2. MINUTES FOR APPROVAL
On motion by Councillor K. Galloway-Sealock the minutes of the regular meeting
held September 20, 2021 and special meetings held September 20, 30 and
October 4, 2021, as mailed to the Mayor and Councillors, were accepted.

5. PRESENTATIONS
5.1 Recognition Islamic Heritage / History Month (October)
5.1.a Mifrah Abid and Sarah Shafiq, Coalition of Muslim Women of KW
Mifrah Abid and Sarah Shafiq, Coalition of Muslim Women of KW, addressed
Council in recognition of Islamic Heritage history month. M. Abid provided an
overview of Islamic Heritage events that were hosted this month to celebrate
Islamic history. In response to questions, S. Shafiq requested Council consider
declaring October Islamic Heritage month and further consider taking additional
action to help curtail Islamophobia.
In response to questions, M. May, Deputy CAO, General Manager, Community
Services Department, stated he could review the delegation's presentation and
provide additional information on actions or By-laws that could be taken by the
City to assist in addressing racist behaviours.
6. DELEGATIONS
6.'I Notice of Motion - M. Johnston - Provincial Vaccine Passport, listed as Item
9.3 under New Business.
6.1.a Mark Bingeman
Councillor M. Johnston gave notice that she would introduce a motion this date
related to lobbying the Province of Ontario to address a province wide vaccine
passport program to support local businesses and to further urge the Province to
provide financial supports for businesses to cover capital and human resource
costs necessary to execute this requirement.
Mark Bingeman, Chair, Economic Development Advisory Committee (EDAC),
addressed Council in support of Councillor Johnston's Notice of Motion, noting
EDAC voted unanimously in support of this direction.

Councillor Johnston acknowledged the recent news announcements by the
Provincial government related to the vaccine passport and agreed to amend her
Notice of Motion to address the current state of the pandemic and the current
needs for support for local business owners.

"WHEREAS the Covid-19 pandemic has been both a health crisis and an
economic crisis; and,
WHEREAS lockdown and physical distancing measures have caused
significant hardship to businesses, particularly those dependent on in-
person delivery or experience (ex: retail, restaurant, hospitality, personal
service, etc.); and,
WHEREAS vaccinations have proven to be an effective means of keeping
Ontarians safe and can enable businesses to safely remain open without
compromising the health of their customers and employees; and,
WHEREAS the Province of Ontario and the Regional Municipality of
Waterloo are the primary authorities governing public health in the city of
Kitchener;
WHEREAS the Economic Development Advisory Committee expressed
concerns about financial supports for businesses and the City's ability to
support, maintain and grow the economy;
THEREFORE BE IT RESOLVED that the City of Kitchener thank the
Province of Ontario for developing the vaccine passport program, but urge
the Province to provide financial supports for businesses to cover capital
and human resource costs necessary to execute the program; and,
THEREFORE BE IT FINALLY RESOLVED that a copy of this resolution
be forwarded to the Honourable Premier of Ontario, the Minster of
Municipal Affairs and Housing, the Association of Municipalities of Ontario;
and, all other Ontario municipalities."

6.2 Development Services Department report DSD -2021-177, listed as item
7.1.b under the Community and Infrastructure Services Committee report
dated October 4, 2021.

6.2.a David Barker
Council considered Development Services Department report DSD -2021-177 —
Neighbourhood Speed Limit Review . B. Cronkite, Director, Transportation
Services was in attendance and responded to questions from Council.
David Barker addressed Council in support of the staff recommendation outlined
in report DSD -2021-177 relating to the neighbourhood speed limit traffic review,
specifically in regard to reducing speed limits on Grand River Boulevard and
Morrison Road. D. Barker requested Council approve the immediate
implementation of the 40 km/hour speed limits including signage and
enforcement on Grand River Boulevard and Morrison Road; and, if possible, the
installation of an Automated Speed Enforcement (ASE) camera on Grand River
Boulevard.
In response to questions, B. Cronkite stated he could further review what
information the City could obtain from the ASE program, and whether the City
could take further action beyond ticketing, and could report back further through
a future staff report, potentially the vision zero report anticipated to be considered
prior to the end of 2021. B. Cronkite further advised a critical component of the
neighbourhood speed limit review will include education.
Questions were raised regarding reducing the timeline to implement the
neighbourhood speed limit review. It was noted staff would be bringing forward
additional information on the two-year time frame during the 2022 budget
process.

