Weylie, Chair with the following members present: Councillors M. Yantzi, J. Ziegler, B. Vrbanovic, T. Galloway, J. Haalboom and John Smola. Mayor C. Zehr and Councillors K. Taylor- Harrison and G. Lorentz entered that meeting after its commencement. Officials Present: Ms. C. Ladd and L. MacDonald and Messrs. B. Stanley, G. Borovilos, R. Morgan, P. Wetherup, D. Mansell, J. Witmer and L.W. Neil. 1. BPS-00-119 - WASHBURN DRIVE, HURON BUSINESS PARK, PHASE 3 - OFFER TO PURCHASE- SITE 151 - FIRST RESPONSE RESTORATION INC. - SOUTH WARD The Committee considered Business and Planning Services staff report BPS-00-119 dated September 5, 2000 dealing with an Offer to Purchase site 151 on Washburn Drive in the Huron Business Park received from First Response Restoration Inc. It was noted in the report that the Offer was conditional for 30 days in respect to several issues and that it was scheduled to close on November 3, 2000. Mr. R. Morgan briefly summarized the offer. No delegations were registered respecting this matter. On motion by Councillor J. Ziegler - It was resolved: "That the City accept the Offer to Purchase from First Response Restorations Inc. for Part 3, Reference Plan 58R-9683, (Site 151) on Washburn Drive, Huron Business Park. The site has an approximate area of 1.06 acres (.43 hectares) and the offering price is $75,000. per acre for a total purchase price of $79,500.; and further, That the Mayor and Clerk be authorized to execute any other necessary documentation required by the City Solicitor." BPS-00-122 EXTENSION OF CLOSING DATE -OFFER TO SELL HURON WOODS DEVELOPMENT CORPORATION Mr. G. Borovilos distributed Business and Planning Services staff report BPS-00-122 dated September 8, 2000. It was pointed out in the report that on March 20, 2000 the City agreed to purchase 18.34 acres of land from Huron Woods Development Corporation and in return Huron Woods was to complete grading and servicing the site prior to the closing of the offer. Since the servicing of these lands is not yet complete, Huron Woods has requested an extension until November 30, 2000. No delegations were present respecting with matter. On motion by Councillor B. Vrbanovic - It was resolved: "That the City of Kitchener grant an extension to the closing date, from September 8, 2000 to November 30, 2000 respecting Huron Woods Development Corporation's Offer to Sell the City of Kitchener 18.43 acres of land (Strasburg Road)." Councillors G. Lorentz and K. Taylor-Harrison entered the meeting at this point. PLANNING & ECONOMIC DEVELOPMENT COMMITTEE MINUTES SEPTEMBER 11, 2000 - 143 - CITY OF KITCHENER 3. BPS-00-099 744-746 QUEEN STREET SOUTH -MUNICIPAL PLAN AMENDMENT APPLICATION MP 00/03/Q/TMW -ZONE CHANGE APPLICATION ZC 00/07/Q/TMW -JAFAR KONOODI ROCKWAY-VICTORIA WARD The Committee was advised that the Department of Business and Planning Services was in receipt of applications for Municipal Plan Amendment and Zone Change from Jafar Konoodi with respect to lands known municipally as 744-746 Queen Street South. The subject property is located on the southwest corner of Queen Street South and Brock Street and contains a two stow brick building bounded by multiple residential use to the south, single family residential uses to the north and west, and the Harry Class Community Pool, Woodside Park, and single family residential uses across the street to the east. It was pointed out in report that the purpose of the municipal plan amendment is to designate the lands from Low Rise Multiple Residential to Low Rise Multiple Residential with Special Policy 15. Further, the purpose of the zone change is to change the zoning from Residential Six Zone (R-6) to Residential Six Zone (R-6) with Special Use Provision 278U and with Special Regulation Provision 325R. These amendments will have the effect of adding a personal service use as a permitted use of the existing building, as well as providing for special regulations for on site parking. In this regard the Committee considered the staff report BPS-00-099 dated August 4, 2000 and a proposed By-law dated August 4, 200 attached to the report. Also attached to the report was the proposed Amendment to the Municipal Plan. Councillor C. Weylie, Chair, read the following statement: "This is a Public Meeting under 'The Planning Act, 1996' to consider Municipal Plan Amendment Application O0/03/Q/TMW. Section 17 (45) of the Planning Act allows the Ontario Municipal Board to dismiss all or part of an appeal without holding a hearing if the appellant did not make oral submissions at a public meeting or did not make written submissions to the council before the plan was adopted and, in the opinion of the Board, the appellant does not provide a reasonable explanation for having failed to make a submission. In order to ensure the record includes all the names of those individuals who are making verbal