CITY OF KITCHENER
A special meeting of City Council was held at 11:45 a.m. this date, Chaired by Mayor C. Zehr with all
members present.
Notice of this special meeting had been previously given to all members of Council by the City Clerk
pursuant to Chapter 25 (Council Procedure) of the Municipal Code.
Council was in receipt of Business and Planning Services Department report BPS-01-017 (R. Morgan/K.
Bissell/G. Borovilos/B. Stanley), dated February 1, 2001, recommending acceptance of an Offer to
Purchase from J.T. Bakeries Inc. for part of Site 164 in the Huron Business Park.
Moved by Councillor G. Lorentz
Seconded by Councillor J. Ziegler
"That the City accept the Offer to Purchase from J.T. Bakeries Inc., for part of Site 164 on
Strasburg Road in the Huron Business Park, being approximately 5.62 acres at $75,000. per
acre for a total purchase price of approximately $421,500.; and further,
That the Mayor and Clerk be authorized to execute any necessary documentation required by
the City Solicitor."
Carried.
Council was in receipt of a memorandum from G. Sosnoski, dated February 2, 2001, outlining a draft
resolution concerning the disposal of municipal waste by the City of Toronto.
Mayor C. Zehr suggested a change to the wording in the draft motion to remove the reference in
Clause 1 to the Adams Mine Landfill and Kirkland Lake, and also to add the City of Windsor to the
municipalities to be circulated.

"WHEREAS the City of Toronto is currently shipping approximately 450,000 tonnes of
municipal waste to Michigan annually and to date has not arranged for alternate waste
disposal/diversion which could result in a further 900,000 tonnes of garbage being shipped to
Michigan by truck along Highway 401, with the possibility of this total amount increasing to
2,700,000 tonnes per year after 2002;
AND WHEREAS this significant increase in truck traffic passing through local communities will
reportedly have negative health, environmental and safety impacts due to air emissions,
accidents and infrastructure damage, along with the attendant costs to the taxpayers of
Ontario;
AND WHEREAS the City of Kitchener has long supported and been actively involved in
initiatives to reduce waste sent to landfill sites, and is of the belief that such initiatives should
form an integral part of any comprehensive waste management and disposal strategy;
THEREFORE, BE IT RESOLVED, that Kitchener City Council wishes to go on record as being
opposed to the disposal of municipal waste outside of a municipal jurisdiction and the Province
of Ontario; and specifically, to the shipping of waste by truck from Toronto to Michigan along
Highway 401;
AND FURTHER, that a copy of this resolution be forwarded to the City of Toronto, local MPPs,
the Region of Waterloo, and the municipalities of Windsor, Sarnia, London, Cambridge,
Waterloo and Milton."

Council was in receipt of Legal Department report LEG-01-019 (J. Shivas), dated February 1, 2001,
recommending a contribution to the Municipal Rights-of-Way Defence Fund being organized by the
Federation of Canadian Municipalities to challenge a January 25, 2001 decision of the Canadian

Radio Television and Telecommunications Commission concerning access to municipal rights-of-way
by private telecommunication carriers.
Mr. Shivas spoke to his report and asked that the recommendation be amended to specify the
Federal Court of Appeal. Mayor C. Zehr advised that Regional Council passed a similar resolution
last week. He also asked that the staff recommendation be amended to include reference to the
$7,400. amount requested.

"That the City contribute to the Municipal Rights-of-Way Defence Fund of the Federation of
Canadian Municipalities to fund both the original LedcorNancouver proceeding resulting in
CRTC decision 2001-23 dated January 25, 2001 and an appeal to the Federal Court of
Appeal, each at the rate of $0.02 per capita or $7,400."

"That the City confirm the acquisition of the following properties within the block bounded by
Cedar Street North, King Street East, Eby Street North and Duke Street East for the purposes
of a new market:
1)
Part of Lots 11 and 12, Registered Plan 364, municipally known as 21 Eby Street
North, from Sara Walesch;
2)
Part of Lot 12 Marked N. Ziegler as shown on B Eby's Survey Registered Plan
364, municipally known as 17 Eby Street North, from Helge & Sabine Mueller;
3)
Part Lot 12, B. Eby's Survey, North of King Street, Plan 364, municipally known
as 290-292-294 King Street East and 11 Eby Street North, from 389159 Ontario
Limited;
4)
Part Lot 12, marked "N. Ziegler" according to B. Eby's Survey, Plan 364,
municipally known as 312 King Street East, from 358070 Ontario Limited;
5)
Part Lot 18, West Side of Cedar Street and North of King Street, Plan 364, being
Parts 55 & 56 on Reference Plan 58R-6534, municipally known as 20 Cedar
Street North, from Judith Elizabeth Hewson; and
6)
Part Lot 12 in Benjamin Eby's Survey North of King Street, Plan 364, municipally
known as 296-302 King Street East and 13 Eby Street North, from Ely Matlow
and 261001 Investments Limited."
Carried Unanimously.
Council was in receipt of Legal Department report LEG-01-016 (L. MacDonald), dated January 31,
2001, requesting authorization to execute an agreement to construct four additional monitoring wells
in the King Street West and Wellington Street road allowances.

"That the Mayor and Clerk be authorized to execute an agreement, satisfactory to the City
Solicitor, with Ernst & Young Inc. Trustee for the Estate of William H. Kaufman Inc. to amend
the existing agreement with William H. Kaufman dated May 24, 2000 to permit construction of
four additional monitoring wells on City road allowances in locations to be approved by staff, as
part of an Environmental Assessment being conducted for Kaufman Footwear."

"That an in-camera meeting of City Council be held immediately following this special meeting to
consider a land acquisition matter, two personal matters and four matters subject to solicitor-client
privilege."

"That leave be given the Mover and Seconder to introduce a by-law to confirm all actions and
proceedings of the Council and that the same be taken as read a first, second and third times, be
finally passed and numbered 2001-21 by the Clerk."
