3. Public Hearing Matters under the Planning Act

3.1 DSD -2021-168 - Zoning By-law Amendment ZBA/21/005/H/CD - 210 Heritage
Drive - Pioneer Tower Homes Inc.
The Committee considered Development Services Department report DSD -2021-
168, dated October 6, 2021, recommending approval of Zoning By-law
Amendment Application ZBA21/005/H/CD, for 210 Heritage Drive; and, approval
of applications for minor variances for the subject lands. C. Dumart presented the
report and responded to questions from the Committee.
Kristen Barisdale, GSP Group, spoke on behalf of the applicant in support of the
staff report and recommendation. K. Barisdale provided an overview of the
original development concept and described the revised concept dated March
2021; which addresses the change in the building orientation and overlook
issues; a reduction of the building height and the number of units; and the
increased tree retention of existing mature trees in the property. K. Barisdale
further described the Landscape Enhancement Plan submitted to the Planning
Department which includes additional planting of trees and other plant materials
to provide screening and buffering with neighboring residential properties. In
response to questions from the Committee, K. Barisdale explained that the
sustainability statement submitted as part of the Zone Change application was
deemed approved by staff and confirmed that additional discussions on this
matter will take place through the Site Plan approval process.
Alberta Piche addressed the Committee in opposition to the recommendation as
outlined in the staff report. A. Piche spoke of the size of the proposed
development, the land density, and the need to obtain the property's land survey.
A. Piche further stated the lack of details about a proposed retaining wall and the
impacts on the vegetation and adjacent properties.
In response to questions, C. Dumart confirmed the application for the proposed
development is compatible with the density ratio permitted for the property. C.
Dumart further explained the retaining wall details proposed in the Landscape
Enhancement Plan would be reviewed through the Site Plan process.
On motion by Councillor S. Davey
It was resolved:
"That Zoning By-law Amendment Application ZBA21/005/H/CD for
the property municipally addressed as 210 Heritage Drive for
Pioneer Tower Homes Inc. be approved in the form shown in the
"Proposed By-law", and "Map No. I", attached to Development
Services Department report DSD -2021-168 as Appendix "A"; and
further,
That in accordance with Planning Act Section 45 (1.3 & 1.4) that
applications for minor variances shall be permitted for lands subject
to Zoning By-law Amendment Application ZBA/21/005/H/CD."

3.2 DSD -2021-169 - Zoning By-law Amendment ZBA20/010/V/AP - 117 & 133
Vanier Drive - 2385235 Ontario Ltd.
The Committee considered Development Services Department report DSD -2021-
169, dated October 26, 2021, recommending approval of Zoning By-law
Amendment Application ZBA20/010/V/AP; approval of applications for minor
variances for the subject lands; and, endorsement of the Urban Design Brief for
117 and 133 Vanier Drive, as prepared by GSP Group. Andrew Pinnell presented
the report and answered questions from the Committee.
Kristen Barisdale, GSP Group, spoke on behalf of the developer, expressing
support to the staff report and recommendations. In response to questions, K.
Barisdale spoke of a public meeting organized in December 2020, in which the
developer has made several changes in an effort to mitigate the concerns of the
neighbourhood, including but not limited to: the installation of a fence;
landscaping; increased property setbacks to address to winter storage;
completing a shadow study; and, changes to outdoor amenity space. In response
to questions, K. Barisdale stated it has not yet been determined the affordability
of the units.
In response to questions from the Committee, Andrew Pinnell spoke of the
receipt of letters submitted by residents expressing concerns towards the
development but confirmed that the overlook and privacy issues have been
addressed. A. Pinnell further advised the development proposal fully complies
with the parking regulations established in the Zoning By -Law.
Garett Stevenson indicated with respect to applications compliance with
minimum requirements from provincial legislation and the Official Plan regarding
intensification goals. G. Stevenson further explained that intensification targets
increase every year, resulting in updated policies that require municipal
compliance.
On motion by Councillor D. Schnider
It was resolved:

"That Zoning By-law Amendment Application ZBA20/010/V/AP for
the property municipally addressed as 117 & 133 Vanier Drive for
2385235 Ontario Ltd. be approved in the form shown in the
Proposed By-law and Map No. 1 attached to Development Services
Department report DSD -2021-169 as Attachment 'A'; and,
That in accordance with Planning Act Section 45 (1.3 & 1.4) that
applications for minor variances shall be permitted for lands subject
to Zoning By-law Amendment Application ZBA20/010/V/AP; and
further,
That the Urban Design Brief for 117 & 133 Vanier Drive, prepared by
GSP Group, dated April 2021, attached to Development Services
Department report DSD -2021-169 as Attachment 'B', be endorsed
and provide general direction for Site Plan development."
