Weylie, Chair, with the following members present: Councillors Jake Smola, J. Ziegler, K. Taylor-Harrison, G. Lorentz, B. Vrbanovic, T. Galloway, J. Haalboom and John Smola. Mayor C. Zehr entered the meeting after its commencement. Officials present: Ms. C. Ladd, J. Jantzi, A. Tanner and Messrs. J. Gazzola, T. McCabe, B. Stanley, J. Shivas, D. Mansell, B. Page, J. Witmer, J. Willmer and L. W. Neil. 1.BPS 99/31- HURON BUSINESS PARK, PHASE 11 - OFFER TO PURCHASE SITE 109 - LEENAN DEVELOPMENTS INC. – SOUTH WARD The Committee was in receipt of Business and Planning Services Staff Report BPS 99/31 dated February 15, 1999 concerning an offer to purchase from Leenan Developments Inc. relating to Site 109 in the Huron Business Park. At the request of Ms. J. Jantzi, the Committee consented to withdrawal of this matter from the agenda. 2.BPS 99/33 - HURON BUSINESS PARK PHASE 11 - OFFER TO PURCHASE - SITES 82C AND 82E - ELOCAB SONDERKABEL GMBH CO. KG. – SOUTH WARD The Committee was in receipt of Business and Planning Services Staff Report BPS 99/33 undated. The report deals with offers to purchase respecting sites 82C and 82E in Phase 11 of the Huron Business Park on McBrine Drive. On motion by Councillor J. Ziegler – It was resolved: That the City accept the Offer to Purchase dated February 17, 1999 from elocab “ Sonderkabel GmbH Co. KG, for Lots 82C and 82E in Phase ll of the Huron Business Park better known as Parts 1 and 3 on Reference Plan 58R-6949 and having an area of about 3 acres on McBrine Drive for the total purchase price of $240,000 based upon $80,000/acre; and further, That the Mayor and Clerk are hereby authorized to execute any other necessary documentation required by the City Solicitor.” 3.BPS 99/28 - 34 FOURTH AVENUE -DEMOLITION CONTROL APPLICATION DC 98/14/F/ZJ -LURKAN HOMES INC. – FAIRVIEW WARD The Committee was in receipt of Business and Planning Services Staff Report BPS 99/28 dated February 11, 1999. The report deals with a demolition control application submitted by Lurkan Homes Inc. with respect to the property known municipally as 34 Fourth Avenue. It was pointed out in the report that the applicant wishes to demolish the one-story vacant dwelling and garage due to the deteriorated condition of each and due to such significant deterioration the building inspector has recommended demolition. It was noted in the report that the property designation and zoning will accommodate proposed construction of two single detached dwellings on the lot after demolition and that the owner has received approval from the Committee of Adjustment for severance of the lands to create two lots to accommodate two single dwellings. Ms. C. Ladd briefly summarized the purpose of the staff report. No delegations were registered respecting this matter. PLANNING & ECONOMIC DEVELOPMENT COMMITTEE MINUTES FEBRUARY 22, 1999-22 -CITY OF KITCHENER 3.BPS 99/28 - 34 FOURTH AVENUE -DEMOLITION CONTROL APPLICATION DC 98/14/F/ZJ -LURKAN HOMES INC. – FAIRVIEW WARD (CONT’D) Councillor J. Haalboom expressed concern relative to the issue of monster homes being developed on smaller lots and Ms. C. Ladd advised that this matter would be addressed in the draft Urban Design Guidelines. On motion by Councillor J. Ziegler - It was resolved: That Demolition Control Application DC 98/14/F/ZJ (Lurkan Homes Inc.) requesting “ approval of the demolition of the vacant building and detached garage at 34 Fourth Avenue, legally described as Lot 80, Registered Plan 254, be approved. It is the opinion of this Committee that approval of this application is proper planning for the City.” 4.PRESENTATION - IMPROVEMENTS TO SITE PLAN APPROVAL PROCESS -(I) VERBAL OUTLINE OF SITE PLAN CONTROL PROCEDURES BPS 99/34-(II) REVISED POLICY - LETTERS OF CREDIT FOR SITE PLAN APPLICATIONS The Committee was in receipt of Business and Planning Services Staff Report BPS 99/34 dated February 17, 1999. The report deals with a proposed revised policy respecting letters of credit for site plan approvals. Ms. C. Ladd introduced the matter by informing the Committee that Mr. J. Willmer would first be giving a presentation utlizing the overhead screen that would outline and analyse the existing site plan control procedures and following that presentation, request consideration of revised policy pertaining to letters of credit for site plan approvals. Before beginning his presentation, Mr. J. Willmer distributed a revision to the recommendation outlined in the staff report. He indicated that the wording shown in bold in the revised recommendation represented the requested revisions. An overhead presentation on the site planning control process was then made as it related to the following stages of the process: •Pre-application •Application review and approval •Building permit clearance •Inspections and letter of credit release •Agreement release In the case of the first four stages of the process, analysis was presented that provided details relative to the current situation, the resulting problems and proposed solutions. Mayor C. Zehr entered the meeting during the presentation. Councillor T. Galloway inquired what the incidence of failure to comply with site plan conditions was and Mr. Willmer replied that