BY-LAWS AS LISTED ON THE AGENDA - 2ND READING It was resolved: "That the by-laws considered by this Committee be taken as read a second time and be recommended for enactment." B. REPORT OF THE CHIEF ADMINISTRATIVE OFFICER 1. Gas Pipe Crossing Agreement with C.N.R. - STANLEY PARK WARD It was resolved: "That the Mayor and Clerk be authorized to execute a Gas Pipe Crossing Agreement with the Canadian National Railway Company to accommodate a 150 mm. diameter gas main at Mile 59.03 of the Railway's Guelph Subdivision at Victoria Street North." 2. Conveyance to Region - Road Widening - BRIDGEPORT NORTH WARD It was resolved: "That the City convey, for nominal consideration, to The Regional Municipality of Waterloo for road widening purposes, Part 13 on Reference Plan 58R-7231, and further that the Mayor and Clerk be authorized to execute all necessary documentation." 3. Execution of Engineering Agreement - CHICOPEE WARD It was resolved: "That the Mayor and Clerk be authorized to execute an agreement for the provision of professional engineering services made between the City of Kitchener and Walter, Fedy, McCargar, Hachborn, regarding Relax Plaza, 2960 King Street East." 4. Offer to Sell - Uniroyal Goodrich Canada Inc. - FAIRVIEW WARD This item was withdrawn from the agenda. 5. Monte Carlo Licence Requests It was resolved: "That the City of Kitchener has no objection to a Provincial licence being issued to the Rotary Club of Kitchener-Westmount to conduct a Monte Carlo Event during Oktoberfest, October 5 & 6 and 8 through 13, 1990 at the Concordia Club, 429 Ottawa Street South, Kitchener." - and - "That the City of Kitchener has no objection to a Provincial licence being issued to the Optimist Club of Stanley Park, Kitchener, to conduct a Monte Carlo Event during Oktoberfest, October 5 to 14, 1990 at Bingeman Park Farms, 1580 Victoria Street North, Kitchener." 6. Master Proof of Loss It was resolved: "That the Mayor and Clerk be authorized to execute two Master Proofs of Loss in the amount of $4,497.47 and $188.42 respectively pertaining to windstorm damage which occurred at Mt. Hope Cemetery on or about November 20, 1989." COMMITTEE OF THE WHOLE MINUTES SEPTEMBER 10, 1990 7. Taq Day It was resolved: "That the City of Kitchener approves of the Waterloo Regional Cadet Organization Police School Cadet Corps No. 1596 conducting a Tag Day in Kitchener on September 24 and 25, 1990." Encroachment Aqreements It was resolved: "That the Mayor and Clerk be authorized to execute an Encroachment Agreement with Central Meat Market (Kitchener) Limited, the owners of Part Lot 29, Subdivision of Lot 15, German Company Tract, municipally known as 760 King Street West, to legalize a City owned bus shelter and asphalt pad as they extend forty (40) feet, more or less, in a westerly direction from the intersection of the Central Meat Access Road and King Street West along the King Street West frontage of the subject lands to a depth of five (5) feet, more or less." - and - "That the Mayor and Clerk be authorized to execute an Encroachment Agreement with the registered owners of 51 Wedgewood Drive to legalize an existing 3 foot high wooden fence which extends onto Wedgewood Drive and an existing 3 foot high wooden fence which extends onto Ada Street." 9. Raffle Lottery It was resolved: "That the City of Kitchener has no objection to a Provincial Licence being issued to the Beth Jacob Congregation to conduct a Raffle Lottery in the City of Kitchener, with the said draw to occur on February 10, 1991 at 161 Stirling Avenue South, Kitchener." 10. Applications for Cancellation, Refund, Reduction or Levy of Taxes Mr. L.F. Parkhouse advised that with respect to Item #162 dealing with Application 228, he was contacted by the agent for the applicant who requested deferral of the matter to 1991. It was resolved: "That, save and except for Item #162 (Application 228) which is deferred to 1991, the applications attached hereto and forming part of these minutes relative to cancellation, reduction, refund or levy of taxes be disposed of as recommended herein." 