HomeMy WebLinkAboutCouncil Minutes - 2019-12-02 SSPECIAL COUNCIL MINUTES DECEMBER 2, 2019 CITY OF KITCHENER A special meeting of City Council was held at 12:14 p.m. this date, chaired by Mayor B. Vrbanovic with all members present. Notice of this meeting had been previously given to all members of Council by the City Clerk pursuant to Chapter 25 (Council Procedure) of the Municipal Code. IN -CAMERA MEETING Mayor B. Vrbanovic advised of an in -camera was being called this date regarding a matter about an identifiable individual. He advised that a motion to waive notice was required to be approved by 2/3 of the whole of Council. Moved by Councillor B. loannidis Seconded by Councillor M. Johnston "That in accordance with Section 25.7.14 of City of Kitchener Municipal Code Chapter 25 (Procedure) the notice requirements be waived to add a matter related to a personal matter (identifiable Individual) to be considered at the in -camera meeting being held this date." Carried, with required 2/3 of the Council members present. IN -CAMERA MEETING AUTHORIZATION Moved by Councillor S. Marsh Seconded by Councillor D. Schnider "That an in -camera meeting of City Council be held immediately following this special meeting to consider a personal matter (identifiable Individual)." Carried. The meeting then recessed at 12:15 p.m. and reconvened at 2:48 p.m., chaired by Mayor B. Vrbanovic with all members present. COR -19-048 - LICENSING TRIBUNAL RECOMMENDATION Council considered Corporate Services Department report COR -19-048 (D. Saunderson), dated November 21, 2019, recommending the adoption of the Licensing Tribunal decision. Moved by Councillor K. Galloway-Sealock Seconded by Councillor S. Marsh "That the decision of the Licensing Tribunal, attached to Corporate Services Department report COR -19-048, on the matter of a lodging house licence (Chapter 553 - City of Kitchener Municipal Code) issued to Mr. S. Mohamed for the operation of a Lodging House, at the property municipally addressed as 374 Louisa Street, Kitchener, Ontario, be adopted." Carried. Council considered Financial Services Department report FIN -19-088 (R. Hagey), dated November 26, 2019, recommending approval of the 2020 Water Utilities Rates. Ms. D. McGoldrick, General Manager, Infrastructure Services Department and Messrs. D. Chapman, Chief Administrative Officer. J. Lautenbach, Chief Financial Officer and R. Hagey, Director, Financial Planning were in attendance to respond to questions from the Committee. Councillor J. Gazzola brought forward a motion to defer the recommendation as outlined in Report FIN - 19 -088, which was seconded by Councillor P. Singh to Final Budget Day January 20, 2020. SPECIAL COUNCIL MINUTES DECEMBER 2, 2019 -188- CITY OF KITCHENER In response to questions, Mr. Lautenbach advised the proposed effective date for the rate change was communicated through the 2018 budget and staff have prepared a budget based on implementing the rates for January 1, 2020. Councillor Gazzola's deferral motion was then voted on and LOST, on a recorded vote with Councillors J. Gazzola, M. Johnston, D. Chapman and S. March voting in favour; and, Mayor B. Vrbanovic and Councillors P. Singh, B. loannidis, D. Schnider, K. Galloway-Sealock, C. Michaud and S. Davey voting in opposition. Councillor Singh requested the stormwater rates be voted on separately. Moved by Councillor S. Davey Seconded by Councillor B. loannidis "That the proposed rates contained in the 2020 Water Utilities Rates schedule attached to Financial Services Department report FIN -19-088 be approved." Singh declared a pecuniary interest with respect to Capital Projects 901002007 `5163 - Ottawa Street - Charles to Expressway'; 701205129 `Stirling/Mausser' and, 901004056 `Dixon/Rockway' as members of his family own property in the vicinity of the subject projects. Accordingly, he did not participate in any discussion or voting regarding those matters. Moved by Councillor S. Davey Seconded by Councillor D. Schnider "That staff be directed to report and/or take appropriate action on the following matters arising from the January 20, 2020 Special Finance and Corporate Services Committee meeting relative to the 2020 Capital Budget, as outlined in the chart below: SPECIAL COUNCIL MINUTES DECEMBER 2, 2019 -189- CITY OF KITCHENER Division/Area Topic Action Prepare issue paper outlining: a. an alternate funding model for hybrid fleet conversions. Explore funding by operating savings as opposed to upfront capital DEVELOPMENT Sustainability contribution. SERVICES Office b. additional projects that could be completed if funding above Option C noted in Issue Paper Cap 04 was approved. c. additional projects that could be completed if this project received $300,000. per year from 2021-2023 Prepare issue paper regarding the Gas Utility funding private property tree planting program INFRASTRUCTURE Gas Delivery through Reep. Prepare issue paper to increase the 2020 Gas SERVICES Delivery dividend by $167,000. Prepare issue paper providing options to reduce the GENERAL Tax Levy operating net tax levy by not fully utilizing $3.5M allocated for Capital Strategic Initiatives Capital Budget Resolutions - Carried. Michaud "That leave be given the Mover and Seconder to introduce the following by-law for three readings and that the same be taken as read a first, second and third times, and finally be passed and numbered serially by the Clerk." a.
