BACKGROUND: On November 5, 2019,the Humane Society of Kitchener-Waterloo and Stratford Perth designatedLoki,adog owned by Keantel Meadus, as a Prohibited Dog.The designation was Lokiwas a Pit Bull type dog, in contravention to City of Kitchener By-law 2014-142 (Being a by-law with respect to the designation of Potentially Dangerous, Dangerous, Prohibited and Restricted Dogs). On November 12, 2019,the Office of the City Clerk subsequently received correspondence from Keantel Meadus appealing the Prohibited Dog Designation; and aNotice of Hearing was issued to the Respondentand Appellant, advising on January 27, 2020,a hearing of the Dog Designation Appeal Committee would be held to consider the matter.Having considered the evidence submitted at the January 27, 2020,hearing, pursuant -law 2014-142, the Dog Designation Appeal Committee adjourned the hearing to September 21, 2020,so it could have more complete evidence to assessthe breed of the dog Loki. The Committee set the hearing date as September 21, 2020, as Lokiwill be two years of age and likely closer to being full-grown. A Notice of Hearing was issued to the Respondent and Appellants, advising on September 21, 2020,a hearing of the Dog Designation Appeal Committee would be held to consider the matter. The Committee heard and considered evidence from all partiesand foundthat due to physical characteristics of and the previous , the Prohibited Dog Designation be affirmed. REPORT: The Dog Designation Appeal Committee established by the Council of the Corporation of the City of Kitchener pursuant to City of Kitchener Municipal By-law 2014-142 and the Statutory Powers Procedure Act R.S.O. 1990 Chapter S.22, sat onSeptember 21, 2020,to consider an appeal filed with the City by Keantel Meadus. On that date, the Dog Designation Appeal Committee considered the evidence related to an incident resulting in the Prohibited DLoki ***This information is available in accessible formats upon request. *** Please call 519-741-2345 or TTY 1-866-969-9994for assistance. 2 - 1 testimony presented on behalf of the Respondent by Brittany Hennessey, Animal Control Officer, and Erin Kearney, Associate City Solicitor; and, having reviewed all of the evidence submitted by Keantel Meadus, Appellant; the Committee hereby confirmsthe designation of Prohibited Lokipursuant to By-law 2014-142 assignedthe following conditions for the keeping of said ProhibitedDog: by Officer Brittany Hennessey, By-law Officer, the Committee hereby affirms the des Waterloo & Stratford Perth; and pursuant to By-law 2014-142 assigns the following conditions for said Prohibited Dog: Kitchener City Council, the owner is required to provide proof satisfactory to the Poundkeeper that the dog has been ALIGNMENT WITH CITY OF KITCHENER STRATEGIC PLAN: The recommendation of this report supports the the delivery of core service. FINANCIAL IMPLICATIONS: There are no financial implications associated with this report. COMMUNITY ENGAGEMENT: INFORM -All those inattendance at the September 21,2020Hearingwere advised of the it would be considered at the October 5, 2020,Councilmeeting. In addition, a Notice of Decision was sent to the Appellant and the Respondents via registered mail onOctober 2, 2020; thereby, would be considered by Council and the process for registering as a delegation.
