B. Dahms, A. Galloway and P. Kruse. OFFICIALS PRESENT: Ms. D. Ross, Region of Waterloo, Ms. J. Given, Principal Planner and Ms. J. Billett, Secretary-Treasurer. Mr. B. Dahms, Chair, called the meeting to order at 10:15 a.m. This meeting of the Committee of Adjustment as a Standing Committee of City Council was called to consider applications regarding variances to Chapter 680 (Signs) of the City of Kitchener Municipal Code. The Committee will not make a decision on these applications but rather will make a recommendation which will be forwarded to the Committee of the Whole and Council for final decision. The Chair explained that this Committee's decisions with respect to sign variances are recommendations to City Council and not a final decision. He advised that the Committee's recommendations will be forwarded to City Council on Monday, January 17, 2000 at 7:00 p.m. and the applicant may register with the City Clerk to appear at the meeting if desired. Dahms declared a pecuniary interest in this application, as his law firm represents the applicant, and did not participate in any discussion or voting with respect to this application. Mr. A. Galloway Chaired the meeting during consideration of this application and, pursuant to the Municipal Conflict of Interest Act, the application was considered by the remaining two members. The Committee was advised that the applicant is requesting permission to construct a sign at the northwest corner of the subject property, having an area of 4.68 m2 (50.37 sq. ft.), rather than the permitted 4 m2 (43.05 sq. ft.). Submission No.: SG 2000-001(Cont'd) The Committee noted the comments of the Department of Business & Planning Services in which they advised that the applicant requests permission to construct a ground sign with a sign area of 4.68 square metres (50.37 square feet) rather than the permitted 4 square metres (43.05 square feet). It is noted that a sign drawing was not submitted with the original application for this variance. The applicant faxed a copy of the sign drawing at a later date (copy attached). After reviewing the drawing staff note that one additional variance would be required to accommodate the desired sign. It is recommended that this application be amended to request an additional variance for a ground sign with a height of approximately 2.7 metres (8.8 feet) rather than the permitted maximum of 1.5 metres (4.92 feet). The applicant wishes to construct a sign large enough to complement the building on the property and to provide adequate visibility to passing vehicular traffic. The intent of the Sign By-law in limiting the size and area of ground signs is to ensure that the signs are not a visibility concern or distraction to passing vehicular traffic. Staff of the Traffic Division has no concerns regarding visibility of the proposed sign, therefore meeting the intent of the by-law. It is noted that a sign of this size is appropriate considering the location and size of the property (26,431 square metres). Its location at the intersection of a collector and arterial road offers the property clear visibility from a traffic perspective. The property is across from a major institutional site and separated from the residential properties to the west by an Arterial Road and a berm, thereby not visually impacting a residential streetscape. Accordingly, the application is deemed to be minor in nature, maintains the intent of the Sign By- law and is considered appropriate development for institutional use of the property. The Department of Business and Planning Services recommends approval of the minor variance as amended to permit a height of 2.7 metres and as shown on the drawing submitted by the applicant. The Committee noted the comments of the Director of Building in which he advised that the Building Division has no concerns or comments with respect to this application. The Committee noted the comments of the Traffic & Project Co-ordinator in which he advised that the Traffic & Parking Division has reviewed this application and has no concerns with the location of the proposed sign. The Committee noted the comments of the Grand River Conservation Authority in which they advised that they have no objection to this application. The Chair reviewed the staff comments, noting that staff are recommending approval of the variance subject to the application being amended to permit a height of 2.7 m, as shown on the drawing submitted by the applicant. The Chair enquired if Mr. Reinders was in agreement with the requested amendment and Mr. G. Reinders concurred. The Chair enquired if Mr. Reinders had anything further to add and Mr. Reinder responded that he did not. Moved by Mr. P. Kruse Seconded by Mr. A. Galloway That the application of The Salvation Army requesting permission to construct a sign at the northwest corner of the subject property, having a height of 2.7 m (8.85 ft.), rather than the permitted maximum of 1.5 m (4.92 ft.) and having an area of 4.68 m2 (50.37 sq. ft.), rather than the permitted 4 m2 (43.05 sq. ft.), on Block 129, Plan 1819, 75 Tillsley Drive, Kitchener, Ontario, BE APPROVED, subject to the following condition: COMMITTEE OF ADJUSTMENT 3 JANUARY 11, 2000 1. Submission No.: SG 2000-001(Cont'd) 1. That the variances as approved in this application shall apply only in accordance with the drawings submitted by the applicant. It is the opinion of this Committee that: 1. The variances approved in this application are minor in nature. 2. This application is desirable for the appropriate development of the property. 3. The general intent and purpose of the City of Kitchener Municipal Code Chapter 680 (Signs) is being maintained on the subject property. Carried The Chair pointed out to Mr. Reinders that the decision of the Committee is a recommendation to Council, which will be considered at the Council meeting of January 17, 2000, at 7:00 p.m., in the Council Chamber and advised that he may register as a delegation to appear before Council at that time.
