HomeMy WebLinkAboutCouncil Minutes - 2020-11-30 SSPECIAL COUNCIL MINUTES NOVEMBER 30, 2020 CITY OF KITCHENER A special electronic meeting of City Council was held in the Council Chamber at 5:46 p.m. this date, chaired by Mayor B. Vrbanovic with all members present. Notice of this meeting had been previously given to all members of Council by the City Clerk pursuant to Chapter 25 (Council Procedure) of the Municipal Code. OPERATING BUDGET — DIRECTION Moved by Councillor S. Davey Seconded by Councillor J. Gazzola "That staff be directed to report and/or take appropriate action on the following matters arising from the November 30, 2020 Special Finance and Corporate Services Committee meeting relative to the 2021 Operating budget, as outlined in the chart below: Division/Area Topic Action Provide additional information on the items included in $1.6M budget for General General Expense Expense — Other on page 0-16 of the agenda package. Kitchener Public Provide a revised budget to reflect what the Library impacts of elimination of fines would have on their overall 2021 Budget. FINANCIAL Provide a revised budget to reflect the PLANNING Centre in the impacts on the 2021 Budget if the CITS Square (CITS) does not commence operation until January 2022. Prepare an Issue paper outlining the Salary & Wages financial impacts of freezing increases for Council and non-union staff salaries for 2021. Winter Prepare an Issue paper outlining the costs Maintenance — of adding 25 more spots for the Working Sidewalk Snow Centre's community assisted snow Clearing clearing. Provide additional information on the City's INFRASTRUCTURE progress towards its road reconstruction SERVICES goals, specifically regarding number of Water kilometres that have been completed Infrastructure versus what was planned. Program (WIP) Provide information about how reductions in either Water or Sanitary could offset the planned increase in Stormwater Prepare an Issue paper outlining the TRANSPORTATION Traffic impacts of increasing the Small -Scale SERVICES Traffic Calming budget by 15%, 25%, and 50% WAIVE NOTICE OF MOTION Council was requested to waive notice and consider a Notice of Motion from Councillor C. Michaud regarding Bill 229, Protect, Support and Recover from COVID 19 Act - Schedule 6 - Conservation Authorities Act. Moved by Councillor C. Michaud Seconded by Councillor K. Galloway-Sealock SPECIAL COUNCIL MINUTES NOVEMBER 30, 2020 - 141 - CITY OF KITCHENER "That pursuant to Section 25.4.4 (f) of Chapter 25 (Council Procedure) of the Municipal Code, the requirement for Notice of Motion be waived to add a Notice of Motion from Councillor C. Michaud regarding Bill 229, Protect, Support and Recover from COVID 19 Act - Schedule 6 - Conservation Authorities Act." Carried by the required 2/3 of the Whole of Council. NOTICE OF MOTION - BILL 229, PROTECT, SUPPORT AND RECOVER FROM COVID 19 ACT - SCHEDULE 6 - CONSERVATION AUTHORITIES ACT. Council considered Councillor C. Michaud's Notice of Motion regarding Bill 229, Protect, Support and Recover from COVID 19 Act - Schedule 6 - Conservation Authorities Act. Moved by Councillor C. Michaud Seconded by Councillor M. Johnston "Whereas the Province has introduced Bill 229, Protect, Support and Recover from COVID 19 Act — Schedule 6 — Conservation Authorities Act; and, Whereas the Legislation introduces a number of substantial changes and new sections that will remove and/or significantly hinder the conservation authorities' role to manage watershed natural resources and ensure people and property are safe from natural hazards; and further, Whereas municipalities value and rely on the natural habitats and water resources within our jurisdiction for the health and well-being of residents; municipalities value and rely on the conservation authorities' critical role to mitigate the serious risks that natural hazards like flooding pose to people's lives and property; and municipalities value and rely on the conservation authorities' essential work to ensure safe drinking water. THEREFORE BE IT RESOLVED that the Province of Ontario work with conservation authorities and municipalities to address these concerns by repealing and/or amending Schedule 6 of Bill 229 and the changes to the Conservation Authorities Act and the Planning Act to address these concerns; that the Province of Ontario delay enactment of clauses affecting municipal concerns and provide at minimum an 18-24 month transition period so that changes can be appropriately incorporated into both municipal and conservation authority budgets; and, that the Province respect the conservation authority/municipal relationships; and further, That the Province embrace their long-standing partnership with the conservation authorities and provide them with the tools and financial resources they need to effectively implement their important watershed management role. BE IT FINALLY RESOLVED that this resolution and a copy of the Grand River Conservation Authority Report (GM -11-85) Proposed Amendments to the Conservation Authorities Act through Bill 229 be forwarded to the Premier, the Ministers of Environment, Conservation and Parks, Natural Resources and Forestry, Municipal Affairs and Housing, and Finance, the Association of Municipalities of Ontario and the Rural Ontario Municipal Association." Johnston "That leave be given the Mover and Seconder to introduce the following by-law for three readings and that the same be taken as read a first, second and third times, and finally be passed and numbered serially by the Clerk" a.
