BY-LAWS AS LISTED ON THE AGENDA - 2ND READING It was resolved: "That the by-laws considered by this Committee be taken as read a second time and be recommended for enactment." B. REPORT OF THE CHIEF ADMINISTRATIVE OFFICER 1. United Way It was resolved: "That we approve of the request of the United Way for permission to utilize the City's postage meter to imprint outgoing City mail with the United Way logo and wording "Support the United Way" for the period September 11 to November 30, 1990." 2. Request for Licence - Monte Carlo Event It was resolved: "That the City of Kitchener has no objection to a Provincial licence being issued to the Kinsmen Club of Kitchener-Waterloo Inc., to conduct a Monte Carlo Event during Oktoberfest, October 5 to 9, 1990 at 400 East Avenue, Kitchener." 3. Request to Conduct Raffle Lottery It was resolved: "That the Ontario Division of the Arthritis Society be granted permission to sell raffle lottery tickets in the City of Kitchener under Provincial Licence #843092 for a draw to be held on October 18, 1990." 4. Industrial Land Consent - Amendment to Resolution - BRIDGEPORT NORTH WARD It was resolved: "That resolution 20. of the Committee of the Whole Minutes passed by City Council at its meeting of July 9, 1990 be rescinded; And further, that resolution B.8 of the Committee of the Whole Minutes passed by City Council at its meeting of July 17, 1990 whereby the City granted its consent to the transfer of the property designated as Part 5, Plan 58R-3388 and municipally known as 15 Howard Place, Kitchener, be amended by deleting the word "Limited" and replacing it with the word "Centre"." Variance to Sign By-law - STANLEY PARK WARD It was resolved: "That the decisions of the Committee of Adjustment sitting as a Standing Committee of City Council, of July 24, 1990, recommending approval of Submission No. S 10/90 -HIP Investments, and S 11/90 and S 12/90 - Hallman Construction - Be Ratified and Confirmed." Licensing Agreement - Queensmount Arena It was resolved: "That the Mayor and Clerk be authorized to execute a Licensing Agreement dated July 27, COMMITTEE OF THE WHOLE MINUTES AUGUST 13, 1990 1990 to allow the Lions Club of Kitchener to use Queensmount Arena during Oktoberfest from September 21, 1990 to October 14, 1990 for rent in the sum of $7,170.00." 7. Certification of Title Application - SOUTH WARD It was resolved: "That the Mayor and Clerk be authorized to execute a Consent and Waiver of Notice and Draft Reference Plan to expedite a Certificate of Titles Application by Failer Holdings Limited with respect to lands described as Part of Lot 14, Registrar's Compiled Plan 1471, in the City of Kitchener, designated as Part 27 on Reference Plan 58R-5668." 8. Raffle Lottery It was resolved: "That the City of Kitchener has no objection to a Provincial Licence being issued to the Kitchener-Waterloo Symphony Orchestra to conduct a Raffle Lottery in the City of Kitchener, with the said draw to occur on February 28, 1991 at The Centre In The Square." 9. Consents to Mortqaqe - BRIDGEPORT NORTH WARD It was resolved: "That the City consent to a mortgage from 874434 Ontario Inc. to Royal Bank for the property described as Part 6 on Reference Plan 58R-7231 and located in Lancaster Business Park." - and - "That the City consent to a mortgage from 874433 Ontario Inc. to Royal Bank for the property described as Part 7 on Reference Plan 58R-7231 and located Lancaster Business Park." - and - "That the City consent to a mortgage from 874435 Ontario Inc. to Royal Bank for the property described as Part 8 on Reference Plan 58R-7231 and located in Lancaster Business Park." 10. Certification of Title Applications It was resolved: "That the Mayor and Clerk be authorized to execute a Consent and Waiver of Notice and draft reference plan to expedite a Certificate of Titles Act Application by Forwell Limited with respect to lands described as Part of Lot 121, G.C.T., in the City of Kitchener." - and - "That the Mayor and Clerk be authorized to execute a Consent and Waiver of Notice and draft reference plan to expedite a Certificate of Titles Act Application by 781083 Ontario Limited/Cybau Holdings Inc. with respect to lands described as Part of Lot 35, G.C.T., in the City of Kitchener." 11. Banner Request It was resolved: "That in conjunction with the designation of the month of January as "International Crime Stoppers Month", we grant permission to the Waterloo Regional Crime Stoppers to have a banner erected on King Street at Frederick/Benton Streets from Tuesday, January 1, 1991 COMMITTEE OF THE WHOLE MINUTES AUGUST 13, 1990 to Monday, January 28, 1991. Further, that this organization make necessary arrangements with the City's contractor for the erection and removal of the banner and the payment of any costs associated therewith." 12. Encroachment Aqreement - CENTRE WARD It was resolved: "That the Mayor and Clerk be authorized to execute an Encroachment Agreement with the registered owners of the Canada Trust Centre, the new development at the corner of King Street, Ontario Street and Hall's Lane, known municipally as 55 King Street West, to permit the installation of a tie-back system of piling and shoring in the public road allowances of King Street, Ontario Street and Hall's Lane in accordance with the excavation shoring drawings prepared by Isherwood Associates." 