A. BY-LAWS AS LISTED ON THE AGENDA - 2ND READING
It was resolved:
"That the by-laws considered by this Committee be taken as read a second time and be
recommended for enactment."
B. REPORT OF THE CHIEF ADMINISTRATIVE OFFICER
1. Taq Days
It was resolved:
"That the City of Kitchener approves of Number 1596 Royal Canadian Army Cadet Corps
conducting an Army Cadet Corps Tag Day in Kitchener on March 30th and 31st, 1990 and
April 13th and 14th, 1990."

"That in conjunction with the Canadian Cancer Society the Air Cadets of Kitchener be
permitted to hold the 11th Annual Scott Wilson Tag Day in Kitchener on April 14, 1990."
2. Banner Request
This item was dealt with under Delegations.
3. Commencement of Preqradinq - STANLEY PARK WARD
Alderman Zehr questioned why the City would support a request for approval of pregrading of
Stage 2 of the subdivision when it was unlikely to develop for several years. Mr. D. Suzuki
advised the Committee of the contents of a memorandum from C. Ladd listing the points in
favour of acceding to the request for approval of pre- grading.
It was resolved:
"That Council allow 225516 Ontario Limited to pregrade Stage 2 of Emerald Hills Estates,
located on the east side in the Ottawa Street/Forwell Road area, subject to the provision
of an acceptable tree saving plan and archaeological study. Topsoil and seed is to be
placed on the pregraded areas prior to the end of August 1990.
It is to be understood by 225516 Ontario Limited that such grading shall be at their sole
risk and liability."
4. Raffle Licences
It was resolved:
"That the City of Kitchener has no objection to a Provincial Licence being issued to the
Kitchener Rotary Club to conduct a Raffle Lottery at The Centre In The Square, Kitchener,
on June 5, 1990."

"That the Canadian Foundation of Ileitis and Colitis be granted permission to sell raffle
lottery tickets in the City of Kitchener under Provincial Licence #795145 for seven draws
to be held between May 31, 1990 and October 13, 1990."

5. Shrine Circus 1990
It was resolved:
"That we grant permission to the Waterloo County Shrine Club to conduct its fourth
annual Shrine Circus at Fairview Park Mall in the Woolco portion of the parking lot on
June 22 and 23, 1990."

(5. Consent - Industrial Land - FAIRVIEW WARD
It was resolved:
"That the Mayor and Clerk be authorized to execute a Quit Claim Deed releasing all rights
of the City, contained in paragraph 5. Title Control of Schedule "A" to Instrument No.
292237 respecting Lot 21, Registered Plan 1525, and known as 101 Webster Road,
Kitchener."
7. Development Charge Policy - City of Kitchener 1990
It was resolved:
"1. That as of March 31, 1990, there be n._~o adjustment to the present City of Kitchener Lot
Levies as set out in Bylaw Number 89-59 all of which is in accordance with Section 44(2)
of The Development Charges Act.
2. That the Council of the Corporation of the City of Kitchener authorize the Legal
Department to take the necessary steps to prepare a new Sewer Impost by-law to be
approved by the O.M.B. which reflects the following changes to be made to Chapter 320
of the City of Kitchener Municipal Code.
The Amount Payable in Column 2 of Schedule 'A' should be amended from "$179.00",
$358.00", "537.00" and "$119.00" to $187.00", "$374.00", "561.00" and "$124.00"
respectively."
8. Tenders
At the request of Alderman B.M. Hiscott it was agreed to revise the recommendation
pertaining to tender T90-11 to provide that after Pioneer Tower West Collector Road, "Deer
Ridge Drive" would be inserted in brackets since the street name was agreed to this date.
Alderman C. Zehr questioned tender T90-18 regarding wall restoration at Don McLaren
Arena. Mr. Graham advised that initially a budget of $300,000.00 was established for the
work, however, an $81,000.00 grant received from the Province and the fact that the work can
be done sub-stantially under budget have resulted in a significantly lower tendered price.
Further, he noted that some of the features of the work to be done were preventative
maintenance to the building facility.
It was resolved:
"That tender T90-2, Concrete Sidewalk and Curb Repairs, be awarded to J.G. Goetz
Construction Limited, Guelph, at their tendered price of $326,705.75."

