A. BY-LAWS AS LISTED ON THE AGENDA - 2ND READING
It was resolved:
"That the by-laws considered by this Committee be taken as read a second time and be
recommended for enactment."
B. REPORT OF THE CHIEF ADMINISTRATIVE OFFICER
1. Statutory Appointments
It was resolved:
"That pursuant to Section 3(2) of The Building Code Act Laurier Proulx be appointed Chief
Building Official and further, that Jim Witmer be appointed Deputy Chief Building Official
for the purpose of the enforcement of The Building Code Act."
2. Consent - Industrial Land - FAIRVIEW WARD
It was resolved:
"That the City of Kitchener consents to a lease from Berkshire Building Corporation to
A.T.S. Automation Tooling Systems Inc. for space at the property designated as Part 14,
Plan 58R-5566 and municipally known as 500 Trillium Drive, Kitchener."
3. Banner Request
It was resolved:
"That in conjunction with the annual Shinerama fundraising drive to raise money for Cystic
Fibrosis to be held on Saturday, September 9, 1989, the Wilfrid Laurier University
Students' Union be granted permission to have a banner erected on King Street at
Francis Street from Monday, August 28, 1989 to Monday, September 11, 1989, inclusive.
Further, that this organization make necessary arrangements with the Department of
Parks and Recreation for the erection and removal of the banner and the payment of any
costs associated therewith."
4. Encroachment Aqreement - CENTRE WARD
It was resolved:
"That the Mayor and Clerk be authorized to execute an Encroachment Agreement
satisfactory to the City Solicitor with the registered owners of the King Value Centre, 255
King Street West, with respect to the encroachment of an entrance canopy over the
sidewalk abutting part of the King Street facade of the building."
5. Street Closures to Accommodate Subdivision Application - SOUTH WARD
It was resolved:
"That the City Solicitor be authorized to make application to a District Court Judge for an
Order to close Koch Avenue and Part of Towerview Avenue as shown on Registered Plan
820 for the City of Kitchener and that, subject to the approval of the Court and the
Regional Commissioner of Planning and Development, the said closure be implemented
and the lands conveyed to the abutting property owner(s) at a price of $100,000. per
hectare, according to law."

Licence to Operate Refreshment Stand
It was resolved:
"That the Breithaupt Neighbourhood YVVCA be granted permission to operate a
Refreshment Stand at the September swim registration at the Breithaupt Centre in
Kitchener on September 9, 1989, provided that the necessary licence and Health
approval is obtained."
7. Industrial Land Consent - FAIRVIEW WARD
It was resolved:
"That the City of Kitchener consent to leases from 360006 Ontario Limited to Technology
Service Corporation Inc., to Sweet Kyla Inc. and to Vipond Sprinkler Company Limited
and a mortgage from 360006 Ontario Limited to Canada Trustco Mortgage Company for
the property designated as Part 4, Plan 58R-5010 and Part 5, Plan 58R-5151 and
municipally known as 330 Trillium Drive, Kitchener."
8. Raffle Licence
It was resolved:
"That the City of Kitchener has no objection to a Provincial licence being issued to the
Kitchener Minor Hockey Association to conduct a Raffle Lottery with the draw to be held
on March 24, 1990 at the Kitchener Memorial Auditorium Complex, 400 East Avenue,
Kitchener."
9. Request to Chanqe Consultinq Enqineers
It was resolved:
"That subject to the firm of Paragon Engineering Ltd. releasing the City from its
engineering agreement, we concur with the request of Zeffer Holdings Inc. that the
services of Paragon Engineering Ltd. be terminated and that Murray H. Schmitt Inc. be
retained to complete such engineering services. Further, that the Mayor and Clerk be
authorized to execute a new agreement providing for engineering services with Murray H.
Schmitt Inc. respecting the Veronica Drive Extension, Phase II, R.P. 1664."
10. Monte Carlo Licence
It was resolved:
"That the City of Kitchener has no objection to Provincial licences being issued to the
Kitchener-Waterloo Oktoberfest Inc. to conduct Monte Carlo events at the Valhalla Inn,
Holiday Inn and Bingeman Park Farms during Oktoberfest, October 6 - 14, 1989
inclusive."
11. Encroachments - CENTRE WARD
It was resolved:
"That the Mayor and Clerk be authorized to execute an Encroachment Agreement with the
registered owners of 505 King Street East in the City of Kitchener to legalize the existing
encroachment of the concrete block and brick building onto the road allowance known as
Cameron Street South."

