BY-LAWS AS LISTED ON THE AGENDA - 2ND READING It was resolved: "That the by-laws considered by this Committee be taken as read a second time and be recommended for enactment." REPORT OF THE CHIEF ADMINISTRATIVE OFFICER 1. Easement - ROCKWAY-ST. MARY'S WARD It was resolved: "That the Mayor and Clerk be authorized to execute an Easement in favour of Kitchener-Wilmot Hydro, to legalize the installation of an overhead hydro service line on City property known as Mausser Park." 2. Chanqe in Siqninq Authority It was resolved: "That the Mayor and Clerk be authorized to execute the necessary documentation with respect to the change in signing authority for the various bank accounts resulting from the appointment of Larry Ryan as Director of Budgets and Financial Services." 3. Advance of Funds to Various Orqanizations It was resolved: "That the City Treasurer is hereby authorized to advance funds as the same may be required to the Social Planning Council of Kitchener-Waterloo, the Kitchener Musical Society, the Kitchener Horticultural Society, Project Lift, the Kitchener Public Library Board, the Centre In The Square Inc., the Kitchener Chamber of Commerce Visitor & Convention Bureau and the Homer Watson House Foundation provided that such advances shall not in any case exceed 70% of the amount provided by Council to any such local Board or organization during the year 1989 save and except the Social Planning Council of Kitchener- Waterloo and Project Lift which shall on a month-to-month basis receive not more than 1/12 of their 1989 City budget funds. Such authorization, however, to exclude the Waterloo County Board of Education, the Waterloo Region Roman Catholic Separate School Board and the Regional Municipality of Waterloo, and provided further, that this arrangement shall remain in effect only until the 1990 budget is established." 4. Renewal - Body-Rub Parlour and Massaqists Licences It was resolved: "That Mr. Frank S. Thomas and Ms. Cecila Van Manen be granted a Body-Rub Parlour licence for a Body-Rub Shop known as Creative Relaxation Centre at 347 Lancaster Street West, Unit 2, Kitchener, for the year 1990, and further, That Massagist licences be granted to the following persons for the year 1990: Ms. Cecila Van Manen 315 Queen Street, New Dundee Mr. Frank Thomas 19 Lewis Crescent, Kitchener." Variance to Siqn By-law - SOUTH WARD It was resolved: "That the decision of the Committee of Adjustment sitting as a Standing Committee of City Council, of February 6, 1990, recommending approval of Submission No. S 2/90 - Conestoga College, Be Ratified and Confirmed." 6. Industrial Land Consent - SOUTH WARD It was resolved: "That the City consent to a lease from Howard and Patrick Beaudoin to 655598 Ontario Ltd. operating as Sax Construction Co. for space at the property described as Part 5 on Reference Plan 58R-5840 and municipally known as 106 McBrine Place, subject to applying for and being issued an occupancy permit." 7. Encroachment Aqreement - VICTORIA PARK WARD It was resolved: "That the Mayor and Clerk be authorized to execute an Encroachment Agreement with the registered owners of 36-50 Francis Street, known as Part 1, Reference Plan 58R-6449, to legalize the frame door entrance and concrete loading dock as they encroach onto Francis Street and the foundation as it encroaches onto Joseph Street." 8. K-W Oktoberfest - Support of Grant Application It was resolved: "WHEREAS Kitchener-Waterloo Oktoberfest Inc. is a local non-profit cultural organization; and, WHEREAS this organization is vested with the responsibility of overseeing one of the largest annual community festivals in Canada; and WHEREAS the organization has applied to the Ontario Ministry of Citizenship for a grant pursuant to the Ministry's Facilities Improvement Program; and, WHEREAS such grant would be used to assist with the acquisition and development of the K-W Oktoberfest "Natural Cultural Centre" to be located at 17 Benton Street, Kitchener; THEREFORE BE IT RESOLVED that the Council of the Corporation of the City of Kitchener endorse the application by Kitchener- Waterloo Oktoberfest Inc. to the Ontario Ministry of Citizenship for the purposes stated herein." 9. Applications for Cancellation, Refund, Reduction or Levy of Taxes The Committee considered a letter dated February 7, 1990, from Mr. R.W. Pritchard, dealing with applications for cancellation, refund, reduction or levy of tax pursuant to Section #496 of the Municipal Act, R.S.O. 1980. Alderman C. Weylie disclosed a conflict of interest and abstained from all discussion respecting Items 3 and 20 (Applications 1004 and 1003 respectively) submitted by Peter Pekurar who is a client of hers. Alderman C. Weylie previously disclosed a conflict of interest and abstained from all discussion and voting respecting Items 3 and 20 (Applications 1004 and 1003 respectively) submitted by Peter Pekurar who is a client of hers. 10. Federation of Canadian Municipalities - 25th Anniversary of Canadian Flaq The Committee considered a letter dated February 5, 1990, from Mr. George Ferguson, President of the Canadian Federation of Municipalities. It was resolved: "That we recognize February 15, 1990, as the 25th Anniversary of the introduction of Canada's flag." 11. Resolution of Metropolitan Toronto - Apolo.qy to Italian Canadian World War II Internees The Committee considered a letter dated February 1, 1990, from the Municipality of Metropolitan Toronto requesting endorsation of a resolution adopted by the Council on January 31, 1990 which supports asking the Federal Government to apologize to the Italian Canadian Community for its actions during World War II. It was resolved: "That we endorse the resolution of the Municipality of Metropolitan Toronto supporting the National Congress of Italian Canadians' request of the Federal Government for an apology to the Italian Canadian Community for the injustices which took place during the 1940's. And further, that the Federation of Canadian Municipalities and the Association of Municipalities of Ontario be advised of our endorsement."
