Weylie, with the following members present: Mayor D.V. Cardillo, and Councillors J. Ziegler, T. Galloway, M. Yantzi, G. Leadston, J. Smola, C. Zehr, G. Lorentz, B. Stortz and M. Wagner. Officials present: Mr. R.W. Pritchard, Mr. S. Klapman, Mr. B. Stanley, Mr. T. McCabe, Ms. B. Newell, Mr. J. Wallace, Mr. J. Shivas, Mr. D. Snow, Mr. T. Boutilier, Ms. C. Ladd, Mr. J. Witmer and Mr. L.W. Neil. 1.PD 94/28 - CITY OF KITCHENER MUNICIPAL PLAN. The Committee was in receipt of Planning and Development Staff Report PD 94/28 dated March 14, 1994 prepared as a response to issues raised at the Committee's Special Meeting held March 2nd dealing with the Municipal Plan. The Committee proceeded to deal with these issues in the order in which they were itemized in Report PD 94/28. A. Deferred Items 1. Brigadoon Collector Roads and Biehn Drive Ms. B. Newell advised that she had met with Mr. Bob Black this date concerning this issue and tabled a recommendation with the Committee. In response to Councillor T. Galloway, Ms. Newell advised that the developers with an interest in this matter must work out an internal road system and Mr. B. Stanley advised that Mr. Black has requested the deferral referred to in the recommendation. Mr. P. Britton, appeared as a delegation regarding this matter and distributed a map with street networks superimposed over the Doon South Creek Subwatershed Plan. He pointed out that Street C on the Plan was deferred as part of Official Plan Amendment #98 and requested that Street C be deferred as part of the Municipal Plan and brought back at a later day as the location of the extension of Street C was relevant in respect to planning of future communities to the west. Mr. Bob Black, 4 Park Avenue West, Elmira, appeared as a delegation regarding two issues. Firstly, he referred to the Committee's March 2 Minutes which stated that it was agreed consideration of the Hearthwood lands, Biehn Drive, be deferred and referred to the meeting this date. He stated that he wished it clarified for the record that the deferral did not relate to the subdivision but just to the Official Plan Map where Biehn Drive and the Collector Road are located. Secondly, he advised that they have resolved the issue of the Biehn Drive extension through the wetland with staff and the intersection was no longer a concern and he was in support of the recommendation tabled by staff. On motion by Mayor D.V. Cardillo, it was agreed that the road alignment as shown on Map 5 for Biehn Drive extension remain the same and that the street connection (Street C) to Biehn Drive be deferred until September, 1994 pending resolution of accessing the western portion of the Brigadoon area. 2.Tilt Drive In response to Councillor T. Galloway, Ms. B. Newell commented that the additional words noted in the staff report served to clarify the issue. Councillor M. Wagner expressed concern with use of the word "minimal" and questioned who would decide what was minimal. Ms. Newell responded that minimal refers to protection of the area and after some consideration it was agreed that minimal means the impact on the scenic nature of the area including vegetation. Mr. P. Britton, appeared as a delegation on this issue and distributed a letter dated March 16, 1994 suggesting that a sentence also be added to Policy 8.3.3.9 (iii) acknowledging in that local street crossings will be necessary to ensure access to lands on the west side of Tilt Drive. His letter commented on previous planning respecting Tilt Drive and noted that permitting only local streets to PLANNING & ECONOMIC DEVELOPMENT COMMITTEE MINUTES MARCH 21, 1994 - 43 - CITY OF KITCHENER cross Tilt Drive rather than collectors roads was a positive development. On motion by Councillor M. Wagner, it was agreed that Policy 8.3.3.9 (iii) Page 2-85 include the phrase "to provide access to abutting lands" as noted in PD 94/28 and also include a revision pointing out that local streets can cross Tilt Drive to service other lands. 3. Proposed Heavy Industrial Designation on Glasgow Street Ms. B. Newell tabled a recommendation respecting this matter along with an addition to it. Mr. B. Stanley pointed out that the existing properties were without various servicing standards and consequently the only approach has resulted in Mr. Magid agreeing to upgrade the property following which the issue could be reconsidered. Mr. Howard Magid, 54 Pinemeadow Crescent, appeared as a delegation to advise that he was in support of the recommendation proposed by staff and advise that it was his intention to complete these matters by May, 1994. Mr. Terry Sosnoski, 1767 Glasgow Street, appeared as a delegation regarding this matter to state that area residents obtained their drinking water from wells on their property and they were concerned because of the potential for oil run off from stored vehicles and other contaminants from the salvage operation. Also, he stated that the location of the operation on a blind corner was unsafe from a traffic point of view. Councillor C. Zehr advised that the Region of Waterloo and the Ministry of the Environment have responsibility for water quality. Mr. B. Stanley advised that automotive repair uses was permitted in a general industrial area and Mr. L. Masseo advised that both the Region and the Ministry of the Environment and Energy committed that they had no concerns with potential contamination. On motion by Councillor B. Stortz, it was agreed that provided Mr. Magid can demonstrate to Council, before the approval of the Plan by Regional Council, that he has made the necessary improvements to his property with respect to fencing, parking, access, operations within the building, verification of water problem, etc., Council may consider redesignation of his property to Heavy Industrial. A list of improvements to be accomplished will be provided by Planning Department. 