B. REPORT OF THE CHIEF ADMINISTRATIVE OFFICER 1. Raffle Lottery It was resolved: "That the Kitchener Knights of Columbus, Father Funcken Council No. 1504, be granted permission to sell Raffle Lottery tickets in the City of Kitchener under City of Toronto Lottery Licence #788471 for a draw to be held in the City of Toronto on May 19, 1990." 2. Execution of Final Release It was resolved: "That the Mayor and Clerk be authorized to execute a Full and Final Release in settlement of a claim against the City and others by Boualone Chouangsirivong and a claim by Farrow Bros. Auto Electric Ltd., said claims arising out of work done in connection with the Shoemaker Creek Improvements in 1984." 3. Provincial Lottery Licence It was resolved: "That the City of Kitchener has no objection to a Provincial licence being issued to the Waterloo Region Catholic Community Foundation, to conduct a Series Raffle lottery from May 16, 1990 to June 5, 1991, to be known as the Catholic Charities Lottery, with all proceeds going to the capital fund drive." 4. Encroachment Aqreements - BRIDGEPORT NORTH & VICTORIA PARK WARDS It was resolved: "That the Mayor and Clerk be authorized to execute an Encroachment Agreement with the registered owners of 71 Waterloo Street to legalize the existing porch which extends 1.88 feet, more or less, into the road allowance known as Waterloo Street." - and - "That the Mayor and Clerk be authorized to execute an Encroachment Agreement with the registered owners of 43 Queen Street South to legalize the existing brick building which extends 0.56 feet, more or less, onto the road allowance known as Siegner Lane." 5. Consent - SOUTH WARD It was resolved: "That the City of Kitchener consent to a mortgages from Leenan Properties Management Limited, Menya Investments Limited and Harwin Developments Limited to Bank of Montreal for the properties described as Parts 8, 9, 10, 11, 12, 13 & 14 on Reference Plan 58R-5840." 6. Offer to Purchase - BRIDGEPORT NORTH WARD COMMITTEE OF THE WHOLE MINUTES DECEMBER 11, 1989 B. REPORT OF THE CHIEF ADMINISTRATIVE OFFICER (Cont'd) The Committee deferred to the Council meeting of December 18, 1989, consideration of a recommendation that the City accept an offer from Sarah Lang to purchase Block "A", Plan 1107, so as to allow staff to submit additional documentation and sketch of the lot in question. 7. Kitchner Waterloo Symphony Orchestra Association Inc. It was resolved: "That, upon the expiration of the current agreement between the City of Kitchener and The Kitchener Waterloo Symphony Orchestra Association Inc. on December 31, 1989, Council give its consent to allow The Centre in the Square Inc. to enter into the renegotiation of this and all subsequent rental agreements with The Kitchener Waterloo Symphony Orchestra Association Inc." 8. Surplus Land - CENTRE WARD The Committee deferred to the Council meeting of December 18, 1989, consideration of a recommendation that the City accept an offer from David Sloan and Gerald White to purchase land described as Parts 1 and 2 on Plan 58R-1473, subject to retention of an easement for utilities, so as to allow staff to submit additional documentation and a legible plan outlining the property in question. 9. Garbaqe Rebate It was resolved: "That the letter dated November 23, 1989 from 257913 Holdings Ltd. be accepted as a late application for garbage rebate." 10. Tender It was resolved: "That tender T89-67, Domestic Water Meters, be awarded to J-M Industrial Supply, Downsview at their tendered price of $276,156." 11. Aqreement of Purchase and Sale - SOUTH WARD It was resolved: "That the Mayor and Clerk be authorized to execute an Agreement of Purchase and Sale dated December 6, 1989 to convey Parts 15, subject in part to an easement, and 14, Plan 58R-5596 to Sail Hill Investments Limited in exchange for an easement on Part 1, Plan 58R-6976." 12. Expression of Interest It was resolved: "That Expression of Interest E89-82, Consultant's Services - Schneider Creek Trunk Sanitary Sewer, be awarded to the Proctor & Redfern Group, Kitchener, to provide consulting engineering services as identified in the terms of reference supplied, subject to an acceptable contract being negotiated and an upset fee established." 13. Applications for Cancellation, Refund, Reduction or Levy of Taxes - Third Sittinq (December 11, 1989) Alderman C.
