Due to COVID-19 and recommendations by Waterloo Region Public Health to exercise physical
distancing, City Hall is open for select services. Members of the public are invited to participate in this

While in-person delegation requests are not feasible at this time, members of the public are invited to

Re: Special Council Meeting
Notice is hereby given that Mayor B. Vrbanovic has called a special meeting of City Council to be held
electronically to consider the following:

The electronic meeting will begin with a Land Acknowledgement given by the
Mayor.
2. Delegations
Pursuant to Council's Procedural By-law, delegations are permitted to address
the Committee for a maximum of five (5) minutes. Delegates must register by
3:00 p.m. on November 8, 2021, in order to participate electronically.
2.1. None at this time.
3. New Business
3.1. Notice of Motion - P. Singh - Alcohol and Gaming Commission of
Ontario (AGCO)
Councillor P. Singh has given notice that he will introduce the following
motion for consideration this date:
"WHEREAS the Covid-19 pandemic has been both a health crisis
and an economic crisis; and,
WHEREAS the Alcohol and Gaming Commission of Ontario
(AGCO), an agency of the Province of Ontario, regulates licensed
establishments; and,
WHEREAS the requirements for temporary extension of a liquor
licence sales and temporary patio extensions have been relaxed
throughout the pandemic, including downloading of certain
approvals to the municipality, and proved beneficial to business
operators; and,
WHEREAS the Downtown Kitchener BIA has invested $600,000
into new downtown restaurant patios and the Belmont Village BIA
invested in creating a new pedestrian -only patio experience; and,
WHEREAS the City of Kitchener has provided $100,000 in
business recovery grants to support Kitchener restaurants in
adapting their patios to respond to the pandemic; and,
WHEREAS the City of Kitchener has developed a seamless
system for approving patio expansion during the pandemic,
supporting more than 60 restaurant owners across the city; and,
WHEREAS the City of Kitchener would like to provide further
opportunities for helping strengthen our economy, continue to
support local businesses, and have successfully managed the
new licensed -area extension approvals delegated to the
municipality;
THEREFORE BE IT RESOLVED that the City of Kitchener
strongly encourages the Province of Ontario to continue the
relaxed regulations in perpetuity, including, but not limited to, the
following: i) permitting extensions of licensed areas without
requiring AGCO approval, subject to municipal authorization; and,
ii) flexibility on the requirements for demarcation of the limits of a
patio, such as not requiring a prescribed physical barrier;

THEREFORE BE IT RESOLVED that should the AGCO propose
to complete a comprehensive review of the temporary extension of
a liquor licence sales and temporary patio extension regulations,
The City of Kitchener wishes to volunteer to participate in any pilot
programs that would allow the current regulations that are in
effect until 3:00 a.m. on January 1, 2022 to be maintained, as the
City would like to continue to show support to our local
businesses;
THEREFORE BE IT FINALLY RESOLVED that a copy of this
resolution be forwarded to the Premier of Ontario, Tom Mungham,
Chief Executive Officer, AGCO, the Association of Municipalities of
Ontario, Federation of Canadian Municipalities and all other
municipalities in Ontario."
4. In -camera Meeting Authorization
Note: Any member of Council may question the appropriateness of a listed in -
camera item. This may be done during the special Council meeting or at the
beginning of the in -camera session.
Council is asked to enact the following resolution to authorize an in -camera
meeting:
"That an in -camera meeting of City Council be held immediately following
the special council meeting this date to consider one land
acquisition/disposition matter and one land acquisition/disposition and
contractual/negotiation matter as authorized by Sections 239 (2) (c) (i) of
the Municipal Act, 2001, respectively."

SUBJECT: Q21-101 Consulting Services - Chicopee Hills Trail Feasibility Study
RECOMMENDATION:
That Quotation Q21-101 Consulting Services - Chicopee Hills Trail Feasibility Study,
be awarded to WSP Canada Inc., Thornhill, Ontario, at their quoted price of
$110,643.00, including contingencies of $10,058.00, plus H.S.T. of $14,383.59, for a
total of $125,026.59, provided a satisfactory contract is executed.
REPORT HIGHLIGHTS:
} The purpose of this report is to obtain approval to proceed with an award as per
Purchasing By-law 2017-106;
There was one (1) response received for this procurement;
This report supports the delivery of core services.
BACKGROUND:
The community plan that provided background context for development in east Kitchener
around the area known as Lackner Woods, bounded by Lackner Woods to the north,
Fairway Road to the south and the Grand River to the east, proposed a trail connection
between the Country Clair Subdivision and the school site at Chicopee Hills.
This new trail would connect to an existing trail at Landgren Court and cross the creek to
access the east of the school property, north from the private properties fronting on
Fairway Road. In 2015, through plans of subdivision, the City agreed to complete a trail
study in support of this connection.
The purpose of the feasibility study is to determine:
a. If the proposed trail connection is physically and financially viable;

b. The environmental impact, accessibility concerns, the cultural impact of each design
option of the trail including safety and security short and long term risk
considerations;
c. The optimal / only position of any special features / e.g., a pedestrian bridge;
d. The options and the most feasible routing of the trail connections;
e. The preliminary costs associated with implementation of the proposed trail
connection; and
f. To identify other development related requirements (access easements,
environmental assessments, GRCA, MNRF, Department of Fisheries and Oceans
requirements, etc.).
REPORT
As per clause 170.7.1 of the Purchasing By-law 2017-106, all consulting services greater
than $100,000 (excluding taxes) must be approved by Council.
Quotations were advertised publicly on the City of Kitchener website. Documents were
downloaded by five (5) interested parties and by the closing date of Wednesday October 6,
2021, one (1) quotation had been received.

Quotation submissions were reviewed and rated by the selection committee, N. Lobley,
Director Parks and Cemeteries and L. Christensen, Project Trails Manager.
The committee recommends awarding the project to WSP Canada Inc., Thornhill, Ontario.
STRATEGIC PLAN ALIGNMENT:
This report supports the delivery of core services.
FINANCIAL IMPLICATIONS:
The net cost for this quotation (A), is fair and reasonable for a project of this scope and the
upset limit is within the funding available (B) for this project. Funding for this project is
included within the approved capital budget. The estimated surplus (E) will remain in the
New Neighbourhood Parks account to fund other parks.