4. 24 Morrison Road and King Street East Ms. B. Newell advised that she had met with Mr. Andre Probst and Ms. Denice Probst and they were satisfied with no action been taken on a request as its relates to the proposed designation of their lands in the Municipal Plan. On motion by Councillor C. Zehr, it was agreed that no action be taken on the request and no change be made to Map 5. 5. Stoltzhaur Farm On motion by Councillor M. Wagner, it was agreed that no action be taken on the request and no change be made to Map 5. 6. Breslau Farms Limited - Huron Business Park On motion by Councillor T. Galloway, it was agreed that no action be taken on the request. 7. Huron Business Park On motion by Councillor T. Galloway, it was agreed that no action be taken on the request of Mr. R. Hardie. Property at the Corner of Bleams and Westmount Road - First Christian Reform Church of Canada On motion by Councillor M. Yantzi, it was agreed that no action be taken on the request of Mr. John Heij. PLANNING & ECONOMIC DEVELOPMENT COMMITTEE MINUTES MARCH 21, 1994 - 44 - CITY OF KITCHENER Gateway Business Park - Lot 1, Block 4, Registered Plan 1744 and Lots 1,2,3,4,5,8,9 and 10, Block 11, Registered Plan 1745 On motion by Councillor M. Wagner, it was agreed that no action be taken at this time on the request of Mr. B. Clarkson. 10. Pioneer Tower West Ms. B. Newell requested approval of additional wording outlined in her report that would be added to the first paragraph of Page 3-41. Mr. P. Britton advised that he was in support of the wording in Report PD 94/28. Councillor T. Galloway was of the view that the additional wording was totally redundant and there was no reason why a specific Official Plan Amendment needed to be mentioned in the Municipal Plan. Mr. B. Stanley advised that the wording was prepared in accordance with the Committee's March 2nd direction. Councillor C. Zehr questioned if the additional wording would apply to all Official Plan Amendments and Mr. B. Stanley advised that the amendment in Pioneer Tower West was the only one that staff were dealing with at this time and that all others have been included in the Municipal Plan. Following further discussion it was suggested that the words "may/or may not result in changes" be added to the proposed rewording after the words, by Council for processing. On motion by Councillor C. Zehr, it was agreed that the following wording be added to the first paragraph, Page 3-41 "...It is however, acknowledged that an Official Plan Amendment has been submitted for the area and accepted by Council for processing which may or may not result in changes. The special policies are under review as part of the comprehensive processing of the Official Amendment and Draft Plans of Subdivision." 11.Land Bounded by Margaret Avenue, Blucher Street, St. Leger Street and Louisa Street Mr. M. Dorfman, appeared as a delegation and advised that he was in support of the redesignation and new policies outlined in Staff Report PD 94/28. On motion by Councillor J. Smola, it was agreed that the lands be redesignated from the proposed Medium Rise Residential to Comprehensive Development Area and that the new policy outlined in report PD 94/28 be added to Part 3 Section 11, Page 3-35." 12. Page 4-2, Policy 1.1.2 - Implementation Strategies Mr. J. Shivas advised that he had provided the Committee with a report dated March 18th respecting this issue. He suggested that it was not advisable to instruct senior levels of the government that they must use the process of a lower level of government and are thus accountable to a lower level of government. He pointed out that senior levels of government were accountable to the electorate for their actions. Mr. Shivas stated that he was in support of the additional wording for the policy as outlined in PD 94/28. At the March 7th Council Meeting, Councillor J. Ziegler had distributed a proposed rewording of Policy 1.1.2 which noted the supremacy of senior levels of government but requested that notwithstanding this, they comply with the policies of Municipal Plan unless they publicly invoke their legislated authority when unable or unwilling to comply. Mr. J. Shivas commented that it was up to the Province or the Federal Government to establish the proper process that they should engaging in in such a matter and that the decision was theirs alone. Councillor T. Galloway pointed out that in other parts of the country, senior levels of governments appeared to be using local government policies and also noted that the Province had threatened the Federal Government with a zoning order on certain lands in Pickering. Mr. J. Shivas responded that there is certain land that the Federal Government will allow to go back to the private sector and when that happens then normal planning process would apply. He stated that it was his understanding in some of the situations Councillor Galloway referred to, the Federal Government did not own the land or volunteered to participate in the process. Councillor J. Ziegler commented that if the City had a policy similar to what he was suggesting, the Federal Government might follow it out of courtesy. It was agreed that copies of Councillor J. Ziegler's resolution would be distributed PLANNING & ECONOMIC DEVELOPMENT COMMITTEE MINUTES MARCH 21, 1994 - 45 - CITY OF KITCHENER to members of Council for consideration at the March 28th Council Meeting. On motion by Councillor C. Zehr, it was agreed that this matter be deferred and referred to the March 28th Council Meeting for further consideration. 