BY-LAWS AS LISTED ON THE AGENDA - 2ND READING It was resolved: "That the by-laws considered by this Committee be taken as read a second time and be recommended for enactment." B. REPORT OF THE CHIEF ADMINISTRATIVE OFFICER 1. En,qineerinq Agreement It was resolved: "That the Mayor and Clerk be authorized to execute an agreement for the provision of professional engineering services made between the City of Kitchener and Knox Martin Kretch Ltd., regarding Wyldwood Estates, Stage 1, Pinnacle Hill Subdivision." 2. Refreshment Stand Requests It was resolved: "That the Soroptimist International of Kitchener-Waterloo be granted permission to operate a Refreshment Stand in front of the Family Centre of Ratz-Bechtel Ltd., 621 King Street West, Kitchener, from 9:00 a.m. to 12:00 Noon on Saturday, November 18, 1989, during the Santa Claus Parade, provided that the necessary licence and health approval is obtained." - and - "That the youth group of St. Mark's Lutheran Church be granted permission to operate a Refreshment Stand on the front of their church property at 825 King St. West, Kitchener, from 9:00 a.m. to 12:00 Noon on Saturday, November 18, 1989, during the Santa Claus Parade, provided that the necessary licence and Health approval is obtained." 3. Variance to Fence By-law - FAIRVIEW WARD It was resolved: "That the decision of the Committee of Adjustment sitting as a Standing Committee of City Council, of October 17, 1989, recommending approval of Submission No. F 5/89 - Wayne & Dorothy Schade - Be Ratified and Confirmed." 4. Consent to Lease of Industrial Land - FAIRVIEW WARD It was resolved: "That the City of Kitchener consent to a lease from Berkshire Building Corporation to Crowntek Business Centres for space at the property described as Part 14 on Reference Plan 58R-5566 and municipally known as 500 Trillium Drive, Kitchener, subject to applying for and obtaining an occupancy certificate." 5. Encroachment Aqreements It was resolved: "That the Mayor and Clerk be authorized to execute an Encroach- ment Agreement with the registered owners of 236, 248 and 264 Victoria Street North to legalize the concrete block wall and brick building as they encroach onto Victoria Street North and the frame entrance as it encroaches onto St. Leger Street." - and - COMMITTEE OF THE WHOLE MINUTES OCTOBER 23, 1989 B. Encroachment Agreements (Cont'd) "That the Mayor and Clerk be authorized to execute an Encroach- ment Agreement with the registered owners of 113 Breithaupt Street to legalize a concrete block building extending 0.04 metres, more or less, into the road allowance known as Breithaupt Street." 6. Tender It was resolved: "That T89-74 for Domestic Gas Meters, be awarded to Canadian Meter Company Inc., of Milton, Ontario at their tendered price of $142,218.00." 7. Farmers' Market - One Hour Free Parking Promotion This item was dealt with under "New Business" in the Council Minutes. Kitchener Response to the Reqional Industrial/Commercial Development Charqe Policy This item was dealt with under Delegations in the Council Minutes. Applications for Cancellation, Refund, Reduction or Levy of Taxes - Second Sitting It was resolved: "That the applications attached hereto and forming part of these minutes relative to cancellation, reduction, refund or levy of taxes be disposed of as recommended therein." The following conflicts of interest and abstention were disclosed: (i) Alderman C. Weylie as she acts as an agent for an Insurance Company with regard to various applications. (ii) Alderman C. Zehr as he provides services for the client corporation listed under Item #149 and 150. 10. Raffle Lottery It was resolved: "That the City of Kitchener has no objection to a Provincial Licence being issued to the Knights of Columbus, Father Funcken Council 1504, to conduct a Raffle Lottery in the City of Kitchener, with twelve monthly draws commencing March 20, 1990 and ending February 19, 1991, at 110 Manitou Drive, Kitchener." 11. Expropriation of Land - Harold Wesley Leis It was resolved: "That the City Solicitor be instructed to initiate expropriation proceedings to acquire title to that portion of land, owned by Harold Wesley Leis, which is composed of Part of Lot 9, Beasley's Broken Front Concession, designated as Part 9 on Reference Plan 58R-5596, for the purposes of constructing the Pioneer Tower West Collector Road, and further, That this Council did receive an application, dated October 23, 1989, for approval to expropriate land owned by Harold Wesley Leis, from James H. Shivas, Assistant City Solicitor, relating to land described as Part of Lot 9, Beasley's Broken Front Concession and shown as Part 9 on Plan 58R-5596."
