BACKGROUND: The Development Services Department is in receipt of Heritage Permit Application HPA-2020-V-004 which is seeking permission to remove a rear addition at the property municipally addressed as 139 Queen Street North, located within the Civic Centre Neighbourhood Heritage Conservation District. Location Map: 139 Queen Street North *** This information is available in accessible formats upon request. *** Please call 519-741-2345 or TTY 1-866-969-9994for assistance. 3 - 1 REPORT: The subject property is located on the east side of Queen Street North, at the intersection of Ellen Street East and Queen Street North. The property is designated under Part V of the Ontario Heritage Act and forms part of the Civic Centre Neighbourhood Heritage Conservation District (CCNHCD). The subject property is identified as a Group ‘A’ building in the CCNHCD Plan. The CCNHCD Plan describes the building as Georgian cottage, constructed c. 1852 and originally built for Nicholas Zieger, the owner of a brickyard in the area. The existing sunroom addition is proposed for removal. 139 Queen Street North – Front Elevation Proposed Removal of Rear Addition The existing rear addition (sunroom) on the subject property is not visible from Queen Street North, but is partially visible from Ellen Street West behind an existing wood fence. According to information provided by theproperty owners, the addition is constructed of painted plywood and contains thin, plexiglass windows, some of which are broken. The demolition policies in the CCNHCD Plan presume demolition of entire structures, not the demolition or removal of portions of buildings. However, there are goals and principles within the CCNHCDPlan that address the demolition or removal of portions of buildings within the district.One of the principles of the CCNHCD Plan is “Respect for Historic Accumulations”, which states that: “the alterations that have been made since the original construction also tell part of the history of the place and the building. Some of those alterations may have been poorly conceived and executed, and research may determine that 3 - 2 they can be removed”. One of the goals of the CCNHCD Plan is “to strongly discourage the demolition of heritage buildings and the removal or alteration of distinctive architectural details”. The sunroom located at the rear of the dwelling is not original to the dwelling and was constructed some time in the late 1970s or early 1980s, according to records obtained from the City’s Building Division. 139 Queen Street North – Existing Rear Addition (Sunroom)to be Removed 139 Queen Street North – Interior of Existing Rear Addition (Sunroom) The owner/applicant has advised that the removal of the rear addition will involve removal of the stud frame and plexiglass, repairs to the roof that currently adjoins the addition to the dwelling, and the 3 - 3 installation of new soffits, fascia and eavestroughs. There is no proposal at this time to replace or construct a new addition once this existing sunroom is removed. Heritage Planning Staff Comments Heritage Planning staff areof the opinion that the removal of the rear addition will not detract from the cultural heritage value or interest of the property or the CCNHCD, but that the removal of this addition will contribute to restoring some of the integrity of the dwelling. In reviewing the merits of the application, Heritage Planning staff note the following: The existing dwelling is a Group ‘A’ property within the CCNHCDand this alteration to the dwelling is visible from the public right-of-way; The rear addition is not original to the dwelling; The rear addition will not result in the removal of a distinctive architectural detail; The applicant has demonstrated that the existing addition is in poor condition; The removal of the addition will not detract from the character of the CCNHCD or the integrity of the Queen Street North or Ellen Street West streetscapes; and The removal of the rear addition is in keeping with the principles and goals of the CCNHCD Plan. In accordance with the Heritage Permit Application form, the approval of an application under the Ontario Heritage Act shall not be a waiver of any of the provisions of any by-law of the City of Kitchener or legislation, including but not limited to, the requirements of the Ontario Building Code and Zoning By-law. In this regard, staff confirm that a Building Permit is required to remove the rear addition. Heritage Application We wish to restore our heritage home to its previous state by removing the additional sunroom structure added in later years. We believe this will increase its value as a heritage property as well as improve the functionality of our greenspace. It is evidenced through poor craftsmanship that the addition was not built with the intention of adding value to this unique historical home, nor was it built to last. The current structure is built from painted plywood. The windows are thin plexiglass, of which some are broken. The structure, situated at the rear of the building, measures 30’ x 7.5’, taking up a significant amount of our personal greenspace. Currently, the backyard measures 34’x 10’. Thus, the sunroom claims almost half of our backyard. See Diagram Below: Driveway We believe the cost to repair and recondition the structure to meet adequate standards far outweighs the value that would be added by removing the building altogether. We are confident that, given the fact that the structure does not add any significant cultural or historical value, it is appropriate in this case to demolish said structure. The intended demolition would proceed as follows: -Removal of the stud frame and plexiglass -Repair of roof that currently adjoins the sunroom to the structure. -Installation of appropriate soffit/fascia/eavestrough (contracted through RMW Exteriors Inc. please see initial quote for reference) All proposed work will be completed by us, the homeowners, apart from the eavestrough and fascia installation. George is a licensedplumber and capable handyman, so we are confident that this undertaking is within his skillset. If consultation is needed during any part of the process, we have the affiliation with the appropriate trades to ensure the job is completed safely, and correctly. 3 - 8 3 - 9