13. Doon Pioneer Park Community Association Ms. B. Newell advised that the recommended rewording outlined in Report PD 94/28 was the result of discussion with Ms. P. Nippell. Following clarification of a few other issues, the revised rewording was then dealt with. On motion by Councillor J. Smola, it was agreed that the revised rewording of policies as outlined in report PD 94/28 be accepted and that the other recommended actions under this item also be accepted. 14. SPUD Councillor M. Wagner questioned who selects a firm to do a heritage impact assessment and Mr. B. Stanley advised that it was usually the responsibility of the proponent. Councillor M. Wagner questioned how a balanced unbiased report could be obtained and Mr. Stanley advised that there was a process for the City to retain an independent consultant. Councillor M. Wagner expressed concern with regard to sub item #3 in Report PD 94/28 respecting the proposal to add a sentence to the first paragraph of Page 2-86. He had a concern with use of the word always as it may imply that widening of the carriageway could take place. Mr. B. Stanley advised that this policy was being put into the Schedule D. Ms. B. Newell also suggested that under sub item #2, an additional sentence be added at the end referring to the listed Scenic Heritage Roads and therefore subject to Scenic Heritage Road Policies. Councillor C. Zehr commented with the reference in sub item #2 to Schedule D and in sub item #3 to general policies, that Councillor Wagner's concern was covered off in two areas. On motion by Councillor M. Wagner, it was agreed that the revised rewording of policies with respect to transportation issues as outlined in report PD 94/28 be accepted subject to the inclusion of the following additional statement at the end of item #2, "These are potential Scenic-Heritage Roads and are therefore subject to Scenic-Heritage Road policies of the Plan". 15. Doon South Community On motion by Councillor G.L. Leadston, it was agreed that the recommendation to redesignate land shown on Map 1 from Limited Service Residential to Low Rise Residential be accepted. B. New Items 1. Page 2-41, Policy 6.1.14 - Universal Access Ms. B. Newell advised that this policy was a modified to include additional wording shown in Report PD 94/28 as a result of a request from the Parks & Recreational Department. On motion by Councillor G. Lorentz, it was agreed that the revised policy rewording as outlined in report PD 94/28 be accepted. 2. Westmount Investments on Westmount Road Ms. B. Newell advised that this matter has been addressed as a result of correspondence received from Mr. M. Dorfman respecting Business Park designation and the matter of compensation for the Huron Park designation. Mr. B. Stanley commented that he wished to draw these issues to the attention to the Committee and advised staff would continue to deal with these issues. Mr. M. Dorfman advised that he did not intend to make a presentation on this matter. On motion by Councillor M. Yantzi, it was agreed that no action be taken on the request concerning the redesignation of the property in the Plan from Business Park to Open Space. PLANNING & ECONOMIC DEVELOPMENT COMMITTEE MINUTES MARCH 21, 1994 -46 - CITY OF KITCHENER 3. Deferral of Clause 8.3.3, #9 (iii) Ms. B. Newell advised that this matter relates to a letter received from Mrs. Jean Haalboom who has claimed that words are missing from the Municipal Plan policy as compared to what was in Official Plan Amendment #78. She advised that the wording is included in Policy 4, Page 2-84 which applies to all Scenic Roads including Tilt Drive. MFS. Jean Haalboom appeared as a delegation and stated that it was very important for the policy to be understood and the wording to be clear. She commented that in the future with change over in staff, residents were looking for assurance that there will be no question about the intent respecting this matter. Mr. B. Stanley advised that staff consider that the issue has been specifically stated in the policy dealing with Heritage Roads. Councillor M. Wagner commented that the issue was reflected in the Municipal Plan and in the minutes of the meeting that Scenic Roads would not be widened. In response to Councillor T. Galloway who questioned why the current wording in Official Plan Amendment #78 could not be maintained, Mr. B. Stanley advised that with the Municipal Plan, a generic policy was being created. He stated that if there is something unique and it was restated over and above general policies, the matter can then become a serious interpretation problem. Mr. J. Wallace concurred that the answer lay in a general policy for all Scenic Roads. Councillor M. Wagner commented that it was his hope future Councils would respect the wishes of current and future residents and noted that ongoing vigilance by the residents would protect Scenic Roads. Mr. J. Wallace suggested that consideration be given to appropriate signing of Scenic Roads and that such signing advise of no alterations without reference to the Municipal Plan. On motion, it was agreed that no action be taken on the request for deferral as the issue is dealt with in Policy 4, Page 2-84 which applies to all Scenic Roads. C. Other Items 1. Page 2-3, Policy 1.1.2 - Housing-Provide Variety and Integration Councillor J. Ziegler commented that in February, 1993, City Council had passed a resolution relative to Non Profit Housing and in view of this he was suggesting a change to the policy. Following some discussion it was agreed to add a phrase that would provide more balance to the policy. On motion by Councillor C. Zehr, it was agreed that the phrase "and cost efficient" be added in the second sentence after the words "seek improved". 