Gosse, Committee Administrator DTS-04-101 - EBY STREET NORTH ON-STREET PARKING BRIDGEPORT-CENTRE WARD The Committee considered Development and Technical Services Department report DTS-04- 101 dated June 28, 2004, regarding on-street parking on Eby Street North. On motion by Councillor G. Lorentz - it was resolved: "That on-street parking be prohibited at anytime on the east side of Eby Street North from King Street East a point 98 metres north thereof; and further, That the Uniform Traffic By-law be amended accordingly." DTS-04-116 - CENTREVILLE STREET & JANSEN AVENUE ON-STREET PARKING CHICOPEE-GRAND RIVER WARD The Committee considered Development and Technical Services Department report DTS-04- 116 dated July 19, 2004, regarding on-street parking on Centreville Street & Jansen Avenue. On motion by Councillor G. Lorentz - it was resolved: "That on-street parking be prohibited at anytime on the north side of Centreville Street from Morgan Avenue to Jansen Avenue; and, That on-street parking be prohibited at anytime on the east side of Jansen Avenue from Centreville Street to Huber Street; and further, That the Uniform Traffic By-law be amended accordingly." DTS-04-118 - KRUG STREET TRAFFIC CONTROL MEASURES BRIDGEPORT-CENTRE WARD The Committee considered Development and Technical Services Department report DTS-04- 118 dated July 29, 2004, regarding traffic control measures on Krug Street. On motion by Councillor G. DTS-04-118 - KRUG STREET (CONT'D) Avenue; and, That Transportation Planning continue to monitor Krug Street with regards to speeding and vehicular volume; and further, That the Uniform Traffic By-law be amended accordingly." 4. DTS-04-119 - STRASBURG ROAD ON-STREET PARKING FAIRVIEW-GATEWAY WARD The Committee considered Development and Technical Services Department report DTS-04- 119 dated July 21,2004, regarding on-street parking on Strasburg Road. On motion by Councillor G. Lorentz - it was resolved: "That parking be prohibited at anytime on both sides of Strasburg Road from a point 98 metres east of Ottawa Street South to a point 50m east thereof; and further, That the Uniform Traffic By-law be amended accordingly." 5. DTS-04-123 - BIEHN DRIVE ON-STREET PARKING SOUTH WARD The Committee considered Development and Technical Services Department report DTS-04- 123 dated August 7, 2004, regarding on-street parking on Biehn Drive. On motion by Councillor G. Lorentz - it was resolved: "That parking be prohibited at anytime on the south side of Biehn Drive from a point 250 metres west of Maxwell Drive to a point 30 metres east thereof; and further, That the Uniform Traffic By-law be amended accordingly." 6. DTS-04-127 - HURON WOODS SUBDIVISION - STAGE 1 MUNICIPAL SERVICING & ROADWORKS STRASBURG ROAD EXTENSION CITY OF KITCHENER NOISE BY-LAW EXEMPTION The Committee considered Development and Technical Services Department report DTS-04- 127 dated August 9, 2004, regarding an exemption to the City's Noise By-law for municipal servicing and roadworks in the Huron Woods Subdivision. On motion by Councillor G. Lorentz - it was resolved: "That the City of Kitchener and its contractor(s) be exempt from the provisions of Chapter 450 for the Huron Woods Subdivision - Stage 1, Municipal Servicing and Roadworks. The request for the exemption is between the hours of 7:00 p.m. to 7:00 a.m. for a full seven (7) days and then intermittently over the time frame from August 9 to September 30, 2004." It was noted that the Committee's recommendation would be considered when the special Council meeting reconvenes later this date. DEVELOPMENT & TECHNICAL SERVICES COMMITTEE MINUTES AUGUST 167 2004 - 68- CITY OF KITCHENER 7. DTS-04-126 - PLAN OF SUBDIVISION 30T-00201 ZONE CHANGE APPLICATION ZC 00/11/W/JW GRAND RIVER SOUTH COMMUNITY 583018 ONTARIO LIMITED (DR. FUNG) FAIRWAY ROAD CHICOPEE-GRAND RIVER WARD The Committee considered Development and Technical Services Department report DTS-04- 126 dated August 6, 2004 dealing with plan of subdivision application 30T-00201 and zone change application ZC 00/ll/VV/JW, for lands on Fairway Road in the Grand River South Community. B. Sloan provided an overview of the draft plan of subdivision and the zone change application advising that the applications are for a residential subdivision on approximately 41.6 hectares of land to the south of the new Fairway Road extension and west of Zeller Drive in the Grand River South Community. The subdivision would consist of 409 units made up of single detached dwellings, potential semi-detached dwellings, street Townhouses, and cluster Townhouses. The subdivision would also include a stormwater management area, neighbourhood park space, open space and public trails. Mr. Sloan pointed out that the lands also include a significant woodlot which is part of a specific policy in the Community Plan regarding the importance of conserving upland forest areas and having the lands conveyed into public ownership. He advised that the draft plan does not propose to