BY-LAWS AS LISTED ON THE AGENDA - 2ND READING It was resolved: "That the by-laws considered by this Committee be taken as read a second time and be recommended for enactment." Alderman M. Yantzi previously disclosed a conflict of interest and abstained from all discussion and voting with respect to a by-law to amend the Zoning By-law arising from Zone Change Application 88/59/Q, which deals with lands located on Queen Street South, since he was an owner of lands in the area and was officially circulated with the zone change proposal. B. REPORT OF THE CHIEF ADMINISTRATIVE OFFICER 1. 1989 Oktoberfest Trade Dollars It was resolved: "That Kitchener-Waterloo Oktoberfest Inc. be authorized to circulate $2.00 coins as trade dollars within Kitchener from July 1, 1989 to October 31, 1989." 2. Execution of Equipment Leasinq Aqreements It was resolved: "That in accordance with the sale of Boothe Computer Leasing to Triathlon Computer Leasing Inc., the Mayor and Clerk be authorized to execute Machine Schedule No. 2 and Notice of Security Interest dated March 29, 1989, to confirm the City's original equipment and lease terms." Association of Municipalities of Ontario - 1989 Conference - Votinq Accreditation It was resolved: "That Alderman B. Stortz, Alderman J. Ziegler, Alderman G. Lorentz, Alderman M. Yantzi, Alderman C. Zehr and Mr. T. McKay be appointed as voting delegates of the City of Kitchener for purposes of the 1989 Annual Conference of the Association of Municipalities of Ontario to be held at the Royal York Hotel," Toronto, from August 20th to 23rd, 1989. 4. Pipe Crossinq Aqreement It was resolved: "That the Mayor and Clerk be authorized to execute a Pipe Crossing Agreement with the Canadian National Railway Company with respect to installation and maintenance by the City of Kitchener of a 200mm Gas Main, a 525mm Sanitary Sewer, a concrete box Storm Drain Culvert and a Pedestrian Undercrossing at Mile 65.40, Guelph Subdivision, Henry Sturm Greenway. The City agrees to pay to the Railway, in advance, effective from May 1, 1989 to April 30, 1999, the sum of $990.00." 5. Proposed Local Improvements (Cont'd) 2) Doon Valley Drive - SOUTH WARD A recommendation respecting petitions for the installation of sanitary sewer and connections and concrete sidewalk on Doon Valley Drive was withdrawn from the agenda. 6. Variance to Siqn By-law - WEST WARD It was resolved: "That the decision of the Committee of Adjustment sitting as a Standing Committee of City Council, of May 2, 1989, recommending approval of Submission No. S 4/89 - Victoria Westmount Developments - Be Ratified and Confirmed." 7. FCM - Election to National Board of Directors It was resolved: "That no action be taken on a request from the Federation of Canadian Municipalities relative to nomination procedure of elected municipal officials who wish to stand for election to the National Board of Directors of the Federation." 8. Construction of Storm Culvert and Pedestrian Walkway - WEST WARD It was resolved: "That the City of Kitchener allow the contractor an exemption from Chapter 450 - Noise; Article 6 - Construction Work; of the City's Municipal Code for the forty (40) hour period that has been provided by the Canadian National Railway for the installa- tion of the culvert crossing and pedestrian walkway at the Henry Sturm Greenway Xlll and Canadian National Railway main line location." 9. Boundary Road Petition It was resolved: "That the City of Kitchener support the Township of Wilmot petition to the Regional Municipality of Waterloo to add to their Regional Road System the section of Trussler Road between Bleams Road and New Dundee Road." 10. Proposed Street Name Chanqe - FAIRVIEW WARD It was resolved: "That the Commissioner of General Services and City Clerk be authorized to give notice for the passing of a by-law changing the name Electrohome Drive to Deilcraft Place by placing the required advertisements in the local newspaper with all costs being paid by Deilcraft Furniture Co. Ltd. c/o Mr. Fred Lange, Director of Human Resources." 11. Various Tenders Alderman Stortz questioned Items 1 and 2 of Tender T89-27 for fleet vehicles. Mr. Clement advised that under Item 1 the lowest tender received was from Stedelbauer Motors for a 3 cyclinder vehicle and it did not meet tender specifications. With respect to Item 2 of the tender, Mr. Clement advised that the second lowest bid received from Wendell Motors Sales became the Iow bid when all requirements were totalled and included in the bid of Royal City Chrysler, which initially appeared to be Iow bid. Various Tenders (Cont'd) It was resolved: "That tender T89-3, Road Construction, be awarded to Warren Bitulithic Limited, Kitchener, at their tendered price of $421,492.69." - and - "That tender T89-6, Domestic Water Meters, be awarded to Neptune Measurement Division of Schlumberger Canada Ltd., Mississauga at their tendered price of $65,190." - and - "That tender T89-18, Road Sub-Base and Base Aggregates, be awarded to Forwell Limited, Kitchener, at their tendered unit prices." - and - "That tender T89-23, Sale of Four (4) Residential Lots Located on Upper Canada Drive, be awarded to Canadian Home Renovation Team Inc., Kitchener at their renegotiated price of $220,000." - and - "That tender T89-22, Radio Maintenance Contract, be awarded to Runke Radio Inc., Kitchener at their tendered price of $61,968. for a twenty-four month period." - and - "That tender T89-26, Five Gang Mowing Tractors and Five Gang Mowing Units, be awarded to DeBoer's Farm Equipment, Elora at their tendered price of $104,700." - and - "That tender T89-27, Fleet Vehicles, be awarded as follows: Item 1 (subcompact car) to Parkway Ford Sales, Waterloo; Item 2 (two 6,600 lb. 8 passenger window vans) to Wendell Motors Sales Limited, Kitchener; Item 3 (one 5,600 lb. GVW Mini Cargo Van) to Royal City Chrysler, Guelph; all at their tendered prices." - and - "That tender T89-29, Supply and Delivery of Gasoline, be awarded to Esso Petroleum Canada, Don Mills at their tendered prices." - and - "That tender T89-30, Supply and Delivery of Diesel Fuel, be awarded to Esso Petroleum Canada, Don Mills, at their tendered prices." 12. Charitable Refreshment Stand and Specific Location Daily Sale Licence Mr. Pritchard advised the Committee that the City was in receipt of a request for permission to operate an outdoor refreshment stand in the parking lot of C.N. Weber Ltd., 675 Queen Street South. It was noted that in addition to typical garage sale items, new goods would also be sold. Charitable Refreshment Stand and Specific Location Daily Sale Licence registered as charitable and all funds raised will be used for the school, they would qualify for the $1.00 charitable licence fee. It was resolved: "That the K-W Fellowship Christian School be granted permission to sell baked goods, plants, cook books and patio tables and to operate a refreshment stand in conjunction with their garage sale on May 13, 1989, at 675 Queen Street South, Kitchener, provided that the necessary licence and health approval is obtained."
