Campbell and Messrs. W. Dahms, S. Kay. OFFICIALS PRESENT: Ms. J. Given, Senior Planner, Mr. R. Morgan, Co-ordinator Zoning Administration, and Ms. D. H. Gilchrist, Secretary-Treasurer. Mr. W. Dahms, Chair, called the meeting to order at 9:40 a.m. This meeting of the Committee of Adjustment as a Standing Committee of City Council was called to consider applications regarding variances to Chapter 680 of the City of Kitchener Municipal Code. The Committee will not make a decision on this application but rather will make a recommendation which will be forwarded to Committee of the Whole and Council for final decision. Farwell 115 Turnbull Court Cambridge, Ontario CONTRA: NONE WRITTEN SUBMISSIONS: IN SUPPORT: NONE CONTRA: NONE The Committee was advised the applicant is requesting permission to erect a ground sign, having a height of 2.01 m (6.6 ft.) rather than the permitted 1.5 m (5 ft.), to be located 0.35 m (1.15 ft.) from the Iotline along Fischer-Hallman Road rather than the required 3 m (9.85 ft.). The Committee considered the comments of the Department of Planning & Development in which they advised that the applicant is requesting permission to erect a ground sign having a height of 2.01 m (6.6 ft.) rather than the permitted 1.5 m to be located 0.35 m (1.15 ft.) from the lot line along fischer-hallman Road rather than the required 3 m (9.85 ft.). The applicant wishes to erect the permanent ground sign at the requested location as it would be more aesthetic than a mobile sign. The proposed sign will have a changeable 3-line readerboard located on each of the two faces. Staff note that the sign cannot be placed the minimum 3 m back from the front lot line as this would place the sign in the parking area. The requested setback abuts the front lot line and offers the best visibility to passing traffic for the sign and its readerboard as Fischer-Hallman Road is a primary arterial road and accommodates high volumes of traffic. COMMITTEE OF ADJUSTMENT 6 MARCH 31, 1998 The intent of the regulations regarding the 3 m setback and the 1.5 m height restriction is to ensure that a ground sign will not pose a visibility concern or distraction for passing traffic or for traffic entering and exiting the facility. 1. Submission No. S 2/98 - Mikron Properties/Michael Wineberq, cont'd The sign is to be located in the southeast corner of the property at a distance of a least 50 m (164 ft.) from the nearest driveway entrance. In this regard it would not cause a visibility concern for traffic entering and exiting the property. It is noted that the neighbouring plaza does not have driveway access onto Fischer- Hallman Road. The requested height of 2.01 m (6.6 ft.) would not be considered excessive when considering the size of the property, which has a frontage along Fischer-Hallman Road of 178 m (584 ft.). Additionally, the city- owned boulevard adjacent to the Fischer-hallman property line provides a buffer of approximately 21 m to the actual paved portion of street. Staff would like to comment that the landscape plan for the subject property will be affected by the placement of the sign. The applicant is advised that he will be required to revise the landscape plan to the satisfaction of the City's Landscape Architect. Based on the above comments, the variance maintains the general intent and purpose of the sign by-law. Staff are also of the opinion that the requested sign variance is appropriate development and use of the land. The Department of Planning and Development recommends approval of the variance as shown on the drawings submitted with the application, conditional upon the landscape plan being revised prior to the sign permit being issued. The Committee noted the comments of the Engineering Department, Region of Waterloo, in which they advised that they have no concerns with this application. The Committee noted the comments of the Traffic & Parking Division in which they advised that the Division has no traffic operation concerns with the proposed sign location. Moved by Mr. S. Kay Seconded by Ms. S. Campbell That the application of Mikron Properties/Michael Wineberg requesting permission to erect a ground sign having a height of 2.01 m (6.6 ft.) rather than the permitted 1.5 m (5 ft.) to be located 0.35 m (1.15 ft.) from the Iotline along Fischer-Hallman Road rather than the required 3 m (9.85 ft.) on Part 1, Reference Plan 58R-5148, 851 Fischer-Hallman Road, Kitchener, Ontario BE APPROVED subject to the following condition: That the landscaping plan for the subject property shall be revised prior to the sign permit being issued. It is the opinion of this Committee that: 1. The variances approved in this application are minor in nature. 2. This application is desirable for the appropriate development of the property. The general intent and purpose of the City of Kitchener Municipal Code Chapter 680 (Signs) is being maintained on the subject property. Carried The Chairman advised those in attendance that consideration of this recommendation, by City Council, will take place at their meeting schedule for Tuesday April 14, 1998, commencing at 7:00 p.m. and they may attend if they wish.
