BY-LAWS AS LISTED ON THE AGENDA - 2ND READING It was resolved: "That the by-laws considered by this Committee be taken as read a second time and be recommended for enactment." Alderman B.M. Hiscott disclosed a conflict of interest and abstention with respect to the following properties, namely: Assessment Roll No. 6-11-066-00 - Bob Kieswetter Assessment Roll No. 6-11-070-01 - Select Sand & Gravel Ltd. Assessment Roll No. 6-11-079-01 - B & B Kieswetter Excavating Inc. Alderman Hiscott advised that these properties relate to clients of his who have an interest in the aggregate industry. B. REPORT OF THE CHIEF ADMINISTRATIVE OFFICER 1. Freeport Hospital - Art Auction It was resolved: "That the $1.00 Charitable Organization licence fees apply to the Hawkers and Pedlars and Auctioneer's licences required by the Freeport Hospital Volunteer Services for their Art Auction to be held on May 10, 1989." 2. Execution of Agreement - 55+ Personnel Placement It was resolved: "That the Mayor and Clerk be authorized to execute an Agreement with Her Majesty the Queen in right of Canada represented by the Minister of Supply and Services respecting 55+ Personnel Place- ment under the Outreach Program." 3. Variance to Sign By-law - WEST WARD This item was dealt with under Delegations. 4. Consent to Mortgage and Transfer of Industrial Land - FAIRVIEW WARD It was resolved: "That the City of Kitchener consents to a mortgage from 667927 Ontario Limited to 448840 Ontario Limited, 742914 Ontario Limited and Debbie Nagy and further to a transfer from 448840 Ontario Limited and 742914 Ontario Limited to 742914 Ontario Limited, with respect to the property designated as Part 2 on Reference Plan 58R-5418 and municipally known as 64 Shoemaker Street, Kitchener." 5. CTA Applications It was resolved: "That the Mayor and Clerk be authorized to execute a Consent and Waiver of Notice and Draft Plan to expedite a Certificate of Titles Act Application by Credit Mountain Land Co. Limited with respect to lands located on the southwest corner of Fergus Avenue and Rutherford Drive, Lot 20 and Part of Lot 21, Registered Plan 742 in the City of Kitchener." - and - COMMITTEE OF THE WHOI,E M]NIXPES FEBRUARY ~7, 1989 B. CTA Applications (Cont'd) "That the Mayor and Clerk be authorized to execute a Consent and Waiver of Notice and Draft Plan to expedite a Certificate of Titles Act Application by Elvira Andres, Juan Andres, Vada Seeds and James Seeds with respect to lands located east of Homer Watson Boulevard, Part Lot 1, Registrars Compiled Plan 1482 in the City of Kitchener." - and - "That the Mayor and Clerk be authorized to execute a Consent and Waiver of Notice and Draft Plan to expedite a Certificate of Titles Act Application by Twingate Construction with respect to lands fronting on McBrine Place, municipally known as 108 McBrine Place, Part of Lot 14, Registrar's Compiled Plan 1471 in the City of Kitchener." 6. Easement - WEST WARD It was resolved: "That the Corporation of the City of Kitchener grant an easement to The Hydro Electric Commission of Kitchener-Wilmot over Part of Lots 33 and 34, German Company Tract, designated as Parts 4 and 5 on Reference Plan 58R-6143 for utility purposes, and further that the Mayor and Clerk be authorized to execute all necessary documentation." 7. Raffle Lottery It was resolved: "That the City of Kitchener has no objection to a Provincial licence being issued to the C.A.W. - Freeport Hospital Health Care Village Committee to conduct a Raffle Lottery on June 23, 1989 at Lulu's Roadhouse, 4263 King Street East, Kitchener, for the purpose of raising funds for the Freeport Hospital Health Care Village." 8. Drainaqe Problem - SOUTH WARD This item was dealt with under Delegations. 9. Road Salt As requested by City Council at its meeting of February 13, 1989, a report was provided by the Director of Operations which sets out the amount of road salt used over the last 4 years and provides background information concerning Council's procedures for salt distribution. Alderman Zehr commented that, notwithstanding the information and procedures set out in the report, he has personally come across excess road salt on City streets. He suggested that staff investi- gate as to whether there has been a change in policy at the operational level of the Department. Alderman Hiscott also commented that he has noticed an excess amount of salt on dry roads. Alderman Ziegler stated that contrary to the procedures set out, it was his view that salt was being placed on roadways prior to commencement of a storm. Following further discussion, it was agreed that individuals members of Council would advise the Commissioner of Public Works of streets that they were aware of where there has been a problem of excess salt being dispensed. Amendment - Consolidated Binqo Requlations It was resolved: "That the City of Kitchener Consolidated Bingo Regulations passed by City Council July 18, 1983, as amended, be further amended by adding the following section thereto; namely: Share the Wealth The aggregate amount of prizes offered or given in all share the wealth games played on a single occasion under the authority of a City of Kitchener bingo licence shall not exceed 15% of the overall licensed prize money for the event." 