submissions today for this Municipal Plan Amendment, please ensure that you clearly identify yourself before you begin your submissions and the Clerk will record your name for the record. If your name does not appear on the record, you may jeopardize any further involvement you wish to have in these matters. Any recommendation made by Planning Committee on these matters today will be considered by City Council on September 18, 2000. If City Council adopts the amendments, they will proceed to the Regional Municipality of Waterloo who has the final approval authority for Municipal Plan Amendments. They are also the body to whom appeals are sent. Further information on these procedures is available from the City's Department of Business and Planning Services or the Region's Department of Planning and Culture." Ms. C. Ladd provided a detailed explanation of the purpose of the applications and advised that staff had nothing further to add. Mr. Jafar Konoodi appeared as the delegation and indicated that he was in support of the recommendations in the staff report. No other delegations were registered respecting this matter. On motion by Councillor M. Yantzi - It was resolved: PLANNING & ECONOMIC DEVELOPMENT COMMITTEE MINUTES SEPTEMBER 11, 2000 - 144 - CITY OF KITCHENER 3. BPS-00-099 744-746 QUEEN STREET SOUTH -MUNICIPAL PLAN AMENDMENT APPLICATION MP 00/03/Q/TMW -ZONE CHANGE APPLICATION ZC 00/07/Q/TMW -JAFAR KONOODI ROCKWAY-VICTORIA WARD (CONT'D) "1) That Council approve Municipal Plan Amendment Application MP 00/03/Q/TMW (744- 746 Queen Street South - Jafar Konoodi), being an amendment to the Victoria Park Neighbourhood Secondary Plan by: a) Amending Map 14, by adding Special Policy 15 to the lands municipally known as 744-746 Queen Street South. b) Amending Section 13.5.4 by adding Special Policy 15 as follows: 15. Notwithstanding the Low Rise Multiple Residential designation, which applies to the lands at 744-746 Queen Street South, a personal service use shall also be permitted within the existing building. It is the opinion of this Committee that approval of this Amendment is proper planning for the City. 2) That Zone Change Application ZC 00/07/Q/TMW (744-746 Queen Street South - Jafar Konoodi) requesting a change in zoning from Residential Six Zone (R-6) to Residential Six Zone (R-6) with Special Use Provision 278U and with Special Regulation Provision 325R, on lands legally described as Lot 14, Registered Plan 158, be approved in the form shown in the attached "Proposed By-law", dated August 4, 2000, subject to the following conditions. That all tax and utility accounts related to the subject property be paid in full prior to Council giving three readings of the zone change by-law. The owner acknowledges that Condition 1 is to be satisfied no later than seven months after Council having approved by resolution Zone Change ZC 00/07/Q/TMW. In the event this resolution is not fulfilled within the seven- month period, Council shall consider rescinding the zone change approval. It is the opinion of this Committee that approval of this application is proper planning for the City and is in conformity with a recommended Amendment (744-746 Queen Street South - Jafar Konoodi) to the City's Municipal Plan." Mayor C. Zehr entered the meeting at this time. BPS-00-091 350 WESTMOUNT ROAD WEST ZONE CHANGE APPLICATION ZC 97/5/W/PB SUNOCO INC. WEST WARD The Committee was advised that the Department of Business and Planning Services was in receipt of an application from Sunoco Inc. to change the zoning of lands known municipally as 350 Westmount Road West. The application would re-zone the subject lands from Service Station Zone (C-7) with Special Regulation Provision 75R to Convenience Commercial Zone (C-1) with Special Use Provision 286U, and Special Regulation Provision 339R which would permit the development of a free standing restaurant and prohibit the development of a dwelling unit on this site. It was noted in the report that the subject property was comprised of approximately 0.68 hectares (1.68 acres) in size and located at the north-east corner of Westmount Road West and Victoria Street South with a portion of the subject land already developed with a gas station. In this regard, the Committee considered staff report BPS-00-091 dated August 22, 2000 and a proposed By-law dated August 10, 2000 attached to the report. PLANNING & ECONOMIC DEVELOPMENT COMMITTEE MINUTES SEPTEMBER 11, 2000 - 145 - CITY OF KITCHENER 4. BPS-00-091 350 WESTMOUNT ROAD WEST ZONE CHANGE APPLICATION ZC 97/5/W/PB SUNOCO INC. WEST WARD (CONT'D) It was pointed out that notice that the Committee would hold a public meeting this date to consider this matter had previously been given. Ms. C. Ladd provided a brief explanation of the application and noted that it had been deferred on May 19, 1998 to allow for City Council to consider 