13. Preqradinq Request - FAIRVIEW WARD It was resolved: "That Polocorp Inc. be permitted to pregrade their Subdivision 30T-88057 which fronts onto Huron Road in Pioneer Park subject to the provision of an acceptable tree saving plan and any approvals required from the Grand River Conservation Authority. The area is to be top-soiled and seeded in time to provide ground dover prior to winter." 14. Offer to Purchase Undersized Lot - SOUTH WARD It was resolved: "That we decline the Offer from 781081 Ontario Limited to purchase approximately 17.601 acres of land located on Westmount Road at Block Line Road considered undersized under the regulations contained in Township of Waterloo By-law 878A and more particularly described as Parts 1 and 2, Plan 58R-5056." 15. Expression of Interest - Enqineerinq Services - Reconstruction of Younq and Colleqe Streets It was resolved: "That Expression of Interest E90-66, Engineering Services - Reconstruction of Young and College Streets, be awarded to MTE Consultants Inc., Waterloo, to provide consulting engineering services as identified in the terms of reference supplied, subject to an acceptable contract being negotiated and an upset fee established." 16. Use of City Crest Council was in receipt of a letter dated August 2, 1990, from Mr. W.B. Stewart, General Manager, Kitchener-Waterloo Oktoberfest, requesting permission to use the City Crest on various souvenir items to be sold in conjunction with Oktoberfest. It was resolved: "That Council permit Kitchener-Waterloo Oktoberfest to use the City Crest on various Oktoberfest souvenir items." 17. Acceptance of Tenders Durinq June, July and Auqust Council accepted this date the report of Mr. F. Clement, Director of Purchasing, dated August 2, 1990 concerning the approval and awarding of City tenders during the summer months. COMMITTEE OF THE WHOLE MINUTES AUGUST 13, 1990 18. Tender - T90-72 - Gate Valves It was resolved: "That tender T90-72, Gate Valves, be awarded to Westburne Central Supply, Kitchener, at their tendered price of $60,120." 19. City of Kitchener Oktoberfest Float Council was in receipt of a report from Mr. F.S. Graham, Commissioner of Parks and Recreation, dated August 8, 1990 requesting increased funding for the 1990 Oktoberfest Parade Float and outlining two funding options. Mr. Graham further informed Council that, following discussions with Mr. J. Shuttleworth, it was his understanding that the sum of $9,000.00 would make the float serviceable, however, it would not be available for use before Oktoberfest and ongoing expenditures to upgrade the float would be required in subsequent years. He also noted that funds had not been budgeted to allow transportation of the float outside of the City as the budget is for construction purposes only. A motion by Alderman G. Leadston to provide additional funds in the amount of $16,000.00 to complete the 1990 Oktoberfest Parade Float was voted on and LOST. It was resolved: "That additional funds in the amount of $9,000.00 be awarded to the City's Oktoberfest Float Committee for the completion of the 1990 Oktoberfest Parade Float." 20. Designation Under the Ontario Heritage Act - 1198 Highland Road West -WEST WARD This item was dealt with under Delegations. 21. Request for Licence - Monte Carlo Event The Committee was in receipt of a report from Mrs. Y. Ashley, Manager of Licensing, dated August 10, 1990 recommending the endorsement of a Provincial Licence. It was resolved: "That the City of Kitchener has no objection to a Provincial Licence being issued to the Kitchener-Waterloo Bilingual School, to conduct a Monte Carlo Event on November 9, 1990 at Westmount Golf and Country Club, Inverness Drive, Kitchener." 22. Certification of Title Application - APCO Development Corporation The Committee was in receipt of a memorandum from Mr. J. Shivas, Assistant City Solicitor, dated August 9, 1990. It was resolved: "That the Mayor and Clerk be authorized to execute a Consent and Waiver of Notice and draft reference plan to expedite a Certificate of Titles Act Application by APCO Development Corporation with respect to lands described as Part Lots 31, 32, 33, Eby & Devitt Survey, Plan 577, being Part 1, Plan 58R-6902 in the City of Kitchener." 23. Acting Mayor It was resolved: "That Alderman B.M. Hiscott be appointed Acting Mayor from September 4 to September COMMITTEE OF THE WHOLE MINUTES AUGUST 13, 1990 7, 1990, inclusive, during the absence of His Worship Mayor D. Cardillo." 24. Transfer of Condominium Units - 100 Campbell Avenue The Committee was in receipt of a memorandum from Mr. J. Shivas, Assistant City Solicitor, dated August 13, 1990 requesting adoption of a resolution allowing the transfer of 10 condominium units. 24. Transfer of Condominium Units - 100 Campbell Avenue (Cont'd) It was resolved: "That, with respect to the property described as Parts 1, 2 and 3 on Reference Plan 58R- 5240, and municipally known as 100 Campbell Avenue, the City consent to the transfer of ten (10) condominium units from 781198 Ontario Limited to Esvari Construction Inc.; Siegner Lumber Limited; Antonio Sila Correia and Fernando Silva Correia; Augen Building Corporation; Harald Schneider; Stephen Halicki, In Trust; Hartshorn Corporation; 900875 Ontario Inc.; Siegbert Sonnenburg; and Siegbert Sonnenburg."