2. Page 3-44, Policy 19 - Caryndale Ms. B. Newell advised that a fax was received this date from Mr. M. Hassen on behalf of Chalon Estates Inc. indicating the membership was unhappy with the wording in the special policy in the plan as its pertains to the Caryndale Community. Mr. Paul Hill, President of Chalon Estates Inc., appeared as a delegation to advise that they favor the wording with respect to distinctiveness and cultural uniqueness which has been provided by Ms. P. Nippell. Councillor J. Ziegler commented that the Caryndale Community was unique and existed prior to annexation to Kitchener. On motion by Councillor J. Ziegler, it was agreed that the policy be revised to incorporate the request of Mr. M. Hasen asking that the cultural distinctiveness of the Caryndale Community be recognized in the Policy. 3. Page 2-57, 58, Policy 7.3.2 - Provincially Significant Wetlands Councillor T. Galloway referred to a memorandum dated March 16, 1994 which he had provided to members of the Committee with respect to the above policy which he requests be amended so as to replace "Environmental Impact Study" with "Environmental Assessment". He pointed out that the matter relates to both the Municipal Plan and the Doon South - Brigadoon Transportation Network and Corridor Study. Councillor C.M. Weylie directed that the issue be considered as part of the Corridor Study later in the meeting. This matter was dealt with under the Doon South - Brigadoon Transportation Network and Corridor Study which was also considered this date. PLANNING & ECONOMIC DEVELOPMENT COMMITTEE MINUTES MARCH 21, 1994 -47 - CITY OF KITCHENER On motion, it was agreed that no change be made to Policy 7.3.2.5 since a motion to substitute a requirement for an Environmental Assessment in place of Environmental Impact Study was lost. The Municipal Plan policies as revised to include the changes agreed to this date, were then considered. On motion by Councillor J. Smola, it was resolved: "That 'Creating a Sense of Place, City of Kitchener Municipal Plan', considered March 2, 1994, be adopted with the major text and map changes outlined in Staff Report PD 94/21 subject to incorporation of the deferred items and new items outlined in Staff Report PD 94/28 and other items which have been resolved as follows: A. The Chairman advised that this recommendation would be considered by City Council at its meeting to be held on Monday, March 28, 1994. 2.PD 94/17 - BLOCK LINE ROAD AND HOMER WATSON BOULEVARD. - ZONE CHANGE APPLICATION 90151BIZJ. -ALPINE INVESTMENTS LIMITED. - FAIRVIEW WARD. The Committee was advised that the Department of Planning and Development was in receipt of a Zone Change Application submitted by Alpine Investments Limited with regard to lands in the area of PLANNING & ECONOMIC DEVELOPMENT COMMITTEE MINUTES MARCH 21, 1994 -49 - CITY OF KITCHENER Block Line Road and Homer Watson Boulevard. The zoning change proposed is from Agricultural (A) according to By-law 4830 to Neighbourhood Shopping Centre (C-2) according to By-law 85-1. In this regard, the Committee was in receipt of Planning and Development Staff Report PD 94/17 dated February 8, 1994 and a Proposed By-law dated February 7, 1994 attached to the report. It was noted in the report that the applicant intends to rezone the subject lands in order to construct a Neighbourhood Commercial Plaza on the .917 hectare site situated at the northeast corner of the intersection of Homer Watson Boulevard and the future extension of Block Line Road. It was pointed out that notice that the Committee would hold a public meeting this date to consider this matter had previously been given. Mr. Bill Green, Green and Associates, 155 Lexington Court, Waterloo, and Ms. Moira Morris of Alpine Investments Limited attended the meeting to support the recommendation in the Staff Report. Mr. Paul Wagner appeared as a delegation representing DGF Group which owns lands across the street from the subject property. Mr. Wagner stated that he wished to raise the matter of traffic movement on the future extension of Block Line Road and express concern that an alignment of entrances to his client's property and the Alpine Investments' property take place. He questioned if there was some method, such as at the time of site plan consideration, to provide that the entrances be aligned opposite each other. No other delegations responded to the Chairman's invitation to address the Committee on this matter. Mr. T. McCabe commented that the issue before the Committee was just a zone change application and that he could not commit to anything without having reviewed a site plan. However, he stated that he would go on record as taking Mr. Wagner's request under advisement. The recommendation in the staff report was then considered. On motion by Councillor M. Wagner, it was resolved: "That Zone Change Application 90/5/B/ZJ (Alpine Investments Limited) requesting a change in zoning from Agricultural (A) according to By-law 4830 to Neighbourhood Shopping Centre Zone (C-2) according to By-law 85-1 on Block K, Registered Plan 1335 and Part of Lot 5, Registered Plan 1028, be approved, in the form shown in the proposed By-law attached, dated February 7, 1994. It is the opinion of this Committee that the approval of this application is proper planning for the City and is in conformity with the City's Approved Official Plan." The Chairman advised that the recommendation would be considered by City Council at its meeting to be held on Monday, March 28, 1994. 