11. Various Tenders Following discussion, it was requested that, in future, information be provided in the staff report with respect to the amount budgeted for consideration in comparison with the tendered price being recommended. With regard to Tender T89-7 for elevator maintenance and repair, Mr. Clement indicated that he would provide members of Council with information on the amount budgeted for this item in the current budget. Mr. Clement responded to questions with respect to quotation Q89-27 for a Perfector Printing Press and noted that while the press was slightly over the budgeted cost there was a small net saving in the purchase of the press in conjunction with a drill. It was resolved: "That tender T89-7, Elevator Maintenance and Repair, be awarded to Otis Canada Inc., Hamilton, Ontario at their tendered price of $62,316.96." - and - "That quotation Q89-27, Perfector Printing Press, be awarded to A.M. International, Burlington at their quoted price of $56,700." 12. Attendance at Special Meetinq of Association of Municipalities of Ontario - March 30, 1989 It was resolved: "That at least the following individuals be registered to attend the Special Meeting of the Association of Municipalities of Ontario to be held on March 30, 1989, in Toronto, Ontario: Mayor Dominic V.P. Cardillo, Alderman C. Zehr, Chairman of the Finance Committee, Alderman B. Stortz, Alderman C. Weylie, the Chief Administrative Officer and the City Treasurer." 13. Report of Coliform Detection in Kitchener's Water Distribution System The Committee considered a report dated February 22, 1989, from Mr. E. Kovacs on the detection of coliforms in Kitchener drinking water during the period of February 1-8, 1989 and recommendations with regard to reporting requirements that would avoid a similar occurrence in future. Alderman Leadston suggested that in any similar future situation or perceived situation, Council should be formally notified by staff and the Mayor consider calling a special Council meeting, if necessary, to fully inform all members of Council. Alderman Leadston recommended to Mr. Kovacs that these suggestions be incorporated within the emergency protocol manual referred to in the recommendations. REPORT OF THE CHIEF ADMINISTRATIVE OFFICER (Cont'd) System (Cont'd) with a map of all wells for his information and questioned when chlorine would be eliminated from the water system. Mr. Kovacs advised that the Medical Officer of Health imposed the order to chlorinate the water supply and that following the analysis of readings that are expected to be complete by February 28th, he would advise the Medical Officer of Health. If the results are favourable, the order to chlorinate would likely be lifted by the Medical Officer of Health. Mr. Kovacs alerted members of Council of the effect that chlorination has on existing iron and manganese in the water supply by speeding up chemical processes and causing water discolouration similar to the reports of occurrences in the municipality last year. It was resolved: "1. That we curtail use of the Ministry of the Environment from the testing and reporting protocol for the municipal water distribution system. 2. That starting immediately the Ministry of Health regional laboratories in London perform all microbiological analysis of samples from Kitchener's water distribution system. 3. That "verbal" reporting be eliminated with Fax machines, combined with verbal confirmation procedures. 4. That a comprehensive co-ordinated emergency protocol manual among all affected organizations be developed. 5. That the number of sampling locations throughout the water distribution system be redistributed and expanded. 6. That daily sampling and monitoring be implemented immediately. 7. That an addition to staff be recruited to accommodate additional sampling. 