A. BY-LAWS AS LISTED ON THE AGENDA - 2ND READING
It was resolved:
"That the by-laws considered by this Committee be taken as read a second time and be
recommended for enactment."
B. REPORT OF THE CHIEF ADMINISTRATIVE OFFICER
1. Proclamation - International Day of Peace
It was resolved:
"That Tuesday, September 17, 1991 be proclaimed "International Day of Peace" in the
City of Kitchener provided that if publication of this proclamation is requested same be
done at no expense to the City."
Sale of Tickets - Friends of the Earth
It was resolved:
"That the Friends of the Earth be granted permission to sell raffle tickets in the City of
Kitchener under Provincial Lottery Licence #P912525 for draws to be held in Ottawa,
Ontario between October 1 and December 2, 1991 ."
Kitchener-Waterloo Area Visitors & Convention Bureau
Alderman M. Wagner advised Council that the Visitors & Convention Bureau wishes to
host an information meeting in the next several weeks for members of both Kitchener and
Waterloo City Councils. Alderman B.M. Hiscott suggested that the Bureau appear at a
Council meeting to convey its message, however, Alderman Wagner indicated that the
proposed information session would likely be quite lengthy.
Upon further discussion Alderman Wagner agreed to convey Council's request to the
Visitors & Convention Bureau that it provide information which it wishes to present to City
Council ahead of time and appear to answer any questions concerning the Submission at
the next Council meeting.
It was resolved:
"That permission is hereby given for the use of the name "Kitchener" in the corporate
name "Kitchener-Waterloo Area Visitors & Convention Bureau" and that the Mayor and
Clerk be hereby authorized to execute any documentation required by the corporation to
signify City consent."
Licences
It was resolved:
"That the City of Kitchener has no objection to a Provincial Licence being issued to the
Rotary Club of Kitchener-Westmount to conduct a Monte Carlo event during Oktoberfest,
October 11-19, 1991 at the Concordia Club, 429 Ottawa Street South."

"That the Kitchener Waterloo Gymnastics Club be granted permission to conduct a raffle
lottery in the City of Kitchener with the draw to be held on December 14, 1991 at 805
Victoria Street South, Kitchener."

Kiwanis Club of Kitchener-Waterloo to conduct a Monte Carlo event during Oktoberfest,

Encroachment Aqreements
It was resolved:
"That the Mayor and Clerk be authorized to execute an Encroachment Agreement with the
registered owner(s) of Lot 15, Plan 938 known as 79 Pinecrest Drive, to permit the
construction of a wooden fence which will encroach 8 feet, more or less, onto the road
allowance known as Pinecrest Drive."

"That the City of Kitchener has no objection to an encroachment agreement with Bost
Holdings Inc. allowing the encroachment of the foundation, constructed on Lot 11,
Registered Plan 1719 into the City's storm water easement ad that the Mayor and Clerk
are hereby authorized to execute an Encroachment Agreement with Bost Holdings Inc. as
prepared by the City Solicitor."
Sale of Surplus Land - CHICOPEE WARD
It was resolved:
"That the City of Kitchener accepts the offer from the Regional Municipality of Waterloo to
sell approximately 1.12 acres of vacant land known as part lot 120 G.C.T. and fronting
onto Ebydale Drive for the sum of $1.00 dollar."
Banner Request
It was resolved:
"That in conjunction with fundraising campaigns to be undertaken by the Big Brothers of
Kitchener-Waterloo during the month of September, that we grant permission to the Big
Brothers of Kitchener-Waterloo to erect a banner on King Street at Frederick/Benton
Streets from Friday, September 13th to Monday, September 30th, 1991, inclusive.
Further, that this organization make the necessary arrangements with the City's contractor
for erection and removal of the banner and the payment of any costs associated therewith.
And further, that the Chief Administrative Officer be authorized to schedule the erection
and removal of this banner on an annual basis as requested."