3.PD94/15 - DOON SOUTH BRIGADOON TRANSPORTATION NE'I'VVORK & CORRIDOR STUDY - STAFF RECOMMENDATIONS AND OFFICIAL PLAN AMENDMENT 94/2 - SOUTH WARD The Committee was in receipt of Planning and Development Staff Report PD 94/15 dated March 8, 1994 which itemizes staff recommendations related to the Doon South - Brigadoon Transportation Network & Corridor Study. Attached to the report was a further report dealing with the Official Plan Amendment Application related to the Study. Also, the Committee members were previously in receipt of the Doon South - Brigadoon Transportation Network and Corridor Study document prepared by McCormick Rankin and an Executive Summary of the document. The purpose of the Official Plan Amendment is to add the "west to south" arterial roadway corridor to the following maps: Plan of Land Use, Floodplain and Environmental Areas, Primary Aggregate Resource Areas and Community Improvement Area. Also the amendment would add an additional policy to section 11 "policies for specific areas" of the Official Plan. It was pointed out that notice that the Committee would hold a public meeting this date to consider these matters had previously been given. PLANNING & ECONOMIC DEVELOPMENT COMMITTEE MINUTES MARCH 21, 1994 - 50 - CITY OF KITCHENER Mr. B. Stanley commented that the reports that were under consideration represented future planning for the entire southwest section of the Municipality and that within the process a direct link had been made between transportation issues and land use issues. Before providing an overview of the reports that were before the Committee, Mr. T. Boutilier advised that Messrs Bob Blay and Jack Thompson of McCormick Rankin were in attendance in support of the Transportation Network and Corridor Study. Mr. Boutilier commented that the origin of the study goes back to 1989 relating to examination of Homer Watson Boulevard. Subsequently staff were requested to look at road patterns in the adjacent area and McCormick Rankin was retained to prepare a report. Mr. Boutilier named the members of the study team and provided an overview of the traffic situation and level of urbanization. He pointed out that City of Cambridge with a population of 95,000 had five interchanges accessing Highway 401 whereas Kitchener-Waterloo with a population of 256,000 had only two connections to Highway 401 to serve this population base plus a developing population in the hinterlands to the north and west of the cities. He indicated that the area bounded by Highway 8, Highway 401, Trussler Road and the Conestoga Expressway comprised the study area and noted that included within this boundary was a substantial portion of the Township of North Dumfries. Mr. Boutilier commented that serious traffic capacity problems were being experienced on Homer Watson Boulevard and Fairway Road and particularly at the intersection of Manitou Drive and Homer Watson Boulevard. He tabled figures of forecast population and employment growth in the next 25 years that will effect the southwest section of the City and noted that to accommodate growthm the following improvements have been proposed: Strasburg Road be four lanes to the New Dundee Road, Fischer Hallman Road be extended to Westmount Road, Block Line Road be extended easterly, River Road be extended and connected to Highway #8, Bleams Road be extended to an interchange with Highway #8. He pointed out that if these works were not undertaken many roads would be in a traffic gridlock situation. Mr. Bob Blay, McCormick Rankin, pointed out that in addition to the Corridor Study report that was distributed earlier, there was a Technical Appendices Report as well. He commented that the study process was based on an Environmental Assessment road process for municipal road projects. This process resulted in completion of two phases of a five phase process with phase 1 being, identification of the problem and phase 2 being identifying alternative solutions to the problem and selecting a preferred solution. Phases 3, 4 and 5 would subsequently follow after acceptance of phases 1 and 2. He itemized factors considered in the process and pointed out that in addition to the project team there was an external team composed of representatives from the City of Cambridge, Township of North Dumfries and two Provincial Ministries. Mr. Blay noted that many environmentally sensitive areas were considered within the report as they relate to network alternatives under consideration. He pointed out that after review of constraint criteria and analysis of impacts of each alternative, revised modified alternative B was chosen as the preferred alternative and he listed the positive features of it. Councillor T. Galloway commented that City Council had approved a recommendation of the Environmental Committee pertaining to how Scenic Roads should be weighted in the evaluation process. He stated that he objected to the factoring rates that were developed and suggested that the intent of the resolution was not taken into account in the study. Mr. T. Boutilier explained that the study team attempted to look at all concerns and had recommended a strategy with a view to attempting to remove future traffic from Homer Watson Boulevard. He suggested that there were four other alternatives the Committee could consider, being: - Abandon the proposed strategy. - Ultimately allow Homer Watson Boulevard to become six lanes. - Abandon the study and petition the Ministry of Transportation to develop an additional interchange west of Homer Watson Boulevard which the study team does not support. - Abandon and prepare alternative approaches for restriction of urban development on the basis that future traffic levels could not be accommodated. Councillor J. Ziegler commented that Highway 401 appears to be the problem and questioned why Highway 401 was the basis