B. REPORT OF THE CHIEF ADMINISTRATIVE OFFICER 1. Execution of Enqineerinq A.qreements It was resolved: "That the Mayor and Clerk be authorized to execute an agreement for the provision of professional engineering services made between the City of Kitchener and Paragon Engineering Limited, regarding Highland Park West Subdivision, Stages 1, 2, 3 and 4, 781083 Ontario Limited." - and - "That the Mayor and Clerk be authorized to execute an agreement for the provision of professional engineering services made between the City of Kitchener and MTE Consultants Inc., regarding Grandview Manor Subdivision, R.P. 1696, Bridge Street." - and - "That the Mayor and Clerk be authorized to execute an agreement for the provision of professional engineering services made between the City of Kitchener and MTE Consultants Inc. regarding St. Paul School Site, Forest Hill Drive and Birchcliff Avenue." 2. Request for Raffle Lottery Licence It was resolved: "That permission be granted to the Kitchener-Waterloo Gymnastics Club to conduct a raffle lottery with the draw to be held on December 9, 1989, at 300 Mill Street, Kitchener, for the purpose of raising funds for the operation of the Club." 3. Housinq Division Sub-Lease - Sixth Floor It was resolved: "That, subject, to the approval of the Ontario Municipal Board, the Mayor and Clerk be authorized to execute a sub-lease and any other documentation required to sub-let 1,540 sq. ft. of office space on the sixth floor of the building municipally known as 22 Frederick Street from the Sublandlord thereof for a term commencing August 1, 1989, and ending September 30, 1993, at an annual rent of $16,940.00, plus occupancy costs as defined therein." 4. Assessment Appeal - STANLEY PARK WARD It was resolved: "That the Mayor and Clerk be authorized to execute Minutes of Settlement with respect to an Assessment Appeal to the OMB for premises municipally known as 1290 Victoria Street North." United Way It was resolved: "That the month of October, 1989 be proclaimed 'United Way Month' in the City of Kitchener, provided that if publication of this proclamation is requested, same be done at no expense to the City. Further, that we approve of the request of United Way for permission to utilize the City's postage meter to imprint outgoing City mail with the United Way Logo and wording 'Support the United Way' for the period September 11 to November 30, 1989, provided the necessary imprint plate is supplied by United Way. And further, that we waive the normal rental fee for the Subscriber's Lounge at the Kitchener Memorial Auditorium Complex which is to be utilized by United Way on September 11, 1989 for the purposes of a Kick-off Rally. And further, that United Way be granted permission to fly its flag at Rockway Gardens from September 11 to November 17, 1989." Variances to City's Siqn By-law - CENTRE & CHICOPEE WARDS It was resolved: "That the decision of the Committee of Adjustment sitting as a Standing Committee of City Council, of August 29, 1989, recommending approval of Submission No. S 5/89 Waterloo Region Roman Catholic Separate School Board and Submission No. S 6/89 - 771108 Ontario Limited, Be Ratified and Confirmed." Proposed Local Improvement- STANLEY PARK WARD It was resolved: "That pursuant to the Local Improvement Act, and subject to Ontario Municipal Board approval, Kitchener Council grant the petitions of Mr. Harold Voll et al for construction of a storm sewer on the north side of Marketa Crescent from Matthew Street to Smetana Drive." Certification of Title Applications It was resolved: "That the Mayor and Clerk be authorized to execute a Consent and Waiver of Notice and Draft Plan to expedite a Certificate of Titles Act Application by Waldemar Schmidt with respect to lands described as Part Lot 14, Registrar's Compiled Plan 1471, more particularly described as Part 1 on Draft Reference Plan." - and - "That the Mayor and Clerk be authorized to execute a Consent and Waiver of Notice and Draft Plan to expedite a Certificate of Titles Act Application by 225516 Ontario Limited with respect to lands described as Parts of Lots 120 and 121, German Company Tract, Upper Block, City of Kitchener and shown as Parts 1, 2, 3, 4 and 5 on Draft Reference Plan." Licensinq Aqreement - Lions Club - Oktoberfest It was resolved: "That the Mayor and Clerk be authorized to execute a Licensing Agreement dated September 6, 1989 to allow the Lions Club of Kitchener to use Queensmount Arena during Oktoberfest from September 29, 1989 to October 15, 1989 for rent in the sum of $7,170.00." 