convey the woodlot into public ownership but, staff are recommending the woodlot be zoned Open Space; be subject to a conservation easement; and that staff continue discussions with the applicant with the intent of having the woodlot conveyed into public ownership. Mr. Sloan concluded his presentation advising the proposed draft plan of subdivision and zone change application comply with the Municipal Plan, the Grand River Conservation Plan and generally with the Community Plan. The development represents proper and orderly development of the City and staff recommend approval. Councillor Weylie, Chair, advised of a written submission from Ms. Kathy Bell, 320 Fairway Road North, which has been circulated to members of the Committee and raised the concern of Ms. Bell with respect to additional traffic on Fairway Road. J. McBride responded that the Community Plan contains measures to control traffic and protect pedestrians. Volumes will increase on Fairway Road as the area is developed and when the traffic warrants are met, traffic lights will be installed. Mr. Bill Green, GSP Group, representing the applicant, attended and provided a brief review of the planned subdivision. Mr. Green advised that the proposed street name, Sims Estate Drive, is an extension of a road which goes through an adjacent subdivision and will front the historic Sims Estate. Mr. Green stated that he and his client have reviewed the staff report and are satisfied with the recommendations and he requested that Council approve the applications. There were no further delegations to speak on the matter. On motion by Mayor C. Zehr - it was resolved: "That the recommendation contained in Development and Technical Services Department report DTS-04-126, dated August 6, 2004 regarding plan of subdivision 30T- 00201 and zone change application ZC 00/11/W/JW, be approved." It was noted that the Committee's recommendation would be considered when the special Council meeting reconvenes later this date. DEVELOPMENT & TECHNICAL SERVICES COMMITTEE MINUTES AUGUST 167 2004 - 69- CITY OF KITCHENER 8. DTS-04-114 - PLAN OF SUBDIVISION 30T-00204 ZONE CHANGE APPLICATION ZC 00/28/M/TMW GRAND RIVER SOUTH COMMUNITY VALLEYVIEW HEIGHTS (ST. JACOB'S) LIMITED MORRISON ROAD CHICOPEE-GRAND RIVER WARD The Committee considered Development and Technical Services Department report DTS-04- 114 dated July 23, 2004, dealing with plan of subdivision 30T-00204 and zone change application ZC 00/28/M/TMW for lands on Morrison Road in the Grand River South Community. B. Sloan provided an overview of the draft plan of subdivision and the zone change application advising that the applications are for a residential subdivision on approximately 9.9 hectares of land to the east of Morrison Road in the Grand River South Community. The subdivision would develop the lands for 98 single-detached dwellings, two Townhouse complexes of 40-55 units, a stormwater management area and an open space block. Mr. Sloan advised that the subdivision is adjacent to the previous discussed plan of subdivision (30T-00201) and is linked through servicing and a collector road. Mr. Sloan concluded his presentation advising the proposed draft plan of subdivision and zone change application comply with the Municipal Plan and the Community Plan. The develooment represents proper and orderly development of the City and staff recommend approval. Mr. Chris Pidgeon, GSP Group, attended representing the applicant and provided a rewew on the proposed development and applications. Mr. Pidgeon advised that an agreement has been reached between Lynndale Development, 583018 Ontario Limited (Dr. Fung) and his client which will allow the three developments to proceed at this time. He further advised that he has reviewed the staff report and his client is in agreement with the staff recommendation and the conditions of the draft plan of subdivision. There were no further delegations to speak on this matter. On motion by Mayor C. Zehr - it was resolved: "That the recommendation contained in Development and Technical Services Department report DTS-04-114, dated July 23, 2004 regarding plan of subdivision 30T- 00204 and zone change application ZC 00/28/M/TMW, be approved." It was noted that the Committee's recommendation would be considered when the special Council meeting reconvenes later this date. DTS-04-129 - DTS-04-115 - ADDENDUM TO DTS-04-115 ZONE CHANGE APPLICATION ZC 04/14/D/KS 28-42 DOON MILLS DRIVE MONARCH CONSTRUCTION INC. SOUTH WARD The Committee considered Development and Technical Services Department report DTS-04- 115 dated July 21, 2004 and addendum report DTS-04-129 dated August 11,2004 regarding a zone change application for lands known municipally as 28-42 Doon Mills Drive. L. Masseo, provided an overview of the report advising that the proposed zone change application will allow the creation of 30 freehold townhomes with 23 units fronting onto a private street. The Zoning By-law presently defines street fronting