of focus. Mr. Boutilier responded that Highway 401 is the Transportation Corridor having travel demand. Further questions and clarifications were then discussed involving Highway 7 easterly to Guelph and the widening of Highway 8. The Committee then heard the submissions of numerous delegations on this matter. PLANNING & ECONOMIC DEVELOPMENT COMMITTEE MINUTES MARCH 21, 1994 -51 - CITY OF KITCHENER Mr. Fred Hasen appeared as a delegation and presented a submission which had been distributed to City Council respecting the Caryndale area and Chalon Estates Inc. His submission referred to the original formation of Caryndale and commitments given by previous Councils to support its unique purpose and distinctiveness. Mr. Hasen stated that it would appear the traffic corridor study ignored a large volume of traffic that finds its way to Highway 401 by going westerly to access the Highway 97/401 interchange. He suggested that the question should be addressed as to whether another access well to the west of what has been proposed in the study should be considered. Mr. Paul Hill appeared as a delegation and advised that Caryndale residents were in support of most of the recommendations but objected to the southern routing of a new west-south arterial road and he gave three reasons for the objection. He pointed out that a compromise solution had been developed in 1993 that would see the arterial road shifted to the south but it was his view that this alternative was dismissed by the study authors. He referred to network alternative D in relation to numeric ratings procedure and stated that after analysis he could demonstrate that the size of the ratings utilized could be reversed if their plan replaced alternative D. He requested that their compromise solution be evaluated before any decision is made as it was his belief their plan would have the highest rating. Mr. Jim Kearns appeared as a delegation in place of Mr. Peter Kruse on behalf of clients having a concern with regard to the intersection of Strasburg Road and Reidel Drive. He commented that if the alignment of Strasburg Road was in question, that it either be aligned more easterly or left where it presently is. Mr. R. Hardie, Richard Hardie & Associates Inc., 268 Huron Road, appeared as a delegation on behalf of Gerald Becker to advise that his client was opposed to the western portion of the east-west arterial alignment. In this regard, he provided a submission dated March 20, 1994 in which the area in question was circled on a copy of Exhibit D of the McCormick Rankin study. His submission lists six concerns with the McCormick Rankin alignment. Mr. Hardie advised that his client's lands were east of Westmount Road and south of Huron Road and that Plains Road passes through the property. Accordingly, he requested that item 2.1 of Report PD 94/15 be revised by deleting reference to the specific alignment shown on Exhibit 24 and that item 2.4 be undertaken in 1995 using development charge funds. Ms. Wendy Diamond appeared as a delegation and objected to the proposed corridor that would pass through her farm property. Ms. Grace Stoner appeared as a delegation on behalf of Mr. V. Tarbutt who had intended to appear on behalf of the Local Architectural Conservation Advisory Committee to present the Committee's objection to the recommended network alternative as it affects Scenic Roads and to generally represent the views of LACAC on the Study. Ms. Stoner then read a submission dated March 21, 1994 prepared by Mr. Tarbutt who had participated as a member of the Network and Corridor Study Team. It was Mr. Tarbutt's opinion that while heritage issues were given reasonable focus, the transportation issues were ultimately given a much higher priority resulting in the west to south arterial road crossing Tilt Drive which is a designated Scenic Road and in close proximity to Stauffer Drive. Other points in the submission focus on the recommended alternative and the related process and requests further evaluation of alternatives. Mr. Ken Tait, 7 Bannockburn Road, advised that he was a resident of Caryndale and his greatest concern was with a large arterial road that would bisect Caryndale. He stated that the impact of such a road system passing through Caryndale has not been taken into consideration. He also questioned the rationale having such a thoroughfare empty onto Homer Watson Boulevard and stated that the route is unacceptable and a third interchange with Highway 401 is warrented. Mr. John Marincic, 368 Biehn Drive, advised that he lives in a Brigadoon Subdivision and had concern over the extension of Biehn Drive, the damaging effect it would have on a tributary to Strasburg Creek and to the Strasburg Creek Watershed itself. He stated that he understood an environmental impact statement has to be completed but that such a study does not address the effects that a roadway would have on the lands. Accordingly, he requested that an Environmental Assessment be required as only it can answer the question of what effect the roadway would have on the environment. Ms. August Cloet, 348 Biehn Drive, advised that she had lived in her present home for 2 1/2 years and PLANNING & ECONOMIC DEVELOPMENT COMMITTEE MINUTES MARCH 21, 1994 - 52 - CITY OF KITCHENER that she wished to submit a petition containing approximately 42 names. She stated that the petition was a measure of the neighbourhood's desire to find a better alternative route than what has been recommended. The petition submission requests that an additional study be done as an amendment to the Doon South Transportation Network and Corridor Study with the study purpose being to investigate and evaluate alternatives to extending Biehn