a. Affordable Housing Councillor B. Ioannidis has given notice that he will introduce the
following motion for consideration this date:
WHEREAS the City of Kitchener recognizes the importance of strong and diverse
neighbourhoods where residents can grow and thrive; and,
WHEREAS a key action in the City of Kitchener Strategic Plan is to create a caring
community through the development of a Housing Strategy, aimed at addressing
challenges to housing affordability in Kitchener across the housing continuum; and,
assessment found that rapid price and rent
increases are making housing unaffordable all along the housing continuum, including
middle income households; and,
WHEREAS the City of Kitchener has identified affordable housing as a priority in the City
and has adopted Council Policies to encourage development of new affordable rental
housing units, which provide exemptions and deferrals of development to fees/charges;
and,
WHERES the City of Kitchener continues to seek options to encourage a broader range
of housing options and increase the supply of affordable housing opportunities available;
and,

WHEREAS Inclusionary zoning is one important, cost effective tool that can be used to
deliver more affordable units to help address growing affordable housing needs; and,
WHEREAS Bill 108 restricted the use of inclusionary zoning to areas around major transit
stations providing rail or bus rapid transit, and provincially mandated community planning
permit system areas; and,
WHEREAS there are city-wide opportunities to achieve affordable housing through
inclusionary zoning in a manner that is financially sustainable for both municipalities and
developers;
THEREFORE BE IT RESOLVED that the City Council request the Province to reinstate
the Planning Act provisions enabling a municipality to apply Inclusionary Zoning
provisions within its entire jurisdiction, or at minimum, to enable Inclusionary Zoning along
Major Transit bus routes throughout the City;
BE IT FINALLY RESOLVED that a copy of this resolution be sent to the Ontario Minister
Municipalities, to the Association of Municipalities Ontario, and to the Region of Waterloo
and local area municipalities.
b. Automated Speed Enforcement Program Councillor P. Singh has given notice that he
will introduce the following motion for consideration this date:
WHEREAS the City of Kitchener is participating in the Automated Speed Enforcement
program through the Region of Waterloo;
THEREFORE BE IT RESOLVED that the City of Kitchener advocate to The Minister of
Transportation and to The Minister of the Attorney General to amend the necessary acts
that would permit municipalities to use an Administrative Monetary Penalty System
(AMPS) for the purpose of administering Automated Speed Enforcement infractions; and,
THEREFORE BE IT FURTHER RESOLVED that the City of Kitchener recommend to the
Region of Waterloo chair and Regional Council that the ASE program proceed with four
Automated Speed Enforcement sites within The City of Kitchener for Phase 1 of ASE as
per the initial strategy discussed prior to the COVID-19 pandemic; and,
THEREFORE BE IT FURTHER RESOLVED that the City of Kitchener recommend to the
Region of Waterloo that the second phase of ASE proceed prior to the start of the 2021
school year; and,
BE IT FINALLY RESOLVED that the number of locations selected in subsequent phases
be determined by population or other scientific metric and applied throughout the Region
rather than distributed equally amongst regional partners.

BACKGROUND:
The Storm & Sanitary Utility (SSU) requires contracted services to support the Pipe Repairs
Program which addresses known defects within both Storm and Sanitary assets, mainly pipe
segments such as storm mains, storm leads, sanitary mains and sanitary laterals.
While the SSU Operations team does perform many sewer repairs on an annual basis, the
intention of this contract is to be able to utilize a contractor to complete pipe repairs that require
either specialized equipment, training or construction methodologie
well suited to attempt.Examples of work may include use of trench boxes or sites that may have
poor soil or high ground water conditions, complicated traffic control plans, requirement to shut
down a regional road for several days at a time, the need to pipe burst and larger scale work.
There is currently a backlog of sites that need to be completed, the bulk of which are planned
for 2021. The need for a continuation of these services will be reviewed by SSU Operations on
an annual basis.
This proposal is based on fixed hourly labour rates and material prices.The actual spend will
depend on the level of activity throughout the term of the contract.

