BY-LAWS AS LISTED ON THE AGENDA - 2ND READING It was resolved: "That the by-laws considered by this Committee be taken as read a second time and be recommended for enactment." B. REPORT OF THE CHIEF ADMINISTRATIVE OFFICER 1. Kitchener Downtown Business Association - Christmas Liqhtinq Council was in receipt of a letter from Ms. Nancy Brawley, Executive Director, Kitchener Downtown Business Association dated October 9, 1990 requesting the installation and illumination of special Christmas decorations in the Downtown. It was resolved: "That illumination of special decorations on City Hall and of the special Christmas Lighting on the downtown streets commence on Friday, November 9, 1990 and continue through Wednesday, January 2, 1991 with illumination from 4:00 p.m. to 12 Midnight daily." 2. Pre-Gradinq Request Alderman B.M. Hiscott informed Council of his concerns regarding sand and soil which would be blown into adjacent residences if, following pre-grading, the area is not covered with top soil and seeded. Mr. McKay replied that Alderman Hiscott's concern has been addressed in the Planning Department Report. It was resolved: "That Council allow the pre-grading of Stages 5 & 6 of Glencairn Subdivision, Ministry of Government Services lands, in conjunction with the servicing and grading of Stage 4 in a manner to be approved by the Commissioner of Public Works. This is to be subject to the provision of an Archaeological Survey and an acceptable tree saving plan." 3. Art Auction - Licence Fees It was resolved: "That the $1.00 Charitable Organization licence fees apply to the Hawkers and Pedlars and Auctioneer's licences required by the Canadian Mental Health Association for their Art Auction to be held on November 2, 1990." 4. Banner Request It was resolved: "That in conjunction with Mental Health Week to be held May 6, 1991 to May 12, 1991, inclusive, we grant permission to the Canadian Mental Health Association, Waterloo Region, to erect a banner on King Street at Frederick/Benton Streets from Monday, April 29, 1991 to Monday, May 6, 1991, inclusive. Further, that this organization make the necessary arrangements with the City's contractor for the erection and removal of the banner and the payment of any costs associated therewith." 5. Encroachment Aqreement - STANLEY PARK WARD It was resolved: "That the Mayor and Clerk be authorized to execute an Encroachment Agreement with COMMITTEE OF THE WHOLE MINUTES OCTOBER 22, 1990 The Hydro-Electric Commission of Kitchener-Wilmot to allow the erection of a 3' high chain link fence which will extend 25 feet, more or less, onto the road allowances known as Breckenridge Drive and Ottawa Street North." B. REPORT OF THE CHIEF ADMINISTRATIVE OFFICER (Cont'd) Variance to Municipal Code, Chapter 680 (Siqn) Dealt with under Delegations. Grand River Trunk Servicinq Scheme Dealt with under Delegations. 8. Tender It was resolved: "That tender T90-19, Lancaster Business Park- Phase II - Site Services, be awarded to Steed and Evans Limited, Kitchener, at their tendered price of $716,716.80." Request for Siqn Variance - CENTRE WARD Dealt with under Delegations. 10. Applications for Cancellation, Refund, Reduction or Levy of Taxes Alderman C. Zehr disclosed a conflict of interest and abstained from all discussion and voting concerning Items 126, 127, 128 and 129 as the applicant is a client. It was resolved: "That the applications attached hereto and forming part of these minutes relative to cancellation, reduction, refund or levy of taxes be disposed of as recommended therein." Alderman C. Zehr previously disclosed a conflict of interest and abstained from all discussion and voting concerning Items 126, 127, 128 and 129 as the applicant is a client. 11. Certification of Title Application Council was in receipt of a memorandum from Mr. J. Shivas, Assistant City Solicitor, dated October 17, 1990 concerning an application from Macapee Holdings Limited, Colette Udvari and D5D Enterprises Limited. It was resolved: "That the Mayor and Clerk be authorized to execute Consents and Waivers of Notice and Draft Plans to expedite Certificate of Titles Act Applications by Macapee Holdings Limited, Colette Udvari and D5D Enterprises Limited with respect to lands described as Part of Lots 8 and 23, Beasley's Broken Front Concession in the City of Kitchener. And further, that the Mayor and Clerk be authorized to execute an application for Certificate of Title to its lands described as Part of Lot 8, Beasley's Broken Front Concession designated as Parts 6 and 8 on Reference Plan 58R-4918, provided that all costs associated therewith are paid by Macapee Holdings Limited, Colette Udvari and D5D Enterprises Limited." 12. Claim for Damaqes - Hans, Diane and Helfred Sitt It was resolved: "That the City pay the sum of $8,250.00 to Hans, Diane and Helfred Sitt to settle in full COMMITTEE OF THE WHOLE MINUTES OCTOBER 22, 1990 their claim for damages relating to fire inspection representations at 103-109 King Street West, Kitchener."