'Drive-Thru' regulations which have been finalized. She advised that the proposed restaurant was intended to have a' Drive-Thru'. Mr. Jeff Willmer, Planning and Engineering Initiatives Limited, appeared as a delegation in support of the recommendation in the staff report. He advised the Committee that work was proceeding on a number of site design concepts that would address issues of concern that had been identified to date. In response to Councillor J. Ziegler, Mr. Willmer stated that requirements with respect to lighting, vehicle noise and intercom operation of the 'Drive-Thru' were already set out and the proposal must comply to those City standards. He emphasized that as part of the site design, the elevation factor would be seriously considered. No other delegations were registered respecting this matter. On motion by Councillor B. Vrbanovic - It was resolved: "That Zone Change Application ZC 97/5/W/PB (350 Westmount Road West- Sunoco Inc.) requesting a change in zoning from Service Station Zone (C-7) with Special Regulation Provision 75R to Convenience Commercial Zone (C-1), with Special Use Provision 286U, Special Regulation Provision 339R, on lands legally described as Part of Lot 7, Registered Plan 1268 and Part of Lot 2, Municipal Compiled Plan 793, more particularly described as Parts 1 and 2, Reference Plan 58R-4532, be approved in the form shown in the attached "Proposed By-law", dated August 10, 2000, subject to the following conditions: 1) That a Record of Site Condition be completed on the subject property, and acknowledged by the Ministry of Environment and Energy, prior to Council giving any readings of the amending Zone Change By-law. 2) The owner acknowledges that Condition 1 is to be satisfied no later than seven months after Council having approved by resolution Zone Change ZC 97/5AN/PB. In the event this resolution is not fulfilled within the seven month period, Council shall consider rescinding the zone change approval. It is the opinion of this Committee that approval of this application is proper planning for the City and is in conformity with the City's Municipal Plan." BPS-00-098 388-394 OTTAWA STREET SOUTH DEMOLITION CONTROL APPLICATION DC O0107101TMW ST. MARY'S COPTIC ORTHODOX CHURCH ROCKWAY-VICTORIA WARD The Committee considered Business and Planning Services staff report BPS-00-098 dated July 31, 2000 dealing with a demolition control application submitted by St. Mary's Coptic Orthodox Church with respect to lands known municipally as 388-394 Ottawa Street South. The subject property is located on the westerly side of Ottawa Street South between Pattandon Avenue and Hoffman Street and the applicant proposes to demolish a single detached dwelling at 394 Ottawa Street South to facilitate redevelopment involving an addition to the front of the existing church building and creation of an additional 13 parking spaces. Ms. C. Ladd provided a brief explanation of the application and advised the staff that nothing further to add to add to the report. BPS-00-098 388-394 OTTAWA STREET SOUTH PLANNING & ECONOMIC DEVELOPMENT COMMITTEE MINUTES SEPTEMBER 11, 2000 - 146 - CITY OF KITCHENER DEMOLITION CONTROL APPLICATION DC O0107101TMW ST. MARY'S COPTIC ORTHODOX CHURCH ROCKWAY-VICTORIA WARD (CONT'D) No delegations were registered respecting this matter. On motion by Councillor M. Yantzi - It was resolved: 'That Demolition Control Application DC 00/07/O/TMW (St. Mary's Coptic Orthodox Church) requesting approval of the demolition of a single detached dwelling located at 394 Ottawa Street South, legally described as being part of Lot 20, John Hoffman's Survey, Registered Plan 384, be approved. It is the opinion of this Committee that approval of this application is proper planning for the City." On motion, it was agreed to refer the Committees' recommendation for ratification at the Special Council meeting which is being re-convened this date following the Planning and Economic Development Committee meeting. BPS-00-116 STATUS REPORT RE: COMMERCIAL POLICY REVIEW STUDY IMPLEMENTATION STRATEGY The Committee considered Business and Planning Services staff report BPS-00-116 dated August 28, 2000 proving an update on the status of the Commercial Policy Review Implementation Strategy in accordance with previous direction. Ms. C. Ladd commented that the review process was moving well and that staff were targeting the November 20, 2000 Planning and Economic Development Committee meeting to bring forward a final recommended Commercial policy structure. In response to Councillor G. Lorentz, Ms. Ladd provided an explanation as to the impact that the proposed changes would have on internal neighbourhood plazas. On motion by B. Vrbanovic- It was resolved: "That staff report BPS-00-116 (Status report re Commercial Policy Review Study - Implementation Strategy) be received for information."
