BY-LAWS AS LISTED ON THE AGENDA - 2ND READING It was resolved: "That the by-laws considered by this Committee be taken as read a second time and be recommended for enactment." B. REPORT OF THE CHIEF ADMINISTRATIVE OFFICER 1. Execution of Enqineerinq Aqreements It was resolved: "That the Mayor and Clerk be authorized to execute an agreement for the provision of professional engineering services made between the City of Kitchener and Wright-Dietrich, regarding Hidden Valley Industrial Park, 30T-81028." 2. Execution of Final Releases It was resolved: "That the Mayor and Clerk be authorized to execute a Final Release in the amount of $2,185.47 pertaining to replacement of a fire hydrant located on Louisa Street at Weber Street West. The fire hydrant was damaged as a result of a motor vehicle accident which occurred on or about March 31, 1989." - and - "That the Mayor and Clerk be authorized to execute a Final Release in the amount of $7,608.47 pertaining to a vehicle collision involving City of Kitchener bus number 725 on King Street North and University Avenue, Waterloo, on or about February 17, 1989." 3. Aqreement - Home Support Services for the Elderly It was resolved: "That the Mayor and Clerk be authorized to execute an Amending Agreement with Her Majesty the Queen in right of Ontario, as represented by The Minister of Community and Social Services, which will permit surplus funds from the 1989 Home Support Service for Seniors Program to be used to purchase an air conditioning system for the 310 Charles Street Seniors' Centre." 4. 1990 Road Proqram It was resolved: "That the Mayor and Clerk be authorized to execute the Program of Proposed Expenditures of Highway Improvements for the year 1990 totalling $8,882,551 ." 5. Raffle Licences It was resolved: "That the City of Kitchener has no objection to a Provincial Licence being issued to The Catholic Community of St. Mark Parish to conduct a Raffle Lottery at St. Mark's School, Kitchener, on December 1, 1990." - and - COMMITTEE OF THE WHOLE MINUTES MARCH 19, 1990 "That the City of Kitchener has no objection to a Provincial Licence being issued to the K-W & Area Big Sisters to conduct a Raffle Lottery at Bingeman Park Farms, Kitchener on May 13, 1990." Banner Request It was resolved: "That in conjunction with St. Mary's Hospital Fundraising Campaign we grant permission to have a banner erected across King Street at Rockway Gardens from May 5th to May 12th, 1990 inclusive. Further, that the Campaign for St. Mary's make the necessary arrangements with the City's Contractor for the erection and removal of the banner and the payment of any costs associated therewith." 7. Conveyance of Parcel - BRIDGEPORT NORTH WARD It was resolved: "That the Corporation of the City of Kitchener convey, for nominal consideration at no cost to the City, a parcel of City-owned land described as Part of Lot 9, Registered Plan 244, to the registered owner of the abutting lands municipally known as 531 Wellington Street North; and, further That the Mayor and Clerk be authorized to execute any documentation required by the City Solicitor to complete this transaction." 8. Neiqhbourhood Garaqe Sale It was resolved: "That the Victoria Park Neighbourhood Residents Association be advised that the City of Kitchener has no objection to them holding a neighbourhood Garage Sale at Victoria Park Pavilion on Sunday, June 3, 1990, with proceeds therefrom being used by the Association for its general purposes." 9. Request for Subsidy Allocation - 1989 It was resolved: "That pursuant to The Public Transportation and Highway Improvement Act, the Mayor and Clerk be authorized to execute Request No. 2 for the allocation of subsidy funds for the provision of public transportation services for the physically disabled for the year 1989." - and - "That the Mayor and Clerk be authorized to execute Request No. 2 pursuant to The Public Transportation and Highway Improvement Act for the allocation of subsidy funds for public transportation for the year 1989 in the amount of $60,569." 10. Certification of Title Applications It was resolved: "That the Mayor and Clerk be authorized to execute a Consent and Waiver of Notice and Draft Plan to expedite a Certificate of Titles Act Application for Xenium Development Limited with respect to lands described as Part of Lots 7, 27 and 28 and Part of Glasgow Lane, closed by By-law No. 402, in the City of Kitchener." - and - "That the City of Kitchener make application for Certification of Title for its lands described as Part Blocks A and B, Registered Plan 254; Part Block A, Registered Plan 1007; and Part Lot 26, Municipal Compiled Plan 765; and further, COMMITTEE OF THE WHOLE MINUTES MARCH 19, 1990 10. Certification of Title Applications (Cont'd) That the Mayor and Clerk be authorized to execute a Consent and Waiver of Notice and Draft Plan to expedite Certificate of Titles Act Application L-6671 by Kenmore Homes (1987) Inc. with respect to lands described as Part Blocks A and B, Registered Plan 254; Part Lot 26, Municipal Compiled Plan 765; and Part Block A, Registered Plan 1007; and further, That the Mayor and Clerk be authorized to execute any further documentation required by the City Solicitor to perfect its CTA Application." 