townhouses as units fronting onto a public street whereas, the applicant wishes to develop the property with the townhouses on a private 'common' street within the complex. The proposed zone change will allow this type of development in addition to reducing the internal side yard setbacks and reduce corner lot widths. Mr. Masseo advised that the Site Plan application for the property has been approved in principle and it is recommended that the zone change application be approved in the form of the revised by-law attached to report DTS-04-129, dated August 11,2004. DEVELOPMENT & TECHNICAL SERVICES COMMITTEE MINUTES AUGUST 167 2004 - 70- CITY OF KITCHENER DTS-04-129 - ADDENDUM TO DTS-04-115 DTS-04-115 - ZONE CHANGE APPLICATION ZC 04/14/D/KS (CONT'D) Glen Scheels, GSP Group, representing the applicant attended advising his client was in agreement with the staff report and recommendation. There were no further delegations to speak on this matter. On motion by Councillor M. Galloway - it was resolved: "That Zone Change Application ZC04/14/D/KS for the purpose of changing the zoning from Neighbourhood Shopping Centre Zone (C-2) (28-42 Doon Mills Drive) with Special Regulation Provision 274R and Special Use Provision 246U to Neighbourhood Shopping Centre Zone (C-2) with Special Regulation Provision 274R, Special Regulation Provision 421R and Special Use Provision 246U, on lands legally described as Block 98, Plan 58M- 226 in the City of Kitchener, be approved in the form shown in the "Proposed By-law", dated August 11, 2004, attached to Development and Technical Services Department report DTS-04-129, without conditions." 10. DTS-04-125 - TRAFFIC CALMING POLICY The Committee considered Development and Technical Services Department report DTS-04- 125 dated August 11,2004, regarding a traffic calming policy. J. McBride provided an overview of the report and traffic calming policy advising that the draft report was circulated to the Neighbourhood Associations, Regional Emergency Services, Grand River Transit, the Cities of Waterloo and Cambridge, the Environmental Committee and various City Departments. The comments received from the circulation were positive and assisted in forming the proposed final policy. Mr. McBride explained that the policy contains a table of appropriate traffic calming measures that can be utilized based on the road classification. Also included are evaluation criteria which will be used to assess the roads resulting in each road being rated and then the problem roads are prioritized in a fair and consistent manner. Mr. McBride concluded his presentation advising that under the proposed policy and criteria, the known problem roads were assessed and the resulting priority list is contained in the staff report. He advised that from the list the 3 highest priority roads, one from each road classification, are being recommended for commencement under the policy. Mr. McBride added that in order to implement the traffic calming program an annual budget of $100,000 was being proposed. Councillor G. Lorentz advised that the residents of Greenbrook Drive have raised an issue with respect to the timing of the traffic lights at Homer Watson Boulevard and he asked that the Region be requested to review the matter as soon as possible. In answer to questions raised by the Committee, J. McBride explained that Provincial Regulations require an Environmental Assessment (EA) on each traffic calming measure being proposed requiring notices and public meetings and the City will require services of a consultant. He added that only those residents directly affected will have a vote on any proposed traffic calming measure although other residents not directly affected will have an opportunity to speak to the proposal. It was pointed out that Clause No. 7 in the proposed policy dealing with the response to a traffic calming proposal should read "60% of the responders support the recommended plan for it to proceed." Ms. Jacqueline Gates, 109 Deer Ridge Drive, attended to request that Deer Ridge Drive be moved up in the priority list so it is among the first roads to be assessed. Ms. Gates advised there are 113 driveways accessing the road and with the construction traffic, speeding and parked vehicles, vehicles being road tested and increased volume, Deer Ridge Drive is an unsafe road. She questioned the designation of Deer Ridge Drive as a major collector road when its primary purpose is for the area residents. She asked if the road was not a major collector and using the proposed criteria, would it have scored higher therefore moving up in the priority list. J. McBride advised that if Deer Ridge Drive was scored under one of the other two categories it may have scored higher but still would not have moved up enough to change the priority list. DEVELOPMENT & TECHNICAL SERVICES COMMITTEE MINUTES AUGUST 167 2004 - 71- CITY OF KITCHENER 10. DTS-04-125 - TRAFFIC CALMING POLICY (CONT'D) Councillor M. Galloway advised