11. Proposed Bill 230 - An Act to Amend the Municipal Elections Act It was resolved: "That the report dated August 21, 1990 and prepared by R.W. Pritchard concerning the proposed Bill 230 - An Act to Amend the Municipal Elections Act be endorsed and forwarded to the Ministry of Municipal Affairs." 12. Proposed Bicycle Race - Huron Industrial Park It was resolved: "That Ziggy's Cycle Club be permitted to conduct a bicycle race on Shoemaker Street, Trillium Drive and Strasburg Road in the Huron Industrial Park on Sunday, September 23, 1990, from 6:30 a.m. to 2:00 p.m.; and further, That Ziggy's Cycle Club provide the necessary liability insurance for this event, and that COMMITTEE OF THE WHOLE MINUTES SEPTEMBER 10, 1990 they incur all costs to effect the closures; and further, That the appropriate by-law under Section 352(61 ) of The Municipal Act be enacted." 13. Various Tenders It was resolved: "That tender T90-57, Truck Mounted Combination Vacuum & High Pressure Water Jet Rodder, be awarded to Neovac Limited, Scarborough, at their tendered price of $138,604. - and - "That tender T90-58, Removal & Replacement of Fuel Storage Tanks, be awarded to G.R. Wilfong & Son Limited, Kitchener, at their revised price of $103,445." - and - "That tender T90-73, Watermain Cleaning, be awarded to Canadian Pipeline Cleaning, Concord, Ontario at their tendered price of $282,299.67." - and - "That Expression of Interest E90-74, Environmental Study -Laurentian West Community Plan, be awarded to Gore & Storrie Limited, Cambridge, subject to an acceptable contract being negotiated." - and - "That tender T90-77, Supply and Delivery of Highway Coarse Salt, be awarded to Domtar Inc., Toronto, at their tendered price." 14. City Hall Urban Square - Ice Rink This item was dealt with under Delegations. 15. Sidewalk Repairs The Committee considered a memorandum dated September 5, 1990, from Mr. S. Gyorffy dealing with a request from Alderman C. Weylie for a report with respect to defective sidewalks in the West Ward. It was resolved: "That we approve an over-expenditure of the 1990 Department of Public Works Operations Budget in the amount of $30,000.00 so as to repair the sidewalks in the following locations: i) Dunbar Road from Glasgow Street to Brandon Avenue and, ii) Katherine Crescent from Dunbar Road to Brandon Avenue." 16. Tender T90-56 - Jansen Avenue Sanitary Sewer Reconstruction It was resolved: "That tender T90-56, Jansen Avenue Sanitary Sewer Reconstruction, be awarded to Elgin Construction Limited, Brantford, Ontario at their tendered price of $560,000.00, subject to the approval of the Ministry of the Environment." 17. Tender Policy COMMITTEE OF THE WHOLE MINUTES SEPTEMBER 10, 1990 It was resolved: "That, from this day forward, the City's policies for the calling of tenders shall include the following: 'No tender shall be accepted from any person or corporation who, or which, has a claim or has instituted a legal proceeding against the City with respect to any previous contract."' 18. Consent- Industrial Land It was resolved: "That the City consent to a transfer from Windowhill Development Corp. to Crosscan Investments Limited of the property described as Part 7 on Reference Plan 58R-5349 and municipally known as 244 Shoemaker Street, Kitchener, subject to applying for and obtaining occupancy certificates; and further, That the Mayor and Clerk be authorized to execute a Quit Claim Deed releasing all rights of the City contained in paragraphs 2.(a), 2.(b) and 2.(d) of Schedule 'A' to Instrument No.887082 respecting Part 7 on Reference Plan 58R-5349 and municipally known as 244 Shoemaker Street, Kitchener."