10. Schneider Creek Trunk Sanitary Sewer - FAIRVIEW WARD It was resolved: "That the City of Kitchener enter into an Agreement with C.N. Rail for the provision of a pipe crossing on C.N. Rail lands for the Schneider Creek Trunk Sanitary Sewer." - and - "That the City of Kitchener enter into an agreement with Ontario Hydro for the acquisition by the City of a permanent easement and a temporary working easement on Hydro lands for the construction of the Schneider Creek Trunk Sanitary Sewer." 11. Consent to Lease of Industrial Land - SOUTH WARD It was resolved: "That the City of Kitchener consents to a lease from 167733 Canada Inc. to Janpar Produits De Bureau Inc. for space at the property designated as Part 6 on Reference Plan 58R-5456 and municipally known as 73 Shoemaker Street, Kitchener, subject to applying for and receiving an occupancy permit." 12. Tenders It was resolved: "That tender T89-69, West Acres Crescent Local Improvements, be awarded to 743570 Ontario Limited (o/a Elgin Construction), St. Thomas, at their tendered price of $212,120.25." - and - "That tender T89-64, Tractor Mounted Flail Mowing System, be awarded to G.C. Duke Equipment Limited, Burlington, at their tendered price of $46,584." 13. Request to Upqrade Street Liqhtinq - Vanier Drive The Committee was in receipt of a memorandum from Alderman J. Ziegler dated August 24, 1989, and related correspondence. It was resolved: "That the City agrees to the replacement of the 38 incandescent luminaires on Vanier Drive from the Expressway to Traynor Avenue with a similar number of high pressure sodium luminaires, and further, That this item be designated as a first call in the 1990 Capital Budget." 14. Temporary Street Closinq- FOREST WARD It was resolved: "That Monteagle Crescent be closed from 2:00 p.m. to 5:00 p.m. on Saturday, September 16, 1989, for the purpose of holding a children's play and that a rain date of Sunday, September 17, 1989 be approved and that the appropriate by-law under Section 352(61) of the Municipal Act be enacted, and further, that the cost to close the road be charged to the appropriate account number." 16. Optimist Club of Stanley Park - Monte Carlo Event The Committee was in receipt of a memorandum and recommendation from Mrs. Y. Ashley, dated September 8, 1989. It was resolved: "That the City of Kitchener has no objection to a Provincial licence being issued to the Optimist Club of Stanley Park, Kitchener to conduct a Monte Carlo event at Bingeman Park Farms during Oktoberfest, October 6-15, 1989, inclusive." 17. Certification of Title Application - High Street Construction Ltd. The Committee was in receipt of a memorandum from Mr. D. Fisher, dated September 7, 1989, concerning the above application. It was resolved: "That the Mayor and Clerk be authorized to execute a Consent and Waiver of Notice and Draft Plan to expedite a Certificate of Titles Act Application by High Street Construction Limited with respect to lands described as Lot 11, Plan 1471, designated as Part 1 on Draft Reference Plan." 18. Applications for Cancellation, Refund, Reduction or Levy of Taxes The Committee was in receipt of a letter from Mr. R.W. Pritchard, dated September 6, 1989, concerning the above applications. Alderman B. Stortz declared a conflict of interest and abstained from all discussion and voting concerning Item #290 as his wife is employed by the Mutual Life Assurance Company of Canada and Items #354, 355 and 356 as he is employed by Weber, Tanner and Miller. Alderman J. Ziegler declared a conflict of interest and abstained from all discussion and voting concerning Items #347 and 348 as the owners are clients. It was resolved: "That the applications attached hereto and forming part of these minutes relative to the cancellation, reduction, refund or levy of taxes be disposed of as recommended therein." Alderman B. Stortz declared a conflict of interest and abstained from all discussion and voting concerning Item #290 as his wife is employed by the Mutual Life Assurance Company of Canada and Items #354, 355 and 356 as he is employed by Weber, Tanner and Miller. Alderman J. Ziegler declared a conflict of interest and abstained from all discussion and voting concerning Items #347 and 348 as the owners are clients.