"That the Mayor and Clerk be authorized to execute an Encroachment Agreement with the
registered owners of 24 Cameron Street South in the City of Kitchener to legalize the
existing encroachment of the retaining wall onto the road allowance known as Charles
Street and the eaves which overhang the said road allowance."
12. Kitchener Waterloo Traffic Operations Study Representation
It was resolved:
"That Alderman J. Smola, as Chairman of Civic Administration Committee, be the City's
elected representative on the Kitchener-Waterloo Traffic Operations Study Committee."
13. Resolution - Reqional Municipality of Hamilton-Wentworth
It was resolved:
"That we endorse the resolution passed on June 6, 1989, by the Regional Municipality of
Hamilton-Wentworth which offers sympathy and support for the Chinese people in light of
recent tragic events in China.
And further, that notice of this endorsement be sent to the Chinese Ambassador to
Canada in Ottawa."
14. Tree - ROCKWAY-ST. MARY'S WARD
The Committee considered a copy of correspondence dated July 31, 1989, from Alderman W.
Ferguson to Mr. Patrick Poire, 41 Stirling Avenue South, as well as a report dated July 11,
1989, from Mr. N. Campbell, Superintendent of Horticulture and Forestry, dealing with a
request for removal of a tree located on Mr. Poire's property. Alderman Ferguson stated that
he felt the situation was a dangerous one and that the tree should be removed in the public
interest.
Alderman Ferguson proposed a motion to cut and remove a tree at City cost located adjacent
to the public right-of-way at 41 Stirling Avenue South. Mayor Cardillo put forward a motion to
defer consi- deration of Alderman Ferguson's motion until further information on this matter
was made available to City Council for its meeting of September 11, 1989. Mayor Cardillo's
motion to defer was put to a vost and LOST.
Alderman Ferguson's motion was put to a vote and it was resolved:
"That a tree be cut and removed at City cost located adjacent to the public right-of-way on
the property of Mr. Patrick Poire, 41 Stirling Avenue South."
15. Redistribution of Crossinq Guard Facilities
For the information of City Council a report was provided from the Traffic & Parking Services
Division outlining the redistribution of Crossing Guard Facilities for certain elementary schools
commencing September 5, 1989.
16. Various Tenders
It was resolved:
"That tender T89-44, Gas Valves for Utilities, be awarded to KTI Limited, Richmond Hill at
their tendered price of $61,592."

16. Various Tenders (Cont'd)
"That tender T89-47, Huron Business Park Stage iii, be awarded to H. Kerr
Construction, Wingham, Ontario at their tendered price of $659,300."

"That tender T89-49, Project Lift Mini Bus Modified for Transportation of the Physically
Disabled, be awarded to Girardin Corporation, Cambridge at their tendered price of
$42,606. for each of two vehicles for a total tendered price of $85,212."

"That tender T89-55, Three Wheel Self-Propelled Street Sweeper, be awarded to Fink
Canada, Cambridge at their tendered price of $105,370."
17. Preqradinq Request - SOUTH WARD
It was resolved:
"That Council allow the Cora Group to pregrade their lands on Trussler Road (Subdivision
Application 30T-88003) exclusive of Blocks 106, 107 and 108. The grading of these
blocks will be subject to an amended Tree Saving Plan being approved. All erosion
control devices are to be erected and top soil and seed is to be replaced in 1989 on those
areas which will not be serviced in 1989. It is to be understood by the Cora Group that
such grading shall be at their sole risk and liability."
18. City Purchase - One Foot Strip - STANLEY PARK WARD
It was resolved:
"That the Corporation of the City of Kitchener accept the Offer of Matthew Frank Kousal to
sell Part of Reserve Block "F", Registered Plan 939, designated as Part 16, Plan
58R-6568 to the City for the purpose of the extension of the Kolb Drain. Consideration for
this conveyance is to be, as stated therein, ONE ($1.00) DOLLAR, with the City to be
responsible for all survey and legal costs.
And further, that the Mayor and Clerk be authorized to execute any documentation
required by the City Solicitor to complete this transaction."
19. Consent - Industrial Land - 99 Shoemaker Street
It was resolved:
"That the City of Kitchener consents to a lease from Ron Zehr Trucking Limited to David
Francis Freiburger c.o.b, as Freiburger Landscaping, for space at the property designated
as Part 1, Plan 58R-5566 and municipally known as 99 Shoemaker Street, Kitchener,
subject to applying for and being issued an occupancy certificate."
20. Consent - Industrial Land - 73 Shoemaker Street
It was resolved:
"That the City of Kitchener consents to a lease from Trimann Enterprises Inc. to Daymond,
A Division of Redpath Industries Limited and a transfer from Trimann Enterprises Inc. to
167733 Canada Inc. of the property designated as part 6 on Reference Plan 58R-5456
and municipally known as 73 Shoemaker Street, Kitchener."

21. Certification of Titles Application - Freure Manaqement Limited
It was resolved:
"That the Mayor and Clerk be authorized to execute a Consent and Waiver of Notice and
Draft Plan to expedite a Certificate of Titles Act Application by Freure Management
Limited with respect to lands described as Block 100, Plan 1318."
22. Raffle Lottery - Rotary Club of Kitchener
It was resolved:
"That the City of Kitchener has no objection to a Provincial licence being issued to the
Rotary Club of Kitchener to conduct a raffle lottery on December 15, 1989, at the
Kitchener Memorial Auditorium."
23. Charitable Refreshment Stand Licence
It was resolved:
"That the Doon Pioneer Park Community Association be granted permission to operate a
refreshment stand at the opening ceremonies of the new Doon Pioneer Park Community
Centre, 150 Pioneer Drive, Kitchener on September 10, 1989, provided that the
necessary licence and Health approval is obtained."
24. Parkinq Prohibition - Spadina Road
On motion by Alderman W. Ferguson -
it was resolved:
"That parking be prohibited on the east side of Winslow Drive from Spadina Road to a
point 91.4 metres north of Spadina Road."