"That the speed limit in all residential neighbourhoods within the City of
Kitchener be reduced from 50km/h to 40km/h, as outlined in Development
Services Department report DSD -2021-177; and,
That the speed limit in school zones and along signed and identified
neighbourhood bikeways be further reduced to 30km/h within residential
neighbourhoods; and,
That the capital budget allocation required for implementation be referred
to the 2022 budget process; and further,
That the Uniform Traffic Bylaw be amended accordingly."

Nicolette Van Oyen addressed Council in support of the recommendation as
outlined in report DSD -2021-165 — Official Plan Amendment OPA21/006/R/TS —
Zoning By-law Amendment ZBA21/009/R/TS — 61 & 65 Roy Street — The
Windermere Apartments Inc. & Roy Street Investments Inc.

"That Official Plan Amendment Application OPA21/006/R/TS for The
Windermere Apartments Inc. & Roy Street Investments Inc. requesting the
addition of Special Policy Area 10 for the lands specified and illustrated as
the "Area of Amendment" on Schedule "A", be adopted in the form shown
in the Official Plan Amendment attached to Development Services
Department report DSD -2021-165 as Attachment "A", and accordingly
forwarded to the Region of Waterloo for approval; and further,
That Zoning By-law Amendment Application ZBA21/009/R/TS for The
Windermere Apartments Inc. & Roy Street Investments Inc., -requesting a
change from Residential Five Zone (R-5) with Special Use Provision 164U
to Residential Five Zone (R-5) with Special Use Provision 164U and
Special Regulation Provision 773R, be approved in the form shown in the
"Proposed By-law" dated September 10, 2021 for the lands illustrated on
"Map No. 1" attached to Development Services Department report DSD -
2021 -165 as Attachment "B"."

7.1 COMMUNITY AND INFRASTRUCTURE SERVICES COMMITTEE - OCTOBER

Councillor D. Chapman requested 7.1.d be voted on separately.
B. Gilmore, Fire Chief, was in attendance to respond to questions from Council
regarding report CSD -2021-17 — Fire Department Suppression Response Time &
Staffing Review, listed as Item 7.1.d on the Community and Infrastructure
Services Committee report. In response to further questions, M. May advised
that, in regard to the existing tiered response agreement, staff will provide
additional information on this matter by Spring 2022.

7.1.a DSD -2021-166 - Old Mill Sanitary Pumping Station - Consultant Contract
Increase
"That the contract for MTE Consultants Inc. for engineering services
related to the Old Mill Sanitary Pumping Station (OMSPS) be increased by
$282,700, funded by the development charge reserve fund, as outlined in
Development Services Department report DSD -2021-166."

7.1.b DSD -2021-177 - Neighbourhood Speed Limit Review

7.1.c CSD -2021-15 -Additional Staff for Proactive Sidewalk Enforcement
"That Council refer the expansion of the proactive sidewalk enforcement
program to the 2022 budget process, as outlined in Community Services
Department report CSD -2021-15; and further,
That staff be directed to find a one-time funding source to implement the
proactive sidewalk enforcement program for the 2021 winter season."

7.1.d CSD -2021-17 - Fire Department Suppression Response Time & Staffing Review
Item 7.1.d of the Community and Infrastructure Services Department report was
voted on separately from the balance of the committee report.

"That City Council approve the plan to increase suppression staff by 20
new firefighters over the next four years and open a new fire station in
2026, as outlined in Community Services Department report CSD -2021-
17; and,
That the financial implications of these additions be referred to the City's
annual budget process; and further,
That staff be directed to complete a fire station location study in 2022 to
determine the optimal location for a new fire station, and subsequent
impacts on the response zones for other Kitchener fire stations."