"That tender T90-11, Pioneer Tower West Collector Road (Deer Ridge Drive), be
awarded to Regional Sewer and Watermain Limited, Cambridge at their tendered price of
$352,415.30."

"That tender T90-18, Wall Restoration - Don McLaren Arena, be awarded to Weatherwise
Canada Limited, Kitchener at their tendered price of $138,535.00."

"That tender T90-30, Asphalt Emulsions, be awarded to Asphalt Engineering Co. Ltd.,
Mississauga, at their tendered prices."

"That tender T90-36, Henry Sturm Greenway Channel Improvements, be awarded to J.G.
Goetz Construction Limited, Guelph, at their tendered price of $223,100.25."

"That tender T90-38, Dump Trucks and Snow Plow Equipment, be awarded to Kirby
International Limited, Kitchener at their tendered price of $193,091.00."

10. Purchase of Land - 90 Heins Avenue
The Committee considered a memorandum dated March 23, 1990, from Mr. J. Shivas
concerning an offer to sell 90 Heins Avenue to the City.
It was resolved:
"That the City accept an offer dated March 21, 1990, from Christine Kuepfer, Lorne
Kuepfer, Leonard Kuepfer and Sylvia Kuepfer to sell 90 Heins Avenue for the sum of
$138,200.00."
11. Quit Claim Deed - 101 Webster Road
The Committee considered a memorandum dated March 21, 1990, from Mr. J. Shivas that in
order to facilitate a mortgage of Westburne Industrial Enterprises Ltd. to Industrial Alliance Life
Insurance Company respecting 101 Webster Road, it was recommended that the City
authorize a Quit Claim Deed to remove a restrictive covenant on title.
It was resolved:
"That the Mayor and Clerk be authorized to execute a Quit Claim Deed releasing all rights
of the City, contained in Paragraph 5. Title Control of Schedule "A" to Instrument No.
292237 respecting Lot 21, Registrar's Compiled Plan 1525, and known as 101 Webster
Road, Kitchener."
12. Consent to Mortgage & Quit Claim Deed - 668 Trillium Drive
The Committee considered a memorandum dated March 26, 1990, from Mr. J. Shivas
recommending passage of a resolution to consent to a mortgage from Edko Industrial Trade
Ltd. to the Canadian Imperial Bank of Commerce and execution of a Quit Claim Deed to
remove a restrictive convenant on title respecting lands known as 668 Trillium Drive.
It was resolved:
"That the City consent to a mortgage from Edko Industrial Trade Ltd. to Canadian Imperial
Bank of Commerce for the property described as Part 19 on Plan 58R-5840 and
municipally known as 668 Trillium Drive, Kitchener; and further,
That the Mayor and Clerk be authorized to execute a Quit Claim Deed releasing all rights
of the City, contained in Paragraphs 2.(a) and 2.(b) of Schedule "A" to Instrument No.
953306 respecting Part Lot 14, Registrar's Compiled Plan 1471, and known as 668
Trillium Drive, Kitchener."
13. Expropriation Settlement - 40 Younq Street
It was resolved:
"That the City accepts the offer of Queen North Properties Limited to settle in full all its
claims arising from the expropriation of 40 Young Street for the all inclusive additional sum
of $216,817.79."

"That, with respect to the City Hall block, the City Solicitor be given authority to provide
where required and without prejudice advances of up to $10,000.00 to businesses on
account of costs to relocate."
"That the sum of $10,000.00 be paid on a without prejudice basis to Moderne Button
Company Limited/Stan Hill as an advance on account of costs to relocate from 182 King
Street West."
