B. REPORT OF THE CHIEF ADMINISTRATIVE OFFICER 1. Kitchener Housinq Inc. - Extendinq & Amendment Aqreement - VICTORIA PARK WARD It was resolved: "That the Mayor and Clerk be authorized to execute an Extending and Amending Agreement dated the 2nd day of January, 1991, being a novation of the earlier Agreement of June 28, 1990 whereby Kitchener Housing Inc., is purchasing from the City lands on Joseph Street, being Lots 6, 7, 8, 9 and 10, Part Lot 5 and Part Lot 11, according to Registered Plan 427, Heins Survey being designated as Part 1, Plan 58R-5773 for the sum of $375,000." 2. Communication - Persian Gulf Conflict It was resolved: "That we recognize and support the Canadian men and women in the Persian Gulf and their families here at home. We encourage citizens and businesses to display the internationally recognized symbol of a yellow ribbon, which is not a religious symbol, but indicates you are supporting them and hoping for their safe return. The yellow ribbon can be displayed on a tree, post or flag pole." 3. Committee of Adjustment - Membership/Conference/Subscriptions It was resolved: "That Messrs. O.D. Juma, R. Reinhart, K.E. Gore, P. Kruse and B. Lackenbauer be permitted to become active members of the Ontario Association of Committees of Adjustment and consent Authorities for 1991, with the total cost of these memberships being approximately $300.00." - and - "That Messrs. O.D. Juma, R. Reinhart, K.E. Gore, P. Kruse and B. Lackenbauer be permitted to attend the Conference of the Ontario Association of Committees of Adjustment and consent Authorities to be held in Niagara Falls, Ontario from June 2 to June 5, 1991 with the City of Kitchener to pay the normal expenses incurred." - and - "That Messrs. O.D. Juma, R. Reinhart, K.E. Gore, P. Kruse and B. Lackenbauer be permitted subscriptions to Municipal World with the total cost of these subscriptions being $169.50." 4. Annual Petition for Subsidy It was resolved: "That the Mayor and Clerk be authorized to execute its annual petition for subsidy under COMMITTEE OF THE WHOLE MINUTES JANUARY 28, 1991 the provisions of The Public Transportation and Highway Improvement Act on expenditures made during 1990 in the amount of $6,178,001 ." Tender T90-97, Item 1 - Track Type Sidewalk Plow and Sander It was resolved: "That Item 1, tender T90-97, for one Track Type Sidewalk Plow and Sander be awarded to Frink Canada, Cambridge, at their tendered price of $51,490." Tender - T90-103 - Trailer Mounted Pipe Thawinq Machine It was resolved: "That tender T90-103, Trailer Mounted Pipe Thawing Machine, be awarded to Hovey Industries Ltd., Ottawa at their tendered price of $90,277." 1991 Reqional Roads Proqram and 10 Year Capital Forecast Alderman C. Zehr referred to the 1991 Regional Roads Program and 10 Year Capital Forecast and the alternative financing plans for the 10 Year Forecast proposed by Regional Staff which range from an unchanged program to the elimination of all system expansion and the majority of planned road widenings. Alderman Zehr noted that staff have recommended that the City support the Region of Waterloo's Alternative "D". However, he pointed out that under Alternative "D" the question of proposals under the Fairway Road Corridor Study must be taken into account and Alternative "D" removes options to alleviate traffic on Fairway Road. Mr. D. Snow referred to Page 5 of his report wherein it was pointed out that Alternative "D" would result in the elimination of the extension of River Road, west of King Street, as well as the extension of Bleams Road/Wilson Avenue to Manitou Drive. Elimination of these links would remove an alternative route to offload traffic from Fairway Road. He pointed out that as the 10 Year Capital Forecast now stands, Alternative "D" does not address the long term traffic problems on Fairway Road and suggested that the recommendation be amended to request the Region to consider the issue of Fairway Road and road extensions and linkages necessary to offload traffic from Fairway Road. It was resolved: "That the City of Kitchener support the Regional Municipality of Waterloo's Alternative "D" for their 1991 Roads Capital Program and 10 Year Capital Forecast, subject to the Region considering the comments contained in the report dated January 23, 1991, from Mr. D. Snow relative to long term traffic problems on Fairway Road." Council Policy Manual It was resolved: "That the attached report dated January 23, 1991 relative to recommended amendments to existing Council policies, be approved." Encroachment Aqreement - 50 Ontario Street South The Committee was in receipt of a memorandum dated January 28, 1991, from Ms. L. MacDonald, Assistant City Solicitor, advising that the City has been requested to agree to an encroachment with respect to construction of a concrete landing pad and steps relative to the property known municipally as 50 Ontario Street South and to approve of additional encroachments from existing structures. It was resolved: "That the Mayor and Clerk be authorized to execute an Encroachment Agreement with the registered owners of Part 1 on Reference Plan 58R-2854, known as 50 Ontario Street South, to permit the construction of a concrete landing pad and steps which will encroach 4 feet, more or less, in width and 11.5 feet, more or less, in length onto adjacent City COMMITTEE OF THE WHOLE MINUTES JANUARY 28, 1991 property and to legalize the existing encroachments of an overhanging fire escape platform as it extends 4 feet, more Encroachment Aqreement - 50 Ontario Street South (Cont'd) or less, in width and 4 feet, more or less, in length; a concrete pad and steps as they encroach 10.4 feet, more or less, in width and 16.8 feet, more or less, in length; and a canopy as it extends 6.5 feet, more or less, onto adjacent City property." 10. City Hall - Relocation Settlement It was resolved: "That a further sum of $30,000.00 be paid on a without prejudice basis to Moderne Button Company Limited as a further advance on account of costs to relocate from 182 King Street West in installments as approved by the City Solicitor."