11. Execution of Enqineerinq Aqreement It was resolved: "That the Mayor and Clerk be authorized to execute an agreement for the provision of professional engineering services made between the City of Kitchener and The Proctor and Redfern Group, regarding Emerald Hills Subdivision, 30T-87025." 12. Variances to Municipal Code, Chapter 680 - Siqns - ROCKWAY-ST. MARY'S WARD & CENTRE WARD Dealt with under delegations. 13. Request for Support from IDAFSA (Canada) It was resolved: "WHEREAS the municipality of Kitchener is committed to the belief that equal opportunity and treatment should exist for all people; WHEREAS the City of Kitchener affirms the legitimacy of the struggle of the South African people for the total eradication of apartheid and the exercise of the right of self determination of all inhabitants; WHEREAS the City of Kitchener notes that the racist regime of South Africa has constantly defied United Nations resolutions calling upon it to end repression of the opponents of apartheid and to release all persons imprisoned or restricted for struggling against the system of apartheid; WHEREAS the General Assembly of the United Nations has designated October 11 as the Day of Solidarity with South African Political Prisoners; AND WHEREAS the eradication of apartheid and release of political prisoners can be accomplished by the awareness and understanding of all people; NOW THEREFORE, I, Mayor D.V. Cardillo on behalf of the Council of the City of Kitchener, do hereby proclaim October 11 as the Day of Solidarity with South African Political Prisoners in the City of Kitchener, and encourage all residents to support the victims of apartheid." 14. Transport 2000 It was resolved: "That no action be taken with respect to the request from Transport 2000 that the City of Kitchener support the concept of public hearings by the National Transportation Agency concerning the deregulation of VIA's routes and frequencies." COMMITTEE OF THE WHOLE MINUTES MARCH 19, 1990 15. Various Tenders Alderman W. Ferguson raised a concern with regard to street reconstruction and site development in the Lancaster Business Park. He advised that Elgin Construction had made an agreement with the City to grade the site and remove fill, however, the firm is using dump truck drivers from London as opposed to local manpower. Alderman Ferguson noted that the Region of Waterloo does not require the use of local trucks and drivers, as in some other parts of the Province, and, in his opinion, this is unfair to local brokers and drivers. He suggested that a clause should be added to all future tenders and agreements stipulating that local drivers and trucks must be used. He suggested that either Council should resolve this issue at the municipal level, or alternately, address it at the Regional level. Alderman Ferguson also suggested that action in this respect should be delayed until the issue is dealt with by the Region's Licensing Committee. It was resolved: "That tender T90-15, Lancaster Street Reconstruction (Frederick to Krug), be awarded to 743570 Ontario Limited (Elgin Construction), St. Thomas, Ontario at their tendered price of $729,600.52." - and - "That tender T90-7, Restoration of the Homer Watson House, be awarded to Phil Fletcher Contracting Limited, Kitchener at their tendered price of $297,870." - and - "That tender T90-17, Huron Business Park, Stage III - Phase I - Site Servicing, be awarded to J. Weber Contracting Limited, Breslau at their tendered price of $1,448,448." - and - "That tender T90-37, Three Dual Rear Wheel Cab & Chassis, be awarded to Stedelbauer Motors Limited, Kitchener at their tendered price of $60,780." - and - "That tender T90-25, Fleet Vehicles, be awarded as follows: Item #1 1 (One) four door suburban style vehicle to Stedelbauer Motors Limited, Kitchener at their tendered price of $19,911. Item #2 - 8 (Eight) 10,000 GVW dual rear wheel crew cabs and chassis to Parkway Ford Sales, Waterloo at their tendered price of $139,833. Item #3 - 1 (One) 1,500 lb. payload compact extended cab pickup truck to Parkway Ford Sales, Waterloo at their tendered price of $12,865. Item #4 - 6 (Six) 2-door hatchback automobiles to Waterloo North Mazda, Waterloo at their tendered price of $53,460. Item #5 - 3 (Three) 5,600 lb. GVW pick-up trucks to Ridgehill Ford, Cambridge at their tendered price of $37,500. Item #6 - 1 (One) 5,600 lb. GVW mini window van to Ridgehill Ford, Cambridge at their tendered price of $14,230. Item #7 - 3 (Three) 6,600 lb. GVW standard vans to Parkway Ford Sales, Waterloo at their tendered price of $40,824. Item #8 - 3 (Three) 8,600 lb.
