B. REPORT OF THE CHIEF ADMINISTRATIVE OFFICER 1. Walkway Fencinq - CHICOPEE WARD It was resolved: "That we accede to the requests of property owners residing at 51 and 54 Burnt Ember Court, 43 and 47 Coventry Drive, 46 and 50 Roehampton Court, 54 and 60 Chartwell Court and 39 and 42 Darlington Place to amend the requirement for fencing of the walkway, as set out on plans approved by the Department of Parks and Recreation, subject to the parties involved entering into an agreement to be registered on title, binding them, and future owners of the properties, to the terms of the registered agreement. Further, that the City Solicitor be authorized to prepare the necessary documentation associated therewith, and the parties involved pay all legal costs necessary for the preparation and registration of any documentation." 2. Encroachment - CHICOPEE WARD Alderman C. Zehr disclosed a conflict of interest and abstained from all voting and discussion on this issue as he is the affected property owner. It was resolved: "That a parcel of Prospect Park, approximately 133 square feet, be severed and conveyed to Carl and Joyce Zehr, the owners of the property municipally known as 35 Broadview Court, Kitchener, for a price to be determined by the City's Land Purchasing Officer, with all legal and survey costs to be paid by the purchasers." Alderman C. Zehr previously disclosed a conflict of interest and abstained from all voting and discussion on this issue as he is the affected property owner. 3. Lease Renewal - CENTRE WARD It was resolved: "That the City of Kitchener renew the five year licence of occupation with the Government of Canada for the lands surrounding the Canada Building, Duke Street, for the period June 1, 1989 to May 31, 1994." 4. Requests for Subsidy Allocations It was resolved: "That the Mayor and Clerk be authorized to execute Request No. 1 with the Ministry of Transportation for the allocation of subsidy for transportation for physically disabled persons for the year 1989 under the Public Transportation and Highway Improvement Act." Requests for Subsidy Allocations (Cont'd) "That the Mayor and Clerk be authorized to execute Request No. 1 with the Ministry of Transportation for the allocation of subsidy for public transportation for the year 1989 under the Public Transportation and Highway Improvement Act." 5. Master Proof of Loss It was resolved: "That the Mayor and Clerk be authorized to execute a Master Proof of Loss relating to damages totalling $5,762.78 sustained by a City vehicle in an incident on the Conestoga Parkway which occurred on or about December 24, 1988." 6. Raffle Lottery Licence It was resolved: "That the City of Kitchener has no objection to a Provincial Licence being issued to the Kitchener-Waterloo Oktoberfest Inc. to conduct a Raffle Lottery in the City of Kitchener, with the said draw to occur on November 21, 1989 at the Valhalla Inn." 7. Downtown Parkinq Study It was resolved: "That, in order to satisfy the terms of the Community Planning Grant 30-3-3 for the Downtown Parking Study, Kitchener Council requests the Community Planning Advisory Branch to extend the present deadline date for completion of the Study from April 28, 1989 to August 31, 1989." 8. Proposed Local Improvements - BRIDGEPORT NORTH WARD It was resolved: "That pursuant to the Local Improvement Act, and subject to the approval of the Ontario Municipal Board, Kitchener Council grant the petition of Mr. R. Calder, et al for concrete curb and gutter on both sides of Clifton Road from Arnold Street to 5.0 m. north of the north limit of Lot 41, Plan 466 on the east side and Lancaster Street on the west side." 9. Request to Erect Banner It was resolved: "That in conjunction with the month of May being declared Multiple Sclerosis month in Kitchener, the Waterloo Regional Chapter of the Multiple Sclerosis Society of Canada be granted permission to have a banner erected across King Street at Frederick Street from April 28, 1989 to May 31, 1989. Further, that this organization make the necessary arrangements with the Department of Parks and Recreation for the erection and removal of the banner and the payment of any costs associated therewith." 10. Proposed Reqional Headquarters Dealt with under Delegations. 11. City of Kitchener Ward System The Committee was in receipt of a report from Mr. R.W. City of Kitchener Ward System (Cont'd) It was resolved: "That consideration of possible changes to the ward boundaries in the City of Kitchener be deferred pending the outcome of a meeting between Council, appropriate City staff and Dr. R.J. Williams, Associate Professor, Department of Political Science, University of Waterloo." Mr. McKay suggested, and it was generally agreed, that a full day meeting would be scheduled in May or June of this year. He noted that Council would be circulated with respect to preferred meeting dates. 12. 1989 Road Proqram The Committee was in receipt of a report and attached schedules from Mr. S. Gyorffy and Mr. B.T. Liddle, dated April 3, 1989, concerning the City's 1989 program for major road resurfacing. Alderman Ziegler suggested that the asphalt resurfacing of Webster Road would be inappropriate in either 1989 or 1990 in light of the pipeline work proposed in the area. It was generally agreed to defer consideration of road resurfacing as it applies to Webster Road until the April 24, 1989 Council meeting, pending a report from Public Works staff regarding Alderman Ziegler's concerns. It was resolved: "That, with the exception of asphalt resurfacing on Webster Road between Wilson Avenue and Manitou Drive, Council approve the 1989 Road Program as outlined by Mr. S. Gyorffy and Mr. B. Liddle in their report and attached schedules, dated April 3, 1989." 13. Various Tenders It was resolved: "That Tender T89-2, Concrete Sidewalk and Curb Repairs, be awarded to G.J.R. Construction Limited, Linwood, at their tendered price of $308,012.85." - and - "That Tender T89-11, be awarded to Ontario Bus Industries Incorporation, Mississauga, Ontario for a three year term at their tendered prices. The quantity of buses to be delivered would be eight in 1989, thirteen in 1990 and ten in 1991 with the 1990 and 1991 quantities to be adjusted up or down as necessary to conform to then applicable capital budget and Ministry of Transport constraints." - and - "That proposal P89-13, Public Information Video Display System, be awarded to Teleride-Sage Corporation of Toronto at their proposed price of $76,000.00." The Committee was in receipt of a report from Mr. T. McKay, dated April 10, 1989, outlining the concerns which have arisen regarding the need for increased development control over the lots on Upper Canada Drive. Matthew Street Closinq Dealt with under Delegations. 15. Kitchener Housinq Inc. - Offer to Purchase - VICTORIA PARK WARD Dealt with under Delegations. 1(5. Urban Park in Huron Business Park Council was in receipt of a memorandum from Mr. T. Clancy, dated April 10, 1989 and an attached letter from the Junior Chamber of Commerce/Jaycees, dated February 17, 1989. It was resolved: "That Council permit the Kitchener-Waterloo Junior Chamber of Commerce/Jaycees to announce their participation in preserving the natural urban park in the Huron Business Park, at their conference in Kitchener on April 15, 1989."
