A. BY-LAWS AS LISTED ON THE AGENDA - 2ND READING
It was resolved:
"That the by-laws considered by this Committee be taken as read a second time and be
recommended for enactment."
B. REPORT OF THE CHIEF ADMINISTRATIVE OFFICER
1. Certification of Title Applications - CHICOPEE & FOREST WARDS
It was resolved:
"That the Mayor and Clerk be authorized to execute a Consent and Waiver of Notice and
Draft Plan to expedite a Certificate of Titles Act Application by Freure Promontory Limited
with respect to lands described as Block 85, Plan 1692 in the City of Kitchener."

"That the Mayor and Clerk be authorized to execute a Consent and Waiver of Notice and
Draft Plan to expedite a Certificate of Titles Act Application by 826454 Ontario Inc. with
respect to lands described as Block G, Plan 1384 in the City of Kitchener."
2. Execution of Enqineerinq Aqreement
It was resolved:
"That the Mayor and Clerk be authorized to execute an agreement for the provision of
professional engineering services made between the City of Kitchener and Planning
Initiatives Limited, regarding Pioneer Park Subdivision, 30T-88057."
3. Banner Request
It was resolved:
"That in conjunction with the free public skating party to be held by 570 CHYM in Victoria
Park in January, on a date to be determined, we grant permission for erection of a banner
on King Street at Francis Street from Monday, December 30, 1990 to Monday, January
21, 1991, inclusive.
Further, that 570 CHYM make the necessary arrangements with the City's contractor for
the erection and removal of the banner and the payment of any costs associated
therewith."
4. Master Proof of Loss
It was resolved:
"That the Mayor and Clerk be authorized to execute a Master Proof of Loss for a claim
totalling $16,724.47 in connection with the vandalising of several riding lawn mowers at
the Parks Operations Centre on Chandler Drive on or about June 5, 1990."

7. Support for Royal Commission on Violence Aqainst Women
The Committee was in receipt of a letter from Arthur Eggleton, Mayor of the City of Toronto,
requesting Council's support for a plan to ask the Federal Government to establish a Royal
Commission on Violence Against Women.

It was resolved:
"That Mayor Arthur Eggleton be advised that the City of Kitchener endorses his initiative
to ask the Federal Government to establish a Royal Commission on Violence Against
Women, and further,
That a copy of this resolution be sent to the City of Toronto - Safe City Committee."
8. 1990 Grant Application
It was resolved:
"That we approve a grant in the amount of $60.00 to Serious About Employment being the
equivalent amount paid to the City in rental fees by this organization."
9. Christmas Tree Collection
It was resolved:
"That the City of Kitchener provide for the separate collection of Christmas trees for the
purpose of landfill diversion. Such a programme would be in accordance with the
attached Browning Ferris Industries proposal dated November 29, 1990.
That an amending agreement to the City's Waste Collection Contract be executed with
Browning Ferris Industries, reflecting the terms set out in their proposal."
10. Tender
The Committee considered a recommendation in respect to award of a tender for demolition of
properties located on the future City Hall site.
Alderman C. Zehr expressed concern in regard to the possibility of a dispute over tipping fees
should such fees be increased during the contract period when the work was taking place.
Accordingly, he recommended that the contract include all tipping fees within the tendered
price.
It was resolved:
"That tender T90-96, Demolition of Properties - City Hall Site, be awarded to Kieswetter
Demolition Inc., Heidelberg at their tendered price of $293,000, on the understanding that
all tipping fees are included in the tendered price."
11. Section 57 - The Assessment Act
It was resolved:
"That the Mayor and Clerk be authorized to execute an acknowledgment to the Ministry of
Revenue relative to the confidentiality of assessment information released to the
municipality not contained in the annual assessment roll."
12. Applications for Cancellation, Refund, Reduction or Levy of Taxes - December 10, 1990

"That the applications attached hereto and forming part of these minutes relative to
cancellation, reduction, refund or levy of taxes be disposed of as recommended therein."
13. Binqo Lottery Licence - St. AIoysius Roman Catholic Church
The Committee was in receipt of a report dated December 7, 1990, from Mrs. Y. Ashley
concerning the failure of St. Aloysius Roman Catholic Church to obtain a bingo lottery licence
for a bingo held November 26, 1990, and recommending that, in keeping with Council's policy,
a licence requested for a bingo scheduled for December 24, 1990 be refused.
It was resolved:
"That whereas St. Aloysius Roman Catholic Church failed to obtain a bingo lottery licence
for the bingo conducted by them on November 26, 1990, this Council instruct the Manager
of Licensing not to issue the licence for the bingo lottery proposed by this Church for
December 24, 1990."
14. Appointment of Kitchener Representative on the K-W Hospital Commission
The Committee was in receipt of a report dated December 6, 1990 from Mr. R.W. Pritchard,
City Clerk, concerning the necessity to appoint a Kitchener representative on the Kitchener-
Waterloo Hospital Commission in place of Mr. A.W. Richardson who was appointed by
Council on December 3, 1990, but as the result of by-laws of the Kitchener-Waterloo Hospital
Commission he is ineligible to hold such appointment.
By general consent, the Committee agreed to defer action on this matter and refer it to the
Council meeting scheduled for December 17, 1990 for consideration.
15. Expropriation Settlement
It was resolved:
"That the City accepts the offer from 678963 Ontario Inc. (Mediterranean Cafe) as set out
in the December 7, 1990 letter from its solicitor, Mr. Arthur Morscher, to settle in full all of
its claims arising from the expropriation of 228 King Street West for the all inclusive sum
of $365,900.00."
