Demolition of a detached garage
RECOMMENDATION:
Thatpursuant to Section 42 of the Ontario Heritage Act, Heritage Permit Application
HPA-2021-V-005 be approved to permit the demolition of an existing detached garage
on the property municipally addressed as 17 Park Street.
REPORT HIGHLIGHTS:
This report supports the delivery of core services.
BACKGROUND:
The Development Services Department is in receipt of Heritage Permit Application HPA-
2021-V-005 which is seeking permission to demolish an existing detached rear yard garage
on the property municipally addressed as 17 Park Street located within the Victoria Park
Area Heritage Conservation District.
REPORT:
The subject property is located on the south side of Park Street. The property is designated
under Part V of the Ontario Heritage Act and forms part of the Victoria Park Area Heritage
Conservation District (VPAHCD). The subject property is described in theVPAHCD Study
as “near original in appearance; a single-storey c. 1920 brown brick Berlin Vernacular
residence with an open front brick porch, and roof dormers, soffits and fascias with newer
metal trim”. It is further described as a “well conserved residence”.

The existing detached garage is not mentioned in the VPAHCD Study or Plan. The detached
garage ispartiallyvisible from Park Streetandis situated behind the rear building line of the
principal dwelling.

Proposed Demolition
In accordance with the Ontario Heritage Act, a heritage permit is required from the Council
of a municipality to demolish a building or structure on a designated property. This includes
the demolition of an accessory structure and Heritage Kitchener must be consulted.
The existing detached garage is constructed with aluminum siding over wood boards and
has an asphalt shingle hip roof. The exact construction date of the garage is not known.
The VPAHCD Plan contains policies and guidelines for demolition within the District. The
policies discourage demolition of original buildings and heritage attributes. While the
construction dateof the detached garage is not known, substantial changes have been
made to the structure over time. The applicant advises that the entire supporting corner
(right side) of the detached garage has been cut out and removed and that the garage door
was not able to close. The applicant is concerned about safety and liability concerns given
the current structural conditionof the garage. The applicant advises that these modifications
were made by a previous owner.

The property owner does not intend to replace the detached garage and advises that repairs
to the existing detached garage would be costly given its current structural state.
Heritage Planning Staff Comments
In reviewing the merits of the application, Heritage Planning staff note the following:
The subject property isdesignated under Part V of the Ontario Heritage Act and
located within the Victoria Park Area Heritage Conservation District;
The detached garagehas been modified substantially anddoes not contribute to the
heritage value of the property; and
The demolition of the detached garage will not detract from the character of the
subject property, theVPAHCD, or the integrity of the Park Street streetscape.
In accordance with the Heritage Permit Application form, the approval of an application
under the Ontario Heritage Act shall not be a waiver of any of the provisions of any by-law
of the City of Kitchener or legislation, including but not limited to, the requirements of the
Ontario Building Code and Zoning By-law. In this regard, staff confirm that a Building Permit
is required to demolish the existing detached garage.

Capital Budget – The recommendation has no impact on the Capital Budget.
Operating Budget – The recommendation has no impact on the Operating Budget.

the Heritage Kitchenercommittee meeting.
CONSULT – Heritage Kitchener has been consulted regarding the subject Heritage Permit
Application.