that the proposed policy puts into place a systematic process to be followed in implementing consistent traffic calming measures across the City. He added that although sympathetic with the residents of Deer Ridge Drive, in his opinion it is important that the City follow the process and deal with the roads as prioritized using the criteria in the policy. Mr. Michael Mooney, 226 Deer Ridge Drive, attended supporting the request to have Deer Ridge Drive moved up in the priority list. Mr. Mooney advised that the road is residential and has a 7/10 of a mile straightaway which is used by vehicles speeding. There have been many vehicles and trees hit by passing vehicles and in his opinion, the road has become unsafe especially for the children living in the area. Mr. Mooney suggested that traffic calming measures should be implemented now before more planned development takes place in the Deer Ridge / Pioneer Tower area. Mr. Mooney also requested that he receive the data compiled by the Traffic Division from the traffic counters and Mr. McBride advised that this information could be provided to him. Councillor J. Gazzola suggested that in consideration of the information provided by the delegations and in speaking to others from the area, that Deer Ridge Drive be included as one of the first roads for traffic calming investigation and assessment. Councillor G. Lorentz re-iterated the views of Councillor Galloway and the need to maintain the priority list using the criteria set out in the policy. On a motion by Councillor Lorentz the staff recommendation was brought forward for consideration. Councillor Gazzola made an amending motion to have Deer Ridge Drive added as one of the roads selected for a traffic calming environmental assessment. Mayor C. Zehr disclosed a pecuniary interest and abstained from all discussion and voting with respect to the amending motion as he has purchased property in the Deer Ridge Drive area. Upon the question of the amendment to the main motion, a vote was taken and the motion lost. J. McBride advised on the timing for the completion of the traffic calming environmental assessments requesting the approval of up to $30,000 to commence the assessments in 2004. Councillor J. Gazzola suggested that if the City is going to undertake this initiative, it is important that the work commence as soon as possible in order to move through the priority list. Councillor J. Gazzola moved that the main motion be amended to include the approval of up to $30,000 to commence the traffic calming environmental assessment in 2004. The amending motion was voted on and carried. The main motion, as amended, was voted on and carried as follows: On motion by Councillor G. Lorentz - it was resolved: "That the Traffic Calming Policy dated August 16, 2004 be adopted; and, That the existing Traffic Calming Policy 1-784 be deleted; and, That funds in the amount of $100,000 annually be referred to the 2005 Capital Budget review to be allocated for Traffic Calming Environmental Assessments and the resulting road improvements; and further, That a Traffic Calming Environmental Assessment be completed on David St/Schneider Ave, Kingswood Dr and Greenbrook Dr and up to $30,000 be approved in 2004 to commence the process." 11. DTS-04-121 - DE-COMMISSIONING OF PRIVATE WATER WELLS The Committee considered Development and Technical Services Department report DTS-04- 121 dated July 29, 2004, regarding de-commissioning of private water wells. DEVELOPMENT & TECHNICAL SERVICES COMMITTEE MINUTES AUGUST 167 2004 - 72- CITY OF KITCHENER 11. DTS-04-121 - DE-COMMISSIONING OF PRIVATE WATER WELLS (CONT'D) J. Willmer advised that this is an update report and includes a request for Council's endorsement of staff's continued efforts in working with other stakeholders in the de-commissioning of abandoned wells. On motion by Councillor M. Galloway - it was resolved: "That Staff continue their efforts to put in place an effective inter-jurisdictional method/protocol to safeguard personal safety and the community's water supply through the prompt de-commissioning of abandoned water wells." 12. DTS-04-111 - KITCHENER GROWTH MANAGEMENT DISCUSSION PAPER 13. The Committee considered Development and Technical Services Department report DTS-04- 111 dated August 11,2004, regarding the Kitchener Growth Management discussion paper. J. Willmer provided a presentation on the report which is a starting point to generate discussion on a strategy to manage growth within the City of Kitchener. Through his presentation, Mr. Willmer advised that the current practice for development was primarily Greenfield development although the preferred method of growth should be a balance of Greenfield and re-urbanization development. He pointed out that the City will reach the countryside line in 20-30 years which will either end any further Greenfield development or initiate the option of extending the countryside line further, adding to urban sprawl and the negative effect