BY-LAWS AS LISTED ON THE AGENDA - 2ND READING It was resolved: "That the by-laws considered by this Committee be taken as read a second time and be recommended for enactment." B. REPORT OF THE CHIEF ADMINISTRATIVE OFFICER 1. Execution of Enqineerinq Agreement - FOREST WARD It was resolved: "That the Mayor and Clerk be authorized to execute an agreement for the provision of professional engineering services made between the City of Kitchener and Cumming Cockburn Limited regarding Forest Heights West, Newbury Drive Extension - 30%88009, Gilezan Homes Ltd." 2. Banner Requests It was resolved: "That in conjunction with the 50th Anniversary of Black Ribbon Day to be celebrated in Kitchener on August 23, 1989, the International Black Ribbon Day Committee be granted permission to have a banner erected on King Street at Frederick/Benton Streets from Monday, August 21, 1989 to Friday, August 25, 1989. Further, that this organization make necessary arrangements with the Department of Parks and Recreation for the erection and removal of the banner and the payment of any costs associated therewith." - and - "That in conjunction with the 1989 United Way Campaign, the United Way of Kitchener-Waterloo and Area be granted permission to have a banner erected on King Street at Frederick/Benton Streets from Friday, September 15, 1989 to Monday, October 23, 1989. Further, that this organization make necessary arrangements with the Department of Parks and Recreation for the erection and removal of the banner and the payment of any costs associated therewith." - and - "That in conjunction with 'National Tourism Awareness Week' to be held across Canada from May 14, 1990 to May 21, 1990, the Kitchener Chamber of Commerce be granted permission to have a banner erected on King Street at Frederick/Benton Streets from Friday, May 11, 1990 to Tuesday, May 22, 1990. Further, that this organization make necessary arrangements with the Department of Parks and Recreation for the erection and removal of the banner and the payment of any costs associated therewith." 3. Appointment - Actinq Mayor It was resolved: "That the following appointments take place during the absence of His Worship Mayor Dominic Cardillo: a) Alderman B. Appointment - Actinq Mayor (Cont'd) b) Alderman J. Ziegler for the period Saturday, August 19th to Wednesday, August 23rd, 1989, inclusive." 4. Watermain Crossinq Aqreement - STANLEY PARK WARD It was resolved: "That the Mayor and Clerk be authorized to execute an agreement with the Canadian National Railway Company for a watermain crossing of CNR property referenced as mileage 59.03, Guelph Subdivision, Victoria Street North." 5. Fence Variance - SOUTH WARD The Committee was in receipt of a letter from Mr. G. Wright, President of Brigadoon Holdings Inc., dated July 12, 1989, objecting to the Committee of Adjustment decision and asking that it be overturned. It was resolved: "That the decision of the Committee of Adjustment sitting as a Standing Committee of City Council, of July 4, 1989, recommend- ing approval of Submission No. F 4/89 - Ruben Bom - Be Ratified and Confirmed." 6. Master Proofs of Loss It was resolved: "That the Mayor and Clerk be authorized to execute a Master Proof of Loss in the amount of $5,516.67 pertaining to a vehicle collision involving a City bus which occurred on Kingsway Drive at Greenfield Avenue on or about December 15, 1988." - and - "That the Mayor and Clerk be authorized to execute a Master Proof of Loss in the amount of $2,786.68 pertaining to a vehicle collision involving a City bus which occurred at the intersection of University Avenue East and Lincoln Road in the City of Waterloo on or about March 10, 1989." 7. Aqreement - Information Kiosks It was resolved: "That the Mayor and Clerk be authorized to execute an Agreement with the Downtown Improvement Area Board of Management, dated June 9, 1988, with respect to the installation and maintenance of informational 'Kiosk' signs in the Downtown and the Transit Terminal." 8. Consents - CHICOPEE WARD & BRIDGEPORT NORTH WARD It was resolved: "That the Mayor and Clerk be authorized to execute a Consent and Waiver of Notice and Draft Plan to expedite a Certificate of Titles Act Application No. L-6365 by 805052 Ontario Inc./Jordane Building Corporation with respect to lands described as Part 1, Plan 58R-6624." - and - COMMITTEE OF THE WHOLE MINIYPES JULY 17, 1989 B. Consents - CHICOPEE WARD & BRIDGEPORT NORTH WARD (Cont'd) "That the City of Kitchener consents to a transfer from Canadian Posture and Seating Limited to Munbrook Holdings Ltd. being the property designated as Part 5, Plan 58R-3388 and municipally known as 15 Howard Place, Kitchener." 9. Monte Carlo Licence It was resolved: "That the City of Kitchener has no objection to a Provincial licence being issued to the Kinsmen Club of Kitchener Waterloo Inc., for a Monte Carlo Event to be held at the Kitchener Memorial Auditorium during Oktoberfest from October 6 to 10, 1989." 10. Raffle Lottery It was resolved: "That the City of Kitchener has no objection to a Provincial licence being issued to the Catholic Community of St. Mark Parish, 338 Westheights Drive, Kitchener, to conduct a Raffle Lottery in the City of Kitchener with the draw to be held December 31, 1989." 11. Fundraisinq Event It was resolved: "That permission be granted to the Women's Committee of the K-W Symphony to conduct a gala auction as a fundraising event for the K-W Symphony in the Concordia Club Tent on October 20-21, 1989." 