MINUTES OF THE REGULAR MEETING HELD FEBRUARY 25, 1997
MEMBERS PRESENT:

This meeting of the Committee of Adjustment as a Standing Committee of City Council was called to
consider applications regarding variances to Chapter 680 of the City of Kitchener Municipal Code. The
Committee will not make a decision on this application but rather will make a recommendation which will
be forwarded to Committee of the Whole and Council for final decision.

The Committee was advised that the applicant is requesting permission to erect a pylon sign accessory to
this legal non-conforming business. The sign would be erected within the fenced area. Currently this
property is zoned residential and pylon signs are not permitted in a residential zone.
The Committee noted the comments of the Department of Planning & Development in which they advised
that the applicant is requesting permission to erect a pylon sign accessory to this legal non-conforming
business. The sign would be erected within the fenced area. Currently, the lands upon which the sign
will be placed is zoned residential and pylon signs are not permitted.
An Application for Minor Variance was submitted in March of 1987 for extension to a legal non-
conforming industrial use. This was refused because at that time there was no proof of legal non-
conformity. In late 1994 Statutory Declarations were submitted by the applicant's solicitor in order to
confirm legal non-conforming status. The City's solicitor required an additional declaration and to date
has not received this information. Staff can therefore not render an opinion at this time with respect to the
requested variance.
Staff recommend that this application be deferred to the meeting of March 25, 1997 in order for the
applicant to satisfy the requirements of the City in determining the legality of the use.
COMMITTEE OF ADJUSTMENT 2 FEBRUARY 25, 1997
The Committee noted the comments of Ms. E. Caston, Senior Resources Planner, Grand River
Conservation Authority in which he advised that the Authority has no objection to the erection of a pylon
sign, subject to the issuance of a Fill, Construction and Alteration To Waterways Permit from the Authority
for any Construction located within the floodplain.
The Committee noted the comments of the Traffic & Parking Division in which they advised that they have
no concerns with the proposed sign location.
The Committee noted the written submission of Ms. K. Rees & Mr. J. Brenner in which they advised that
they are not opposed to the sign, provided it is no higher than 19 ft. and no wider than 8 ft.; it is erected
within the fenced area; it is not externally lit and it has no flashing or running lights.
Based on the comments of the Department of Planning & Development the Committee agreed to defer
consideration of this application to the meeting to be held on Tuesday, March 25, 1997.