this has on the community. Mr. Willmer advised that the goal of developing a growth management strategy was to ensure the best use of limited supply of Greenfield land and to encourage positive re-urbanization through infilling, intensification and adaptive re-use of various properties. Mr. Willmer concluded his presentation advising that a further discussion paper will be presented to the Committee in advance of the next Staging of Development report, quantifying the current supply of designated land and lots in context of past consumption rates. On motion by Mayor C. Zehr - it was resolved: "That Development and Technical Services Department report DTS-04-111 titled Kitchener Growth Management Discussion Paper be received for information." DTS-04-117 - A GROWTH PLAN FOR THE GREATER GOLDEN HORSESHOE KITCHENER RESPONSE - PRELIMINARY REPORT The Committee considered Development and Technical Services Department report DTS-04- 117 dated August 5, 2004, regarding the Provincial discussion paper and growth plan for the Greater Golden Horseshoe, 'Places to Grow'. J. Given advised that the Province released a discussion paper on growth in the Greater Golden Horseshoe region and that staff have presented key elements of the paper to various Advisory Committees of Council for feedback. Ms. Given provided a presentation to the Committee on the discussion paper noting that the Province has identified four key strategic areas: where and how to grow; what critical infrastructure is needed; what do we need to protect; and, how will the strategy be implemented. The Province has identified future growth areas which include the Waterloo Region and provides objectives and outlines strategies to ensure proper and economic growth in the province. Ms. Given concluded her presentation advising that a final report from the Province regarding the discussion paper from the Province will be presented to the Committee on September 13, 2004 which will include recommendations with respect to the City's position on the paper. DEVELOPMENT & TECHNICAL SERVICES COMMITTEE MINUTES AUGUST 167 2004 - 73- CITY OF KITCHENER 13.DTS-04-117 - A GROWTH PLAN FOR THE GREATER GOLDEN HORSESHOE (CONT'D) On motion by Councillor G. Lorentz - it was resolved: "That staff be directed to prepare a staff response to Places to Growto be considered at the Development and Technical Services Committee meeting of September 13, 2004 and to continue to work with the advisory committee members who have formed a subcommittee; and further, That Council advise staff of any specific issues or questions around which staff should direct its efforts in the completion of the final submission to the Province on Places to Grow." 14. DTS-04-112 - PROVINCIAL PLANNING REFORM - KITCHENER RESPONSE The Committee considered Development and Technical Services Department report DTS-04- 112 dated August 12, 2004, regarding a Provincial discussion paper on Planning Reform. J. Willmer provided a review of the staff report which contains a summary, brief discussion and recommendations on each of the following three reform components of the Provincial discussion paper: Planning Act reform; the draft Provincial Policy Statement; and the Ontario Municipal Board (OMB) reform. Mr. Willmer highlighted the following issues from the report: · increased planning decision timelines which would increase the time that decision- makers have to review and make decisions on specific planning applications; · the appeal rights on urban growth boundary decisions which will ensure the municipality has the ability to determine their urban settlement boundaries by limiting OMB appeals in this matter. The intent is to limit urban expansion and allow it only where necessary and justified; · declaration of Provincial Interest which staff are recommending should be done in advance of an OMB hearing so as not to create a situation whereby OMB decisions are being made in anticipation of ministerial concerns rather than based on evidence at a hearing; · transition provisions for implementing Bill 26 (Planning Reforms) to ensure applications filed prior to the legislation being introduced or when Royal Assent is given, are dealt with fairly and consistently; · new implementation tools to assist municipalities in ensuring proper development including increasing parkland dedication and clear authority to require dedication of natural heritage resources; and, · reform of the OMB. J. Willmer concluded his presentation advising that the matters contained in the Provincial discussion paper have been discussed with various Advisory Committees of Council and it is being recommended that the staff report be endorsed and forwarded to the Province. On motion by Mayor C. Zehr - it was resolved: "That Development and Technical Services Department report DTS-04-112 be endorsed by Council and submitted to the Ministry of Municipal Affairs and Housing as the City of Kitchener response on the proposed Provincial Planning Reforms." 15.