12. Grant Application The Committee was in receipt of a report from Mr. L. Wiegand dated June 28, 1989 and accompanying grant application dated May 17, 1989, concerning the 1990 Ali-Ontario High School Hockey Champion- ship. Moved by Mayor D.V. Cardillo - "That a grant-in-kind in the amount of $2,000.00 be awarded to the Waterloo County Secondary School Athletic Association to partially off-set ice rental rates in conjunction with the All- Ontario High School Hockey Championship to be held in the Kitchener Memorial Auditorium Complex March 22, 23 and 24, 1990." Moved by Alderman M. Yantzi - "That consideration of the request from the Waterloo County Secondary School Athletic Association for a grant-in-kind to partially off-set the cost of ice rental at the Kitchener Memorial Auditorium Complex in conjunction with the 1990 All- Ontario High School Hockey Championship be deferred and referred to the August Finance Committee agenda. Various Tenders It was resolved: "That tender T89-41, Repair of the Deck Surface - Conestoga Parkway Pedestrian Overpass between Dixon Street and Boniface Avenue, be awarded to Canadian Construction Controls Limited, Breslau at their tendered price of $57,722.25." - and - "That tender T89-42, Repair of Stairway and Retaining Walls - Charles Street at Madison Avenue, be awarded to Canadian Construction Controls Limited, Breslau at their tendered price of $63,482.16." - and - "That tender T89-51, One 95 HP Loader & Two 80 HP Loader Backhoes, be awarded as follows: One 95 HP four wheel drive articulated rubber tired loader to Equipment Sales, Rexdale at their tendered price of $70,741. Two 80 HP four wheel drive loader backhoes to Advance Construction Equipment, Kitchener at their tendered price of $95,732. plus options." - and - "That tender T89-53, Gas Pipeline Construction, be awarded to Cliffside Utility Contractors, Division of Foundation Company of Canada Limited, Scarborough, at their tendered price of $553,408.67." - and - That tender T89-57, Power Vent 40 and 50 Gallon Hot Water Heaters, be awarded to Wesmech Technical Sales Inc., Etobicoke, Ontario, at their tendered price of $231,750." 14. Downtown Parkinq Study It was resolved: "In order to satisfy the terms of the Community Planning Grant 30-3-3 for the Downtown Parking Study, Kitchener Council requests the Community Planning Advisory Branch for an additional extension to the present deadline date for completion of the study from August 31, 1989 to December 31, 1989." 15. Resolution - Kitchener Public Library Board It was resolved: "That the request from the Kitchener Public Library Board to reconsider the $25.00 non-resident fee for library services be referred to the Finance Committee for consideration." 16. Special Bank Account It was resolved: "That City Council pass a resolution establishing a Special Imprest Bank Account for the purpose of payment of the insurance deductible." Homer Watson Boulevard/Conestoqa Colleqe Boulevard It was resolved: "That the City of Kitchener recommend that the Regional Municipality of Waterloo award the contract for the widening of Homer Watson Boulevard and the construction of the new Conestoga College Boulevard to E & E Seegmiller Ltd. at their tendered price of $1,969,155.68." 18. Monarch Subdivision - Standard for Street Liqhtinq & Street Siqns It was resolved: "That, notwithstanding the present City of Kitchener standards for street lighting and street identification signs, Monarch Construction Limited be allowed to install in their Doon South Area, Pinnacle Hill Subdivision only, revised standards for street lighting and street identification signs as per the attached drawings. Further, that Monarch Construction Limited agrees to supply to the City of Kitchener with each phase of construction, two extra sets of light standards including light fixtures and street identification poles as well as four sign blanks." 19. Kitchener-Waterloo Track & Field Association It was resolved: "That the Kitchener-Waterloo Track and Field Association be given 50% ($4,282.) of their 1989 approved grant." 20. City Position on Provincial Policy on Eliqibilit¥ for Special Transit Services It was resolved: "WHEREAS the Ministry of Transportation of Ontario has provided a new definition to describe persons eligible for special transit service and has indicated that this represents their new policy direction in this area; AND WHEREAS this new definition could result in a large increase in the number of individuals eligible for special transit services; AND WHEREAS to meet this increase in number there could be a substantial financial impact on both capital and operating cost to the municipality; AND WHEREAS the Province has not given any indication of changes in current funding policies to meet the increased financial cost that could result from this change; AND WHEREAS there is confusion in the Province's policy statement where at one point it is indicated that municipalities will set the rules for increased eligibility where at another it indicates that the Province will ensure consistency in interpretation of the policy throughout the Province; THEREFORE, BE IT RESOLVED that the Council of the City of Kitchener requests the Province to: 1) clarify its intentions with regard to this new policy direction in increased user eligibility for special transit services COMMITTEE OF THE WHOLE MINIYPES JULY 17, 1989 B. City Position on Provincial Policy on Eliqibility for Special Transit Services (Cont'd) 2) carry out a financial impact study of the change in policy as it affects municipalities; and 3) in light of the financial impact study, revise its funding policies to ensure that the change in Provincial policy is accompanied by Provincial dollars to ensure that the policy implementation does not have a negative impact on municipal fiscal resources." 21. Raffle Lottery - Kitchener-Waterloo Symphony Orchestra The Committee was in receipt of a memorandum from Mrs. Y. Ashley, Manager of Licencing, dated July 14, 1989, and related correspon- dence pertaining to the above organization's request for permission to conduct a raffle lottery. It was resolved: "That the City of Kitchener has no objection to a Provincial licence being issued to the Kitchener-Waterloo Symphony Orchestra to conduct a raffle lottery in the City of Kitchener on February 10, 1990, at the Centre In The Square." 22. Termite Infestation The Committee was in receipt of a memorandum from Mr. L. Proulx, Director of Building and Inspections, dated July 12, 1989, and a draft Termite Control By-law. It was resolved: "That leave be given the mover and seconder to introduce a by-law to control termites and other wood-destroying insects, and that the same be taken as read a first and second time and be recommended for enactment."
