning Act that would strengthen enforcement of the Act. Carried The Chairman advised that this recommendation would be considered by City Council at its meeting to be held on Monday, September 21, 1992. 17. WIDENING OF WOOLWICH STREET Alderman J. Smola requested that the City ask that Woolwich Street be deleted from the street widening list of the Region of Waterloo. PLANNING AND ECONOMIC - ~80 - SEPTEMBER 14, 1992 DEVELOPMENT COMMITTEE MINUTES Mr. D. Snow explained that because of a development by Kraushaar resulting in the rerouting of traffic utilizing Bridge Street, Lancaster Street and Woolwich Street and approval by the Council of the City of Waterloo of the Subdivision without Kitchener's input, widening of Woolwich Street was now redundant and should be deleted which would then accomodate the plans of a Kitchener property owner to proceed with a Committee of Adjustment matter. Following further discussion Alderman J. Smola agreed to raise this request at the September 21 st Council Meeting for action at that time. 18.