9. NEW BUSINESS
9.1 REGIONAL COUNCIL UPDATE — MAYOR B. VRBANOVIC
Mayor B. Vrbanovic advised Council that, as of the week of October 11, 2021,
the Region hit a 90% rate for vaccination levels for first dose vaccine rate and
87% for those who are fully vaccinated within the Region for those residents
eligible to be vaccinated. Questions were raised regarding the roll out for booster
shots within the Region.
9,2 Notice of Motion - D. Chapman - "Renovictions" - Safe and Adequate
Housing
Councillor D. Chapman gave notice that she would introduce a motion this date
related to lobbying the Province of Ontario to take additional and meaningful
steps to address the ever increasing problem of "Renovictions".
Councillor M. Johnston suggested and it was agreed that an additional clause be
included in the motion to encourage all levels of government to collaborate in
data sharing and collection related to renovations and the impacts on tenancy.

'WHEREAS safe and adequate housing is recognized as a fundamental
human right by the Federal Government, whose effect as a major social
determinant of health and wellbeing goes well beyond a basic requirement
for shelter; and,
WHEREAS Kitchener's housing situation has dramatically shifted since
2016, a Housing Needs Assessment demonstrating the average price for
a house increased by 104% between 2009 to 2019, with the greatest
increase since 2016, and rents increased by an average of 41 %; and,
WHEREAS the City is experiencing a gap in the provision of housing, in
particular the need for 450 units of supportive housing, over 5,000 units of
community housing and 9,300 units of affordable rental housing to
address the gaps in the existing supply; and,
WHEREAS the City of Kitchener has adopted "Housing for All — The City
of Kitchener's Housing Strategy" demonstrating a commitment to realizing
the right to housing locally and addressing the housing crisis within the
municipality; and,
WHEREAS landlords and investors are adding to the strain on the housing
supply through the unscrupulous act of "Renovictions" by claiming they
are completing major renovations and evicting and displacing existing
tenants, and subsequently raising rents which affects those generally
identified as lower income earners and their ability to find safe, adequate
and affordable housing; and,
WHEREAS citizens and communities are hurt by these practices which
can and does directly impact the housing and homelessness crisis, as well
as inflict damage and trauma (both financially and mentally) particularly on
our most vulnerable citizens;
THEREFORE IT BE RESOLVED that the City of Kitchener lobby the
Province of Ontario to take additional and meaningful steps to address the
ever increasing problem of "Renovictions";
THEREFORE IT FURTHER BE RESOLVED that the City of Kitchener
urge all levels of government to collaborate in data sharing and collection
related to renovations, specifically the impacts of renovations on tenancy;
THAT IT FINALLY BE RESOLVED that a copy of this motion be sent to
the Association of Municipalities of Ontario, the Premier of Ontario, the
Ministry of Municipal Affairs and housing, the Region of Waterloo and
other Municipalities in Ontario for their consideration and possible
endorsement."

Deputy Clerk, Council agreed to add two By-laws related to Planning and
Strategic Services report Item 7.2.b - an Official Plan Amendment By-law and
Zoning By-law Amendment for 61 & 65 Roy Street.

11.1.a To further amend By-law No. 2019-113, being aby-law to regulate traffic

11.1.b To further amend By-law No. 2010-190, being a by-law to prohibit
unauthorized parking of motor vehicles on private property.
11.1.c To further amend By-law No. 88-171, being a by-law to designate private
roadways as fire routes and to prohibit parking thereon.
11.1.d To further amend By-law No. 2008-117, being a by-law to authorize
certain on -street and off-street parking of vehicles for use by persons with
a disability, and the issuing of permits in respect thereof.

11.1.e Being a by-law to amend Chapter 599 of The City of Kitchener Municipal
Code with respect to Licensing and Regulation of Businesses.

12.2 ADMINISTRATIVE REPORTS
12.2.a INS -2021-7 - Agreement for Maintenance Services on Regional Roads
R. Lusk, Director, Operations Roads & Traffic, was in attendance to respond to
questions from the Committee.
It was resolved:
"That the Mayor and Clerk be authorized to execute the Agreement for
Maintenance Services with the Region of Waterloo for the provision of
summer and winter maintenance services on selected Regional roads
within the City of Kitchener, as outlined in the Infrastructure Services
Department report INS -2021-7 following Regional Council approval,
expected to be granted on October 20, 2021, said documentation to be to
the satisfaction of the City Solicitor; and further,
That the Operations — Roads & Traffic staff complement be increased by
seven (7) full-time equivalents at zero impact to the City of Kitchener's tax
base pursuant to the terms of the agreement between the City of
Kitchener and the Region of Waterloo."
