BY-LAWS AS LISTED ON THE AGENDA - 2ND READING It was resolved: "That the by-laws considered by this Committee be taken as read a second time and be recommended for enactment." B. REPORT OF THE CHIEF ADMINISTRATIVE OFFICER 1. Certification of Title Application - CENTRE WARD It was resolved: "That the Mayor and Clerk be authorized to execute a Consent and Waiver of Notice and Draft Plan to expedite a Certificate of Titles Act Application by 547685 Ontario Limited, with respect to lands described as Part of Lot 60, Registered Plan 651 in the City of Kitchener, Regional Municipality of Waterloo (formerly in the County of Waterloo)." 2. Concordia Choirs - European Tour It was resolved: "That during their Concert Tour to Europe from September 7 to September 22, 1990, the Concordia Choirs be declared official Goodwill and Friendship Ambassadors for the City of Kitchener." 3. Banner Request It was resolved: "That in conjunction with the 1990 du Maurier Ltd. LPGA Golf Classic to be held the last week of June at the Westmount Golf and Country Club, permission be granted to have a banner erected on King Street at Francis Streets from Saturday, June 16, 1990 to Tuesday, July 3, 1990. Further, that this organization make necessary arrangements with the City's Contractor for the erection and removal of the banner and the payment of any costs associated therewith." 4. Various Tenders It was resolved: "That tender T90-4, Slurry Seal Resurfacing, be awarded to Miller Paving Limited, Unionville, at their tendered price of $80,250." - and - "That tender T90-55, In Place Recycling of Asphalt Pavements, be awarded to RSR (Road Surface Recycling) Inc., Agincourt, at their tendered price of $86,966.28." - and - "That tender T90-59, Gas Pipeline Construction, be awarded to R.L. Coolsaet of Canada Limited, Brantford, Ontario, at their adjusted tender price of $650,712.96." - and - "That quotation Q90-52, Ready Mix Concrete, be awarded to Cross Country Concrete, COMMITTEE OF THE WHOLE MINUTES JUNE 11, 1990 Heidelberg, at their quoted unit prices." 5. Temporary Noise Exemption This item was dealt with under Delegations. 6. Amendment to Chapter 650 - Municipal Code - Lot Maintenance It was resolved: "That Chapter 650 of The Municipal Code (Lot Maintenance) be amended to define "unlicensed" relating to motor vehicles and to redefine "waste material"." 7. K-W Oktoberfest Inc. - Monte Carlo Events The Committee considered a memorandum from Mrs. Y. Ashley advising that the City was in receipt of a request from Kitchener-Waterloo Oktoberfest Inc. for permission to hold spielcasinos during Oktoberfest and that since Provincial licences are required, Council's approval is necessary. It was resolved: "That the City of Kitchener has no objection to Provincial licences being issued to the Kitchener-Waterloo Oktoberfest Inc. to conduct Monte Carlo events at the Valhalla Inn, Holiday Inn and Bingeman Park Farms during Oktoberfest, October 5-13, 1990, inclusive." 8. Rotary Club of Kitchener - Raffle Lottery The Committee was in receipt of a memorandum from Mrs. Y. Ashley advising that the Rotary Club of Kitchener requests Council's approval to conduct a Raffle Lottery with a prize structure in excess of the $5,000.00 municipal maximum for lotteries. It was noted that Council's permission is required in order for the organization to obtain the necessary Provincial licence. It was resolved: "That the City of Kitchener has no objection to a Provincial Licence being issued to the Rotary Club of Kitchener to conduct a Raffle Lottery on December 21, 1990, at the Kitchener Memorial Auditorium." Schneider Trunk Sanitary Sewer - Phase III re: Performance Bond - The Guarantee Company of North America The Committee considered a request from Mr. J. Wallace concerning the failure of Elgin Construction to continue work relative to its contract for the Schneider Trunk Sanitary Sewer - Phase III. Mr. Wallace requested that City Council declare the Contractor as being in default under the contract in order to formally call upon the bonding company to perform. It was resolved: "That Elgin Construction, a division of 743570 Ontario Limited, having failed to perform under their contract with the City dated June 20, 1989, with respect to the Schneider Trunk Sanitary Sewer -Phase III, the City Solicitor notify The Guarantee Company of North America and call upon it to perform under the terms of its Performance Bond with the City." 10. Kitchener-Wilmot Hydro Request re: Aqreement for Storaqe of PCB Ballasts from the Street Liqht Retrofit Project The Committee considered a letter dated June 1, 1990, from Mr. R. Charie, General Manager, Kitchener-Wilmot Hydro requesting Council's consideration of a recommendation that has received verbal approval from the Kitchener-Wilmot Hydro prior to formal ratification at the COMMITTEE OF THE WHOLE MINUTES JUNE 11, 1990 Hydro Commission meeting scheduled for July 6, 1990. 10. Kitchener-Wilmot Hydro Request re: Aqreement for Storaqe of PCB Ballasts from the Street Li.qht Retrofit Project (Cont'd) It was resolved: "That the Mayor and Clerk be authorized to execute an agreement with the Hydro Electric Commission of Kitchener-Wilmot to be prepared by the City Solicitor in accordance with the Terms and Conditions contained in a June 1, 1990, letter from Mr. R. Charie relative to the storage of P.C.B. ballasts from the street light retrofit project." Alderman J. Ziegler disclosed a conflict of interest and abstained from all discussion and voting as the Hydro storage site on Bleams Road is located beside the home in which his parents reside. 11. Expropriation - City Hall - 27-29 Colleqe Street It was resolved: "That the City accepts the offer of Army, Navy and Air Force Veterans' in Canada - Unit 247, as set out in the June 8, 1990 letter of Mr. Stewart Mank, its solicitor, to settle in full all its claims arising from the expropriation of 27-29 College Street for the all inclusive additional sum of $41,416.64."
