BY-LAWS AS LISTED ON THE AGENDA - 2ND READING
It was resolved:
"That the by-laws considered by this Committee be taken as read a second time and be
recommended for enactment."
B. REPORT OF THE CHIEF ADMINISTRATIVE OFFICER
1. Association of Municipalities of Ontario - 1991 Conference - Votinq Accreditation
It was resolved:
"That Aldermen C. Zehr, G. Lorentz, M. Yantzi and G. Leadston, as well as Mr. T.
McKay, be appointed as voting delegates of the City of Kitchener for the purposes of
the 1991 Annual Conference of the Association of Municipalities of Ontario to be held
at the Metro Toronto Convention Centre from August 18th to August 21st, 1991 ."
2. Industrial Land Consent - SOUTH WARD
It was resolved:
"That the City consent to a lease from Leenan Properties Management Limited,
Menya Investments Limited and Harwin Developments Limited to Things Engraved, a
division of Minit of Canada Limited for space at the property described as Part 10 on
Plan 58R-5840 and Municipally known as 61 McBrine Place, Kitchener, and further,
That the Mayor and Clerk be authorized to execute a Quit Claim Deed releasing all
rights of the City, contained in paragraphs 2.(a), 2.(b) and 2.(d) of Schedule "A" to
Instrument No. 976708 respecting Part Lot 14, Registrar's Compiled Plan 1471,
designated as Part 10 on Reference Plan 58R-5840 and municipally known as 61
McBrine Place, Kitchener."
3. Aqreement - Off-Site Parkinq - VICTORIA PARK WARD
It was resolved:
"That the Mayor and Clerk be authorized to execute an agreement dated May 21,
1991 with Ball Brothers Limited, respecting the provision of off-site parking."
4. Raffle Lotteries
It was resolved:
"That the City of Kitchener has no objection to a Provincial licence being issued to the
Kitchener Conestoga Rotary Club to conduct a Raffle Lottery at 205 Chandos Drive,
Kitchener on January 11, 1992."

"That the City of Kitchener has no objection to a Provincial Licence being issued to
the Kitchener-Waterloo Art Gallery to conduct a raffle lottery in the City of Kitchener
with the said draw to be held on November 23, 1991 at 101 Queen Street North,
Kitchener."
5 Refreshment Stand Licence
It was resolved:

"That the Youth Group of St. James Rosemount United Church be granted permission
to operate a Carnival and Refreshment Stand at the Mutual Life parking lot on Union
Street, Kitchener on June 8, 1991, provided that the necessary Health approvals and
licence are obtained."
.Aqreement -Budd Park - FAIRVIEW WARD
Mr. J. Wallace requested an amendment to the recommendation in the agenda involving
renewal of the agreement following expiry of the 10 year term.
It was resolved:
"That the Mayor and Clerk are hereby authorized to execute an agreement in the form
of the draft dated 27th of May, 1991 between Kitchener Minor Soccer Incorporated
and the City with The Budd Automotive Company of Canada Limited joining in to
consent thereto, and,
That the City agree to negotiate in good faith with Kitchener Minor Soccer
Incorporated as to a renewal of the agreement upon expiry of the 10 year term, and
further,
That the Clerk is hereby directed to submit the agreement to the Ontario Municipal
Board for approval upon execution by all parties."
Automated Bankinq Machine Installation - VICTORIA PARK WARD
It was resolved:
"The Mayor and Clerk are hereby authorized and directed to execute an agreement
dated 28th day of December, 1990 with The Toronto-Dominion Bank with respect to
the installation and operation of a banking machine at the Transportation Centre, 15
Charles Street, Kitchener."

Grant Application
It was resolved:
"That the Mayor and Clerk be authorized to execute a grant application with
Employment and Immigration Canada in the amount of $19,488.00 for an Arts
Inventory Researcher to assist the Art, Memorabilia and Public Donations Working
Group and two Cultural Researchers to work with the Parks an Recreation
Department."
10. Schneider Trunk Sanitary Sewer - Easements - FAIRVIEW WARD
It was resolved:
"That the City of Kitchener accepts the offer from T.N.T. Canada Inc. to sell to the City
an easement in perpetuity under part lots 9, 10, 12 and 16, Plan 791 for the sum of
$56,000.00. Said easement is required to protect the new Schneider Trunk Sanitary
to be built, and further,
That the City accepts the offer from T.N.T. Canada Inc. to buy a temporary
construction easement at $900.00 per month plus the cost to replace the security
fence and payment for a private security company to patrol area as needed during
construction, and further,

That the Mayor and Clerk are hereby authorized to execute any documentation
approved by the City Solicitor required to complete these transactions."
11. City of Kitchener Building Facade Improvement Loan Program
Council was in receipt of a letter from Alderman B. Stortz dated May 29, 1991 and a copy
of the study report for the Loan Program from Mr. T. O'Brien dated February 1991. In
response to a question from Alderman C. Zehr, Ms. R. Upfold indicated that there is no
budget implication arising from the proposed changes to the repayment schedule.
It was resolved:
"That Council endorse the recommendation of the Downtown Action Committee (May
2, 1991) concerning the Facade Improvement Loan Program, specifically, that 30% of
the original loan be forgiven where projects are completed within 6 months and 20%
where work is completed within 12 months, with the entire program to be reviewed
after 1 year."
12. Various Tenders
Alderman B.M. Hiscott disclosed a conflict of interest and abstained from all voting and
discussion concerning Tenders T91-19 (Road Sub-Base and Base Aggregates) and T91-
20 (Miscellaneous Aggregates) as B & B Kieswetter Excavating Inc. is associated with a
company in which he is a shareholder.
It was resolved:
"That tender T91-14, Refurbishing of Twelve Flyer Model D800 Transit Coaches, be
awarded to Mississauga Truck and Bus, Mississauga at their tendered price of
$368,776.44."

"That tender T91-18, Hot Mix Asphalts, be a split award to Warren Bitulithic Limited
and Forwell Limited, both of Kitchener, at their tendered unit prices.
- and -
"That tender T91-19, Road Sub-Base and Base Aggregates, be a split award to
Forwell Limited, Warren Bitulithic Limited, B & B Kieswetter Excavating Inc. and
Kieswetter Holdings Limited, all of Kitchener, at their tendered unit prices."

"That tender T91-20, Miscellaneous Aggregates, be awarded on a split basis to
Forwell Limited, B & B Kieswetter and Warren Bitulithic Limited all of Kitchener at their
tendered unit prices."

14. Fundraisinq - AM 109 & CFCA Radio
It was resolved:
"That subject to obtaining proper authorization with respect to Licensing and Health
regulations and requirements of all other Municipal and Regional Departments, AM
109 and CFCA Radio be granted permission to sell popcorn on King Street on
Tuesday, June 18, 1991, from the hours of 12 Noon to 2:00 p.m. for the purpose of
raising funds for the K-W Hospital Kidney Dialysis Unit."
