BY-LAWS AS LISTED ON THE AGENDA - 2ND READING
It was resolved:
"That the by-laws considered by this Committee be taken as read a second time and be
recommended for enactment."
B. REPORT OF THE CHIEF ADMINISTRATIVE OFFICER
1. Raffle Lottery
It was resolved:
"That permission be granted to the Ontario Shuffleboard Association of the Blind to
conduct a Raffle Lottery on April 21, 1990 at the Brantford Senior Centre C Beckett, 219
Colborne Street, Brantford, Ontario, for the purpose of raising funds to offset expenses for
tournaments to be held in Hamilton and Brantford in 1990."
2. Art Auction
It was resolved:
"That the $1.00 Charitable Organization licence fees apply to the Hawkers and Pedlars
and Auctioneer's licences required by the Canadian Mental Health Association for their
Art Auction to be held on November 3, 1989."
3. Variances to City's Sign By-law - WEST & CENTRE WARDS
It was resolved:
"That the decision of the Committee of Adjustment sitting as a Standing Committee of City
Council, of September 12, 1989, recommending approval of Submission No. S 7/89 -
Imperial Oil Limited and Submission No. S 8/89 - Corporation Square Management Inc.,
be Ratified and Confirmed."
4. Execution of Engineering Agreement
It was resolved:
"That the Mayor and Clerk be authorized to execute an agreement for the provision of
professional engineering services made between the City of Kitchener and Paragon
Engineering Ltd., regarding Winston Park Nursing Home, Westmount Road and Blockline
Road."
5. Encroachment Agreement - CENTRE WARD
It was resolved:
"That the Mayor and Clerk be authorized to execute an Encroachment Agreement with the
registered owners and tenant of 27-33 King Street West (Weber Big V Drug Store) to
authorize the encroachment of a canopy and protruding sign overhanging the King Street
road allowance to the extent of 2.25 feet more or less."
6. Rental Agreement - CENTRE WARD
It was resolved:
"That the City accepts an Offer dated September 20, 1989 from George Magarin to lease
premises known as 226 King Street West from October 15, 1989 to January 31, 1991 for

a monthly rent of $850.00, and further that the Mayor and Clerk be authorized to execute
a lease approved by the City Solicitor."
7. Condition of Property - ROCKWAY-ST. MARY'S WARD
This item was dealt with under Delegations.
8. Tenders
It was resolved:
"That tender T89-38, Grading & Site Services, Lancaster Business Park - Phase I, be
awarded to 743570 Ontario Limited (Elgin Construction), St. Thomas, Ontario at their
tendered price of $2,133,528.29, subject to confirmation from the City of Kitchener Legal
Department that all lands and easements necessary for the construction work have been
obtained by the City."
- and -
"That tender T89-71, Supply and Delivery of Highway Coarse Salt, be awarded to Domtar
Inc., Toronto, at their tendered price."
9. Sale of Surplus Lands - FAIRVIEW WARD
Mr. D. Snow, Director of Traffic and Parking, commented that 717743 Ontario Limited was fully
informed of the restricted access onto Courtland Avenue in making a decision to purchase this
parcel of land.
It was resolved:
"Further to the Council Resolution of November 28, 1988 and considering the limitation of
access to only Courtland Avenue over the Purchaser's lands, the market value to be fixed
for the land to be purchased by 717743 Ontario Inc. shall be at the rate of $62,500.00 per
acre and the Agreement to be presented to Council shall so reflect."
10. Raffle Lottery
It was resolved:
"That permission be granted to Ontario District Assoc. of Chapters S.P.E.B.S.Q.S.A. Inc.,
to conduct a raffle lottery on October 28, 1989 at the Centre In The Square, Kitchener, for
the purpose of raising funds for their Harmonize for Speech of Ontario Program."
11. Claim - Expropriation
It was resolved:
"That the City accepts the offer of Jan Woudenberg c.o.b, as Frontier Leather to settle in
full all his claims arising from the expropriation of premises leased at 23 College Street,
for the sum of $2,109.25 plus legal costs in the sum of $550.00."
12. Execution of Enqineerinq Aqreement
It was resolved:
"That the Mayor and Clerk be authorized to execute an agreement for the provision of
professional engineering services made between the City of Kitchener and Conestoga
Rovers & Associates Ltd., regarding Autoplaza Site, Victoria Street North."