BACKGROUND:
On November 5, 2019,the Humane Society of Kitchener-Waterloo and Stratford Perth
designatedLoki,adog owned by Keantel Meadus, as a Prohibited Dog.The designation was
Lokiwas a Pit Bull type dog, in contravention to City of Kitchener
By-law 2014-142 (Being a by-law with respect to the designation of Potentially Dangerous,
Dangerous, Prohibited and Restricted Dogs). On November 12, 2019,the Office of the City Clerk
subsequently received correspondence from Keantel Meadus appealing the Prohibited Dog
Designation; and aNotice of Hearing was issued to the Respondentand Appellant, advising on
January 27, 2020,a hearing of the Dog Designation Appeal Committee would be held to consider
the matter.Having considered the evidence submitted at the January 27, 2020,hearing, pursuant
-law 2014-142, the Dog Designation Appeal Committee adjourned the
hearing to September 21, 2020,so it could have more complete evidence to assessthe breed of
the dog Loki. The Committee set the hearing date as September 21, 2020, as Lokiwill be two
years of age and likely closer to being full-grown. A Notice of Hearing was issued to the Respondent
and Appellants, advising on September 21, 2020,a hearing of the Dog Designation Appeal
Committee would be held to consider the matter. The Committee heard and considered evidence
from all partiesand foundthat due to physical characteristics of and the previous
, the Prohibited Dog Designation be affirmed.
REPORT:
The Dog Designation Appeal Committee established by the Council of the Corporation of the
City of Kitchener pursuant to City of Kitchener Municipal By-law 2014-142 and the Statutory

RECOMMENDATION: That the decision of the Dog Designation Appeal Committee

BACKGROUND:
On February 14, 2020,the Humane Society of Kitchener-Waterloo and Stratford Perth
designatedChorizo,adog owned by Justine Feliciano, as a Dangerous Dog.The designation
was applied after determining that on January 24Chorizodid attack a dog without
provocation in contravention to City of Kitchener By-law 2014-142 (Being a by-law with respect
to the designation of Potentially Dangerous, Dangerous, Prohibited and Restricted Dogs). On
February 19, 2020,the Office of the City Clerk subsequently received correspondence from
Felicianoappealing the Dangerous Dog Designation; and aNotice of Hearing was issued to the
Respondentand Appellants,advising on September 21, 2020,a hearing of the Dog Designation
Appeal Committee would be held to consider the matter.The Committee heard and considered
evidence from all partiesand found that due to the severity of the attack, and the lack of
substantive mitigating factors, the Dangerous Dog Designation should be confirmed.
REPORT:
The Dog Designation Appeal Committee established by the Council of the Corporation of the
City of Kitchenerpursuant to City of Kitchener Municipal By-law 2014-142 and the Statutory
Powers Procedure Act R.S.O. 1990 Chapter S.22, sat onSeptember 21, 2020,to consider an
appeal filed with the City byJustine Feliciano.
Having considered all of the evidence and exhibits presented on behalf of the Respondent
by Gary Boes, Animal Control Officer, and Erin Kearney, Associate City Solicitor; and,
having reviewed all of the evidence submitted by Justine Feliciano, Appellant; the
Committee hereby confirms and amends the designation of Dangerous Dog applied to
-Waterloo and Stratford Perth; and,
pursuant to By-law 2014-142 assigns the following conditions for the keeping of said
Dangerous Dog:

(a) The owner shall ensure that all conditions pertaining to the designated dog are
followed when it is off the property of the owner or otherwise in an enclosed yard
as approved by the animal services provider unless specified otherwise in this
designation;
(b) The owner shall ensure that the animal services provider is provided with the
new address and telephone number of the owner within two working days of
moving the designated dog;
(c) The owner shall provide the animal services provider with the name, address
and telephone number of the new owner within two working days of selling or giving
away the designated dog;
(d) The owner shall advise the animal services provider within two working days of
the death of the designated dog;
(e) The owner shall advise the animal services provider forthwith if the designated
dog runs at large or has bitten or attacked any person or animal;
(f) The owner shall provide a copy of this designation to any person who keeps or
harbours the designated dog;
(g) The owner shall provide a copy of this designation to any veterinarian treating
the requirements of this designation to the extent necessary to secure veterinary
treatment for the dog at the discretion of the veterinarian;
(h) The owner shall ensure that the designated dog has a current City dog license;
(i) The owner shall ensure that the designated dog wears the tag or tags provided
by the animal services provider at all times and shall pay the reasonable cost for
such tag or tags;
(j) The owner shall ensure that the designated dog is kept, when it is on the lands
and premises of the owner, confined:
a. Within the dwelling;
b. In an outdoor pen that is both secure and provides humane shelter to the
satisfaction of the animal services provider;
c. In an area with a secure and adequate fence to the satisfaction of the
animal services provider however the animal services provider may refuse
to approve any fenced area if, in the sole discretion of the animal services
provider, a fenced area would provide insufficient protection to members of
the public including unsupervised children who may wander into the area;
or
d. When outside of the dwelling and the approved pen or fenced area
contemplated by subsections (b) and (c), under the effective control of a
person of at least eighteen years of age and under leash, such leash not to
exceed 1.8 metres (6 feet) in length and to be approved by the animal
services provider, and, where the dog is required to wear a muzzle off its
property by this designation shall also wear a muzzle confined in
accordance with this subsection (d);
(k) The owner shall ensure that the designated dog is kept caged, penned, or in a
locked room not accessible to children or through inadvertence, or under the