it would be rare. Councillor Galloway then alluded to typical site plan problems that involve light migration off commercial properties after development was complete and noise issues relating to activity on the site. Mr. Willmer commented that with a letter of credit in place, occupancy could be permitted and that the one-year term was a city established time limit but it was necessary to wait until one year after occupancy to act on any uncompleted work covered by the letter of credit. Mr. C. Ladd advised that the staff recommendation should also be revised to provide for the PLANNING & ECONOMIC DEVELOPMENT COMMITTEE MINUTES FEBRUARY 22, 1999-23 -CITY OF KITCHENER establishment of a new fee for re-inspection of outstanding site works related to requests for final release of letters of credit. In this regard she suggested that the new fee be set at $100.00 per inspection. 4.PRESENTATION - IMPROVEMENTS TO SITE PLAN APPROVAL PROCESS -(I) VERBAL OUTLINE OF SITE PLAN CONTROL PROCEDURES BPS 99/34-(II) REVISED POLICY - LETTERS OF CREDIT FOR SITE PLAN APPLICATIONS (CONT’D) The recommendation in the staff report and the revisions to the recommendation as tabled by staff this date were then considered. On motion by Councillor by Councillor T. Galloway - It was resolved: A. That Council Policy I-670 dated July 18, 1988 and revised December 19, “ 1988, be deleted and replaced with the following: POLICY CONTENT 1.That for development proposals approved under Section 41 of the Planning Act the City may require the owner to provide performance securities prior to the issuance of any building permits, in a form and amount satisfactory to the City Solicitor and the Director of Planning. The performance securities shall be held as security for the completion of required site development works. 2.If a cost estimate is completed to the satisfaction of the Director of Planning the following shall apply: 2.1 The amount of the performance security shall be 50% of the total cost of all site development works; 2.2After satisfactory completion of 50% of the value of site development works, the amount of security held by the City shall be reduced, as set out in the site plan agreement, by amounts in accordance with the cost estimate, for additional works completed; 3.If no cost estimate is completed to the satisfaction of the Director of Planning the following shall apply: 3.1For new development, the amount of the performance security shall be based on the following, which may or may not represent 50% of the total cost of all site development works, but in no case shall the amount be less than $50,000.00: Residential:$60,000 per hectare + 600 per metre frontage Industrial:$20,000 per hectare + 150 per metre frontage Institutional:$25,000 per hectare + 500 per metre frontage Commercial:$60,000 per hectare + 500 per metre frontage 3.2For additions, alterations or additional buildings on developed sites, the amount of the performance security shall be based on the following, which may or may not represent 50% of the total cost of all site development works, but in no case shall the amount be less than $25,000.00: Residential:$30,000 per hectare + 300 per metre frontage Industrial:$10,000 per hectare + 75 per metre frontage PLANNING & ECONOMIC DEVELOPMENT COMMITTEE MINUTES FEBRUARY 22, 1999-24 -CITY OF KITCHENER Institutional:$12,500 per hectare +250 per metre frontage Commercial:$30,000 per hectare+250 per metre frontage 3.3After satisfactory completion of all site development works, the total amount of security held by the City shall be released. Subsequent to the provision of performance securities under Policy 3, a cost 4.PRESENTATION - IMPROVEMENTS TO SITE PLAN APPROVAL PROCESS -(I) VERBAL OUTLINE OF SITE PLAN CONTROL PROCEDURES BPS 99/34 - (II) REVISED POLICY - LETTERS OF CREDIT FOR SITE PLAN APPLICATIONS (CONT’D) estimate may be provided and security reductions granted under Policy 2. 5.Council Policy I-670.1 shall not apply to the City or any local board thereof, the Regional Municipality of Waterloo or any local board thereof, the Hydro-Electric Commission of Kitchener-Wilmot, the Waterloo Region District School Board, the Waterloo District Catholic School Board, or the Federal or Provincial Government or any crown agency thereof. Development approvals for such agencies may be subject to the following requirement: 5.1That in the event the facilities or improvements required by the Agreement are not completed prior to occupancy, as specified by this agreement, due to adverse weather conditions or other extenuating circumstance, occupancy will be approved, provided that a Letter of Undertaking and Indemnity is given by the Owner to the City's Director of Planning agreeing to complete the outstanding site work within a specified time. B.That a new fee of $100.00 per inspection be established for re-inspection of outstanding site works related to requests for final release of Letters of Credit. BOUNDARY REPORT th Councillor J. Haalboom advised that at the January 18 Council meeting she had requested a report pertaining to boundary issues. Mr. B. Stanley advised that staff were working on it and nd expected to bring the report to the Committee’s March 22 meeting.
