BY-LAWS AS LISTED ON THE AGENDA - 2ND READING
It was resolved:
"That the by-laws considered by this Committee be taken as read a second time and be
recommended for enactment."
B. REPORT OF THE CHIEF ADMINISTRATIVE OFFICER
1. Appointment of Fence Viewer
It was resolved:
"That we approve the appointment of Mr. Jim Witmer as a Fence Viewer to fill the vacancy
which exists due to the resignation of Mr. John Sajkunovic. This appointment is for a term
to expire November 30, 1989."
Request to Erect Banner
It was resolved:
"That in conjunction with National Tourism Week being celebrated from May 15-21, 1989,
the Kitchener Chamber of Commerce be granted permission to have a banner erected
across King Street at Francis Street from May 12 to May 23, 1989.
Further, that they make the necessary arrangements with the Department of Parks and
Recreation for the erection and removal of the banner and the payment of any costs
associated therewith."
Amendment re 1989 Transit Fares
It was resolved:
"That the following changes be made to Clause 7(b)(semester passes) of the Finance
Committee report (current budget) adopted by Council on March 20, 1989, as outlined in
Mr. Beck's memorandum dated April 13, 1989:
a) the length of time the pass is effective for should read 5 months rather than 4 months.
b) since this is a new pass, reference to a previous value of $145.00 should be deleted
with no figure appearing in that column."
4. Certificate of Titles Application
It was resolved:
"That the Mayor and Clerk be authorized to execute a Consent and Waiver of Notice and
Draft Plan to expedite a Certificate of Titles Act Application No. L-6312 by Freure Tall
Pines Limited with respect to lands described as Block F, Registered Plan 1367."
Minor Variance
It was resolved:
"That the decision of the Committee of Adjustment sitting as a Standing Committee of City
Council, of April 18, 1989, recommending approval of Submission No. S 3/89-766931
Ontario Ltd., be ratified and confirmed."

6. Request to Erect Banner
It was resolved:
"That in conjunction with their 50th Anniversary celebrations, the House of Friendship be
granted permission to erect banner across King Street at Frederick Street from October
23rd to November 3, 1989.
Further, that they make the necessary arrangements with the Department of Parks and
Recreation for the erection and removal of the banner and the payment of any costs
associated therewith."
Execution of Enqineerinq A,qreement
It was resolved:
"That the Mayor and Clerk be authorized to execute an agreement for the provision of
professional engineering services made between the City of Kitchener and
Cumming-Cockburn Ltd., regarding Commercial West Subdivision, R.P. 1650, Phase 2,
Estate Residential Section."
Encroachment Aqreement - VICTORIA PARK WARD
It was resolved:
"That the Mayor and Clerk be authorized to execute an Encroachment Agreement with the
registered owners of 124 Strange Street to legalize the existing encroachments consisting
of concrete steps, a brick pillar, overhanging eaves and a portion of a retaining wall as
they extend onto the road allowance known as Strange Street."

Dealt with under Delegations.
10. Re,qional Resource Recovery
It was resolved:
"1) That the City of Kitchener agrees to the Region's request to direct materials from our
recycling programme to the Region's facility.
2) That the Region be requested to assume responsibility for recycled materials and the
cost of recycling programmes as of February 1, 1990, the date of commencement of our
new waste collection contract.
3) That the City of Kitchener continue to administer the collection portion of the recycling
programme as part of the City's waste collection contract."
11. Various Tenders
Alderman B.M. Hiscott disclosed a conflict of interest and abstained from all discussion and
voting concerning Expression of Interest E89-10 as his employer is one of the bidders.
It was resolved:
"That Expression of Interest E89-10, Consultant's Services - Information Systems
Strategy, be awarded to R. Liley & Associates, Vancouver, British Columbia to develop an
Information Systems Strategy as per the terms of reference developed by the
Administrative Services Department subject to a satisfactory agreement being negotiated
and an upset fee of $75,000. established."

11. Various Tenders (Cont'd)
Alderman B.M. Hiscott disclosed a conflict of interest and abstained from all discussion and
voting concerning Expression of Interest E89-10 as his employer is one of the bidders.
It was resolved:
"That tender T89-16, Asphalt Emulsions, be awarded to Asphalt Engineering Co. Ltd.,
Mississauga at their tendered unit prices, subject to the approvals of the other
Participating Agencies."

"That tender T89-17, Miscellaneous Aggregates, be awarded to Forwell Limited,
Kitchener and Preston Sand and Gravel Co. Ltd., Cambridge, at their tendered unit
prices."

"That tender T89-19, Hot Mix Asphalts, be awarded to Capital Paving Inc., Guelph, and
Forwell Limited, Kitchener, at their tendered prices."

"That tender T89-20, Refurbishing of four Transit Coaches, be awarded to
Refurbishing Inc. Concord, at their tendered price."
12. Chlorination of Water Supply
National
Dealt with under Delegations.
13. Lot Clearinq By-law
It was resolved:
"That the by-law respecting lot maintenance be taken as read a first, second and third
time and numbered 89-62 by the Clerk."
14. Raffle Lottery - Children's Hospital of Western Ontario
The Committee was in receipt of a memorandum from the Manager of Licencing dated April
21, 1989, concerning a request by the Children's Hospital of Western Ontario for permission
to conduct a raffle lottery in the City of Kitchener.
It was resolved:
"That the Children's Hospital of Western Ontario be granted permission to conduct a raffle
lottery in the City of Kitchener with the draw to be held on May 26, 1989, at the Canadian
Imperial Bank of Commerce, Fairview Park Mall, Kitchener."
15. Applications for Cancellation, Refund, Reduction or Levy of Taxes -
Third Sitting
The Committee was in receipt of a letter from Mr. R.W. Pritchard, dated April 19, 1989,
concerning the above applications.
It was resolved:
"That the applications attached hereto and forming part of these minutes relative to
cancellation, reduction, refund or levy of taxes be disposed of as recommended therein."