8. That authorities of the Regional Municipality of Waterloo be requested to immediately curtail chlorination of Greenbrook and Strange reservoir supplies until the Regional Municipal of Waterloo successfully completes facilities that will either reduce concentrations of iron and manganese to levels that comply with Ontario Drinking Water Standards, or until sequestration prevents post precipitation of iron and manganese in the distribution system. Further, that in the interim, chlorination is to be undertaken only upon the directive of the Medical Offices of Health. 9. That the question of future chlorination of the water supply to and throughout Kitchener's distribution system be deferred until such time as the iron and manganese concentrations are under control." 14. Applications for Cancellation, Refund, Reduction or Levy of Tax - First Sittinq 1989 Conflicts of interest and abstention were disclosed by Alderman J. Ziegler with respect to Applications 142 and 143 and by Alderman C. Zehr with respect to Applications 114 and 115. Alderman Ziegler vacated the Chair in favour of Alderman Ferguson who called for a vote on this matter. It was resolved: "That the applications attached hereto and forming part of these minutes relative to cancellation, reduction, refund or levy of taxes be disposed of as recommended therein." Applications for Cancellation, Refund, Reduction or Levy of Tax - First Sittinq 1989 (Cont'd) Alderman J. Ziegler disclosed a conflict of interest and abstained from voting with respect to Applications 142 and 143 as the applicant is one of his clients. Alderman C. Zehr disclosed a conflict of interest and abstained from voting with respect to Applications 114 and 115 as his brother is the manager of the subject business. 15. Quit Claim Deed - Franz & Rosina Rimpf - 46 Ellen Street West The Committee considered a memorandum dated February 24, 1989, from Mr. J. Wallace recommending execution of a Quit Claim Deed in favour of Franz and Rosina Rimpf of 46 Ellen Street West. These owners have had long time adverse possession of the subject triangle parcel of land and have requested the City to quit claim its interest in the lands. It was resolved: "That the Mayor and Clerk be authorized to execute a Quit Claim Deed as prepared by the City Solicitor in favour of Franz Rimpf and Rosina Rimpf of 46 Ellen Street West for a triangular parcel of land at the intersection of an adjacent open lane with Ellen Street West provided that the Rimpfs be responsible for the preparation of a Reference Plan at their cost." 16. 360006 Ontario Limited Lease to Ontario Professional Disc Jockey Services Ltd.; Lease to 678942 Ontario Inc. and Lease to Ulmer Developments Limited - Huron Business Park - 330 Trillium Drive The Committee considered a memorandum dated February 27, 1989, from Mr. J. Shivas recommending that the City consent to various leases with regard to the lands known municipally as 330 Trillium Drive. It was resolved: "That the City of Kitchener consent to a lease from 360006 Ontario Limited to Ontario Professional Disc Jockey Services Ltd.; a lease to 678942 Ontario Inc. and a lease to Ulmer Developments Limited for space at the property described as Part 4, Plan 58R-5010 and Part 5, Plan 58R-5151 and municipally known as 330 Trillium Drive, Kitchener, subject to applying for and obtaining occupancy certificates and sign permits." 17. Berkshire Buildinq Corporation Lease to Lenox Polymer Limited; Lease to lES Business Products Inc. and Lease to Berkshire Buildinq Cor- poration - Huron Business Park - 500 Trillium Drive The Committee considered a memorandum dated February 27, 1989, from Mr. J. Shivas recommending that the City consent to a number of leases with regard to the lands known municipally as 500 Trillium Drive. It was resolved: "That the City of Kitchener consent to a lease from Berkshire Building Corporation to Lenox Polymer Limited; a lease to lES Business Products Inc. and a lease to Berkshire Building Corporation for space at the property described as Part 14 on Reference Plan 58R-5566 and municipally known as 500 Trillium Drive, Kitchener, subject to applying for and obtaining occupancy certificates." Execution of Enqineerinq Aqreement The Committee was in receipt of a memorandum dated February 23, 1989, requesting that an engineering agreement submitted by Wright- Dietrich Limited with respect to the Westchester Drive Extension, Hallman Idlewood Limited, be executed with the City. It was resolved: "That the Mayor and Clerk be authorized to execute an agreement for the provision of professional engineering services made between the City of Kitchener and Wright-Dietrich Limited regarding Westchester Drive Extension, Hallman Idlewood Limited."