8. Aqreement - Queensmount Arena - FOREST WARD
It was resolved
"That the Mayor and Clerk be authorized to execute a Licensing Agreement dated
September 6, 1991 to allow the Lions Club of Kitchener to use Queensmount Arena
during Oktoberfest from September 27, 1991 to October 20, 1991 for rent in the sum of
$7,170.00."
9. The Kitchener-Waterloo Area Visitor and Convention Bureau
It was resolved:
"That the City of Kitchener formally recognizes and approves the formation of The
Kitchener-Waterloo Area Visitor and Convention Bureau and the use of the City's name
by this Bureau. This non-profit Association is being formed to ensure the development of
the area visitor and convention industry and the maximizing of visitors and convention-
goers to the area covered by the Bureau. The new entity will begin the formation of its
organization by November 1, 1991, and will be fully operational by April of 1992. It is
anticipated that the City of Kitchener will continue to contribute funds for the purposes of
the Association on a grant basis, to be reviewed annually. It is further anticipated that
Council will begin to commit funds to the Association effective in January 1992. Other
revenues will be secured from the City of Waterloo, area Municipalities and from the
industry through memberships and fees for service."
10. Applications for Fence Variances - CENTRE AND VICTORIA PARK WARDS
This item was dealt with under delegations.
11. 1991 Pitch-In Week
On motion by Mayor D.V. Cardillo
it was resolved:
"That the Honourable Bob Rae, Premier of Ontario and the Honourable Ruth Grier,
Minister of the Environment be advised that the Corporation of the City of Kitchener
supports the Pitch-In Week Program and encourages the Ministry of the Environment to
continue funding at the $75,000. level."
12. Local Government Week 1991
It was resolved:
"That the period September 30 to October 5, 1991 be proclaimed Local Government
Week in the City of Kitchener and that the City Clerk be instructed to insert an
advertisement in the Kitchener-Waterloo Record to inform the citizens of this fact."
13. Various Tenders/Proposals
Alderman C. Zehr expressed concern regarding tender T91-68 for the Reconstruction of
Duke Street from Wellington Street to Victoria Street since the lowest tender was
substantially below the next lowest tender. Mr. F. Clement indicated that the tender was
fully investigated and work would be watched closely. As a point of explanation he noted
that the company through its submission was attempting to establish a name for itself.
Alderman M. Wagner referred to tender T91-80 respecting the Reconstruction of Queen's
Boulevard from Rex Drive to Highland Road and noted that residents wish heritage
lighting on Queen's Boulevard in future. Alderman Wagner commented that it was his
understanding that lighting would not be affected by the reconstruction work but that
conduits would be installed to accommodate future special lighting.

Mr. T. McKay recommended that Alderman Wagner meet with staff of the Public Works
Department to determine cost differentials for such lighting and then have the matter
referred to the Finance Committee for consideration.
13. Various Tenders/Proposals, cont'd
It was resolved:
"That tender T91-63, Reconstruction of Breithaupt Street - Weber to Ahrens, be awarded
to Mir-Cor Sewer Contracting Inc., Hamilton, at their tendered price of $194,978.61,
including G.S.T."

"That tender T91-68, Reconstruction of Duke Street - Wellington to Victoria, be awarded
to Mir-Cor Sewer Contracting Inc., Hamilton, at their corrected tender price of
$307,168.11 ."

"That tender T91-74, Reconstruction of Cameron Street - King Street East to Weber
Street East, be awarded to Subterra Waterloo Inc., Kitchener at their tendered price of
$423,452.39 plus 7% G.S.T. ($29,641.67) which totals $453,094.06."

"That tender T91-77, Roof Replacement and Restoration at the Transportation Operations
Centre, be awarded to Palmer Roofing of St. Jacobs at their tendered price of $52,720."

"That tender T91-79, Supply of Concession Beverages, be awarded to Kitchener
Beverages, Kitchener at their tendered price of $87,255. annually for the contract period
September 17, 1991 to June 30, 1994."

"That tender T91-80, Reconstruction of Queen's Boulevard - Rex Drive to Highland Road,
be awarded to E & E Seegmiller Limited, Kitchener at their tendered price of $608,421.70
plus 7% GST ($42,589.51) which totals $651,011.21 ."

their tendered price of $59,499.83."

