1. Commencement
The Planning and Strategic Initiatives Committee held an electronic meeting this
date, commencing at 7:00 p.m.
2. Public Hearing Matters under the Planning Act (7:00 p.m. advertised start
time)
Councillor P. Singh advised this is a formal public meeting to consider
applications under the Planning Act. If a person or public body that would
otherwise have an ability to appeal a decision of the City of Kitchener to the
Ontario Lan Tribunal, but if the person or public body does not make oral
submissions at the public meeting or make written submissions to the City of
Kitchener before the By-law is passed, the person or public body is not entitled to
appeal the decision.
2.a DSD -2021-159 - Draft Plan of Condominium (Vacant Land) 30CDM-21207 -
60 Trussler Road - Elev8 Properties Inc.
The Committee considered Development Services Department report DSD -2021-
159, dated August 11, 2021, recommending draft approval of Condominium
Application 30CDM-21207 for 60 Trussler Road in the City of Kitchener, subject
to the conditions shown in Appendix "A" to Report DSD -21-159.
E. Schneider presented to the Committee regarding the site context, the
proposed draft plan of condominium, and the proposed site plan. E. Schneider
explained that privacy concerns raised by neighbouring residents had been
addressed by the applicant's agreement to construct a privacy fence, which
would be addressed through the landscape plan during the site plan process.
S. Patterson addressed the Committee in support of the staff report and
recommendation.
In response to the Committee's questions, E. Schneider spoke to the planning
process for draft plans of condominiums for vacant land.
On motion by Councillor B. loannidis
it was resolved:
"That the City of Kitchener, pursuant to Section 51(31) of the Planning Act
R.S.O. 1990, c.P.13, as amended, and By-law 2002-164 of the City of
Kitchener, as amended, grant draft approval to Condominium Application
30CDM-21207 for 60 Trussler Road in the City of Kitchener, subject to the
conditions shown in Appendix "A" to Development Services Department
report DSD -21-159."

2.b DSD -2021-124 - Draft Plan of Condominium (Vacant Land) 30 CDM -20206 -
Demolition Control DC21/019/N/ES - 99-109 North Hill Place & 29 Chicopee
Terrace - 99 North Hill Place Inc.
The Committee considered Development Services Department report DSD -2021-
159, dated August 11, 2021, recommending draft approval of Condominium
Application 30CDM-20206 for 99-109 North Hill Place & 29 Chicopee Terrace
subject to the conditions shown in report DSD -21-124, Appendix "A"; and further,
the Demolition Control Application DC21/019/N/ES requesting permission to
demolish 4 single detached dwellings located at 99-109 North Hill Place & 29
Chicopee Terrace be approved.
E. Schneider presented to the Committee regarding the site context, the draft
plan of condominium, the original site plan submission, and the resulting
concerns regarding privacy and pedestrian connection to North Hill Place. E.
Schneider described how the applicant had addressed the concerns raised by
neighbouring property owners in the amended site plan submission by relocating
the proposed sidewalk to the side of the drive aisle which does not face a
residential lot, creating a pedestrian connection to North Hill Place, and
rearrangings lots so only backyards faced the existing properties on Chicopee
Terrace. During a public consultation meeting, E. Schneider noted that
neighbouring property owners expressed further concerns regarding privacy,
traffic, parking, nuisance, and disruption during construction. E. Schneider
reported the applicant had agreed to address these concerns by installing light
standards, shielding light to limit light trespassing, re -grading, demolishing the
current structures as soon as possible to limit trespassers and vandalism.
Further, the applicant agreed to review driveway grading during the site plan
process and install low-level landscaping and decorative features to limit vehicle
headlights where possible. E. Schneider advised the existing traffic levels on
Chicopee Terrace are low, well within the peak levels for a residential roadway,
and do not meet the threshold for a traffic impact assessment. E. Schneider
explained that access to the proposed development from North Hill Place is not
recommended because the roadway is undersized and does not meet modern
standards for access or servicing. E. Schneider further explained that expanding
and reservicing the road would face significant costs and challenges as the
Grand River Conservation Authority owns the land and cannot sell lands for

development purposes without Provincial approval. E. Schneider stated that staff
would continue to work with the applicant throughout the design phases to
ensure the concerns of neighbouring property owners are addressed, mitigated,
or resolved wherever possible.
S. Patterson addressed the Committee in support of the staff report and
recommendation. S. Patterson requested the permission to demolition the
existing structures be granted as soon as possible to address concerns about
trespassing and vandalism. In response to the Committee's questions, S.
Patterson spoke to grading and the use of retaining walls to limit the impact to
surrounding lands, as well as the history of the property, and the tree
management plan.
D. Pinette spoke in opposition to the proposed development due to concerns
regarding increased traffic, street parking, pedestrian safety, privacy, light
pollution, snow removal, and a lack of environmental studies.
R. Dunn stated opposition to the proposed development due to concerns
regarding the impacts of construction, zoning, density, and the need to
investigate the use of Grand River Conservation Authority Land to facilitate
access to the proposed development from North Hill Place.
In response to questions from the Committee, E. Schneider confirmed staff could
provide an engineering estimate for infrastructure improvements to North Hill
Place by the September 20, 2021, Council meeting. E. Schneider further
described the applicant's commitment to mitigate stormwater management
concerns and tree protection fencing through the site plan agreement. E.
Schneider further discussed considerations for public notice and the conditions
for the proposed development.
On motion by Councillor D. Schnider
it was resolved:
That consideration of the following recommendation be referred to the
September 20, 2021, Council meeting to allow for an opportunity for
staff to provide cost estimates for infrastructure improvements to North Hill
Place from Fairway Road to the proposed development; and, to receive
confirmation the developer is amenable to constructing an 8 -foot -high
privacy fence along the property line shared with 3, 7, 11, 15, 21, and 25
Chicopee Terrace; and further, to receive confirmation the developer
commits to address the overland storm water flow issues at the site plan
process:

3. Discussion Items
3.a DSD -2021-161 - City of Kitchener Development Manual Update
The Committee considered Development Services Department report DSD -2021-
161, dated August 17, 2021, recommending the updated City of Kitchener
Development Manual be adopted; and, the Development Manual be reviewed by
staff every two (2) years for minor revisions and every five (5) years for major
revisions; and further, the General Manager of the Development Services
Department be authorized to approve minor changes to the Development
Manual, as needed, with major changes requiring Council approval.
J. Brule presented to the Committee regarding the purpose of the City's
Development Manual as a collection of guidelines and procedures for
development applications and explained how changes to industry standards and
technology had required the document to be reviewed and updated. J. Brule
reviewed the engagement of internal and external stakeholders and the
coordination with other projects in the development of the document. J. Brule
explained how the update better aligns important City documents and initiatives
for future development.
In response to the Committee's questions, staff discussed how the technical
guidelines consider the priorities identified by Council, including sustainability and
density.

On motion by Councillor B. loannidis
it was resolved:
"That the updated City of Kitchener Development Manual be adopted and
in force as of Council's approval; and,
That the City of Kitchener Development Manual be reviewed by staff every
two (2) years for minor revisions and every five (5) years for major
revisions to keep current; and further,
That the General Manager of the Development Services Department be
authorized to approve minor changes to the Development Manual, as
needed, with major changes requiring Council approval."
