It was resolved:
"That the by-laws considered by this Committee be taken as read a second time and
be recommended for enactment."

REPORT OF THE CHIEF ADMINISTRATIVE OFFICER
Proclamation
It was resolved:
"That in recognition of National Nurses' Week and the theme, 'Mental Health: Priority
for Nurses', the week May 6 to 12, 1991, be declared 'Nurses' Week' in the City of
Kitchener. Provided that if publication of this proclamation is requested, same be
done at no expense to the City."
2. Loqo - CUPE Local 68
It was resolved:
"That the Council of the Corporation of the City of Kitchener hereby approves of the
use of the words 'City of Kitchener' on the proposed logo to be developed by C.U.P.E.
Local 68 of the City of Kitchener."
· Monte Carlo Licence
It was resolved:
"That the City of Kitchener has no objection to a Provincial licence being issued to St.
Mary's General Hospital to conduct a Monte Carlo event on July 16, 1991 at Lulu's,
4263 King Street East, Kitchener."
Charitable Carnival Licence
It was resolved:
"That the Canada Trust be granted permission to operate a Carnival in the parking lot
of Highland Hills Mall, 875 Highland Road W., Kitchener, on May 11, 1991, provided
that the necessary licence is obtained."
Execution of Encroachment Aqreements
It was resolved:
"That the Mayor and Clerk be authorized to execute an Encroachment Agreement with
the registered owners of Part 1 on Reference Plan 58R-7507, known as 530 Belmont
Avenue West, to legalize the concrete block building and asphalt paving as they
encroach onto an easement registered as Instrument No. 240021 ."

"That subject to the approval of the Traffic & Parking Division, Public Works
Department and Fire Department, the City of Kitchener approve the use of a portion of
the sidewalk directly in front of Stages, located at 312 King Street West, for the
creation of a sidewalk patio to be operated from May 17, 1991 to October 14, 1991 in
accordance with the terms and conditions to be set out in an Encroachment

City of Kitchener Participation at Central Ontario Exhibition
The Committee entered into a discussion with respect to the recommendation of City Staff
that the City not participate in the 1991 Central Ontario Exhibition.
Mr. F. Graham advised that the question of participation was fully evaluated and it was
staff's view that there was no benefit for the City to continue to participate in any way.
Alderman G. Leadston commented that the Exhibition would provide required space for a
City display on a free of charge basis and noted that the display which the City had put on
at the recent Home Show had been very well received. Mr. T. McKay commented that the
Home Show attracted a different type of group as compared to the Exhibition and that was
seen as the reason for the success of the City's display at the Home Show.
He noted that if the City was to participate, costs of approximately $600.00 to $800.00
would be incurred for a static display and at least $4,000.00 for a display with
accompanying staff involvement.
On motion by Alderman J. Ziegler-
it was resolved:
"That no action be taken with respect to participation by the City in the 1991 Central
Ontario Exhibition."
Execution of Standard Custom Aqreement
It was resolved:
"That the Mayor and Clerk be authorized to execute a Standard Custom Agreement
regarding Summer Employment Experience and Part-Time Employment Experience
Programs."
Appointments - Ontario Traffic Conference
It was resolved:
"That Alderman John Smola, Don Snow, Director of Traffic & Parking Services and
Ken Mayer, Traffic Analyst be appointed as the City of Kitchener's delegates to the
1991 Ontario Traffic Conference Annual General Meeting being held in Niagara Falls,
May 5-8, 1991 ."

This item was dealt with under Delegations.
10. Land Transfer Request
It was resolved:
"That the City consent to a transfer from Erich Hingsberg to Bender Family Holdings
Inc. and a lease from Bender Family Holdings Inc. to Ceramics Unlimited for the
property described as Parts 2 & 3 on Reference Plan 58R-5001 and municipally
known as 64 Dumart Place, Kitchener."
Tenders
Alderman B. Stortz disclosed a conflict of interest and abstained from all discussion with
respect to Tender T91-1 for concrete sidewalk and curb construction and repairs as it was
his information that some of the work involved was to be done on the street where he
maintains his residence.

11. Tenders (Cont'd)
Alderman M. Wagner raised a question with respect to Tender T91-25 for fleet vehicles
and Mr. T. McKay advised that air conditioning and am/fm radio were included as part of
the package. In response to Alderman G. Lorentz, Mr. F. Clement explained the
disposition procedure with respect to old City vehicles that were being replaced with new.
Questions and comments were then raised with respect to Expression of Interest E91-27
for engineering services on various streets. Mr. Suzuki agreed to supply a list of planned
works with respect to sidewalk and road reconstruction. In response to Alderman B.
Stortz, it was noted that with commencement of the Expression of Interest process it was
hoped to deal with tenders in a few months and then start works as soon as possible
thereafter. It was noted that the work on Duke Street must proceed as quickly as possible
as it was under a time constraint in connection with the PRIDE Program. In reply to a
question from Alderman M. Wagner with regard to the process involving the work on
Queen's Boulevard, Mr. D. Suzuki advised that the project was just getting underway and
that the consultant would be involving affected property owners.
It was resolved:
"That tender T91-25, Fleet Vehicles (Automobiles and Vans), be awarded as follows:
Item #1 to Stedelbauer Motors, Kitchener at their tendered price of $18,118.
Items #2,3 and 6 to Weiland Ford Sales Ltd., Kitchener at their tendered price of
$65,720. Item is being requested with optional air conditioning at $941. and optional
AM FM stereo radio at $290.
Items #4 and 5 to Forbes Motors Inc., Waterloo at their tendered price of $55,356.
plus optional glass on Item #4 at $118."

"That tender T91-31, Fleet Vehicles (Pickup Trucks, Cab & Chassis) be awarded as
follows:
Item #1 to Weiland Ford Sales at their tendered price of $11,504. plus optional air
conditioning at $941. and optional AM FM stereo radio at $231.
Items #2,3 and 4 to Stedelbauer Motors at their tendered price of $118,850."

"That tender T91-1 Concrete Sidewalk & Curb Construction and Repairs be awarded
to All Por Construction Limited, Cambridge at their tendered price of $492,348.99."
- and -
"That Expression of Interest E91-27, Reconstruction of Cameron Street, Duke Street
and Queen's Boulevard be awarded to MTE Consultants Inc., Waterloo; Paragon
Engineering Limited; Kitchener and R.G. Shugg Engineering Limited, Kitchener
subject to satisfactory agreement being negotiated and an upset fee established.
Each Consultant is to be awarded one contract."
Alderman B. Stortz previously disclosed a conflict of interest and abstained from all
discussion and voting with respect to Tender T91-1 for concrete sidewalk and curb
construction and repairs as this improvement work may benefit the street on which his
personal residence is located.

12. Land Exchanqe
It was resolved:
"That the Mayor and Clerk are hereby authorized to execute a Land Exchange
Agreement dated the 15th day of April, 1991 between the City of Kitchener and
Kilbasch Investments Ltd."
13. Applications for Cancellation, Refund, Reduction or Levy of Taxes
The Committee considered a letter dated April 24, 1991, from Mr. R.W. Pritchard,
requesting consideration of tax adjustment applications pursuant to Section 496 of the
Municipal Act, R.S.O. 1980.
It was resolved:
"That the applications attached hereto and forming part of these minutes relative to
cancellation, reduction, refund or levy of taxes be disposed of as recommended
therein."
Alderman C. Zehr disclosed a conflict of interest and abstained from all discussion and
voting with regard to applications 265 and 266 as the applicant was a client of his
employer.