14. Applications for Cancellation, Refund, Reduction or Levy of Taxes
The Committee was in receipt of a letter dated September 11, 1991 from the City Clerk
requesting that pursuant to Section #496 of The Municipal Act, R.S.O. 1980, applications

for cancellation, reduction, refund or levy of taxes be dealt with.
Alderman C. Weylie disclosed a conflict of interest and abstained from all discussion as
the applicant listed with respect to item #80 was a client.

It was resolved:
"That the applications attached hereto and forming part of these minutes relative to
cancellation, reduction, refund or levy of taxes be disposed of as recommended therein."
Alderman C. Weylie disclosed a conflict of interest and abstained from all discussion and
voting as the applicant listed with respect to item #80 was a client.
15. Transit Division Re: Full time Transportation Clerk Positions
The Committee considered a memorandum dated September 12, 1991 from Mr. D.
Paterson, dealing with a staffing situation at the Transportation Centre, 15 Charles Street
which recommends transfer of four existing temporary positions to permanent status at no
additional cost.
It was resolved:
"That the existing four temporary Transportation Clerk positions be eliminated from the
complement of the Transit Division at the Transportation Centre and these be replaced by
four permanent full time Transportation Clerk positions. Further, that staff of the Human
Resources Division be authorized to amend the Collective Agreement with C.U.P.E. Local
#791 to recognize the seven day a week schedule at the Transportation Centre."
16. Recreation Division - Replacement of Two Part Time Positions with a Full Time

Position
The Committee considered a memorandum dated September 12, 1991 from Mr. D.
Paterson, advising that the role of Recreation Clerk at Breithaupt Centre has been filled
from 8:00 a.m. to 5:00 from Monday to Friday on a part time basis by two staff members.
Issues relating to this practice were discussed in the memorandum and staff recommend
that one full time position be authorized on the understanding that some additional costs
estimated at $5,000 could be expected.
It was resolved:
"That two existing Recreation Clerks positions (part time) be eliminated from the
complement of the Recreation Division at Breithaupt Centre and these be replaced by one
permanent full time Recreation Clerk."
Alderman G. Lorentz questioned if there were any other similar situations within the City's
organization that had to be dealt with. Mr. R. Freeborn advised that staff are investigating
this issue and will be preparing a report for consideration by the Administrative Review
Committee.
Reproduction or Printinq of the of Preliminary List of Electors by Mechanical or
Electronic Means
The Committee was in receipt of a letter dated September 13, 1991 from the City Clerk
advising that upon receipt of a written request from a registered candidate, pursuant to
section 25(8) of The Municipal Elections Act, the City Clerk may supply the Preliminary
List of electors in a format that will facilitate use of mechanical or electronic means in the
printing or reproduction of the list and that the City may recover it's administrative and
material cost in supplying this information.

Mr. R. Freeborn stressed that the data would be supplied, but in a format that still requires
the user to develop his own program in accordance with his own needs.
Reproduction or Printinq of the of Preliminary List of Electors by Mechanical or
Electronic Means, cont'd
It was resolved:
"That pursuant to section 25(8) of The Municipal Elections Act, Mr. R.W. Pritchard, City
Clerk and Returning Officer, be directed to provide the Preliminary List of Electors to a
written request of any registered candidate, in a format that will facilitate the use of
mechanical or electronic means in the printing or reproduction of the list.
That each request be charged the sum of $125 per ward to cover projected administrative
and material cost to be incurred in the production of this information."
18. Consent to Mortgage - Devtek Corporation
The Committee was in receipt of a memorandum dated September 16, 1991 from Mr. J.
Shivas advising that pursuant to restrictions in the original Deed from the City for 100
Hollinger Crescent, the City has been requisitioned to consent to a mortgage for the
subject property.
It was resolved:
"That the City consent to a mortgage from Devtek Corporation (Grantech Manufacturing)
to Bank of Nova Scotia for the property described a Part 1 on Reference Plan 58R-4551
and municipally known as 100 Hollinger Crescent, Kitchener."
