COMMITTEE OF THE WHOLE MINUTES

A. BY-LAWS AS LISTED ON THE AGENDA - 2ND READING
It was resolved:
"That the by-laws considered by this Committee be taken as read a second time and be
recommended for enactment."
Alderman J. Ziegler disclosed a conflict of interest and abstained from all discussion and voting with
respect to the by-law to adopt Amendment No. 110 to the Official Plan as he owns land within the
area of the Amendment.
Alderman J. Smola and Alderman B. Stortz disclosed a conflict of interest and abstained from all
discussion and voting as both live within the circulation area of the Improvement Area with respect
to the by-law to designate a Community Improvement Project area to be known as the Breithaupt
Street Community Improvement Project area in the City of Kitchener and to provide for the
preparation of a Community Improvement Plan for the said area.
B. REPORT OF THE CHIEF ADMINISTRATIVE OFFICER
1. Binqo Lottery Licence
It was resolved:
"That permission be granted to Parents are People Too to conduct bingo lotteries at the
Concourse Bingo Centre, 7 Water Street North, Kitchener."
2. Raffle Lottery
It was resolved:
"That the Easter Seal Society of the City of North York be granted permission to sell raffle
lottery tickets in the City of Kitchener under Provincial Licence #812754 for a draw to be
held on December 7, 1990."
3. Consent - Industrial Land - FAIRVIEW WARD
It was resolved:
"That the City consent to a mortgage from 360006 Ontario Limited to The Standard Life
Assurance Company for the property described as Part 4 on Reference Plan 58R-5010
and Part 5 on Reference Plan 58R-5151 and municipally known as 330 Trillium Drive,
Kitchener; and further,
That the Mayor and Clerk be authorized to execute a Quit Claim Deed releasing all rights
of the City contained in paragraphs 2.(a), 2.(b) and 2.(d) of the Schedule attached to
Instrument No. 879864 respecting Part 4 on Reference Plan 58R-5010 and Part 5 on
Reference Plan 58R-5151 and municipally known as 330 Trillium Drive, Kitchener."
4. Variance to City of Kitchener Municipal Code - Chapter 680 (Siqn) - CHICOPEE WARD
It was resolved:
"That the decision of the Committee of Adjustment sitting as a Standing Committee of City
Council, of October 30, 1990, recommending approval of Submission No. S 17/90 -
Council Property Corporation -Be Ratified and Confirmed."
5. Temporary Emerqency Access - STANLEY PARK WARD
It was resolved:

"That the City proceed immediately to install a temporary emergency access, gravel
surfaced, from Brembel Street to Lackner Boulevard across Block 108, R.P. 1678, in order
to provide secondary access to the Grand River North Subdivisions; with the approximate
cost of $3,000. to be charged as an over-expenditure by the Department of Public Works.
Further, that the City Solicitor be authorized to prepare the appropriate indemnification
agreement for the emergency access with Ar-Jel Developments Limited/High Tree
Developments Limited."
6. Tender
It was resolved:
"That tender T90-91, Co-operative tender for Propane and Dispensing Systems, be
awarded to ICG Propane Inc., London, Ontario, at their tendered price of $71,980."
7. Ontario Hydro Street Liqht Conversion Grant
It was resolved:
"That the Mayor and Clerk be authorized to sign a financial subsidy contract with Ontario
Hydro for a grant of 25% of the Street Light Conversion project cost."
8. Pro-Canada Network
The Committee considered correspondence from the Pro-Canada Network requesting
Council's support by letter or action relative to opposition to imposition of the Goods and
Services Tax.
A motion by Alderman B.M. Hiscott that no action be taken with respect to the request from the
Pro-Canada Network was voted on and LOST.
It was resolved:
"That the position of the Pro-Canada Network outlined in its 'Message to Canadian
Mayors and Civic Councils' dated October 29, 1990 be endorsed."
9. Offer to Sell - FAIRVIEW WARD
It was resolved:
"That the City accept the Offer from Uniroyal Goodrich Holdings Inc. to sell .7769 ha (1.92
acres) of vacant land being Part of Lot 10, Registrar's Compiled Plan 1524 designated as
Parts 5, 6, 7, 8 and 9, Plan 58R-7333 for the sum of $150,500.00 for the extension of
Wabanaki Drive and Uniroyal Goodrich will acquire Part 3, Plan 58R-7333 from the City.
Further, that the Mayor and Clerk be authorized to execute all necessary documentation
as approved by the City Solicitor."
10. Quit Claim Deed - 728937 Ontario Limited - 385 Fairway Road South
It was resolved:
"That the Mayor and Clerk be authorized to execute a Quit Claim Deed in favour of
728937 Ontario Limited (Canadian Tire Plaza) to release the lands known as 385 Fairway
Road South from the industrial restrictive covenants set out in Instrument No. 268360."
11. Easement - Union Gas Limited
It was resolved:
"That the Mayor and Clerk be authorized to execute an Easement over Part of Lot 155,

German Company Tract, designated as Part 1, Plan 58R-6906 in the City of Kitchener in
favour of Union Gas Limited for a nominal sum and on the understanding that the old
registered Easement will be surrendered to the City."
12. Expropriation Settlement - Dr. Disc (Kitchener) Inc. - 172 Kinq St.W.
It was resolved:
"That the City accepts the offer of Dr. Disc (Kitchener) Inc. to settle in full all of its
expropriation and flooding claims respecting 172 King Street West for the all inclusive
additional sum of $59,638.38."
13. Relocation Settlement - Moderne Button Company Limited
It was resolved:
"That a further sum of $40,000.00 be paid on a without prejudice basis to Moderne Button
Company Limited as a further advance on account of costs to relocate from 182 King
Street West in installments as approved by the City Solicitor."
14. Claim - 743750 Ontario Limited (Elqin Construction)
It was resolved:
"That the City counterclaim in the action launched against it by 743750 Ontario Limited
(Elgin Construction) and also claim over as against the Bonding Company (Guarantee
Company of North America) as it may be advised by its legal counsel."
