Demolition of a detached garage
RECOMMENDATION:
Thatpursuant to Section 42 of the Ontario Heritage Act, Heritage Permit Application
HPA-2021-V-005 be approved to permit the demolition of an existing detached garage
on the property municipally addressed as 17 Park Street.
REPORT HIGHLIGHTS:
This report supports the delivery of core services.
BACKGROUND:
The Development Services Department is in receipt of Heritage Permit Application HPA-
2021-V-005 which is seeking permission to demolish an existing detached rear yard garage
on the property municipally addressed as 17 Park Street located within the Victoria Park
Area Heritage Conservation District.
REPORT:
The subject property is located on the south side of Park Street. The property is designated
under Part V of the Ontario Heritage Act and forms part of the Victoria Park Area Heritage
Conservation District (VPAHCD). The subject property is described in theVPAHCD Study
as “near original in appearance; a single-storey c. 1920 brown brick Berlin Vernacular
residence with an open front brick porch, and roof dormers, soffits and fascias with newer
metal trim”. It is further described as a “well conserved residence”.

The existing detached garage is not mentioned in the VPAHCD Study or Plan. The detached
garage ispartiallyvisible from Park Streetandis situated behind the rear building line of the
principal dwelling.

Proposed Demolition
In accordance with the Ontario Heritage Act, a heritage permit is required from the Council
of a municipality to demolish a building or structure on a designated property. This includes
the demolition of an accessory structure and Heritage Kitchener must be consulted.
The existing detached garage is constructed with aluminum siding over wood boards and
has an asphalt shingle hip roof. The exact construction date of the garage is not known.
The VPAHCD Plan contains policies and guidelines for demolition within the District. The
policies discourage demolition of original buildings and heritage attributes. While the
construction dateof the detached garage is not known, substantial changes have been
made to the structure over time. The applicant advises that the entire supporting corner
(right side) of the detached garage has been cut out and removed and that the garage door
was not able to close. The applicant is concerned about safety and liability concerns given
the current structural conditionof the garage. The applicant advises that these modifications
were made by a previous owner.

The property owner does not intend to replace the detached garage and advises that repairs
to the existing detached garage would be costly given its current structural state.
Heritage Planning Staff Comments
In reviewing the merits of the application, Heritage Planning staff note the following:
The subject property isdesignated under Part V of the Ontario Heritage Act and
located within the Victoria Park Area Heritage Conservation District;
The detached garagehas been modified substantially anddoes not contribute to the
heritage value of the property; and
The demolition of the detached garage will not detract from the character of the
subject property, theVPAHCD, or the integrity of the Park Street streetscape.
In accordance with the Heritage Permit Application form, the approval of an application
under the Ontario Heritage Act shall not be a waiver of any of the provisions of any by-law
of the City of Kitchener or legislation, including but not limited to, the requirements of the
Ontario Building Code and Zoning By-law. In this regard, staff confirm that a Building Permit
is required to demolish the existing detached garage.
STRATEGIC PLAN ALIGNMENT:
This report supports the delivery of core services.
FINANCIAL IMPLICATIONS:
Capital Budget – The recommendation has no impact on the Capital Budget.
Operating Budget – The recommendation has no impact on the Operating Budget.
COMMUNITY ENGAGEMENT:
INFORM – This report has been posted to the City’s website with the agenda in advance of
the Heritage Kitchenercommittee meeting.
CONSULT – Heritage Kitchener has been consulted regarding the subject Heritage Permit
Application.

Draft Scoped Cultural Heritage Evaluation Report & Heritage Impact
Assessment
The Planning Division is in receipt of a draft Cultural Heritage Evaluation Report (CHER)
and Heritage Impact Assessment (HIA) dated January 7, 2021 prepared by CHC Limited
regarding a proposal to sever the property municipally addressed as 43 Sheldon Avenue
North. The subject property is neither designated nor listed under the Ontario Heritage
Act but is identified on the former Heritage Kitchener Inventory of Historic Buildings as a
property of interest.
The applicant’s heritage consultant will attend the February 2, 2021 meeting of Heritage
Kitchener to present the draft CHER/HIA and answer any questions. Heritage Planning
staff will be seeking the committee’s input and comments which will be taken into
consideration as part of staff’s review of the CHER/HIA and the processing of related
Planning Act applications. A motion or recommendation to Council will not be required at
the February meeting.
A copy of the draft CHER/HIA is attached to this memo.

Background
On December 14, 2020, Kitchener City Council approved the protected downtown cycling grid, a
connected network of cycling infrastructure for all ages and abilities. It connects to popular trails
like the Iron Horse Trail, Spur Line Trail, and the Great Trail, creating a new way for people to
access all that downtown has to offer. More information can be found in the staff report:

A boulevard multi-use trail on Margaret Avenue (Victoria Street to Queen Street) will maintain the
grass boulevards and trees, as required by the Civic Centre Heritage Conservation District Plan.
Separated bike lanes on Joseph Street (Victoria Street to Queen Street) run parallel to the Victoria
Park Heritage Conservation District Plan.
Section 7.3.4 and Section 7.3.6 of the Civic Centre Neighbourhood Heritage Conservation District
Plan contain recommendations for street signage and street furniture in the district. Page 83 of
the Victoria Park Area Heritage Conservation District Plan contains guidelines and policies for
furniture and signage within the district.
City staff is seeking feedback from Heritage Kitchener on proposed street furnishings (i.e.
bike racks) for Civic Centre, as well as wayfinding signage that will be posted through Civic
District and Victoria Park neighbourhoods.
Wayfinding Signs
Wayfinding and network information help people make decisions about how to navigate and get
to desired destinations. The city’s wayfinding approach is to ensure the signs are predictable and
consistent with surrounding municipalities. There are three types of signs, which will become the
city-wide standard for cycling routes.

Advance Warning Signs
Provide notice in advance of a coming decision point.
Decision Making, Directional Signs
At a decision point, provides direction to select destinations through directional arrows, as well as
time to destination and amenities, such as transit, shopping, recreation, etc. Pedestrian
information will be added, where appropriate.
Bike Route Confirmation Signs
Provide confirmation, reassure people cycling of their direction, and confirm additional
destinations reached along the route.
Note: regulatory signage will also be installed, as directed by the Ontario Traffic Manual. On
Margaret Avenue specifically, this includes Rb-71 Shared Pathway, Rb-1 40 km/h Speed Limit,
Rb-51 No Parking and Rb-73 Bikes Yield to Pedestrians.

Street Furniture
Bike racks are proposed next to a new bus shelter on Margaret Avenue near Victoria Street, as
well as on Joseph, Cedar and Water streets. Known as “Inverted-Us”, the bike racks provide two
points of contact for a bike to lean against while locked up.
