A. BY-LAWS AS LISTED ON THE AGENDA - 2ND READING
It was resolved:
"That the by-laws considered by this Committee be taken as read a second time and be
recommended for enactment."
B. REPORT OF THE CHIEF ADMINISTRATIVE OFFICER
1. Industrial Land Consents - BRIDGEPORT NORTH & SOUTH WARDS
It was resolved:
"That the City consent to a mortgage from MGR Properties Ltd. to Royal Bank of
Canada for the property described as Parts 1, 14, 15, 16, 28, 29 and 30 on Reference
Plan 58R-7231 and municipally known as 675 Riverbend Drive, Kitchener."

"That the City consent to a mortgage from Failer Holdings Limited to Central
Guarantee Trust Company and leases from Failer Holdings Limited to lan Kennedy
c.o.b, as Bonded Magnet Technologies; Robert Bice Construction Inc.; 925360
Ontario Inc.; Yukio Ogyu and Siu Sang Lo; Monitario Technical Services Inc.; and
Caper Drywall and Acoustics Ltd. for the property described as Part 27 on Reference
Plan 58R-5668 and municipally known as 63 Mclntyre Place, Kitchener."
2. Refreshment Vehicle
It was resolved:
"That the Ventures Drum & Bugle Corps be granted permission to operate a
Refreshment Vehicle on the sidewalk adjacent to the Oktoberfest Office, 17 Benton
Street, Kitchener, during Oktoberfest, October 5, 11, 12, 13, 14, 15, 16, 17, 18, 19,
1991, provided that the necessary licence and Health and Fire approval is obtained."
3. Intermunicipal Tourism Committee
It was resolved:
"That the IMTC Heartland Committee dissolve as of December 31, 1991 ."
4. Raffle Lottery
It was resolved:
"That the Canadian Ski Patrol System be granted permission to conduct a Raffle
Lottery in the City of Kitchener with the draw to be held on April 11, 1992 at Chicopee
Ski Club, 396 Morrison Road, Kitchener."
5. 1252 Doon Villaqe Road - Request to Demolish - SOUTH WARD
Council was in receipt of a report from Mr. K. Curtis, Principal Planner, requested at its
meeting of June 24, 1991, containing various recommendations among them, approval for
a request to demolish the above building and direction to decline the Offer of Purchase
from Mr. Helmut Klingspon.
Alderman B.M. Hiscott referred to the Offer of Purchase appended to Mr. Curtis' report
and advised that Mr. Klingspon has agreed to indemnify the City for all time in regard to
water damage affecting the structure and will repair the building and keep same in a

habitable condition at his own expense. Mr. J. Wallace expressed concern over this
agreement due to the difficulty of registering a suitable legal document on title and the
potential difficulty the City may encounter in enforcing the agreement if the property is
subsequently sold by Mr. Klingspon. Alderman Hiscott replied that the Purchaser is
willing to further negotiate the agreement.
It was resolved:
"That consideration of the request to demolish 1252 Doon Village Road be deferred
with the intention of negotiating an Agreement of Purchase and Sale satisfactory to
both the City and Mr. H. Klingspon, 1290 Doon Village Road."
6. Expression of Interest/Request for Proposal/Tenders
It was resolved:
"That Expression of Interest E91-72, Architect's Services - New Fire Stations, be
awarded to Rieder Hymmen Lobban, Kitchener to provide architectural and
engineering services for the construction of the future #6 fire station, subject to a
satisfactory agreement being negotiated and an upset fee established."

"That Request for Proposal P91-73, Network Management System, be awarded to
Unis Lumin Inc., Oakville, Ontario at their proposal price of $182,936. plus Provincial
Sales Tax and G.S.T. for a total of $210,376.40."
- and -
"That tender E91-36, Emergency Support Vehicle, be awarded to Almonte Fire Trucks
Ltd., Carleton Place, Ontario, at their tendered price of $323,260."
- and -
"That tender T91-83, 12" Watermain Construction on Queen Street, be awarded to
Steed and Evans Limited, Kitchener, at their tendered price of $171,192.74 plus 7%
GST ($11,983.49) which totals $183,176.23."
- and -
"That tender T91-84, Transit Centre Roof Replacement and Repairs, be awarded to
Nedlaw Roofing Limited, Breslau at their tendered price of $86,327."
7. Fourth Avenue - Speedinq/Transit - FAIRVIEW WARD
Dealt with under delegations.
8. Street Vendor Cart
It was resolved:
"That notwithstanding section 5 of Street Vendor By-law No. 91-157, permission be
granted to Danuta Lubieniecki, wife of Zbigniew Lubieniecki, to operate his street
vendor cart during his absence from October 20 to November 30, 1991 ."
9. Application for Closure - Reqistered Plan 640
Council was in receipt of a report from Mr. J. Wallace dated September 26, 1991
recommending the conveyance or transfer of closed road allowances.

9. Application for Closure - Reqistered Plan 640 (Cont'd)
It was resolved:
"That, in accordance with the Judgement of the Honourable Mr. Justice West dated
the 28th day of August, 1991, a conveyance or transfer of closed road allowances as
set out therein be given to the respective applicants entitled, namely Hallman
Aberdeen Limited and 673099 Ontario Limited, or as they may direct, for the nominal
sum to TWO ($2.00) DOLLARS. Provided, however, that all costs involved in the
conveyance thereof are borne solely by Hallman Aberdeen Limited and 673099
Ontario Limited."
10. Request for Mortgage Consent - Ralph Van Dyke Construction Co. Ltd.
Council was in receipt of a report from Mr. J. Shivas dated September 30, 1991
recommending a consent to the mortgage.
It was resolved:
"That the City consent to a mortgage from Ralph Van Dyke Construction Co. Limited
to Royal Bank of Canada for the property described as Part 33 on Reference Plan
58R-5668 and municipally known as 208 Mclntyre Drive, Kitchener, subject to
applying for and obtaining a sign permit."
11. Street Vendors - Oktoberfest
Council was in receipt of a report from Mrs. Y. Ashley dated September 30, 1991
recommending the approval of temporary licences for 15 vendors.
It was resolved:
"That 15 vendors from Pretzel D'Lite Inc. and Kin-Tien Sun be granted permission to
sell their pretzels and hot dogs and sausages on Kitchener streets in areas to be
designated by Kitchener-Waterloo Oktoberfest Inc. from October 11 to 19, 1991,
provided that the necessary $1.00 Hawker & Pedlar licence is obtained by each
individual."
12. Expropriation Claim - D. Weinberq Limited/Cedarfield Developments Ltd.
It was resolved:
"That the City accept the offer of D. Weinberg Limited and Cedarfield Developments
Limited, as set out in the September 26, 1991 letter from their solicitor, Gerald M.
Taub, to settle in full all of their claims respecting the expropriation of 200-204 King
Street West for the additional all inclusive sum of $40,000.00."
