Dahms, A. Galloway and Ms. S. Campbell. OFFICIALS PRESENT: Mr. L. Masseo, Intermediate Planner, Ms. J. Billett, Committee Administrator and Ms. D. H. Gilchrist, Secretary. Mr. W. Dahms, Chairman, called the meeting to order at 10:10 a.m. This meeting of the Committee of Adjustment as a Standing Committee of City Council was called to consider applications regarding variances to Chapter 680 of the City of Kitchener Municipal Code. The Committee will not make a decision on this application but rather will make a recommendation which will be forwarded to Committee of the Whole and Council for final decision. The Chairman explained that this Committee's decision with respect to sign variances is a recommendation to City Council and not a final decision. He advised that the Committee's recommendations will be forwarded to City Council on Monday March 29, 1999 at 7:00 p.m. and they may appear at the meeting if they wish. He also advised that if they wish to appear as a delegation they must register with the Clerk. APPLICATIONS Submission No. S 3/99 - Heffner Toyota Limited, 3131 King Street East, Kitchener, Ontario Re: Lot 27, Part of Lot 32 and 33, Registered Plan 986, 3131 King Street East, Kitchener, Ontario. Hennebry National Sign & Awning Group 2880 King Street East, Suite D Kitchener, Ontario Contra: None Written Submissions: In Support: None Contra: None The Committee was advised that the applicant is requesting permission to erect a pylon sign 0 m from the property line along King Street rather than the required 0.4 m (1.32 ft.) The Committee noted the comments of the Department of Business & Planning Services in which they advised that the applicant is requesting permission to erect a pylon sign 0 m from the front lot line along King Street rather than the permitted 0.4 m (1.32 ft.). A pylon sign is defined as a free-standing sign which is anchored in the ground and which has its sign face at least 2.44 m (8 ft.) above finished grade. Additionally, the by-law COMMITTEE OF ADJUSTMENT 9 MARCH 9, 1999 1. Submission No. S 3/99 - Heffner Toyota Limited, Cont'd states that the pylon sign must be set back a minimum distance of 0.4 m (16 inches) from any lot line. The intent of this regulation is to allow for unobstructed vehicular ingress and egress to the commercial site. It is noted that a previous variance submission, S 15/90, was approved for another pylon sign set 0 m from the King Street lot line. The subject pylon sign will be approximately 20 m (65.5 ft.) from the existing pylon sign, which meets the distance separation requirement in the Sign By-law. The proposed sign has a total width of 2.4 m (7.9 ft.) and will be placed perpendicular to the street line. The sign will be located in the landscaped area between the parking lot and the street line along King Street East. The proposed 0 m setback will place the sign 0.6 m from the parking lot, which meets the minimum setback required for a pylon sign with a clearance less than 4.3 m (14.1 ft.). It is noted that the sign will be at least 9 m (29.5 ft.) from the travelled portion of King Street. Additionally, the proposed location of the sign is 2.4 m (7.9 ft.) from a driveway leading into the subject commercial property. The staff of the Traffic Division has concerns with the sign's location in relation to the driveway. They would like to have the sign outside a 4 m corner visibility triangle formed by the street line and the driveway. In discussion with the applicant, he had agreed to amend this variance to relocate the proposed sign 4 m (13.1 ft.) from the driveway. Consequently, the amended location would not pose a visibility concern. The sign complies with all other regulations of the Sign By-law. Based on the above comments, staff are of the opinion that the requested variance is minor in nature , meets the intent of the Sign By-law and is considered appropriate development for the commercial use of the property. The Department recommends approval of the variance, as amended, to locate the sign 4 m from the driveway. The Committee noted the comments of the Transportation Division, Engineering Department, Region of Waterloo, in which they advised that they have no concerns with this application. The Committee noted the comments of the Transportation Division, Traffic & Parking, in which they advised that the Division has reviewed the application and have no concerns with the proposed variance in the distance the sign will be from the property line. They would; however, require that the sign be located outside the 4.57 m driveway visibility corner. The Chair reviewed the staff comments with Mr. Hennebry, specifically the requested amendment for a 4 m setback from the driveway and Mr. Hennebry asked for an amendment to his application and advised that the sign would be setback at least 4 m from the driveway. Moved by Mr. A. Galloway Seconded by Ms. S. Campbell That the application of Heffner Toyota Limited requesting permission to erect a pylon sign 0 m from the property line along King Street rather than the required 0.4 m (1.32 ft.) on Lot 27 and Part Lots 32 & 33, Registered Plan 986, 3131 King Street East, Kitchener, Ontario BE APPROVED, subject to the following condition: That the proposed new pylon sign shall be located a minimum of 4 m from the driveway on the King Street frontage of the property. The variance approved in this application is minor in nature. 2. This application is desirable for the appropriate development of the property. 3. The general intent and purpose of the City of Kitchener Municipal Code Chapter 680 (Signs) is being maintained on the subject property.
