HomeMy WebLinkAboutAdjustment - 2000-12-12 SIGCOA\2000-12-12-SIGN COMMITTEE OF ADJUSTMENT FOR THE CITY OF KITCHENER MINUTES OF THE REGULAR MEETING HELD DECEMBER 12, 2000 MEMBERS PRESENT: Messrs. P. Britton, D. Cybalski and B. Isaac. OFFICIALS PRESENT: Ms. J. Given, Principal Planner and Ms. J. Billett, Secretary-Treasurer. Mr. P. Britton, Acting Chair, called this meeting to order at 10:05 a.m. This meeting of the Committee of Adjustment sitting as a Standing Committee of City Council was called to consider applications regarding variances to Chapter 680 (Signs) of the City of Kitchener Municipal Code. The Committee will not make a decision on this application but rather will make a recommendation which will be forwarded to the Committee of the Whole and Council for final decision. The Chair explained that the Committee's decisions with respect to fence variances are recommendations to City Council and not a final decision. He advised that the Committee's recommendations will be forwarded to City Council on Monday, December 18, 2000, at 7:00 p.m., and the applicants may register with the City Clerk to appear at the meeting if desired. Dahle Eastern Synod Evangelical Lutheran Church in Canada 74 Weber Street West Kitchener ON N2H 3Z3 Contra: None Written Submissions: In Support: None Contra: None The Committee was advised that the lands involved in this application consist of an existing 2 storey building used as an office for the Eastern Synod Church. The applicant is proposing to install an illuminated ground sign having a frontyard setback of 0.14 m (0.46 ft.), rather than the required 3 m (9.84 ft.). The Committee noted the comments of the Department of Business & Planning Services in which they advised that the front yard of the property has been significantly reduced due to a Regional Road Widening of approximately 4 m (13 ft.). The road widening has left the property with a 1.92 m (6.3 ft.) front yard setback, which makes it impossible to meet the required setback for the sign. Submission No.: SG 2000-013 (Cont'd) The access from Weber Street on the westerly side of the property, and the proposed location of the sign with a 0.14 m (0.46 ft.) setback will not impede visibility for pedestrians or vehicular movements to and from the site as the location is outside of the required 4.5 m (14.76 ft.) visibility corner. The sign is appropriate for the property and the variance in this case can be considered minor in nature. The location of the proposed sign will maintain the intent of the Sign By-law and Municipal Plan in as much that there will be no impact on visibility for pedestrians or vehicular traffic. The Department of Business and Planning Services recommends approval of Submission SG 2000-013. The Committee noted the comments of the Director of Building in which he advised that the Building Division has no concerns or comments with respect to this application. The Committee noted the comments of the Traffic & Parking Anaylst in which he advised that the Traffic & Parking Division has reviewed this application and has no concerns with the location of the proposed sign. The Committee noted the comments of the Planning & Culture Department, Region of Waterloo in which they advised that Regional staff have reviewed the application and have no concerns. The Committee noted the comments of the Grand River Conservation Authority in which they advised that they have no objection to this application. The Chair reviewed the staff comments, noting that staff are recommending approval of the application and enquired if Rev. Dahle had anything further to add. Rev. G. Dahle advised that he had reviewed the staff reports and had nothing further to add. As there were no further questions or comments forthcoming, the Chair called for a motion. Moved by Mr. D. Cybalski Seconded by Mr. B. Isaac That the application of the Eastern Synod Evangelical Church in Canada requesting permission to install an illuminated ground sign having a frontyard setback of 0.14 m (0.46 ft.), rather than the required 3 m (9.84 ft.), on Part of Lot 7, Registered Plan 401, 74 Weber Street West, Kitchener, Ontario, BE APPROVED. It is the opinion of this Committee that: 1. The variance approved in this application is minor in nature. 2. This application is desirable for the appropriate development of the property. The general intent and purpose of the City of Kitchener Municipal Code Chapter 680 (Signs) is being maintained on the subject property.
