COMMITTEE OF THE WHOLE MINUTES

A. BY-LAWS AS LISTED ON THE AGENDA - 2ND READING
It was resolved:
"That the by-laws considered by this Committee be taken as read a second time and be
recommended for enactment."
B. REPORT OF THE CHIEF ADMINISTRATIVE OFFICER
1. Execution - Master Proof of Loss
It was resolved:
"That the Mayor and Clerk be authorized to execute a Master Proof of Loss in the amount
of $2,026.24 in connection with damage to a number of City facilities which occurred on or
about July 8, 1990, as a result of a lightning strike."
2. Petition for Interim Payment - Ministry of Transportation
It was resolved:
"That the Mayor and Clerk be authorized to execute with the Ministry of Transportation a
Petition for Interim Payment under the Public Transportation and Highway Improvement
Act on expenditures for construction and maintenance of roads/streets and
bridges/culverts made in the year 1990 totalling $6,465,675."
3. Licensinq Aqreement - Pedestrian Street Furniture
It was resolved:
"That the Mayor and Clerk be authorized to execute a Licensing Agreement on behalf of
the Corporation of the City of Kitchener with M.S.K. Developments Limited and the
Canada Life Assurance Company, for the supply and installation of pedestrian street
furniture, dated November 7, 1990."
4. Encroachment Aqreements - CENTRE WARD
It was resolved:
"That the Mayor and Clerk be authorized to execute Encroachment Agreements with the
registered owners of 277-281 King Street West, to legalize encroachments consisting of
the face of the building and a canopy which encroach onto Water Street."
5. Proposed 1991 Meetinq Schedule
It was resolved:
"That the 1991 Meeting Schedule, as attached hereto and forming part of these minutes,
be approved."
6. Application for Siqn Variance - CENTRE WARD
It was resolved:
"That the decision of the Committee of Adjustment sitting as a Standing Committee of City
Council, of November 14, 1990, recommending approval of Submission No. S 18/90 -
Queen North Properties Limited -Be Ratified and Confirmed."
7. Assessment Appeals - Ontario Hydro Properties

It was resolved:
"That the Mayor and Clerk be authorized to execute Minutes of Settlement between
Ontario Hydro and the Ministry of Revenue whereby certain assessments or valuations for
the 1990 taxation year are to be fixed as set out in Schedule "A" to the Minutes of
Settlement."
Nominations for The Jack Younq Civic Award
The Committee was in receipt of a letter from the Regional Municipality of Waterloo dated
November 20, 1990, requesting nominations for The Jack Young Civic Award.
Mayor D.V. Cardillo indicated that Aldermen could submit nominations independently by
notifying the Regional Clerk and Alderman Lorentz questioned whether Council, as a whole,
should nominate an individual. Mayor Cardillo agreed to circulate nomination forms to all
Aldermen.
Promotion of Public Awareness of Violence and Its Effect on Women and Children
The Committee was in receipt of a letter from the Coalition on Violence and Its Effect on
Women and Children requesting observance of a minute of silence at an official meeting
during the week of December 3-7, 1990, in memory of the massacre of 14 Women at the
Ecole Polytechnique in Montreal on December 9, 1989.
Mayor D.V. Cardillo requested that the observance requested take place at the special
Council meeting on December 3, 1990.
10. Tenders
Alderman J. Ziegler requested clarification of the Canadian content calculation used in
tenders and asked that this be supplied in future, where applicable.
It was resolved:
"That Tender T90-83, Domestic Gas Meters, be awarded to Canadian Meter Co. Inc.,
Milton, at their tendered price."
- and -
"That tender T90-98, 1", 1-1/2" and 2" Water Meters, be awarded to Ontario Water
Products, London at their tendered price of $53,600."
11. Application for Payment of Capital Financial Assistance
The Committee was in receipt of a memorandum from Mr. R. Arnot, Director of Recreation,
dated November 26, 1990 requesting approval to submit the above application in the amount
of $7,837.00 relating to a capital expenditure at the Rockway Gardens Senior Centre.
Alderman B.M. Hiscott inquired whether the additional $17,000.00 for furnishings had been
budgeted in 1990. Mr. McKay replied that it was his assumption the amount would come from
the 1990 Parks and Recreation Department Budget. Alderman Hiscott asked that the
application be forwarded only if this amount has been budgeted in 1990 and, if not, to defer
consideration of this item to the December 10, 1990 Council. Mr. McKay agreed to Alderman
Hiscott's request.
It was resolved:
"That the Mayor and Clerk be authorized to execute the Application for Payment of Capital
Financial Assistance in the amount of $7,837.00 to the Ministry of Community and Social
Services under the Elderly Persons Centres Act for capital expenditures at Rockway
Gardens Senior Centre totalling $26,124.00."