control of an occupant of the dwelling who is at least eighteen years of age when
(l)The owner shall ensure that the designated dog iskept under the effective
control of a person of at least eighteen years of age with the use of a body harness
to be approved by the animal services provider, and under leash, such leash not
to exceed 1.8 metres (6 feet) in length and to be approved by theanimal services
caged or otherwise penned or confined to the satisfaction of the animal services
provider;
(m)The owner shall ensure that the designated dog wears a securely attached
muzzle that is satisfactory to the animal services provider at all times when it is off
satisfaction of the animal services provider;
(n)The owner shall ensure that the warning sign or signs provided by the animal
person would normally approach and at any other place on the property as directed
by the animal services provider. The sign(s) shall be posted in such a manner that
it/they cannot be easily removed by passersby and the sign posted at the entrance,
which a person would normally approach must be clearly visible to a person
approaching the entrance, or, when in a multiple unit dwelling,the owner will
provide the name of the property owner and property manager if any and allow the
animal services provider to request that person to post a sign or signs;
(o)The owner shall ensure that the designated dog is microchipped by a licensed
veterinarian and supply the microchip information to the animal services provider.
The owner shall also permit the animal services provider to verify the implantation
of such microchip.

including third party information.

In order for staff to have benefit of all the information from the companies/parties they are dealing with when
looking at various business arrangements the City needs to be in a position to execute aNon-Disclosure
Agreement in a timely manner.All agreements are subject to the law.

1. That the Uniform Traffic By-law be amended for the installation of a stop control on Gage Avenue
at the intersection of Gage Avenue and Waverly Road, as outlined in Development Services
Department report DSD-20-149.
2. That staff be directed to proceed with installation of a new mechanical ventilation unit at Budd
Park Indoor Soccer Facility, as outlined in Infrastructure Services Department report INS-20-

INS-20-11, be approved and added to the scope of work for Heritage Restoration Inc. (T19-177);
and,
That the City Hall Outdoor Spaces capital project budget be increased by the following amounts:
$900,000 for Necessary Repairs
$1,150,000 for Comprehensive Renewal
$150,000 for Accelerated Schedule; and further,
That the funding sources for the additional budget be allocated as follows:
$815,000 Facilities Management capital project closeouts
$1,385,000 Tax Capital reserve fund.
5. That the Director of Transportation Services be authorized, subject to the satisfaction of the City
Solicitor, to execute all necessary agreements, renewals, and other such documentation with
the Region of Waterloo for the administration and operation of Automated Speed Enforcement
on City roads, as outlined in Development Services Department report DSD-20-104; and,
That Franklin Public School be approved as the priority location for automated speed
enforcement; and further;
That the school zones outlined in Appendix A be approved and added to Schedule 19 of the
Uniform Traffic Control By-law.

1. That staff be directed to develop a business case for a downtown district energy system as
outlined in Development Services Department report DSD-20-151; and further,
That staff be directed to submit a Green Municipal Fund Feasibility Study grant application to
help fund the downtown district energy business case development.
2. That Development Services Department report DSD-20-150, Inclusionary Zoning for Affordable
Housing: Background and Fiscal Impact Analysis, be received.

3. That Zoning By-law Amendment Application ZBA19/013/S/KA for Thresholds Homes and

to Development Services Department report DSD-20-106 as Appendix A; and,
That in accordance with Planning Act Section 45 (1.3 & 1.4) that applications for minor variances
shall be permitted for lands subject to Zoning By-law Amendment Application ZBA19/013/S/KA;
and further,
That the City of Kitchener grant an exemption to Council Policy MUN-PLA-
municipally addressed as 290 Sheldon Avenue North, to allow development on a cul-de-sac
having a length greater than 150 metres provided that:
a) buildings are sprinklered; and,
b) Direct-to-Fire Alarm Monitoring be installed.
