A. BY-LAWS AS LISTED ON THE AGENDA - 2ND READING
It was resolved:
"That the by-laws considered by this Committee be taken as read a second time and be
recommended for enactment."
B. REPORT OF THE CHIEF ADMINISTRATIVE OFFICER
1. Banner Requests
It was resolved:
"That in conjunction with the annual Christmas Seal Campaign to be launched on
November 1, 1989, The Lung Association, Waterloo Region, be granted permission to
have a banner erected across King Street at Frederick Street from November 20, 1989 to
December 15, 1989, inclusive.
Further that this organization make the necessary arrangements with the Purchasing
Division for the erection and removal of the banner and the payment of any costs
associated therewith."

"That in conjunction with the Fourth Annual Kitchener Minor Soccer Tournament to be
hosted by The Mutual Group and held on August 11 and August 12, 1990, Kitchener
Minor Soccer be granted permission to have a banner erected across King Street at
Frederick Street from July 25, 1990 to August 13, 1990 inclusive.
Further that this organization make the necessary arrangements with the Purchasing
Division for the erection and removal of the banner and the payment of any costs
associated therewith."
2. Lease - CENTRE WARD
It was resolved:
"That the Mayor and Clerk be authorized to execute a Lease between the City and The
Regional Municipality of Waterloo with respect to premises municipality known as 122
Frederick Street, Kitchener, for a term commencing August 1, 1989 and terminating March
31, 1991 at a monthly rent of Two Thousand Two Hundred Dollars ($2,200.00)."
3. Easements
It was resolved:
"That the Mayor and Clerk be authorized to execute an Easement in favour of Bell
Canada to legalize the installation of an equipment box on City property known as the
Breithaupt Community Centre."

"That the City provide Bell Canada with an easement over Part 9 of the draft reference
plan for Site 130 in Huron Industrial Park in exchange for releases of easements in favour
of The Bell Telephone Company of Canada registered as Instrument No.'s B-282608,
B-28609 and 344339 from Parts 2 (except Part 1, Plan, 58R-6202), 23, 29 and 30, Plan
58R-5010."

3. Easements (Cont'd)
"That the Mayor and Clerk be authorized to execute an Easement in favour of G.F.W.
Funding Corp. over City lands designated as Parts 1 and 2, Plan 58R-6809 to facilitate
service connections to a townhouse development at 170 Cherry Street."
4. Body-Rub Parlour and Massaqists Licences
It was resolved:
"That Mr. Frank S. Thomas and Ms. Cecila Van Manen be granted a Body-Rub Parlour
licence for a Body-Rub Shop to be known as Creative Relaxation Centre at 347 Lancaster
Street West, Unit 2, Kitchener, for the year 1989;
And further, that Massagist licences be granted to the following persons for the year 1989:
Ms. Cecila Van Manen, 315 Queen Street, New Dundee Mr. Frank Thomas, 19 Lewis
Crescent, Kitchener."
5. Execution of Enqineerinq Aqreement
It was resolved:
"That the Mayor and Clerk be authorized to execute an agreement for the provision of
professional engineering services made between the City of Kitchener and Cumming
Cockburn Ltd., regarding Beechwood Forest North, Stage 2, 30T-88012."
6. Certification of Title Applications
It was resolved:
"That the Mayor and Clerk be authorized to execute a Consent and Waiver of Notice and
Draft Plan to expedite a Certificate of Titles Act Application by Freure Management
Limited with respect to lands described as Part of Lot 4, M.C.P. 966, Part of Lot 1, M.C.P.
975 and Part of Lots 4, 5 & 6, Easterly Range Registered Plan 589 and designated as
Part 1 on Draft Reference Plan."

"That the Mayor and Clerk be authorized to execute a Consent and Waiver of Notice and
Draft Plan to expedite a Certificate of Titles Act Application by Freure Management
Limited with respect to lands described as Block "C", Registered Plan 1441 and
designated as Part 1 on Draft Reference Plan."

"That the Mayor and Clerk be authorized to execute a Consent and Waiver of Notice and
Draft Plan to expedite a Certificate of Titles Act Application by Waechtersbach Canada
Limited with respect to lands described as Part of Lot 14, Registrar's Compiled Plan 1471,
and designated as Parts 1 and 2 on Draft Reference Plan."
7. Licensinq Aqreement - SOUTH WARD
It was resolved:
"That the Mayor and Clerk be authorized to execute a Licensing Agreement dated
November 3, 1989 to allow the Laurentian Pre School to use a portion of the Kitchener
Lions Community Arena from September 5, 1989 until June 1, 1990 for rent in the sum of
$1,975.00 and from September 4, 1990 until May 31, 1991 for rent in the sum of
$2,075.00."

8. Request for Subsidy
It was resolved:
"That the Mayor and Clerk be authorized to execute a petition for interim payment under
the Public Transportation and Highway Improvement Act on expenditures made for
construction and maintenance of roads or streets, bridges and culverts in the year 1989
totalling $4,193,119.00."
9. French Lanquaqe Services Act
On October 23, 1989, City Council deferred the following motion by Alderman J. Ziegler to the
November 14th meeting:
"That local members of the Provincial legislature be requested to take whatever action
necessary as as not to allow the City of Kitchener to become an area designated within
the French Language Services Act (Bill 8) prior to November 18, 1989. And further, that if
in the future, the City of Kitchener is to be designated by amendment to the legislation, the
municipality first be permitted to conduct a referendum on the provision of language
services in a language other than English."
It was resolved:
"That consideration of the motion by Alderman J. Ziegler concerning the possibility of
Kitchener becoming a designated area within the French Language Services Act (Bill 8)
be deferred to a future meeting, pending receipt of additional information."
10. Offer to Sell - CENTRE WARD
It was resolved:
"That the City of Kitchener inform the Regional Municipality of Waterloo that it has no
interest in acquiring the property municipally known as 111 Duke Street East, Kitchener."
11. Provincial Unconditional Grant Proqram/Municipal Road Subsidies
It was resolved:
"That City Council adopt the following resolution:
That the Council of the Corporation of the City of Kitchener strongly urges the Treasurer
of Ontario and the Minister of Municipal Affairs to support the reinstatement of at least a
cost-of-living adjustment to the Unconditional Grant Program of Transfers to Municipalities
in 1990 to lessen the prospects of sharp increases in municipal mill rates due to the
'flatlining' of unconditional grant transfers."
12. Tenders
The Committee was in receipt of a memorandum from Mr. F.J. Clement, Director of
Purchasing, dated November 9, 1989, concerning a tender for the construction of the
Detweiler Culvert.
It was resolved:
"That tender T89-80, Highland Park West - Detweiler Culvert Construction, be awarded to
J. Weber Contracting Limited, Breslau, at their tendered price of $182,182.00."