Drive through class 1 wetland. Finally, she commented on the substantial value of the wetlands and that it was unknown what mode of transportation would be utilized in 25 years and we should do everything possible to promote preservation of the natural environment. Mr. Bob Black appeared as a delegation representing Hearthwood which owns land in Brigadoon, west of Caryndale Drive. He pointed out that the extension of Biehn Drive will cross his client's land and was necessary for servicing purposes. In regard to the request that an Environmental Assessment should be required rather than an Environmental Impact Study, he advised that development work on his client's land had commenced in 1987 but it had been necessary to wait for other studies to be completed and it appears concerns have been satisfied. Councillor T. Galloway commented that if the same proposal was made today it would not be allowed. Mr. Black pointed out that the development process had been ongoing for a considerable long period of time and that when Council adopted the study, it should have included the requirement for Environmental Assessment in the direction if that is what Council desired. Councillor Galloway suggested that there must be a cheaper transportation solution than crossing environmentally sensitive areas. However, Mr. Black stated that it was necessary for the extension to take place from a servicing and transportation perspective. Councillor Galloway pointed out that if an Environmental Assessment was required, it would require a study of alternative transportation routes. Mr. Erwin Brueckman, 80 Chapel Hill Drive, appeared as a delegation regarding the Transportation Study and stated that he was disappointed the consultants did not seek to consult with the land owners and indicated that in 1989 he was lead to believe the consultants would do so. Mr. Brueckman questioned why these lands should be crossed with an arterial when the Westmount Road/New Dundee alternative was available to reach Highway 401 at a new entrance. Mr. Bob Blay advised that the consultants analyzed this suggestion but did not consider it one of the solutions. In response to a potential motion of Councillor J. Ziegler, Mr. B. Stanley advised that if a further alternative was to be considered it could result in an approximate $15,000.00 over expenditure involving consultant fees and modelling requirements. Mr. T. Boutilier commented on the process to determine alternatives that were available and pointed out that the study team had to make a decision as to how many alternatives they could model and had applied the funding for the study as efficiently as possible toward the alternatives that were considered. Councillor C. Zehr commented that it would appear that sensitivity to Caryndale was in fact a major issue since day one that should have been considered. Councillor J. Ziegler stated that with all the information from the McCormick Rankin Study, staff should be able to evaluate the modified D alternative keeping in mind that Council was not in favor of bisecting Caryndale. Councillor T. Galloway stated that the alternative proposed by Mr. Paul Hill could be one several that might work to avoid the bisecting of Caryndale, Scenic Roads and environmentally significant areas. Mr. Mark Tutton, Monarch Construction, 2025 Sheppard Avenue East, Willowdale, appeared as a delegation and advised that he was opposed to a change to Policy 5, Page 2-58 to require an Environmental Assessment rather than an Environmental Impact Study. He stated that a high degree of study has already gone into this matter and that the only other alternative was to utilize Doon Village Road or Tilt Drive. Ms. Pat Nippel, appeared as a delegation and commented that she would accept the notion provided Spud and Doon Pioneer Park Association are considered and consulted in the process. As to the study, she stated that the process was not complete until other options were modeled. Mr. Paul Britton, appeared as a delegation to comment on three issues. Firstly, with regard to the Arterial Road, he stated that his only concern would be how direction to staff might predetermine the result, being the alternative route to be chosen was a city wide issue. He stated that he has no predisposed option in terms of his client Hallman Aberdeen. Secondly, in reference to Biehn Drive crossing of the wetland he understood that through the Municipal Plan the question of crossing has actually been dealt with and noted that the only other option was the direct crossing of Caryndale PLANNING & ECONOMIC DEVELOPMENT COMMITTEE MINUTES MARCH 21, 1994 - 53 - CITY OF KITCHENER Drive which has previously been unacceptable. Finally, in regard to Policy 5 on Page 2-58 where it has been suggested that Environmental Assessment replace the requirement for Environmental Impact Statement, he stated that there will always be situations where it is necessary to act based on decisions that have taken place earlier where there are no other options. Mrs. Pat Wagner appeared as a delegation on behalf of the Local Architectural Conservation Advisory Committee to express the Committee's concern with regards to the Corridor Study. She stated that on Page 5 it was pointed out that the West to South corridor may require relocation of one heritage structure and such a move was unacceptable to LACAC which on February 4th formally objected to the route alternative. She stated that this heritage structure must be taken seriously and pointed out the effort that has been made over the years to preserve it which resulted in agreement with Monarch that this 1815 (Stauffer) log house will be preserved when the subdivision goes forward. Mr. Wagner was of the view that if the structure was moved from its original location it would loose it significance in a new location. Heritage groups are unanimous that it be preserved and she presented letters from the Mennonite Historical Society and the Ontario Architectural Conservancy supporting LACAC's objection. Finally, she asked that the Committee reject the West-South traffic corridor alternative. Mrs. Jean Haalboom, 1165 Doon Village Road, appeared as a delegation representing Spud and members of the Heritage Conservation District. She commented that if the Committee was to support the road proposal, they would also be destroying Tilt Drive and one of the goals of the Heritage Conservation District was to eliminate traffic. Further, she commented that it had been neglected to show continuation of the Heritage District along Tilt Drive. She then spoke of the social, recreational environmental needs of the Community and pointed out that the Community wishes a diversion of traffic not minimization of traffic. Accordingly, she asked that the Committee develop an alternative that would result in a straight road that would facilitate traffic movement. Also, Mrs. Haalboom questioned why planning was taking place without pushing for an appropriate interchange with Highway 401. She then listed recommendations in the State of the Environment Report and pointed out that Westmount Road could function as the straight road that would move large volumes of traffic. No other delegations responded to the Chairman's invitation to address the Committee on this matter. On motion by Councillor J. Ziegler, it was resolved: "That in reference to the Doon South - Brigadoon Transportation Network and Corridor Study, Kitchener Planning Staff be instructed to evaluate the alternative "modified D" plan submitted by the Caryndale Community. It is the objective of this Committee that the Caryndale Community Holdings and the Scenic Roads not be bisected by a West-South Arterial Road, and if the "modified D" is not acceptable with or without further modifications, then another alternative be developed which has minimal impact on the existing Scenic Roads and which does not bisect Caryndale and/or environmentally significant areas." Mr. B. Stanley estimated it would take at least three months to respond to the request and would require input from the consultants in any event. As a result, he stated that the question of further development west of Westmount Road could not be dealt with and recommended it be deferred. Councillor B. Stortz stated that he had no objection to allocating funding necessary to carry out this further review. Councillor C. Zehr suggested deferral until June 20th. Councillor G.L. Leadston advised that some years ago discussion took place with regard to developing an access from the industrial basin and requested that staff examine this past suggestion as part of their consideration. On motion by Councillor C. Zehr, it was resolved: "That consideration of Staff Report PD 94/15 (Staff Recommendations related to the Doon South - Brigadoon Transportation Network and Corridor Study and Official Plan Amendment Application 94/2) be deferred and referred to the meeting of the Planning and Economic Development Committee to be held on June 20, 1994." Lorentz, it was resolved: "That consideration of Staff Report PD 69~93 (Update of Kitchener West Side Study Part 1 Report: Existing Conditions and Land Needs and Staff Recommendations Concerning Official Plan Amendments for Areas Located Beyond the Existing Urban Settlement Boundary) and the following Official Plan Amendments: - OPA Application 94/1 - West Side Study. - OPA Application 91/6 - Hesch Farm. - OPA Application 90/6 - Cybau Holdings Inc. be deferred and referred to the meeting of the Planning and Economic Development Committee to be held on June 20, 1994." 5.MUNICIPAL PLAN - POLICY 5, PAGE 2-58 Councillor T. Galloway proposed a motion to amend Policy 5, Page 2-58 of the Municipal Plan so as to require an Environmental Assessment in place of Environmental Impact Study. Mr. B. Stanley proceeded to explain the difference between Environmental Impact Study and Environmental Assessment. He noted that under ElS the study looks at alternatives but restrict alternatives under consideration to alternative forms of achieving the undertaking in question. Under Environmental Assessment he pointed out that the study looks at alternatives to the proposed undertaking and the number of other alternatives relative to the problem which result in a complete review and much more extensive and costly consideration. With an Environmental Assessment it would mean that the Community Plans were being completely reviewed and subdivisions can not commence until the Environmental Assessment process was complete. Councillor T. Galloway stated that there were strong statements in the Municipal Plan and the City's Strategic Plan for the Environment relating to the City's environmental commitment. He commented that there must be assurances that alternatives will be investigated and pointed out that there are four or five other wetland situations in the Municipal Plan that should be investigated. Councillor T. Galloway's motion to amend Policy 5 was then put on a vote and lost. 6.WEST SIDE STUDY RE SELECT SAND AND GRAVEL Councillor J. Ziegler advised that he had spoken with Mr. Mark Nowak concerning the Select Sand and Gravel operation on Bleams Road. He commented that the West Side Study purports another change that will again affect Select Sand and Gravel and requested that staff discuss this issue with Mr. Nowak before the Committee's June 20th meeting. 7.ADJOURNMENT On motion, the meeting adjourned at 8:10 p.m. L.W.
